1. Having visited the site and examined the Bid Documents, Conditions of Contract, Schedules, Preamble to
INSPECTION SERVICES OF THE ABOVE WORK, we the under signed offer our inspection services from the
date of commissioning including defects liability period as given in Conditions of Contract and in
Schedules, Annexure, Bidding Documents, ifor Lump Sum ixed price mention in the summary cost. Our
inancial proposal shall be ixed and irm binding upon us subject to the modi ications resulting from
contract negotiations up to expiration of the validity period of the proposal. The amount of consultancy
services is inclusive of all taxes, duties, service charges etc.
2. We undertake, if our Bid is accepted, to complete and deliver the Works In accordance with the Contract
within 15 months or till the Project Implementation period, inclusive of monsoons, from the date of receipt
of work order to us by you. We will observe the laws applicable to perform the services.
3. We agree to abide by this Bid for a period of 180 days from of opening of online Bid the date ixed for
receiving the same and it shall remain binding upon us and may be accepted at any time before the expiry
of that Period.
4. In the event of our Bid being accepted, we agree to enter into a formal Contract Agreement with you
incorporating the conditions of Contract there to annexed and conditions of form “C” but until such
agreement is prepared this Bid together with your written acceptance thereof shall constitute a binding
Contract between us.
5. We agree, if our Bid accepted, to furnish Performance Bond / Security in the forms and of value speci ied
in the Conditions of Contract of a sum equivalent to Rs. 24,710/- for due performance of the Contract.

The bidder shall quote his irm and ixed lump sum price for the entire work under this Contract,
de ined in more details in various sections of this bid document & form “C” of Lump sum
1. The rates and prices shall be submitted in the formats given in then closed Price
Schedules. Rates and prices received in any other formats will be rejected and the Bids
will be disquali ied.
2. It will be entirely at the discretion of the NWRWS & KD to accept or reject the bidder’s
proposal, without giving any reasons whatsoever and the bidder shall not be permitted
to withdraw his bid on this account.
Schedule only will be considered for price evaluation & shall form a part of the Contract
4. Each item is to be individually priced, and the amounts shall be added up to arrive at the
except where the item description requires the item to be priced on "as applicable" basis.
The item shall not be priced if it is "not applicable" to the bidder's design, in which case
the bidder shall add the words "NOTAPPLICABLE". The wording in the item description
is for subject matter guidance only: clause references are indicative only and all other
relevant clauses shall also be referred to. The prices shall allow for all the works covered
under the bid and all liabilities and contractual obligations whether separately speci ied
or not. Items against which no prices are quoted shall not be separately paid for and the
bidder shall be deemed to have covered the cost for execution of such items (according
to the requirements of the bid document) in the prices quoted for the other items.

8. The Consultant shall be deemed to have allowed in his price for provision, maintenance
and inal removal of all temporary works of whatsoever nature required for the
inspection services for the proper execution of works. The rates shall be deemed to
include any works and setting out that may be required to be carried out for laying out
of all the works involved.

9. Prices shall be entered online and shall be entered in igures and in words. Where there
is a discrepancy between the unit rates and the amount entered, the latter shall govern.
Speci ications and the other sections of these bid documents and these documents are
to be taken as mutually explanatory of one another.
11. Prices quoted by the Consultant shall be irm for the entire consultancy work of Contract
without any escalation or extra payment than tendered cost.
12. The Consultant shall interpret the data furnished if any additional survey work or
investigation required shall be carried out by EPC Contractor.
13. The Consultant should acquaint himself with the site conditions including the access to
Work site. The successful bidder shall have to make suitable access to work sites at his
own cost. These accessed will be used by the other contractors working for NWRWS &
KD/ Government.

Payment to the consultant shall be made by the department in different stages as prescribed in the forgoing

