1. Jamnagar Municipal Corporation invites Tenders from the reputed, technically and
financially sound Consultant having experience in Project Management Consultancy of
Sewerage System and well equipped to manage large projects and those who are meeting
the eligibility criteria specified in the tender. The consultant shall be registered or shall
have enough experience with Govt. of Gujarat, other State Govt., Semi Govt. bodies or
Central Govt. PWD, Western Railway or other such institutions. Tenderer having
experience with private institute shall not be considered.

The tender document for these work are available on website https://tender.nprocure.com. The
bidder shall pay the Tender Fee to the Corporation in the form of Demand Draft issued by any
Nationalized Bank/ RBI approved Scheduled Bank only (as per annexure-I), in favor of
Municipal Commissioner, payable at Jamnagar shall be attached with the Pre-qualification
Document. The downloaded documents shall be signed on every page with company’s authorized

(D) SUBMISSION OF TENDER :-
The Complete Tender document shall be submitted at above –mentioned address. Tenders,
which are not signed, will not be accepted. Tender copy shall be accompanied by EMD in
form of Demand Draft / B.G. / F.D.R. of Nationalized Bank / RBI approved Scheduled Bank
only (as per annexure-I) in favor of Municipal Commissioner, Jamnagar. The tenders not
submitted in line with the tender clauses and without EMD in the form specified, will be out
rightly rejected. The Technical bid of only those bidders will be opened who have remitted
tender fees and submitted EMD.
(G) OPENING OF TENDER
The Technical bid of work will be opened as mentioned in the Table Sr. No. 5 above.
Intending bidders or their representative who wish to participate in tender opening can remain
present on the due date and time. Only one representative of each firm will be allowed to
remain present. Price Bids of only those bidders will be opened, who are successful in
the qualification Criteria and the Technical Evaluation. The date for price bid opening shall
be informed to the successful bidders at a later date.
(H) GENERAL INSTRUCTIONS:
1. The cost of Bid document will not be refunded under any circumstances.
2. EMD in the form specified in Bid document only shall be accepted.
3. The tender offer shall be valid for 180 days from the date of opening of Technical Bid.
4. Tender offers without Bid document fees, Earnest Money Deposit (EMD) and which do not
fulfill all or any of the condition or submitted incomplete in any respect will be rejected.
5. The Bidder shall submit only one bid in his name. Submission of any additional bids in the
name of their partner /associates / Group Company, etc. shall disqualify them.
6. Conditional tender shall not be accepted.
7. As per the Bombay Stamp Rules Act – 1958, Appendix – 1, Article 5, the Consultant shall
enter in to an Agreement with the JMC on Rs.300 Stamp Paper and not to pay separate stamp

The tenderers are advised to read carefully the “Instruction” and “Eligibility Criteria” contained in
the tender documents.

Instructions/Conditions to Applicants and Submissions to be made
1. Application received from joint venture / consortium or sublation work shall not be
considered (as tenderer or also as experience).
2. The work certificate of working as sub contract shall not be considered for evaluation as
tenderer or also as experience.
3. Completed work shall mean works which are as completed as upto and on date 31-03-
4. Applicant shall provide information pertaining to the project works (for which PMC
services provided) completed for S T P s , C E T P s , T T P s , A S P s works in past
years. Ending last day of month previous to the one in which applications are invited.
5. All the information shall have to be filled and signed in the prescribed Statement
wherever mentioned.
6. All the details required in the prescribed statement shall have to be duly filled up.
No information shall be left out. Relevant item without required information shall not
be considered for evaluation.
7. All the required attachments shall have to be invariably attached.
Relevant item, without required attachment shall not be considered for evaluation or
later submission on of bidder’s request shall not be consider.
8. The details given by the applicants in the qualification documents will be
evaluated as per qualifying criteria. However, Jamnagar Municipal Corporation
reserves the right to restrict or relax qualified applicant to any number deemed suitable
by it. Jamnagar Municipal Corporation’s decision for qualifying the applicants shall be
final and binding to all.
9. All information has to be typed or hand written legibly in English language.
All pages of the qualification document have to be initialed by the applicant.
10. The applicant shall have to note specifically that, all the information given including
those in the form of various format, must be supported by certificate, dully attested,
from respective clients (i.e. any Government / Semi Government Organizations /
authorities only shall be considered for evaluation).
11. In case of large projects, executed on "Package" or as comprehensive basis, a
separates detail of individual drainage works shall be given for evaluation. In short any
package / chain of projects as a whole shall not be considered while evaluation.
12. The Municipal Commissioner reserves the right to accept or reject any application
and to annul the post-qualification process and reject all applications at any time,
without assigning any reason or incurring any liability to the applicants.
13. Overwriting should be avoided. Correction, if any, should be made by neatly
crossing out, initialing, dating and rewriting, pages of the post qualification
documents are numbered. Additional sheets, if any added by the tenderer, shall be
placed at end and separate index sheet with added page numbered in sequence shall be
done. They should be submitted as a package with signed letter of transmittal.
14. References, information and certificates form issued by the Respective clients certifying
suitability, technical know-how or capability of the applicant should be signed by an
officer not below the rank of executive Engineer or equivalent.
15. The applicant should submit the information regarding average annual financial
turnover (Gross) of PMC / Design consultancy works during the last three
financial years ending on 31st March, 2026. This should be duly audited/signed by a
Chartered Accountant. Year in which no turnover is shown would also be considered
for working out the average of three years.
16. For recorded reasons Jamnagar Municipal Corporation shall have powers to post
qualify the tenderer for this work irrespective of its monetary value/requirements.
17. The Volume-III (Price bid) of those Firms / Co.'s / Consultants who are post
qualified as stated in documents, shall be opened and processed. The Volume-III of
those firms / Companies / consultants who will not meet with qualifying criteria
as stated in documents, shall not be opened.
18. The tendering authority reserves the right to correct any clerical, typographical,
grammatical, or linguistic errors or omissions in the tender document at any time
prior to the award of the contract. Such corrections shall be deemed part of the
tender document and shall be binding on all bidders.
18 (A). Qualification Criteria of Applicant:
I. Turnover of the firm is minimum average annual turnover of the firm for
the last three years for the consultant activity shall not be less than Rs.2.00
Cr. (i.e. Minimum average turn over = summation of turnover of last three
financial year/3). (last three year 2023-24, 2024-25, 2025-26)
II. Experience of having successfully completed similar works during last
years ending last day of month previous to the one in which applications are
invited should be either of the following.
a) Three similar completed works costing not less than the amount equal to
Rs.20.00 Cr. (Capital Cost) for each project work.
b) Two similar completed works costing not less than the amount equal to
Rs.25.00 Cr. (Capital Cost) for each project work.
c) One similar completed work costing not less than the amount equal to Rs.
40.00 Cr. (Capital Cost).
(capital cost of project means Final cost of Project without operation and maintenance)
i) Similar works mean the whole project works for which Project Management
Consultancy has been carried out for STP, CETP, TTP, ASP for any city in India.
Which included A) feasibility study & Design consultancy, B) Details Estimate,
DPR preparation & Approvals, tendering consultancy & PMC during execution
works of STPs, CETPs, TTPs, APSs etc.
ii) Agency having enough experience in the Govt./Semi. Govt. for above
mentioned STPs, CETPs, TTPs, APSs Works as a PMC during last 7 years
shall only be considered. Ending last day of month previous to the one in which
applications are invited.
iii) The following multiplying factors shall be considered for calculating relevant
cost of the project.

opening the initial bids, the main sealed cover and cover containing envelope shall be opened.

12. Tender Validity Period:
The validity period of the tender submitted for this work shall be of one hundred Eighty (180)
calendar days from the last date of submission of tender documents and the Tenderer
shall not be allowed to withdraw or modify the tender offer on his own during the
validity period.
13. Rights Reserved:
Without assigning any reason, The Municipal Commissioner reserves the right to reject
the lowest or any other or all tenders or part of its. To waive any informality or irregularity
in any tender, which in the opinion of the Jamnagar Municipal Corporation does not
appear to be in its best interest and the tenderer shall have no cause of action or claim against
the Jamnagar Municipal Corporation or its officers, employee, successors or assignees for
rejection of this tender.
The Jamnagar Municipal Corporation further reserves the right to withhold issuance of the
notice to proceed, after execution of the contract agreement by the successful
Tenderer. The Jamnagar Municipal Corporation is not obliged to give reasons for any such