3. Information to Consultants
3.1 INTRODUCTION
1. The consultant must familiarize themselves with local conditions and consider them in preparing their
proposals. To obtain irst-hand information on the Assignment and on the local conditions, Consultants
are encouraged to pay a visit to the Client before submitting a Proposal. The Consultant's
representative should contact the of icials to arrange for their visit or to obtain additional information.
2. Please note that (i) the costs of preparing the proposal and of negotiating the contract, including a visit
to the Client, are not reimbursable as a direct cost of the Assignment; and (ii) the department is not
bound to accept any of the Proposals submitted.
3. The Consultants shall provide professional, objective, and impartial advice and at all times hold the
department’s interest paramount without any consideration for future work and strictly avoid
con licts with other assignments or their own corporate interest. Consultant shall not be hired for any
assignment that would be in con lict with their prior or current obligations to their other clients or
that may place them in a position of not being able to carry out the assignment in the best interest of
4. The Consultant under contracts, observe the highest standard of ethics during the selection and
execution of contracts. In pursuance of this,
I. De ine, for the purposes of this provision, the terms set forth below as follows:
a) corrupt practice" means the offering, giving, receiving, or soliciting of anything of value to in luence
the action of a public of icial in the selection process or in contract execution and
b) "fraudulent practice" means a misrepresentation of facts in order to in luence a selection process or
the execution of a contract to the detriment of the Borrower, and includes collusive practices among
Consultant (prior to or after submission of Proposals) designed to establish prices at arti icial, non-
competitive levels and to deprive the Borrower of the bene its of free and open competition.
II. will reject a proposal for award if it determines that the irm recommended for award has engaged
in corrupt or fraudulent activities in competing for the contract in question;
III. will cancel the portion of the payment allocated to the irm's contract if it at any time determines
that corrupt or fraudulent practices were engaged in by representatives of the Consultant during the
selection process or the execution of that contract, without the Consultant having taken timely and
appropriate action satisfactory to the Client to remedy the situation;
IV. will declare a irm ineligible, either inde initely or for a stated period of time, to be awarded a
contract if it at any time determines that the irm has engaged in corrupt or fraudulent practices in
competing for, or in executing, a contract; and
V. will have the right to require that, in contract a provision be included requiring Consultants to permit
the Client to inspect their accounts and records relating to the performance of the contract and to
have them audited by auditors appointed by the Client.
5. Consultant shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued
by the Client in accordance with the above para.
6. The terms / conditions and detailed scope of work with agencies shall be part of the TOR.
3.2 DOCUMENTS COMPRISING THE BID
1. Consultant may request a clari ication of any of the BID documents up to the number of days indicated
in the Schedule of E-tendering before the Pre-bid conference date. Any request for clari ication must
be sent in writing by paper mail or electronic mail to the Client's address indicated in the Schedule of
E-tendering. The Client will respond by paper mail or electronic mail to such requests and will send
copies of the response to all invited Consultants who intend to submit proposals.
2. At any time before the submission of proposals, the Client may, for any reason, whether at its own
initiative or in response to a clari ication requested by an invited irm, modify the BID documents by
amendment. Any amendment shall be issued in writing through addenda. Addenda shall be done

online only and will be binding on them and it will become part of the tender document. The Client
may at its discretion extend the deadline for the submission of Proposals.
3.3 PREPARATION OF PROPOSALS
Consultants are requested to submit a Proposal written in English language.
In preparing the Technical Proposal, Consultants are expected to examine the documents comprising this
BID in detail. Material de iciencies in providing the information requested may result in rejection of a

1. While preparing the Eligibility and Technical Proposal, Consultants must give particular attention to

rendered the services individually or corporate entity. In case of claiming an experience of consortium

PERSONALS, preferably under conditions similar to those prevailing in the country of the Assignment.
III. Alternative professional staff shall not be proposed, and only one curriculum vitae (CV) may be
submitted for each position.
IV. Reports to be issued by the Consultants as part of this assignment must be in the language(s) specified
in SC. It is desirable that the firm's personnel have a working knowledge of the client's national

TOR/BID only. No inancial implication arising out of modi ication proposed by bidder shall be loaded
in to price bid.
5. However, all intending bidders are requested to offer modi ication in TOR/BID during pre-bid meeting.
Any such modi ication suggested by one or more bidder and if found acceptable by department shall
be intimated to all bidders and put up on (n)-procure web site as addendum and/or corrigendum and
bidders shall bear these addenda/corrigendum in mind while submitting their price bid.
6. In preparing the Financial Proposal, Consultants are expected to take into account the requirements
and conditions of the BID documents. The Financial Proposal should include costs associated with the
Assignment, including (a) remuneration for staff (foreign and local, in the ield and at headquarters),
and (b) reimbursable such as subsistence (per diem, housing), transportation (international and local,
for mobilization and demobilization), services and equipment (vehicles, of ice equipment, furniture,
and supplies), of ice rent, insurance, printing of documents, surveys; and training, and all allied
activities, material consumption etc. and any other expenses required for the performance of the scope
of work narrated in ToR.
7. The Financial Proposal shall be exclusive of GST.
8. Any statutory variation in rates of GST arises during the contract period; necessary adjustments shall
be made by the department. Such adjustments shall be based on the prevailing rates of GST at the time
of bid submission.
9. Consultant shall express the price of their services in the currency of Indian Rupee only.
10. Commissions and gratuities, if any, paid or to be paid by Consultants and related to the Assignment
will be borne by the Consultant.

11. Costs shall be ixed for the consultancy work under EPC Contract. Amounts are to be quoted in igures
and in words. The rates in words shall be governing in the event of a discrepancy between igures and

13. Any costs not entered shall not be payable, except as otherwise provided for in the contract agreement.
14. Submission of Various forms for Technical Proposal shall be prepared considering the following.
I. A work program, which shall distinguish clearly between the phases of
• Pre – Construction Work
• Scrutiny / review of design & approval
• Contract Management, inspection of materials and Supervision of construction
• Defects Correction Supervision & Post construction work.
For each phase, the program shall include an organization chart, an activity Bar Chart and a staffing
schedule, consistent with the construction contract information enclosed herein or otherwise made
available to Consultant. The staffing schedule shall clearly indicate the duration of the assignments of
proposed staff to be employed on the site of the works and elsewhere. Each part of the program shall
also clearly distinguish between activities in your head/ branch office and on the site.
Generally, it is considered that a competent Consultant is able to carry out the preconstruction work
with minimum time inputs. In taking account of this, Consultant may presume proper coordination by
the Client between the mobilization of the Consultant and the contractor.
Regarding contract management, scrutiny of design, inspection of materials and Supervision of
construction, Consultant shall consider the need for staff inputs such that standard Procedures of
NWRWS&K Dept, Gandhinagar are adhered to while any checking of contractor’s work and
subsequent approval of certi icates for payment by the Client can be carried out quickly and ef iciently.
The need for standard site procedures, documentation and communication will be clear from this.
Consultant are expected to provide fulltime qualitative and quantitative inspection of works’ execution
by staff experienced in structural design, pipeline and Reinforced concrete construction as well as on
a need basis- mechanical and electrical installation including instrumentation & automation.
In determining staff inputs, Consultant may give due attention to certain complicated parts of the
construction works, which will in particular cases be carried out under day work provisions like e.g.
rehabilitation of existing facilities, depending on the caliber of the proposed staff, consultant may
consider additional inputs for such parts of the works.
Under this, Consultant will be required to appoint a “Team Leader for project management services
including scrutiny of design, construction supervision, certifying measurements & inspection and
testing of materials” to act on your behalf in managing of ice works & site supervision in carrying out
all contractual and administrative activities based on the requirements of the Terms of Reference. The
“Team Leader” is key functionary and evaluation of the technical proposals will be in luenced
signi icantly by the calibre of the person proposed; apart from being management expert / technically
competent, they must be familiar with and capable to carry out all procedural activities required.
Provided proper contract management, scrutiny of design, inspection of materials, machineries and
equipment and Supervision of construction, it is expected that, for the purpose of this Contract
Agreement, supervision during the defects correction period will be limited to routine site visits, by
the “Team Leader” to ensure remaining work is got completed and to supervise the functioning of the
trained operators. Any other requirements will be on a Client-demanded basis. No extra Payment will
be made for defect correction period.
The Client requires that post-contract work will be carried out by the “Team Leader” and expects that,
with the exception of any disputes which may have arisen and not solved hitherto, the work will be
minimal and routine as speci ied in these instructions.
For all components of the service, Consultant shall provide adequate back supporting stopping from
your head / branch of ice. Whilst such backstopping will normally be considered part of the irm’s
overheads, Consultant may be depending on the caliber of the staff proposed- provide for this
separately at risk to Consultant / Bidder’s inancial competitiveness.