15. The Municipal Commissioner reserves the right to reject any or all tenders without assigning any

17. Only successful consultant/tenderer shall have to submit the information required for bank
account through Electronic Credit System (ECS).
(a) penalty shall be levied @ 0.10% of the approved fees per week up to 10% for delay in
commencement or continuity of project work due to delay in any kind of approval / design
submission from the consultant. In case of absence of any technical personnel during
execution/progress of the whole project, penalty shall be levied @ Rs.3,000/- per person
(b) Penalty up to 10% of the fee of the consultancy should be done for,
(i) Preparation of faulty estimates which may differ with design quantities. Which may
lead drastically change in the quantity and cost of the work and may establish direct
mistake of the consultant.
(ii) Faulty evaluation / justification of the tender which may affect the cost of the work.
21 The consultant / Bidders shall have to submit under taking letter on Stamp paper of Rs.300/-duly
Notarized that they are not debarred (Even in past) by any Government / Non Government /
Semi Government Agency / Agencies.
22 The successful consultant shall have to establish full flanged their own office in JAMNAGAR
city along with necessary Technical personnel as shown in qualifying criteria within 15 days
after receipt of work order.
23 Any discrepancy and misinterpretation between BOQ (Price Bid) and Scope of Work shall not be
allowed and shall be item wise consistent for smooth process. Any quote/tender in
contradiction to scope of work shall be straight away rejected.
24 A. Security Deposit :
S.D. amounting to Rs.5.0 Lacs in the form of D.D. of Nationalized Bank / RBI approved
Scheduled Bank only (as per annexure-I) shall be submitted. When total value of all projects
cost exceeds Rs.50.00 Cr. an additional S.D. shall be submitted at the rate of 5% of amount
exceeding Rs.50.00 Cr. on written request.
B. Tenure for the consultancy work : It shall be years from date of work order or up-to completion of
ongoing project whichever is later. This work can be extended for two more years or up to
completion of ongoing project whichever is later on approval of competent authority of JMC.
25 Agreement: Agency will have to executed the agreement with the JMC as per prevailing
rules, terms, conditions, etc. on Rs.300/- Stamp paper and not to pay separate stamp duty.
26 Bank Guarantee :
The Consultant will be required to furnish Bank Guarantee from Nationalized / RBI approved
Scheduled Bank only (as per annexure-I) by way of Performance Guarantee in the prescribed
Performa (Format to be attached annexure-II), for due fulfillment of the Contract and shall
submit after award of work and before signing of the Contract/Agreement. The Performance
Guarantee shall be of 10% of final consultancy fees paid and remain valid up to completion of
the work and the same shall be released after 5 years from satisfactory completion of the
project. The consultant shall have to furnish every half yearly Performance Detail Reports for
Five years after the satisfactory completion of the project.
In case the Consultant fails to complete the work, the Client, without prejudice to rights and
remedies available under the contract, shall forfeit and encash the Performance Guarantee
Amount and credit it to the Client. Further, in case the bank goes in liquidation or for any
reason is unable to make payment against the said Bank Guarantee the loss caused thereby
shall be borne by the Consultant. The Consultant forthwith, on demand from the Client, shall
make good the deficit.
27 That if the consultant abandons the work for any reason whatsoever or becomes incapacitated
from acting as Consultant as aforesaid, the Client shall forfeit/encash the Performance
Guarantee (Decision of Municipal Commissioner in this regard shall be final and binding).
The Client shall be at liberty to make full use of all or any of the drawings prepared by the
Consultant The Consultant shall also be liable to refund all the fees paid to him up to date plus
such damages as may be assessed by the Client (Decision of Municipal Commissioner shall
be final and binding) subject to a maximum of 10% of the total project Fee under this agreement
including the recovery of liquidated damages if any caused to the Client.
28 In case of the over or unnecessary payment is made on account of consultant’s defaults as
checking of measurement, checking of bills, recommendation of payment including any
default in scope of work etc, and by any means JMC suffers/incurred such losses, the decision
of Municipal Commissioner regarding compensation to be made to JMC, such losses /
damages shall be binding to consultant’s responsibility.
29 Important Note: JMC reserves the rights for empanelment of Nos. of
Consultants at the first lowest consultant’s approved rate.

GST etc. borne by the Consultant and nothing extra). Conditional tender shall not be accepted
in this regards.
30. Sole Arbitrator: Municipal Commissioner, JMC shall be the Sole Arbitrator for any dispute &
difference of any kind arising out of or in connection with the Consultant/Consultancy work
during the progress of the project works or after their completion shall be referred to & settled
by Municipal Commissioner, JMC. The decision of the Municipal Commissioner shall be final
& binding to both parties.
31. No mobilization advance / escalation shall be given in quoted fees.
32. The consultant shall have to undergo his consultancy works for third party proof checking by
JMC at any instant during progress of work.
33. The consultant shall submit all soft copies in editable format and if at all any security provision
are made same shall be made available to JMC.

CONSULTANT’S SCOPE OF WORK :
The scope of work for “PROJECT MANAGEMENT CONSULTANCY (PMC) FOR
THE CONSTRUCTION WORKS OF VARIOUS CAPACITY STP, TTP, CETP
AND APS FOR SEWERAGE SYSTEM IN JAMNAGAR CITY.”
(A) Design Consultancy
• Data Collection/Survey : Details of existing APS, STP, Storm Water Drain, Natural Drain,
Kaans, River passing through city or any other naturally available carrier and storage spaces,
Network, Disposal, Water body if any, Over/Under Ground Services and other required details
etc. This will also cover carrying out detailed survey of Top/Ground/Road Levels, Invert/Bed
Levels regular/required intervals of existing drains/proposed drains at regular /required intervals
including preparation of Cross Section as well as L-Section etc.
• Carrying out topographic survey : Details of wall to wall / full road width, Kaans/Rivulets,
including all physical appearances of Temporary/Permanent Structures, Poles, Trees, Central
Divider, Foot-paths, Kerbs, D.P., Drains, Storm Water Drains, Machine holes, Catch-pits, and
any other required details etc. complete.
• Preparation of Plan, Cross Section at 30 mt./regular/required intervals as well as L-Section on
basis of above mentioned survey work etc.
• Carrying out Soil investigation and submission of detailed report.
• Preparation of various alternative General Arrangement Drawings (GAD) and suggesting best
techno-eco alternate.
• Preparation of detail Hydraulic design along with calculations as per prevailing BIS codes,
NBC and best engineering practices,
• Preparation of detail working and structural drawings / design along with calculations as per
prevailing BIS codes, NBC and best engineering practices for execution.
All detail design, working and structural drawings for the entire work shall be submitted in 5 sets
in form of editable soft copies and hard copies by the consultant within the stipulated time period
from the work awarded to him.
• Preparation of preliminary/final design drawing and Estimates/Specifications as per
latest/prevailing SORs/Approved Rate Analysis and preparation new SOR/Rate Analysis as per
Frequent site visits during execution of work and give necessary modifications if required
according to site situation.
Issuing structural stability certificate after completion of the work. (For Executed work)
Providing full-fledged assistance to JMC or JMC’s appointed consultant, TPI agencies etc.
Consultant shall follow best engineering practice and code of ethics.
(B) Design & Tendering Consultancy
• This includes Scope of Work as (A) Design consultancy mentioned above.
• Preparation of Detailed Project Report (DPR) as per latest/prevailing SORs/Approved Rate
Analysis as well as latest prevailing version of CPHEEO- Manual which must be competent
enough to get approval from STATE / CENTRAL GOVERNMENT.
• Submission of DPR in hard & soft copy as required by JMC.
• Preparation of Tender Document, Tender Evaluation till award of work and
recommendation for acceptance or rejection of Tender.
• Preparation of detail design, hydraulic design, structural design, working and structural drawings
for execution and submission of all detail calculations and drawing for both designs.
• All detail design, its calculations, working and structural drawings for the entire work shall be
submitted by the consultant within the one month from the work awarded to the contractor. In
case of addition / introduction of new venders, consultant should have to take approval from JMC.
• Attending Pre Bid Meeting, Prepare Meeting summary notes & clarify the questions that arise
from potential bidders during and after the pre bid meeting.
• Carrying out Revision of estimate/hydraulic/structure design during execution if needed as per
instructions of JMC and or its appointed consultant/agency.
• Approval of Bill of Quantity at Tender Stage.
• The consultant shall follow best engineering practice and code of ethics.
• Details Presentation shall be made in JMC / Govt. as per requirements and make co-ordinate with
Govt. agency for approval.
(C) Project Management Consultancy
SCOPE WORK IS INCLUDED AS IN (A) AND (B).
DAY TO DAY SUPERVISION OF PROJECT DURING THE EXECUTION OF
THE WORK INCLUDING SUBMISSION OF DAILY INSPECTION REPORTS
AND SHALL INCLUDE FOLLOWING.
• Appointment of qualified permanent staff for day to day site supervision of
particular project. At least one B.E.Civil having five years minimum experienced
shall be appointed on each site separately. He shall not be assign more than one site
• Checking levels, lineout, hydraulic design, structural design, general arrangement
drawing, working drawing etc. and approve the same.
• Accessing and assisting to find out possible hindrances before execution of work or
• Recommendation of any technical changes in approved tender items or extra items
if any required to be carried out.
• Providing full-fledged assistance to JMC along with TPI and structural consultant
in co-ordination with State & Central Government Organizations Western Railway
and other concerned departments to expedite the work.
• Addressing Complaints of citizens during execution of the project and furnishing
satisfactory compliance to the Authority.
Attending weekly review meetings held by JMC, preparing minutes of meeting for
the same & circulates to concer officials.
• Appraisal to the Government inspection committee as and when if required.
• To monitor physically quality assurance, inspection and testing carried out at
laboratory/site/manufacturing plant for all materials & machinery and comment on
the same if any, for satisfactory completion of the entire project in specified time
schedule in all respect.
• 100% checking of Measurements recorded for work, executed by contractor and
assisting JMC to any objection/quarry raised by competent authority.
• Consultant shall provide certificate of 100% checking of measurement of all time and
its quality confirming to tender requirement.
• Before recommending for payment, consultant make sure all suggestions/objections
are complied as per tender and suggestion/objection/ compliance report shall be
submitted at the time of certification of each bill
• Checking of bills submitted by the contractor and recommendation of payment with
interim quantity and quality/specification verification reports. Consultant shall also
recommend part rate in case of partly executed items are not acceptable in all way.
• Monitoring of work progress for timely completion including various methods of Bar
chart, CPM – PERT, etc.
• Issue of completion certificate and monitoring performance of the project till
release of performance guarantee.
• The Consultant shall have to submit every half Yearly Performance Reports during
performance period after the satisfactory completion of the project.
• Preparation of excess/saving statement along with technical justifications at the time
of release of each running bill as well as final bill.
The consultant shall follow best engineering practice and code of ethics.
Submission of weekly progress report in 2 nos of hard copy.
CONSULTANT’S SCOPE OF WORK IN DETAILS:-
1. The consultant shall exercise powers and authority as well as perform all the duties,
liabilities, functions and obligations as "Engineer in Charge" except for the following for
which the Engineer in charge shall submit proposals for obtaining specific approval of the
competent authority in JMC, before taking any action, In general any matter involving
financial liabilities on the employer shall be referred to employer.
2. The Consultant shall obtain prior approval of the JMC in respect of.
a. Approving subletting of the work.
b. Granting claims to the agency.
c. Ordering suspension of the work.
d. Waiving off the penalty and arranging the repayment of compensation for delay.
e. Determining an extension of time and its justification.
f. Issuing a variation order.
g. Ordering any works/test beyond the scope of the contract if needed for quality of work.
h. Determining rates for the extra items/extra work.
i. Any variation in the contract condition. Approval to designs submitted to the
j. Issuing any kind of certificates to the contractor.
3. Immediately on award of work, the consultants shall set up local area office under the
Team Leader who will be in constant charge of the direction and control of the work.
4. The Team Leader shall visit the work site personally from time to time (no longer than
15 days’ time) regular for ascertaining that the work is being carried out satisfactorily and
also for studying the problems on the spot and giving necessary clarifications/directions.
5. The consultant shall engage and retain for this purpose, adequate supervisory staff as agreed
upon between the client and the consultant. The supervisory staff shall consist of well qualified
and experienced engineer not less than graduate with five years’ experience and the consultant
shall undertake to keep a qualified and experienced technical Resident site Engineer who shall
always be in charge of the works and be available on the site until the project is
6. The consultant shall issue power of Attorney on Govt. Stamp Paper in favour of its Resident
Engineer authorizing him to raise and accept bills, to give instructions to the contractor, to
prepare measurements, bills and to certify the payment including communication with contractor
and the JMC The above authorization should be submitted immediately on execution of
agreement with the consultant.
7. (a) The Resident Engineer available at site shall receive instructions on behalf of the consultants
which may be given from time to time either by the City Engineer or by any Inspecting Officers.
(b) The contractor will submit bar/CPM chart of the work to consultant. The consultant shall
study the same in detail if required necessary correction shall be made and contractor shall be
asked to submit the revised Bar/CMP chart. The same after approval and duly signed shall be
submitted to JMC P.M.C. shall study existing traffic movement on roads. Various alternative
routes for diverting traffic some portion of road depending up on location required to execute the
work (as per Bar/CPM chart submitted by the contractor) shall be prepared by P.M.C. the same
being after consultation with Traffic Police Department the decided portion of road will be
allowed to barricade for execution. P.M.C. shall see that barricading is properly carried out and
maintain properly by the contractor in order to avoid hindrance to traffic movement. P.M.C.
shall ensure that Traffic Boards, Traffic signs, Traffic signal light shall be properly placed by the