II. A named list of proposed staff including location and duration of assignments as well as proposed
positions. Consultant are free to determine the additional number and the quali ications of the staff
required, bearing in mind the need for supervision presence on the one side and to be inancially
competitive on the other side.
Full curriculum vitae of all staff proposed, in the format enclosed, shall be part of the technical
proposal. The curricula vitae shall comprise a description of academic or trade qualifications and of
previous exposure to work related to their proposed positions.
III. A list of facilities and provisions required to provide the service.
3.3.2. FINANCIAL PROPOSAL
1. The inancial proposal shall be quoted as a irmed and ixed for project management services including
Supervision of construction and scrutiny of designs inspection and testing of materials etc. in
accordance of the scope of work narrated in the ToR.
2. The costs shall be given lump sum ix price for entire scope of work as narrated in the Terms of
Reference. Major task to be performed is narrated below, however consultants are advised to refer
terms of reference before quoting the price.
I. Pre-Construction Work
The Period for the Pre-contract work is assumed at two weeks and shall be used to ensure that all
head / branch office and site staff to be involved fully understands
• The Contract Agreement
• The design and construction contract documentation
• The activities and tasks required under their proposal position
• The particular procedures and ways of interaction with the Employer and the contractor The period
shall also include for the consultant’s mobilization prior to the contractor entering the site .
II. Design review / approval
The design review / approvals is included in the period of construction period.
For detailed scope of work, refer ToR. The approval is to be accorded after getting compliance /
required modification if any. Necessary charges for scrutiny of design and site visit if required have to
be taken in the consideration.
III. Contract management, inspection of materials & Supervision of construction
The Project management, inspection of materials & Supervision of construction period is “Twenty-
Four Months”, which includes the contractor’s mobilization period. You shall base your pricing on this
duration but take into account the various items in the construction contract (e.g. work schedule and
bill of quantities), the material and equipment to be used in the project shall have to be inspected at
various vendor premises located anywhere in the country for which necessary travelling charges as
well as lodging & boarding charges shall have to be taken in to consideration, which may affect the
need for reduced/increased staff input during particular stages of works’ execution. With regard to
early or delayed completion, refer to Clause 8.3.1.6. For the purpose of pricing, you shall assume that
during the 24 (Twenty-Four Months) stipulated time limit 48 (Site visit) by the Team leader, each of
duration of Four Days including travel time, will be needed.
IV. Post construction work & Defects correction supervision
a. The “Defects Correction Supervision” will be of duration of 36 (Thirty-Six) Months from the date of
issue of the certi icate of substantial completion to the contractor. During this period, permanent
presence of your staff on site is not necessary. However, your Team Leader / ield staff during contract
management and Supervision of construction shall be on standby in your head (branch) of ice to be
available for a site visit at any time on 24 hours’ notice by the Client.
b. Post Construction Work will be of duration of two weeks and shall be used to ensure:
• The removal of all material, plant, equipment and staff from the site by the contractor, agree with the
Client and the contractor on all monies owed to or by the contractor, including the remaining retention

money, and release all guarantees and securities in accordance with the provisions of the construction
• After clearing and grading up of the site by the contractor is complete, carry out all work required to
inalize the construction contract administratively.
V. Verifications and Finalizations of Land acquisition proposal/ROU proposal for Notification under
varies section.
In due consideration of the pertaining descriptions of the Terms of Reference.
3. The financial proposal shall include all the cost to perform various activities specified in the Terms of
reference including maintaining the professional staff as mentioned below.
i. Professional staff at of ice at Godhra:
Professional staff for review & monitoring of project management, scrutiny of design, construction
supervision and inspection of materials, machineries &equipment shall be adequately engaged. It is
necessary to maintain suf icient staff at this of ice for easy co-ordination with consultant’s ield staff,
EPC Contractor and Department’s of ice for other day-to-day activities. The irm should setup such
of ice at their own cost. The irm and ixed price bid shall be all inclusive of salary, social charges,
overhead charges for travel of staff from home to site & ield allowances for boarding & lodging etc.
and of ice at Godhra shall be covered.
ii. Professional staff at work site and at various other places
Professional staff for construction supervision at site and inspection of materials, machineries
&equipment at various places in the country as well as project contract management shall be provided.
The irm and ixed price bid shall be all inclusive of salaries, social charges, overheads, charges for
travel of staff from home to site and ield allowances for boarding and lodging, etc. shall be covered.
iii. Transportation
The Consultant shall make adequate transportation facilities including running and maintenance,
driver’s wages, charges and allowances, consumables and any other accountable and variables. This
facility shall be available throughout the period of project implementation, defect liability and post
project conditions. Arrangement for necessary transportation shall have to be made during day as well
as night times. These facilities shall also be considered while quoting irm and ixed price under this
project management, INSPECTING services including cost for visit outside Gujarat for inspection,
testing of materials, machinery equipment etc. If any inspection requires to be repeated form want of
insuf icient stock/lot, defects in material, un successful inspection etc. all actual expense of travel and
lodging, boarding will be borne by bidding agency
iv. Site Of ice and Equipment
The firm and fixed price shall be all-inclusive for site office accommodation &equipment which shall
cover, operation, running and maintenance, costs for document reproduction, communication,
support staff like draughtsman, tracers, laborers, etc. and any other accountable and variables. Site
office shall be provided by the EPC Contractor.
v. Other Expanses ( if any )
a) Any expenses not covered anywhere in foregoing para but essential for effective, efficient project
contract management shall be covered in your fixed & firm price bid.
b) All costs and rates quoted shall be ixed for the whole consultancy work under EPC contract of the
contract agreement, except as otherwise provided for therein.
c) Any costs not entered shall not be payable, except as otherwise provided for in the contract agreement.
d) No any excess payment will be made for the extended time period for the work under the agreement
& for the excess and extra items of work under EPC contract whose consultancy services has to

4. Terms of Reference and Scope of Services
The consultant shall provide various services like Request for proposals THIRD PARTY INSPECTION
AGENCY FOR THE SERVICES OF PROJECT MANAGEMENT, CONSTRUCTION SUPERVISION AND INSPECTION
OF MATERIALS FOR THE WORK OF GRAVITY FLOW PIPELINE PROJECT FROM PANAM HIGH LEVEL CANAL
TO PANAM MAIN CANAL.
4.2 WORKS SUBJECT OF THE SERVICES
Works under this para are pertaining to the EPC contractor for following works THIRD PARTY
INSPECTION AGENCY FOR THE SERVICES OF PROJECT MANAGEMENT, CONSTRUCTION SUPERVISION AND
INSPECTION OF MATERIALS FOR THE WORK OF GRAVITY FLOW PIPELINE PROJECT FROM PANAM HIGH
LEVEL CANAL TO PANAM MAIN CANAL.
As per the terms set forth herein. The works will be undertaken by NWRWS & KD on behalf of the
Government of Gujarat and funds for the works will be obtained from the Government of Gujarat. Whatever
items covered in this para are to be executed by the EPC contractors and services specified in the forgoing
paras are to be provided by the consultant.
The entire scope of services is to be rendered for the time limit of EPC contract – Construction and
commissioning of various works (6 months or extended period) and the defect correction period shall be
3 years after commissioning of the project.
Consultants are advised to refer bid documents for the work to be executed by EPC contractors
understand the scope of services is to be rendered. For this purpose, they may approach the of ice of The
Executive Engineer, Panam Project Division, Civil Lines Road, Godhra. District Panchmahal Pin code-
389001. However, some of the key items under the scope of the EPC contractor is as under.
Twin line of 1366.8 mm dia MS pipeline of 7.5 km each to be laid from Panam High Level canal (PHLC)
from approx. chainage 16.800 km to Panam Main Canal (PMC) to carry water of 62.5 cusec from each
pipeline. Total 125 Cusec of water to be transfer from twin line from PHLC to PMC by Gravity. HR-CR
Crossing is proposed at Panam High Level Canal at taping point to regulate the low. Also End Structure is
considered at Panam Main Canal to receive the smooth low of water.
HR-CR structure consist of gate installed near tapping area to regulate the low with receiving chamber
and pipe connection by gravity. HR-CR structure has one existing gate after the taping point on canal. HR-
CR structure designed by EPC contractor in such a way to regulate the low in smooth operation with
sound engineering practice.
End structure is considered at panam main canal to receive the smooth low of water. End structure
should be designed and constructed in such a way to regulate the gravity pipe low with Panam Main
Canal low without creating vertex to the canal low. Any damage in both the canal at taping points should
be repaired as per original. Coffer dam should be executed on both the canal as per the instruction of
engineer in charge.
Pipeline will have internal epoxy coating of 406 Microns and external 3LPE coating of 3.7 mm