inspecting officers about the quality of work are attended by the contractor.
9. The consultant shall deploy adequate staff at the site of work for supervision and exercising
adequate and constant day to day technical supervision over the construction including
submission of daily inspection report, layout checking, checking requirements of material and
their procurement in time, checking their quality conformance to approved specifications and
accepted standard.
10. The consultants shall provide and maintain at their cost, own vehicles required for use in
connection with their assignment.
11. Consultant shall make his own arrangements for Water, Electricity, all furniture, Computer with
internet facilities, Printer, Digital camera with HD video recording facilities etc at site office at
12. The consultant shall be fully responsible in their capacity as consultants for the soundness and
correctness of all works executed assuming responsibility of the conformity of the work to the
approved plans, and specifications and conditions of contract applicable to the work in question.
13. Any approval / concurrence by the client to consultant's instructions, preliminary or detailed
engineering, design, drawings and estimates shall in no way absolve the consultant to ensure
sound construction and performance as per the specification of the scheme as a whole. The
appointment of any engineering staff by the client at the site of the work shall not in any way
diminish the responsibility of the consultants in this respect.
14. The consultant shall not have any objection to the client maintaining any civil engineering staff /
inspecting agency (the office space for whom will be provided separately by the client) at its
own cost at the site of works to carry out work and duties allotted to them by the client in
respect of works at the site of other areas. In this case during inspection of such authorities the
consultant shall produce necessary records drawings, documents etc. to the inspecting officer.
15. The consultants shall check, scrutinize and certify that the work measured and recommended for
payment are fully consistent with the type, measurement, quality and specifications prescribed in
the agreement entered into with the consultant. In the matter of approving such bills, the
consultant shall conform to the rules and instructions issued by JMC from time to time and
guidelines prescribed by GOG, CVC or any other Govt. inquiry agency. The consultant shall be
deemed to guarantee the correctbess scrutinized, checked or issued by them, as to the quality
control of the work concerned. Consultant shall have to submit the measurement sheets of R.A.
bills within 7 days to JMC which have been submitted by contractor for approval.
16. The consultant shall supervise the work on daily basis and submit the report on the same day.
Also for check measurement of hidden items to be done jointly by the consultant’s staff in
the presence his authorized representative before execution of such items of work and the
consultants shall affix their signature.
17. The consultant shall prepare draft of minutes of meeting of progress review meeting etc. that will
held in the presence of J.M.C., P.M.C., Contractor, Design consultant & other agencies.
The soft and hard copy of the same shall be submitted to JMC within three days after same being
approved by J.M.C. delivered to the Contractor, TPI and related authorities. Contractor & P.M.C.
shall see that points mentioned in minutes of meeting are strictly followed & complied.
Compliance report on follow up action of the minutes shall be made available a week before the
18. Before excavation is carried out by the contractor, the detail of underground services from all
Private / GOVT. / Semi GOVT. various agencies like Torrent power., Gujarat Gas Co. Ltd.,
Adani GAS, GAIL, , B.S.N.L., Reliance Telephone, Idea, Vodafone, Airtel, MTS, Tata/PGVCL
/GETCO., J.M.C. etc. shall be collected by Project Management Consultant. And before carrying
out excavation the service lines falling under particular location as per the details submitted.
P.M.C. shall inform the concern agencies so that they can keep their representative present
during excavation. P.M.C. shall see that all the excavation shall be carried out in presence of
their staff and proper care is taken by the contractor for protecting underground services. P.M.C.
shall keep record of damaged / undamaged / shifted underground service, encountered during
execution. PMC shall prepare and keep jointly signed records of all trial pits with all dimensions,
showing service line/utilities/manholes or any other obstructions etc encountered if any. PMC
shall also keep record of service line/utilities/manholes etc. shifted / removed by
agency/contractor.
P.M.C. shall see that no service lines shall be allowed to pass below approach road or footing of
any pier locations, Abutment location, return etc.
19. P.M.C. shall take, check and verify spot level of slab (initial level, execution level, final level of
site and different component of project and certify that level are as per drawings. The copies
(Hard and Soft) duly signed and submitted to JMC by RE/ARE within a week and after all slabs
are casted the spot level of all slabs shall be properly taken by PMC After same being properly
checked verified and found correct by P.M.C, only then wearing coat shall be allowed to cast
under the intimation of JMC.
20. The consultant shall have responsibility of submitting Quality Management plan and ensuring
compliance with its requirements and the instruction received from the client or its representative
from time to time during the execution of the work. Additional actions listed in the following
scope for generating such Quality Management realization have been indicated hereunder. Each
Quality Control requirement needs to be stitched into the overall Quality Management plan to
realize a total Quality Control Management function. The Quality Management Plan shall consist
the following points; however the list is not exhaustive.
a. Prepare a manual containing quality Management Plan including Quality Control
procedures and check lists for approved to materials and methods at various stages of
construction and a system for maintaining records of work and test results with prior
approval from Engineer-in-charge.
b. Following approval to the Quality Management plan by JMC the consultant will monitor and
instruct the consultant in its day to day implantation including advising on the organization of
laboratory and equipment at site and demonstrate the different work procedures and
maintenance of records.
c. Checking on the contractor’s construction methods, sequence of operations and temporary
works needed for ensuring quality of output and safety during construction.
d. Suggest and approve the system/methodology of temporary works, including staging,
shuttering, suggested, adopted by the consultant to ensure the quality and safety during the
e. Monitoring the implementation of the quality Management System and various other
suggestions made by the Officers of the JMC, by periodical visit compiling and analyzing the
test results and advising on necessary remedial/corrective action in time.
f. Furnishing monthly reports on monitoring of Quality Control to the JMC covering the above
mentioned aspects and any other important points relevant to quality of work and the extent of
g. Submitting a final report on quality aspects of the entire job on its completion.
h. Some of the subtasks to be included, but not limited to under the above stated scope of the
Quality Management plan are :

consultants will include the following. The P.M.C. shall prepare check list for each item

by P.M.C. and submit copy of the same once in a week to J.M.C. duly signed.
j. Collection of drawings & checking, verification & put endorsement that drawings are good for
construction. For any change Engineer-in-charge of J.M.C. decision will be final.

viii) The team leader shall have to attend site inspections and progress review meetings with the
higher officer etc. of JMC whenever required. The Team Leader shall have to inspect the site at
least twice a month till completion of project.
ix) The Consultant shall have to submit MPR with ‘S’ curve.
x) To carry out periodic (at least 4 times in a year) site inspections during the defect liability
period and submit the reports for the same as per the format approved by JMC.
The consultant shall undertake preparation of maintenance manual in respect of contracted work
and further advice the client by periodical inspection during the defects liability period on
maintenance requirement, if any.
In case of any defects found, consultant shall have to provide necessary supervision during
entire repairing period at site. Consultant has to submit a detail report of maintenance/repairing
work carried out by the contractor/Agency with photographs within three days.
To carry out joint principal inspection (detailed inspection) at the end of defects liability period
and advising on remedial measures for defects, if any, discovered.
No separate or any kind of payment/ charges shall be paid by the JMC.
xi) To submit daily/weekly progress reports to the JMC, covering physical progress against targets,
financial forecast, analyzing of test results and suggestions for corrective actions, quality
aspects compliance with tender specification/provisions and suggestions for wiping out back-
logs if any. The progress reports shall also include the consultant's inputs on the job for the
period of reporting and any other observations.
21. Under the intimation of JMC, consultant shall have to arrange and provide detail drawings
shall be issued to the contractor and JMC simultaneously well in advance. In any case work
shall not be held up as a whole or part due to non-availability of detail drawing during execution
and if at all such delay in issuing drawing or decision / direction. The consultant shall be liable
for penalty at the rate of Rs.5,000/- per day.
22. To maintain the register for drawings in the format suggested by Engineer-in- charge in soft and
hard copy and to submit the same in quarterly to JMC.
23. The consultant shall evolve appropriate plan and strategy for smooth execution of obligations of
contractor and maintain record of strategic materials and events related to work. Such records
shall be made available from time to time and as may be required by JMC.
24. The consultant shall ensure proper establishment of field laboratories by contractor to conduct
laboratory tests on materials for constructions such as cement, steel, bricks etc. essential gauges,
instruments etc. should be arranged to be calibrated periodically. The consultants shall maintain
necessary site records and obtain date in support of the same. The consultant shall ensure all field
and laboratory tests on materials of construction as well as partially or completely erected
structures etc. are carried out by contractor and maintain adequate records thereof.
25. The consultant shall suggest to client modifications if any, due to site conditions and advising
regarding cost variations on account of extra items and excesses on the contract.
26. The consultant shall monitor the progress by using modern methods of control such as
computerized CPM. and submission of progress reports of work executed weekly. The
consultant shall prepare draft minutes of meeting for the progress review meeting submit the
same in soft and hard copy to J.M.C. Both financial and physical progress reports with reference
to prefixed targets will be prepared. Constant review of progress within prescribed time and cost
parameters will have to be done by the project manager who will also suggest improvements
from time to time.
27. The consultant shall undertake complete administration and management of contract till end of
the contract and payment of final dues to the consultant. The responsibility of PMC will be up to
defect liability period.
28. The consultant shall submit 'As-Built' drawings stage wise to J.M.C. with the progress of work
both in soft and hard copies.
29. The consultant shall undertake verification of work during execution and on completion and
submitting certificate of completion of work along with completion report in 5 copies. The
project manager will prepare this certificate and furnish the same to the JMC.
30. The consultant shall carryout verification, by taking and recording joint measurements of the
final bill to be submitted by the consultant, preparation and finalization of final bills, as per items
and conditions of contract agreement and certificate for release of final payment by the
JAMNAGAR MUNICIPAL CORPORATION.
31. The consultant shall advise the client with regard to extra claim/disputes if any till the cases are
settled. The consultant will also be required to brief the legal adviser/legal consultant of the
client on cases pertaining to the work at no extra cost.
Consultant shall comply the correspondences from the contractor timely and effectively keeping
in view of contractual agreement and standard codal provisions under the intimation of this office
(UNDERGROUND DRAINAGE PROJECT, JMC) as may be approved by this office.
32. The consultant shall render to the client every assistance, all technical services, guidance or
advice on any matter concerning the technical and engineering aspects of the project including
periodical interaction and also through invited experts on specific subjects with client's prior
33. JAMNAGAR MUNICIPAL CORPORATION reserves the right to relieve the project
management consultant from the constancy at any stage of the work by giving one month prior
notice. In which case due fees shall be paid in proportion of the work completed at such stage.
34. In event the project is not completed within the stipulated time for any reason not attributable to
JMC, the services of PMC shall be continued at no extra cost to the JMC However in event of
any change of scope of work extending the period of completion an equitable adjustment in fees
payable beyond the stipulated period shall be made by JMC for which the decision Head of
Department shall be final and binding. (testing of all materials)
35 To maintain the register for Cement/Steel etc. material received and to record the above
details at site with necessary copy of bill, royalty pass etc. in format suggested by JMC.
All registers and all other data must be computerized and soft copy of the same must be ready
available with PMC as and when needed to JMC
36. To maintain cement, steel and asphalt and all construction materials consumption register
in the format suggested by JMC and send the same to the Engineer-in-charge (JMC) for
approval at the end of every month.
37. To control the cement distribution for the work and daily records for actual consumption of
cement and standard consumption of cement.
38. To check the Bar Bending Schedule for the work and maintain the record for the same in the
format suggested by Engineer-in-charge (J.M.C.).
39. The consultant shall maintain and submit daily progress report of each site covering progress of
each item of tender.
40. To maintain site visit register and issue the instruction accordingly to the consultant if
required and submit the register at the end of every month to the Engineer-in-
charge (JMC) for information and necessary action.
41. The consultant would be responsible for checking the materials, workmanship and soundness of
all components of structures keeping in view Q. A. checks and safety standards. Consultants
shall submit weekly and monthly progress reports as per the directions of the client and should
also submit recommendations in regards to extra items with supporting site records and also
supervise field tests on materials structures etc. in accordance with predetermined schedules. The
consultant shall also maintain adequate records to ensure proper certification of bills for the work
done for payment to consultants, including recommendations of extension application, extra
items variation statements.
42. The consultant shall not have any objection to the works being inspected by any other
agency appointed by the client for inspection of the same.
43. The consultant shall exercise complete day to night supervision during construction period of
the assigned work, ensuring quality control in accordance with tender stipulations,
specifications, drawings and site conditions. The quality control shall be exercised at all stages
of construction, viz. approval of materials there of the in proper proportion including prescribing
norms for tests periodically and acceptability criteria and workmanship at all stages of
execution of individual items of work.
44. The consultant shall ensure proper establishment of RMC plant (in case of the contractor’s
plant for producing desired concrete mix) and field laboratories by contractor to conduct
laboratory tests on materials for constructions such as cement, steel, bricks etc. essential
gauges, instruments etc should be arranged to be calibrated periodically. The consultants
shall maintain necessary site records and obtain date in support of the same. The consultant
shall ensure all field and laboratory (it includes outside laboratory also) tests on materials of
construction as well as partially or completely erected structures etc. Are carried out by
contractor and maintain adequate records thereof. The consultant shall make sure all testing of
material is done in their presence and shall be recorded and signed. PMC representative must
remain present in all testing at site or at plant based in Jamnagar city or out of Jamnagar city at
45. The consultant shall be made responsible if any accident occurs during execution of the project
due to negligence of the contractor, improper work done, in adequate safety measures.
46. The consultant shall suggest to client modifications if any, due to site conditions &

49. The consultant shall undertake complete administration and management of contract till end of

show all existing services located stage wise to JMC with the progress of work both in soft and
hard copies with all drawing GIS mapping (Geographic Information System mapping) all
Manhole / chamber Exact Location & Coordinate and all pipe dia wise Demands.
51. The consultant shall undertake verification of work during execution and on completion and
submitting certificate of completion of work along with completion report in 5 copies. The
project consultant shall prepare this certificate and furnish the same to the JMC only.
52. The consultant shall perform his duty in such a way there is no undue financial impact on cost of

The consultant shall furnish to the JMC following reports and documents (along

consultant has convened, to the JMC commencing at the end of the month
following the date of the contract for construction. After the issue of the
completion certificate these reports shall be submitted at ½ (Half) Yearly interval,
until the end of maintenance period.

completion report at the time of final certification in 5 with All drawing GIS mapping

Coordinate and all pipe dia wise Demands.
i) The consultant shall have to submit the soft copy (CD/DVD) of the photographs and
video recording with every monthly progress report showing progress at site, casting
methodology, workmanship, safety precautions, testing, flow test or any other activities
as in tender scope of work carried out at site and out site laboratory at his own cost.
Consultant has to submit at least 30 different type of activities photographs duly binded
in Album (with entitling of each photo) separately with every monthly progress report at
j) Consultant shall have to take photographs on daily basis wherever required and at the
places where works are in progress to capture the type of activities running, resources
mobilized and to show the day to day progress effect from the contractor with the
impression of date and time on the photographs. Month wise soft copy of all such

construction works of various capacity STP, TTP, CETP and APS for Sewerage System
in Jamnagar City as specified in the tender by JAMNAGAR MUNICIPAL
CORPORATION and.
Where as the said M/s. has appointed as Project Management Consultant
(PMC) us, Bank to provide a PERFORMANCE GUARANTEE bond to the JMC for
the work undertaken by M/s. and
Where as we, the Bank have agreed to provide the following PERFORMANCE
GUARANTEE bond.
Now THEREFORE we the Bank provide the following Performance Bank
Guarantee by way of this bond to the JMC.
1. The Project Fee of the Project Management Consultant (PMC) provided that to M/s.
by the JMC is . This guarantee in the nature of PERFORMANCE
GUARANTEE is provided so as to ensure and indemnity the JMC for the full and proper
performance of the contract by Consultant M/s. the bank hereby
indemnify the JMC for all looses and/or damages to Drainage / Sewerage project work which
would be executed by contractor M/s. and such PERFORMANCE
GUARANTEE would include any damage to the executed work or its components which may be
suffered by the JMC, as a result of defective supply and workmanship, or at all by way of this
We the bank agree and promise that in the eventuality of the Consultant M/S.
not remedying the problem, loss or damage to the executed work. We shall indemnify
and pay the JMC, such expenses, losses and damaged that may be incurred by the JMC, as a
result of the JMC getting the work done itself or from other source.
2. We bank agree and understand that the decision as to whether any losses or
damages to the executed work have taken place or not and/or whether the work suffer from poor
workmanship or not will be taken by the Commissioner of JMC and on the commissioner's
decision regarding such losses or damage or defect whatsoever being so notified by the JMC to
us. We shall immediately take steps and ensure that M/S-------------------- faithfully and diligently
carry out the necessary remedial steps to the full satisfaction of the commissioner of JMC. The
opinion of the commissioner as to whether a full and complete remedial step, to the full
satisfaction of the commissioner of JMC has been taken or not will be that of the Commissioner
of JMC. For the purpose of arriving at such decision as aforesaid, it will be open to the
commissioner of JMC to take assistance of such technical people as may be available and it will
be also open to the commissioner of JMC in case he desires, to delegate this power to a
subordinate, like City Engineer, to take appropriate decisions and the decisions referred to above
will be deemed to be properly taken by the Commissioner of JMC. In the eventuality of M/s.
not taking remedial action to the at most satisfaction of the commissioner of
JMC the JMC will be entitled to get the work done itself or from other sources. On the
Commissioner of JMC notifying to us the total expenses incurred for the purpose we hereby
expressly undertake to pay to JMC the said amount forthwith and in any case not later than 7 days
from such intimation. We shall accept as final and binding the amount indicated by the
Commissioner of JMC and our obligation to pay such amount will be a continuing obligation
irrespective of any dispute or difference that may arise between us and M/s. of
between JMC and M/s. .
3. The Project Fee is Rs. . This PERFORMANCE GUARANTEE is limited to
10% of the said Project Fee and accordingly it comes to Rs. . Our liability, in all
cases is limited to Rs. .
4. We agree and undertake that this PERFORMANCE GUARANTEE will be valid for a period of
Five years from the date when the contract work is completed. The Commissioner of JMC will
notify such completion date to us. In case no such completions date if notified, this
PERFORMANCE GUARANTEE will come in to effect from such completion date. It is
expressly understood that in considering this period of 5 years, the date by which the Corporation
intimate the Bank about the losses, damages or problem as the case may be, shall be considered
and as long as such intimation is within a period of Five years, from the completion date, we the
Bank will be liable irrespective of whether the remedial actions or lack there of
has taken place after the period of three years.
5. We Bank agree that the PERFORMANCE GUARANTEE which is a
continuing guarantee, will be binding and enforceable against us irrespective of any difference or
dispute between JMC and M/s. or between us and M/s. and
irrespective of any change or variation or extension of time or any forbearance or waiver made or
granted by JMC to M/s. .
6. In case any disputes arises as to the interpretation or implementation of this PERFORMANCE
GUARANTEE THE MATTER shall be referred to the sole arbitration of the commissioner of
JMC, whose decision in the matter will be final. In case any recourse to any court of law is
necessitated, the appropriate Civil Court at Jamnagar Alone will have jurisdiction.