4.3 ASSISTANCE FROM NWRWS & KD
The Consultants would be assisted by NWRWS & KD in obtaining relevant information from the
authorities as well extend co-operation on following areas:
a) Exchange of data and information related to the study.
b) Day-to-day interactions and monitoring of activities to enable active project management.
c) Issue letters of authority to Consultants to facilitate activities related to Assignments and
collection of data from State Government Departments and other agencies.
d) Shall provide certi ied copy of the contract made with the EPC contractor.
4.4 PHASING OF AND LOCATION FOR CONSULTANCY SERVICES
The service is to be rendered in following four phases together with the locations:
1 Contract Management Of ice / site, as appropriate
2 Pre-Contract work
3 Scrutiny of design
4 Construction Supervision At work Site
Material inspection, machineries inspection, At Vendor premises anywhere in
5 Equipment inspection and India.

4.5 PROCUDURE AND AUTHORITY LEVEL
The Consultant shall carry out the Services as de ined these Terms of Reference or as otherwise required
for ef icient works' execution, while acting in the capacity of the "Representative of the Client" according
to the intentions of the "Conditions of Contract", which form part of the tender/contract documents for
works execution and are available for review at the Of ice of the Executive Engineer, Panam Project
Division, Civil Lines Road, Godhra. District Panchmahal Pin code- 389001. The "Conditions of Contract"
clari ies in detail, the duties and authorities of the Consultant and of his representative, to whom the
Consultant may delegate duties and authorities as required.
Principally, the Consultant have to carry out the day-to-day qualitative and supervision of works
execution and construction contract administration on behalf of the Client as per the following laid down

to limitations as stipulated in the above said "Conditions of Contract" in respect of taking major steps in
construction contract administration notably referring to.
Assisting the department for issuing a certi icate of substantial completion assisting the department for

needed in advance.

Whilst therefore being fully accountable to the client in ensuring that the EPC works are executed within
the tender total or such other sum as may become payable to the contractor under the provisions of EPC
contract and within the scheduled time for completion. The Consultant also has duties towards the
contractor in administrating and interpreting the contract properly and fairly to maintain the work
schedule and to avoid disputes.
Thereto the Consultant shall ensure that the departments and the contractor rights under the EPC
contract are upheld by ensuring good verbal and written communication between himself, the
department and his representatives and the contractor and his representatives.
The Consultant shall follow the contractor's progress carefully and forecast well ahead the needs for
critical actions to be taken. He shall ensure, that items with a lead time or otherwise not readily available
e.g. pipes, pumps and electrical installation items etc. are ordered well in time by the contractor. He shall
also ensure that excessive quantities of materials are not ordered where the delivery of such quantities
could cause dif iculties on site or the materials could deteriorate.
In particular, the Consultant shall ensure that payments to the contractor can be made on time by giving
ample notice and opportunity to the Client's representative to carry out whatever quality checks and
measurements he may wish prior to payment to the Contractor.
The Consultant shall therefore agree with the department's representative on a regular basis and well in
advance on items on which the department's representative wishes to carry out checks and
measurements and on the extent of such checks and measurements. Provided that the department’s
representatives have been given adequate notice in writing to carry out his own checks and
measurements but fails to do so, works execution will continue without delay and payment of the
amounts certi ied by the Consultant will be deemed to be authorized.
In such events, the Consultant shall state in writing to the department that he was requested to carry out
his own checks and measurements but failed to do so. However, wherever inspection could not be carried
out due to short notice or unavailability of contractor representative or testing or materials etc. should
inform in writing immediately to client and request for fresh date of inspection. In any case no inspection
will be carried out without raising a request for inspection by contractor. Further, the department may
carry out spot checks and measurements at any time.
The Consultant, during the contract, shall provide the Client with monthly reports indicating physical
progress compared to the work schedule. The Consultant shall also include observations and comments
on testing results and quality of workmanship.
4.6 KEY FUNCTIONS OF THE CONSULTANT
The Consultant shall carry out duties and authorities which include, without being limited to them, the
following functions and tasks by phase of work.
Contract Management, Progress Monitoring, Inspection and testing of materials, machineries and
Equipment, Review and Approval of documents, Quality Surveillance, Supervision of Construction,
Measurement Certi ication & Settlement of claims and inancial control, Reporting and Co-
ordination, Defect Correction Supervision, Post Contract Work etc.
The Consultant shall be responsible to generate the data/reports required to be submitted to Govt. of
Gujarat on a periodic basis as required in the contract agreement
4.6.1. CONTRACT MANAGEMENT
I. Within the powers granted to the Consultant, administer the construction contract on behalf