consultancy services and has the necessary professional expertise and skills and personnel to
perform the required consultancy services;
And Whereas the Client requested the Consultant to undertake the assignment for providing
Consultancy Service as a Project Management Consultant (PMC) in connection with the
construction of above mentioned work.
And Whereas pursuant to the said request of the Client, the Consultant has submitted a proposal
dated …………, which the Client finds is acceptable with modifications and communicated its
acceptance to the Consultant vide its letter of Intent bearing Outward No.
……………………………………. after the same being approved by the Standing Committee of the
Client vide its resolution bearing No. ………… dated ................ ;
And Whereas 0n receipt of the Client’s offer, the Consultant has agreed to render the consultancy
services called for in this Agreement, pursuant to which both the Parties have agreed to enter into
this Agreement on the terms and conditions and covenants hereinafter set forth as under.
NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:
The basic objective of the assignment is to prepare design, a Technical Document for Detail Project
Report (DPR), Tender Document and providing Supervision during Project Implementation.
1. The Client has engaged the Consultant to perform professional services in connection with
construction of different Sewerage Works for which the scope of services to be rendered by the
Consultant are set forth in Annexure – B to this Agreement.
2. The Consultant’s work will be in accordance with the manner, method and techniques normally
used by competent professional in performing the assigned work. All of the Consultant’s work
under this Agreement will be in accordance with the standards of its profession and all
drawings, designs and studies will be in full accordance with all applicable laws and regulations
governing the project.
3. The Consultant warrants and represents that it is competent, knowledgeable and experienced in
the type of work to be performed. The Client has selected the Consultant, based upon the
Consultant’s representation of its knowledge and expertise in the area. The Consultant
understands that the Client in executing this Agreement, has relied on the representations made
in the Consultant’s proposal and on the Consultant’s skill and judgment in identifying the work
which would need to be performed to accomplish the stated objectives, and the manner and
method in which it should be performed. If there are additional services which would normally be
required or necessary to accomplish the stated objectives, the Consultant shall be obligated to
provide them within the price stated in this Agreement, even though they are not specifically
referred to in its proposal or in Annexure - A to this Agreement.
4. The services of Consultant are to be completed according to the schedule set out in Annexure
– B, entitled as “Time Frame”. Time is of the essence in this Agreement.
5. The Consultant shall be responsible apart from the scope of work mentioned in clause 2 above
for the followings:
a) Visiting the site, discussing details with the Client, prepare plan and site particulars of the
entire Sewerage / Drainage project showing all structures/features and services and
facilities to be made available.
b) Institute planning and preparing concept plans, preliminary drawings and designs, i.e.
preliminary sketches, plans, elevations, sections and perspective adequate to explain the
general nature of the work with basic dimensions in consultation with the Client.
c) To indicate the name of his sub- consultants for various services with their organization,
qualification and experience and shall obtain prior approval of the Client for the same.
However, he shall be fully responsible for the correctness and accuracy of services design
prepared by such sub-consultants and shall indemnify the Client for damage or loss caused
due to negligence of sub-consultant.
d) To supply all the approved working drawings and Structural drawings, specifications and
details in the manner required by the Client for proper execution of the work. (In total 5 sets
of approved drawings shall be supplied free of charge to the Client).
e) To obtain Client’s approval for any material deviation in design or specifications.
f) To inspect and certify correctness of the physical layout at site as per approved plans.
g) To undertake periodical supervision and inspection as may be considered necessary to
ensure execution of works in accordance with working drawings and specifications. To
obtain commencement certificates at various stages according to local bodies' byelaws
during execution from the local bodies in such a manner that the work’s progress should
continue unhindered.
h) To coordinate the various activities of his sub-consultants.
6. The Client agrees to pay to the Consultant the following fee for the professional services to be
rendered by him.

Important Notes :

2. Price Bid submitted in other mode will be straight way rejected without any intimation.
3. The amount of Fees shall be calculated as mentioned above.
4. The above Fees are total including all Taxes etc.
5. Project DPR shall be prepared with capital cost + 10 to 15 years O & M cost. The % fee for PMC
work shall be paid only on capital cost.
(This fee is inclusive of all the direct and indirect taxes including GST, Service Tax, Duties /Cess
etc. to be paid by the Consultant and nothing extra).
a. (These fees are inclusive of all the direct and indirect taxes including service tax, duties/
cess etc. to be paid by the Consultant and nothing extra over & above the assignment fee
shall be paid to consultant by the Client. However, the expenditure incurred by the
Consultant towards payment of actual fee to various statutory departments for obtaining the
required statutory approvals shall be reimbursed by the Client on submission of
documentary evidence for actual payment made by the Consultant for the same. The
payments made by the Client to the Consultant shall be subject to deductions as per Indian

The Consultant will be required to furnish Demand Draft from nationalized / RBI approved
Scheduled Bank for due fulfillment of the Contract and shall submit after award of work and before
signing of the Contract/Agreement, for a sum equal to Rs.5.00 lac. When total value of all projects
cost exceeds Rs.50 crores, an additional S.D. shall be submitted at the rate of 5% of amount
exceeding Rs.50 crores on written request.
8. The Consultant will also be required to furnish Bank Guarantee from Nationalized / RBI
approved Scheduled Bank by way of Performance Guarantee in the prescribed
format (Format is attached as Annexure-‘II’), for due fulfillment of the Contract and shall
submit on completion of project consultancy work as a whole or in part. The Performance
Guarantee shall be of 10% of final consultancy fees paid and remain valid up to 5 years from
the completion of the work and the same shall be released after satisfactory performance
of the project. The Performance Bank Guarantee shall be submitted for 5 years period at a
In case the Consultant fails to complete the work, the Client, without prejudice to rights and
remedies available under the contract, shall forfeit and encash the Performance
Guarantee Amount / Security Deposite and or unpaid work amount and credit it to the
JMC. Further, in case the bank goes in liquidation or for any reason is unable to make
payment against the said Bank Guarantee the loss caused thereby shall be borne by the
Consultant. The Consultant forthwith, on demand from the Client, shall make good the deficit.
9. Additions and Alterations:
a) The Client shall have the right to request in writing for changes, additions, modifications or
deletions in the design and drawings or any part of the work and to request in writing
additional work in connection therewith and the consultant shall comply with such request.
b) The consultant shall not make any deviations, alterations, additions, to or omissions from the
work shown/described and awarded to the contractor except through and with proper
approval of the Client.
10. Abandonment of Work:
That if the consultant abandons the work for any reason whatsoever or becomes incapacitated
from acting as Consultant as aforesaid, the Client shall forfeit/encash the Performance
Guarantee (Decision of Municipal Commissioner in this regard shall be final and binding).
The Client shall be at liberty to make full use of all or any of the drawing/data/documents
prepared by the Consultant The Consultant shall also be liable to refund all the fees paid to
him up to date plus such damages as may be assessed by the Client (Decision of
Municipal Commissioner shall be final and binding) subject to a maximum of total project Fee
under this agreement including the recovery of liquidated damages if any caused to the Client.
In case of consultant fails to perform the assignment in time and as per need of JMC. JMC
may take legal as well as criminal action without any constraint.
11. Provided, however, that in the event of the termination of the Agreement under proper notice as
provided in the clause hereinafter, the Consultant shall be liable to refund any excess payment
made to him over and above which is due to him in accordance with the terms of this
agreement, for the services rendered by him till the date of termination of Agreement.
a) The Consultant shall agree to redesign at his cost any portion of his engineering and design
work, which due to his failure to use a reasonable degree of skill shall be found defective
within two years from the date of start of regular use of the portion of the work affected. The
Client shall grant right of access to the Consultant, of this portion of the work claimed to be
defective for inspection.
b) The Client may make good the loss by recovery from the dues of the Consultant in case of
failure to comply with the above clause.
13. Independent Contractor:
It is understood and agreed that Consultant, in the performance of the work and services agreed
to be performed by Consultant, shall act as and be an independent contractor and not an agent
or employee of the Client and as an independent contractor, Consultant shall obtain no rights to
retirement benefits or other benefits which accrue to the Client’s employees, and Consultant
hereby expressly waives any claim it may have to any such rights.
14) Determination and Rescission of Agreement:
a) The Client without any prejudice to its right against the Consultant in respect of any
delay by notice in writing absolutely determine the contract in any of the following cases:
i) If the Consultant, being a company has passed a resolution or the court has made
any order that the company shall be wound up or if a receiver or a manager on behalf
of the creditor has been appointed or if circumstances has arisen which entitles the
court to appoint a receiver or a manager or which entitles the court to make up a
winding up order.
ii) If the Consultant commits breach of any of the terms of this Agreement.
b) When the Consultant has made himself liable for action under any of the clauses
aforesaid, the Client shall have powers:
i) To rescind the Agreement.
ii) To engage another Consultant to carry out the balance work debiting the Consultant
the extra amount, if any, so spent for getting the balance work done.
This amount would be in addition to the recovery of liquidated damages under Clause
15) Assign ability :
The Parties agree that the expertise and experience of Consultant are material considerations
for this Agreement. Consultant shall not assign or transfer any interest in this Agreement nor
the performance of any of Consultant’s obligations hereunder, and any attempt by Consultant
to assign this Agreement or any right duties, or obligations rising hereunder shall be void and
of no effect. There are no third party beneficiaries to this Agreement.
16) Indemnification:
The Consultant agrees to keep the Client, its officers and employees and agents fully and
effectually indemnified from and against any loss, claim or liability (if proved) whatsoever
arising out of or resulting in any way or incurred or suffered by the Client due to the willful or as
are result of negligence or any default or omission by the Consultant (or its employees, agents
or representatives) of its obligations however arising in connection with the services. However,
the acceptance of said services and duties by the Client shall not operate as a waiver of such
right of indemnification. Such indemnity shall be limited upto a maximum of 10% of consultancy
17) Ownership of Materials:
All data, documents, CAD drawings files, photos, digital photos, discussions notes or other
information discovered, developed or received by or from the Consultant or any other person
engaged directly or indirectly by the Consultant to perform the services required hereunder
shall be and remain the property and ownership of the Client without restriction or limitation
upon their use.
18) Prior Agreement and Amendments:
This Agreement, including the Annexure attached hereto, represents the entire understanding
of the Parties as to those matters contained herein. No prior oral or written understanding shall
be of any force or effect with respect to those matters covered hereunder. This Agreement may
only be modified by a written amendment duly executed by the Parties to this Agreement.
However, the following documents attached hereto shall also be deemed to form an integral
part of this Agreement:

19) Standard of Care :
All of the services to be performed by the Consultant under this Agreement from the inception
of this Agreement until termination of the Agreement shall meet or exceed the professional
standard and quality which prevails among the Consultant’s having similar knowledge and skill
engaged in related work under the same or similar circumstances. All documentation prepared
by the Consultant shall provide for a completed Sewerage / Drainage Project that conforms to
all applicable codes, rules, regulations and guidelines, which are in force at the time such
documentation is prepared.
20) Dispute Resolution :
If any dispute arises between Parties hereto during the subsistence or thereafter in connection
with the interpretation, reasonableness, validity, implementation or alleged material breach of
any provisions of this Agreement or regarding any question including the question as to
whether the termination of this Agreement by any Party hereto has been legitimate, the Parties
hereto shall endeavor to settle such disputes amicably. The attempt to bring about such
amicable settlement shall be considered to have failed as soon as one of the Parties hereto,
after not less than thirty (30) days of such attempt, gives notice to the other Party in writing.
Failing amicable resolution through mutual negotiations, all disputes shall be referred to and
settled by Municipal Commissioner of Jamnagar Municipal Corporation, Jamnagar who will act
as an arbitrator, and the decision given by him shall be binding upon both the Parties. The
arbitration proceedings shall be held in Gujarati / English, in accordance with the Arbitration
and Conciliation Act, 1996 or any subsequent enactment or amendment thereto. The venue of
arbitration proceedings shall be at Jamnagar.
Notwithstanding any pending reference to arbitration, both Parties shall continue to perform
their respective obligations under this Agreement and the Parties shall not withhold. For any
reason whatsoever, including pendency of arbitration proceedings, payment of any amount
which has become due.
Unless otherwise stated, notices to be given under this Agreement including but not limited to a
notice of waiver of any term, breach of any term of this Agreement and termination of this
Agreement, shall be in writing and shall be given by hand delivery, recognized international
courier, mail, telex or facsimile transmission and delivered or transmitted to the Parties at their
respective addresses set forth below:

a) The Consultant shall be fully responsible for the technical soundness of the work including
those of specialists engaged if any, by him and also ensure that the work is carried out
generally in accordance with drawings, specifications and his conception.
b) The Client will have the work of Consultant and/or his sub-consultants
supervised/inspected/verified at any time by third party proof checking, any officer, check
estimates and designs.
c) The appointment of Client’s own supervisory staff, if any, does not absolve the Consultant of
his responsibility of general supervision. The Consultant shall be responsible for designs of
structures and all provisions/services of the work entrusted to him so as to satisfy their

full discharge of functions to be performed by him and no claim whatsoever shall be made
against the Client in respect of any proprietary rights or copy right on the part of any other

and against all costs and expenses paid by the Client in defending himself against such
f) The Consultant hereby agrees that the Client shall have the right to take out any of the
activities, which in the opinion of the Client is not being performed by the Consultant with due
diligence, and within the agreed time schedule, and which can be performed independently.
The fees or the expenses incurred shall be debited to the Consultant.
23) The Consultant warrants and represents the truth and accuracy o f all the promise,
representations and agreements made in this Agreement. The Consultant understands that the
Client relies on the truth and accuracy of the information contained herein.
24) This Agreement shall be subject to all applicable laws as prevalent and in force in India and
other applicable laws and rules formed and notified there under or any statutory modification or
reenactment thereof for the time being in force.