II. Work closely with the client, to assist him to carry out his obligations under the construction
contract in order that the contractor is not hampered in any way in carrying out his duties.
III. Ensure that the contractor carries out the works in accordance with the construction contract
and assist the contractor therewith, all to enable the contractor to fully carry out his
obligations within the tender total or such other sum as may become payable to him under
the provisions of his contract and within the scheduled time for completion.
IV. Liaison between the Client and the contractor to ensure good communication between all
parties such that disputes do not arise and that any such disputes are settled reasonably and
amicably and assist in any adjudication.
V. Keep accurate records of all site activities and operations and those required elsewhere for
ef icient works execution from the contractor and others under the construction contract,
including but not restricted to correspondence between client, Consultant and contractor as
well as between them and other parties. All registers shall be maintained by TPI agency
including ROU. If required TPI should hire retired revenue person who has experience in land
acquisition and ROU.
VI. Minutes of scheduled meetings
VII. Weekly and monthly report from the Engineer's representative and the site inspectors
Instructions, variation orders, approval forms, etc.
VIII. Check of Survey work, Levels, survey books, including checks on setting out and completed
work. Work records, such as measurement, level, dimension, as built drawings and material
testing onsite/offsite, machineries and equipment delivery notes.
IX. Progress monitoring and prepare progress reports like test data and laboratory reports, plant
and laboratory returns, daily work records, financial records including interim statements
plus supporting particulars and certificates based on M.S. Word / EXCEL or M.S. Project
software as appropriate charts and drawings.
X. Scrutiny with alignment and with revenue records. Field veri ication and Finalizations of Land
acquisition proposal/ROU proposal submitted by contractor.
XI. The Consultant shall report to the Client at frequent intervals, and submit, daily progress
report and monthly progress report, such details as are mutually agreed between the Client
and Consultant. Apart from period reports, the Consultant shall intimate the Client in writing
of any deviations from approved alignment & designs, Technical Requirements and
Performance Standards.
XII. It is reiterated that the contract for the pipeline work is an EPC one; the Client binds the
contractor only on performance. The measurements and reviews do not constitute approval
rights as between the Client and the contractor, but in so far as the Consultant is concerned,
he shall ensure that a complete internal record of the work is available. The
Consultant shall ensure that his inspections do not impede the design, construction and
operation and maintenance of the Facility.
XIII. Monitor Work program, identify slacks and slippage, and suggest remedial measures
adequacy of manpower, machinery and other resources to meet the target.
XIV. Co-ordinate the review meetings.
XV. Review and verify variations and advise in value engineering.
4.6.2. PROGRESSING MONITORING
i. Ensure that the work carried out by the EPC contractor shall be as per the construction
program accepted by the Engineer in Charge. Noncompliance of the accepted program shall
also be brought to the Engineer in Charge.
ii. Monitor progress of the works and ensure that the contractor, as and when required,
produces revised programs.
iii. Ensure that the contractor allows for suf icient lead time for the provision of all materials,
plant, equipment and labour to avoid hold ups or bottlenecks.