provide supervision for Project Management Consultancy (PMC) for the construction works of
various capacity STP, TTP, CETP and APS for Sewerage System in Jamnagar City.
“ SCOPE OF WORK ”
(A) Design Consultancy
• Data Collection/Survey : Details of existing APS, STP, Storm Water Drain, Natural Drain, Kaans, River passing
through city or any other naturally available carrier and storage spaces, Network, Disposal, Water body if any,
Over/Under Ground Services and other required details etc. This will also cover carrying out detailed survey of
Top/Ground/Road Levels, Invert/Bed Levels regular/required intervals of existing drains/proposed drains at regular
/required intervals including preparation of Cross Section as well as L-Section etc.
• Carrying out topographic survey : Details of wall to wall / full road width, Kaans/Rivulets, including all physical
appearances of Temporary/Permanent Structures, Poles, Trees, Central Divider, Foot-paths, Kerbs, D.P., Drains,
Storm Water Drains, Machine holes, Catch-pits, and any other required details etc. complete.
• Preparation of Plan, Cross Section at 30 mt./regular/required intervals as well as L-Section on basis of above
mentioned survey work etc.
• Carrying out Soil investigation and submission of detailed report.
• Preparation of various alternative General Arrangement Drawings (GAD) and suggesting best techno-eco alternate.
• Preparation of detail Hydraulic design along with calculations as per prevailing BIS codes, NBC and best
engineering practices,
• Preparation of detail working and structural drawings / design along with calculations as per prevailing BIS codes,
NBC and best engineering practices for execution.
All detail design, working and structural drawings for the entire work shall be submitted in 5 sets in form of editable
soft copies and hard copies by the consultant within the stipulated time period from the work awarded to him.
• Preparation of preliminary/final design drawing and Estimates/Specifications as per latest/prevailing
SORs/Approved Rate Analysis and preparation new SOR/Rate Analysis as per market rate.
Frequent site visits during execution of work and give necessary modifications if required according to site situation.
Issuing structural stability certificate after completion of the work. (For Executed work)
Providing full-fledged assistance to JMC or JMC’s appointed consultant, TPI agencies etc.
Consultant shall follow best engineering practice and code of ethics.
(B) Design & Tendering Consultancy
• This includes Scope of Work as (A) Design consultancy mentioned above.
• Preparation of Detailed Project Report (DPR) as per latest/prevailing SORs/Approved Rate Analysis as well as latest
prevailing version of CPHEEO- Manual which must be competent enough to get approval from STATE / CENTRAL
• Submission of DPR in hard & soft copy as required by JMC.
• Preparation of Tender Document, Tender Evaluation till award of work and recommendation for acceptance
or rejection of Tender.
• Preparation of detail design, hydraulic design, structural design, working and structural drawings for execution and
submission of all detail calculations and drawing for both designs.
• All detail design, its calculations, working and structural drawings for the entire work shall be submitted by the
consultant within the one month from the work awarded to the contractor. In case of addition / introduction of new
venders, consultant should have to take approval from JMC.
• Attending Pre Bid Meeting, Prepare Meeting summary notes & clarify the questions that arise from potential
bidders during and after the pre bid meeting.
• Carrying out Revision of estimate/hydraulic/structure design during execution if needed as per instructions of JMC
and or its appointed consultant/agency.
• Approval of Bill of Quantity at Tender Stage.
• The consultant shall follow best engineering practice and code of ethics.
• Details Presentation shall be made in JMC / Govt. as per requirements and make co-ordinate with Govt. agency for
(C) Project Management Consultancy
SCOPE WORK IS INCLUDED AS IN (A) AND (B).
DAY TO DAY SUPERVISION OF PROJECT DURING THE EXECUTION OF THE WORK
INCLUDING SUBMISSION OF DAILY INSPECTION REPORTS AND SHALL INCLUDE
• Appointment of qualified permanent staff for day to day site supervision of particular project.
At least one B.E.Civil having five years minimum experienced shall be appointed on each site
separately. He shall not be assign more than one site at a time.
• Checking levels, lineout, hydraulic design, structural design, general arrangement drawing, working
drawing etc. and approve the same.
• Accessing and assisting to find out possible hindrances before execution of work or its any part.
• Recommendation of any technical changes in approved tender items or extra items if any required to
be carried out.
• Providing full-fledged assistance to JMC along with TPI and structural consultant in co-
ordination with State & Central Government Organizations Western Railway and other concerned
departments to expedite the work.
• Addressing Complaints of citizens during execution of the project and furnishing satisfactory
compliance to the Authority.
Attending weekly review meetings held by JMC, preparing minutes of meeting for the same &
circulates to concer officials.
• Appraisal to the Government inspection committee as and when if required.
• To monitor physically quality assurance, inspection and testing carried out at
laboratory/site/manufacturing plant for all materials & machinery and comment on the same if any, for
satisfactory completion of the entire project in specified time schedule in all respect.
• 100% checking of Measurements recorded for work, executed by contractor and assisting JMC to any
objection/quarry raised by competent authority.
• Consultant shall provide certificate of 100% checking of measurement of all time and its quality
confirming to tender requirement.
• Before recommending for payment, consultant make sure all suggestions/objections are complied as
per tender and suggestion/objection/ compliance report shall be submitted at the time of certification of
• Checking of bills submitted by the contractor and recommendation of payment with interim quantity
and quality/specification verification reports. Consultant shall also recommend part rate in case of
partly executed items are not acceptable in all way.
• Monitoring of work progress for timely completion including various methods of Bar chart, CPM –
• Issue of completion certificate and monitoring performance of the project till release of
performance guarantee.
• The Consultant shall have to submit every ½ (Half) Yearly Performance Reports during performance
period after the satisfactory completion of the project.
• Preparation of excess/saving statement along with technical justifications at the time of release of each
running bill as well as final bill.
The consultant shall follow best engineering practice and code of ethics.
Submission of weekly progress report in 2 nos of hard copy.
CONSULTANT’S SCOPE OF WORK IN DETAILS:-
1. The consultant shall exercise powers and authority as well as perform all the duties, liabilities, functions and
obligations as "Engineer in Charge" except for the following for which the Engineer in charge shall submit
proposals for obtaining specific approval of the competent authority in JMC, before taking any action, In general
any matter involving financial liabilities on the employer shall be referred to employer.
2. The Consultant shall obtain prior approval of the JMC in respect of.
a. Approving subletting of the work.
b. Granting claims to the agency.
c. Ordering suspension of the work.
d. Waiving off the penalty and arranging the repayment of compensation for delay.
e. Determining an extension of time and its justification.
f. Issuing a variation order.
g. Ordering any works/test beyond the scope of the contract if needed for quality of work.
h. Determining rates for the extra items/extra work.
i. Any variation in the contract condition. Approval to designs submitted to the consultants.
j. Issuing any kind of certificates to the contractor.
3. Immediately on award of work, the consultants shall set up local area office under the Team Leader who
will be in constant charge of the direction and control of the work.
4. The Team Leader shall visit the work site personally from time to time (no longer than 15 days’ time)
regular for ascertaining that the work is being carried out satisfactorily and also for studying the
problems on the spot and giving necessary clarifications/directions.
5. The consultant shall engage and retain for this purpose, adequate supervisory staff as agreed upon between the
client and the consultant. The supervisory staff shall consist of well qualified and experienced engineer not less
than graduate with five years’ experience and the consultant shall undertake to keep a qualified and experienced
technical Resident site Engineer who shall always be in charge of the works and be available on the site
until the project is completed.
6. The consultant shall issue power of Attorney on Govt. Stamp Paper in favour of its Resident Engineer authorizing
him to raise and accept bills, to give instructions to the contractor, to prepare measurements, bills and to certify the
payment including communication with contractor and the JMC The above authorization should be submitted
immediately on execution of agreement with the consultant.
7. (a) The Resident Engineer available at site shall receive instructions on behalf of the consultants which may be given
from time to time either by the City Engineer or by any Inspecting Officers.
(b) The contractor will submit bar/CPM chart of the work to consultant. The consultant shall study the same in detail if
required necessary correction shall be made and contractor shall be asked to submit the revised Bar/CMP chart. The
same after approval and duly signed shall be submitted to JMC P.M.C. shall study existing traffic movement on
roads. Various alternative routes for diverting traffic some portion of road depending up on location required to
execute the work (as per Bar/CPM chart submitted by the contractor) shall be prepared by P.M.C. the same being
after consultation with Traffic Police Department the decided portion of road will be allowed to barricade for
execution. P.M.C. shall see that barricading is properly carried out and maintain properly by the contractor in order
to avoid hindrance to traffic movement. P.M.C. shall ensure that Traffic Boards, Traffic signs, Traffic signal light
shall be properly placed by the contractor.
8. The consultant shall ensure that all observations made during the periodic visits by various inspecting officers about
the quality of work are attended by the contractor.
9. The consultant shall deploy adequate staff at the site of work for supervision and exercising adequate and constant
day to day technical supervision over the construction including submission of daily inspection report, layout
checking, checking requirements of material and their procurement in time, checking their quality conformance to
approved specifications and accepted standard.
10. The consultants shall provide and maintain at their cost, own vehicles required for use in
connection with their assignment.
11. Consultant shall make his own arrangements for Water, Electricity, all furniture,
Computer with internet facilities, Printer, Digital camera with HD video recording facilities etc at site office at his
12. The consultant shall be fully responsible in their capacity as consultants for the soundness and correctness of all
works executed assuming responsibility of the conformity of the work to the approved plans, and specifications and
conditions of contract applicable to the work in question.
13. Any approval / concurrence by the client to consultant's instructions, preliminary or detailed engineering, design,
drawings and estimates shall in no way absolve the consultant to ensure sound construction and performance as per
the specification of the scheme as a whole. The appointment of any engineering staff by the client at the site of the
work shall not in any way diminish the responsibility of the consultants in this respect.
14. The consultant shall not have any objection to the client maintaining any civil engineering staff / inspecting
agency (the office space for whom will be provided separately by the client) at its own cost at the site of works to
carry out work and duties allotted to them by the client in respect of works at the site of other areas. In this case
during inspection of such authorities the consultant shall produce necessary records drawings, documents etc. to
the inspecting officer.
15. The consultants shall check, scrutinize and certify that the work measured and recommended for payment are fully
consistent with the type, measurement, quality and specifications prescribed in the agreement entered into with the
consultant. In the matter of approving such bills, the consultant shall conform to the rules and instructions issued by
JMC from time to time and guidelines prescribed by GOG, CVC or any other Govt. inquiry agency. The consultant
shall be deemed to guarantee the correctbess scrutinized, checked or issued by them, as to the quality control of the
work concerned. Consultant shall have to submit the measurement sheets of R.A. bills within 7 days to JMC which
have been submitted by contractor for approval.
16. The consultant shall supervise the work on daily basis and submit the report on the same day. Also for check
measurement of hidden items to be done jointly by the consultant’s staff in the presence his authorized
representative before execution of such items of work and the consultants shall affix their signature.
17. The consultant shall prepare draft of minutes of meeting of progress review meeting etc. that will held in the
presence of J.M.C., P.M.C., Contractor, Design consultant & other agencies. The soft and hard copy of the same
shall be submitted to JMC within three days after same being approved by J.M.C. delivered to the Contractor, TPI
and related authorities. Contractor & P.M.C. shall see that points mentioned in minutes of meeting are strictly
followed & complied. Compliance report on follow up action of the minutes shall be made available a week before
the next meeting.
18. Before excavation is carried out by the contractor, the detail of underground services from all Private / GOVT. /
Semi GOVT. various agencies like Torrent power., Gujarat Gas Co.Ltd., Adani GAS, GAIL, , B.S.N.L., Reliance
Telephone, Idea, Vodafone, Airtel, MTS, Tata/PGVCL /GETCO., J.M.C. etc. shall be collected by Project
Management Consultant. And before carrying out excavation the service lines falling under particular location as per
the details submitted. P.M.C. shall inform the concern agencies so that they can keep their representative present
during excavation. P.M.C. shall see that all the excavation shall be carried out in
presence of their staff and proper care is taken by the contractor for protecting underground services. P.M.C. shall
keep record of damaged / undamaged / shifted underground service, encountered during execution. PMC shall
prepare and keep jointly signed records of all trial pits with all dimensions, showing service line/utilities/manholes
or any other obstructions etc encountered if any. PMC shall also keep record of service line/utilities/manholes etc.
shifted / removed by agency/contractor.
P.M.C. shall see that no service lines shall be allowed to pass below approach road or footing of any pier locations,
Abutment location, return etc.
19. P.M.C. shall take, check and verify spot level of slab (initial level, execution level, final level of site and different
component of project and certify that level are as per drawings. The copies (Hard and Soft) duly signed and
submitted to JMC by RE/ARE within a week and after all slabs are casted the spot level of all slabs shall be properly
taken by PMC After same being properly checked verified and found correct by P.M.C, only then wearing coat shall
be allowed to cast under the intimation of JMC.
20. The consultant shall have responsibility of submitting Quality Management plan and ensuring compliance with its
requirements and the instruction received from the clien or its representative from time to time during the execution
of the work. Additional
actions listed in the following scope for generating such Quality Management realization have been indicated
hereunder. Each Quality Control requirement needs to be stitched into the overall Quality Management plan to
realize a total Quality Control Management function. The Quality Management Plan shall consist the following
points; however, the list is not exhaustive.
a. Prepare a manual containing quality Management Plan including Quality Control procedures and check lists for
approved to materials and methods at various stages of construction and a system for maintaining records of work
and test results with prior approval from Engineer-in-charge.
b. Following approval to the Quality Management plan by JMC the consultant will monitor and instruct the consultant
in its day to day implantation including advising on the organization of laboratory and equipment at site and
demonstrate the different work procedures and maintenance of records.
c. Checking on the contractor’s construction methods, sequence of operations and temporary works needed for
ensuring quality of output and safety during construction.
d. Suggest and approve the system/methodology of temporary works, including staging, shuttering, suggested, adopted
by the consultant to ensure the quality and safety during the construction.
e. Monitoring the implementation of the quality Management System and various other suggestions made by the
Officers of the JMC, by periodical visit compiling and analyzing the test results and advising on necessary
remedial/corrective action in time.
f. Furnishing monthly reports on monitoring of Quality Control to the JMC covering the above mentioned aspects and
any other important points relevant to quality of work and the extent of his inputs.
g. Submitting a final report on quality aspects of the entire job on its completion.
h. Some of the subtasks to be included, but not limited to under the above stated scope of the Quality Management plan
i. To prepare comprehensive check lists for each item of work and guidelines for quality control/guilty assurance
operations. The quality Management plan to be prepared by the consultants will include the following. The
P.M.C. shall prepare check list for each item before execution. The same shall be verified (levels & dimensions,
spacing of bar, cover etc.) by P.M.C. and submit copy of the same once in a week to J.M.C. duly signed.
j. Collection of drawings & checking, verification & put endorsement that drawings are good for construction. For any
change Engineer-in-charge of J.M.C. decision will be final.

ii) To analyze the various results of laboratory and field tests carried out, prepare and submit reports to JMC, and
suggest remedial measures, if any to remedy shortcomings.
iii) To check & advise the centering and shuttering and other temporary works proposed to be erected by the
consultant. The consultant shall have to give his suggestions/rectifications if any for that.
iv) To check and approve all items of work before commencement. For all important items of work like concreting
operations the consultants Engineer shall supervise the operation throughout.
v) To advice and approve construction methods, sequence of operations and program for work proposed by the
vi) To ensure that all the work is in line, level and vertically and the finishing are as per the approved drawings.
vii) To develop a format of "workmanship Index" in respect of all primary activities carried out for each items of work,
so that qualitative assessment of the project can be generated to facilitate acceptance criteria for reference and

JMC whenever required. The Team Leader shall have to inspect the site at least twice a month till completion of

The consultant shall undertake preparation of maintenance manual in respect of contracted work and further advice
the client by periodical inspection during the defects liability period on maintenance requirement, if any.
In case of any defects found, consultant shall have to provide necessary supervision during entire repairing period at
site. Consultant has to submit a detail report of maintenance/repairing work carried out by the contractor/Agency
with photographs within three days.
To carry out joint principal inspection (detailed inspection) at the end of defects liability period and advising on
remedial measures for defects, if any, discovered.
No separate or any kind of payment/ charges shall be paid by the JMC.
xi) To submit daily/weekly progress reports to the JMC, covering physical progress against targets, financial forecast,
analyzing of test results and suggestions for corrective actions, quality aspects compliance with tender
specification/provisions and suggestions for wiping out back-logs if any. The progress reports shall also include the
consultant's inputs on the job for the period of reporting and any other observations.
21. Under the intimation of JMC, consultant shall have to arrange and provide detail drawings shall be issued
to the contractor and JMC simultaneously well in advance. In any case work shall not be held up as a whole or
part due to non-availability of detail drawing during execution and if at all such delay in issuing drawing or
decision / direction. The consultant shall be liable for penalty at the rate of Rs. 5,000/- per day.
22. To maintain the register for drawings in the format suggested by Engineer-in- charge in soft and hard copy and to
submit the same in quarterly to JMC.
23. The consultant shall evolve appropriate plan and strategy for smooth execution of obligations of contractor and
maintain record of strategic materials and events related to work. Such records shall be made available from time to
time and as may be required by JMC.
24. The consultant shall ensure proper establishment of field laboratories by contractor to conduct laboratory tests on
materials for constructions such as cement, steel, bricks etc. essential gauges, instruments etc. should be arranged to
be calibrated periodically. The consultants shall maintain necessary site records and obtain date in support of the
same. The consultant shall ensure all field and laboratory tests on materials of construction as well as partially or
completely erected structures etc. are carried out by contractor and maintain adequate records thereof.
25. The consultant shall suggest to client modifications if any, due to site conditions and advising regarding cost
variations on account of extra items and excesses on the contract.
26. The consultant shall monitor the progress by using modern methods of control such as computerized CPM. and
submission of progress reports of work executed weekly. The consultant shall prepare draft minutes of meeting for
the progress review meeting submit the same in soft and hard copy to J.M.C. Both financial and physical progress
reports with reference to prefixed targets will be prepared. Constant review of progress within prescribed time and
cost parameters will have to be done by the project manager who will also suggest improvements from time to time.
27. The consultant shall undertake complete administration and management of contract till end of the contract and
payment of final dues to the consultant. the responsibility of PMC will be up to defect liability period.
28. The consultant shall submit 'As-Built' drawings stage wise to J.M.C. with the progress of work both in soft and hard
29. The consultant shall undertake verification of work during execution and on completion and submitting certificate of
completion of work along with completion report in 5 copies. The project manager will prepare this certificate and
furnish the same to the JMC.
30. The consultant shall carryout verification, by taking and recording joint measurements of the final bill to be
submitted by the consultant, preparation and finalization of final bills, as per items and conditions of contract
agreement and certificate for release of final payment by the JAMNAGAR MUNICIPAL CORPORATION.
31. The consultant shall advise the client with regard to extra claim/disputes if any till the cases are settled. The
consultant will also be required to brief the legal adviser/legal consultant of the client on cases pertaining to the work
at no extra cost.
Consultant shall comply the correspondences from the contractor timely and effectively keeping in view of
contractual agreement and standard codal provisions under the intimation of this office (DRAINAGE-STORM
WATER DRAINAGE PROJECT, JMC) as may be approved by this office.
32. The consultant shall render to the client every assistance, all technical services, guidance or advice on any matter
concerning the technical and engineering aspects of the project including periodical interaction and also through
invited experts on specific subjects with client's prior approval.
33. JAMNAGAR MUNICIPAL CORPORATION reserves the right to relieve the project management consultant from
the constancy at any stage of the work by giving one month prior notice. In which case due fees shall be paid in
proportion of the work completed at such stage.
34. In event the project is not completed within the stipulated time for any reason not attributable to JMC, the services of
PMC shall be continued at no extra cost to the JMC However in event of any change of scope of work extending the
period of completion an equitable adjustment in fees payable beyond the stipulated period shall be made by JMC for
which the decision Head of Department shall be final and binding. (testing of all materials)
35. To maintain the register for Cement/Steel etc. material received and to record the above details at site
with necessary copy of bill, royalty pass etc. in format suggested by JMC.
All registers and all other data must be computerized and soft copy of the same must be ready available with PMC as
and when needed to JMC
36. To maintain cement, steel and asphalt and all construction materials consumption register in the format
suggested by JMC and send the same to the Engineer-in-charge (JMC) for approval at the end of every
37. To control the cement distribution for the work and daily records for actual consumption of cement and
standard consumption of cement.
38. To check the Bar Bending Schedule for the work and maintain the record for the same in the format suggested by
Engineer-in-charge (J.M.C.).
39. The consultant shall maintain and submit daily progress report of each site covering progress of each item of

the register at the end of every month to the Engineer-in- charge (JMC) for information and necessary action.
41. The consultant would be responsible for checking the materials, workmanship and soundness of all components of
structures keeping in view Q. A. checks and safety standards. Consultants shall submit weekly and monthly
progress reports as per the directions of the client and should also submit recommendations in regards to extra items
with supporting site records and also supervise field tests on materials structures etc. in accordance with
predetermined schedules. The consultant shall also maintain adequate records to ensure proper certification of bills
for the work done for payment to consultants, including recommendations of extension application, extra items
variation statements.
42. The consultant shall not have any objection to the works being inspected by any other agency appointed by
the client for inspection of the same.
43. The consultant shall exercise complete day to night supervision during construction period of the assigned work,
ensuring quality control in accordance with tender stipulations, specifications, drawings and site conditions.
The quality control shall be exercised at all stages of construction, viz. approval of materials there of the in
proper proportion including prescribing norms for tests periodically and acceptability criteria and workmanship
at all stages of execution of individual items of work.
44. The consultant shall ensure proper establishment of RMC plant (in case of the contractor’s plant for producing
desired concrete mix) and field laboratories by contractor to conduct laboratory tests on materials for
constructions such as cement, steel, bricks etc. essential gauges, instruments etc should be arranged to be
calibrated periodically. The consultants shall maintain necessary site records and obtain date in support of the
same. The consultant shall ensure all field and laboratory (it includes outside laboratory also) tests on materials of
construction as well as partially or completely erected structures etc. Are carried out by contractor and
maintain adequate records thereof. The consultant shall make sure all testing of material is done in their presence
and shall be recorded and signed. PMC representative must remain present in all testing at site or at plant based in
Jamnagar city or out of Jamnagar city at his own cost.
45. The consultant shall be made responsible if any accident occurs during execution of the project due to negligence of
the contractor, improper work done, in adequate safety measures.
46. The consultant shall suggest to client modifications if any, due to site conditions & advising regarding cost
variations on account of extra items and excesses on the contract.
47. The consultant shall ensure regular and timely flow of working drawing, structural drawings and other
details/instructions.

51. The consultant shall undertake verification of work during execution and on completion and submitting certificate
of completion of work along with completion report in 5 copies. The project consultant shall prepare this
certificate and furnish the same to the JMC only.
52. The consultant shall perform his duty in such a way there is no undue financial impact on cost of project.
53. No price escalation shall be paid by Jamnagar Municipal Corporation in any case.
(II). REPORTS AND DOCUMENTS
The consultant shall furnish to the JMC following reports and documents (along with all other necessary
data, reports, documents, etc.) in addition to those mentioned in the terms of reference in the number of
copies, as stated. All reports and documents shall be in English and the relevant Soft Copies (in editable
formats) shall be in software as decided by JMC
a) Survey Reports : 5 Copies along with Soft Copy
b) Hydraulic & detail Structure Design : 5 Copies along with Soft Copy
Calculations & preliminary Drawing for execution.
c) Tender Documents & feasibility report : 5 Copies along with Soft Copy
d) Detailed Cost Estimate : 3 Copies along with Soft Copy
e) Tender Evaluation & Item wise : 3 Copies along with Soft Copy
Justification Report. :
f) Detail Structural Drawings and : 5 Copies along with Soft Copy detailed
Drawings ready for execution :
g) Progress Reports : The consultant shall submit following progress reports which shall include minutes of
site meeting with the consultant which the consultant has convened, to the JMC commencing at the end of
the month following the date of the contract for construction. After the issue of the completion certificate
these reports shall be submitted at ½ (Half) Yearly interval, until the end of maintenance period.
1) Daily Reports :: 2 copies
2) Weekly Reports :: 2 copies.
3) Quarterly Reports :: 2 copies along with Soft Copy
4) Yearly Reports :: 4 copies along with Soft Copy
5) Interim Reports as when needed :: 4 copies along with Soft Copy
h) Completion Report ( 5 copies along with soft copy) :: The consultant shall submit a completion report at the
time of final certification in 5 copies with all drawing GIS mapping (Geographic Information System mapping)
all Manhole / chamber Exact Location & Coordinate and all pipe dia wise Demands.
a. The consultant shall have to submit the soft copy (CD/DVD) of the photographs and video recording with every
monthly progress report showing progress at site, casting methodology, workmanship, safety precautions, testing or
any other activities as in tender scope of work carried out at site and out site laboratory at his own cost. Consultant
has to submit at least 30 different type of activities photographs duly binded in Album (with entitling of each photo)
separately with every monthly progress report at his own cost.
b. Consultant shall have to take photographs on daily basis wherever required and at the places where works are in
progress to capture the type of activities running, resources mobilized and to show the day to day progress effect
from the contractor with the impression of date and time on the photographs. Month wise soft copy of all such
photographs shall have to submit to the JMC
NOTE :: JMC will be free to use various reports and drawings, data, documents, etc. provided/submitted by
the consultant, wherever it deems fit to the authority without any constraint.
Time Frame : As mentioned in Clause-7 of this agreement.

5. Project DPR shall be prepared with capital cost + 10 to 15 years O & M cost. The % fee for PMC work shall
be paid only on capital cost.
(This fee is inclusive of all the direct and indirect taxes including GST, Service Tax, Duties /Cess etc. to be