iv. Timely devise, jointly with the contractor, a plan of action for detailed investigations and
testing of existing facilities, if any to be incorporated in the permanent works.
v. prevent any hold ups due to factors beyond the control of the contractor, including such
factors in the hands of the client like granting of access to all parts of the site, provision of
certain facilities and storage areas, obtaining of rights of way and way leaves and any such
other items which are the duty of or where assistance is to be given by the Client.
4.6.3. INSPECTION AND TESTING OF MATERIALS, MACHINERIES AND EQUIPMENTS
I. Inspection on-site and Manufacturer’s site and testing of Materials Machineries and
equipment’s at the place of manufacture within Gujarat and outside Gujarat in the country.
II. The inspection shall consist of preparation of methodology, sequences and system report
inclusive its commissioning for each category works ensuring quality assurance and control
so, as to achieve the desired objective and sustainability of the system for the anticipated
serve life to each category.
III. Any effective modi ication found necessary during their inspection process for achieving the
designated aim shall be brought to the notice of the client and obligatory on the agency.
IV. Typical inspection checklists shall be prepared for each category of works on each operation
and activities with reference to documents and standards. The acceptance/ rejection report
through the concerted inspection engineer ensuring all the points shall be mandatory.
V. The inspection system and procedure shall be prepared and maintained on day–to-day basis.
The inspection crews shall have guidelines, test plans, scope of inspection, procedures,
checklists and various formats to carry out inspection in a systematic method.
VI. The inspection reports shall have to be prepared on computer based software.
VII. The inspection report based on factory and / or onsite inspection shall be submitted to the
Engineer-In-Charge of the project, periodically as per requirement.
VIII. All stationary, drawing stationary, design facilities, photographic facilities etc. shall be
provided by the inspecting authority at his own cost.
IX. The consultant shall issue necessary certi ication on progressive completion of each category
of work after ensuring quality control and assurance so as to achieve the designed objectives
of the particular works. The certi ication shall be based on satisfactory adherence of the
system and procedures of the inspection.
X. The consultant shall have to provide soft & hard copies of photograph by HD camera to the
Department. (Site condition, machineries, equipment, testing, execution of work etc.)
XI. Witness 100% on-site and Manufacturers Site testing and inspection of materials of
4.6.4. REVIEW AND APPROVAL OF DOCUMENTS
I. Study of contract documents for Civil, Mechanical Electrical, and instrumentation work.
Inspection test plan prepared by the EPC contractor for Civil, Mechanical Electrical, and
instrumentation work.
II. Review of all Quality Assurance Plan (QAP), Welding procedure, testing procedure etc.
prepared by contractor/vendor
III. Review and approval of all type of RCC structural designs of various components, pipeline
design, water hammer control analysis, Mechanical, Electrical and Instrumentation
components in the project.
IV. Checking and inspecting factory / ield laboratories provided by Vendor / contractor to
conduct laboratory tests.
V. Test certi icates / reports of materials to be used for inished product for use in
construction and installation.

VI. Performance Test & Ef iciency Test for Pumping Station.
VII. Compliances of the inspection notes issued by various authorities shall be done on site and
compliance reports shall be submitted to engineer in charge within time limit.
4.6.5. QUALITY SURVEILLANCE
The consultant shall carry out quality surveillance for all the items/materials - as de ined in the
scope of EPC contract. Some of them are as under:
1. M.S. Plates, H.R. Coils, Mild Steel Pipes, Valves, Specials and ittings etc.
2. MS Pipe external coating, internal lining at coating yards and site etc.
3. Various type of valves, sluice gate, expansion bellows etc.
4. Surge Control devices such as Air Vessels, Air Cushion & Zero Velocity Valves.
5. Flow measuring devices
6. Welding electrodes
7. Ordinary port land cement
9. Drinking & Construction water
10. Building materials such as steel, cement, bricks, coarse aggregates, sand etc.
11. All other required machineries & equipment etc.
4.6.6. SUPERVISION OF CONSTRUCTION
Supervise the mobilization of the contractor, his staff, plant, equipment etc. and his provisions for
storage and other operating areas, paying particular attention to land made available for the
construction of the works, including rights-of-way and way leaves.
During the construction period at site, the Consultant shall be available on a continuous basis at
the project site in order to supervise, inspect, monitor and certify the works, and conformity with
Technical Requirements and the Performance Standards stipulated for various item and works in
1. Provide the contractor with points, lines and levels of reference, as made available by the Client
or otherwise established, and check the contractor’s setting out and shall include the accurate
locations and levels of all structures, the lines and levels of pipelines and the locations of
accesses, storage areas, working areas, way leaves etc.
2. Check all construction materials and equipment arriving on site to ensure that they are in
compliance with the lists of supplies submitted by the contractor and meet the requirements
of the speci ication and the applicable standards’ ensure that all materials handling and
storage is in accordance with the manufacturers’ recommendations. Advise to the EPC
contractor for safety measures & epidemics.
3. Monitor and inspect the contractor’s methods of construction for permanent and temporary
works, including false work, checking of centring & scaffolding, reinforcement and supervision
of concrete & other civil work, as well as materials and equipment installation, workmanship
and other site operations in regard of compliance with the requirements of the speci ication,

the applicable standards and the manufacturer’s recommendations, with all due attention
being given to adherence to safety codes, labour laws, either laws, bye-laws and regulations
and avoidance of public nuisance.
4. Prepared and Issue to the contractor from time to time, as and when necessary, such further
drawings, speci ication and instructions as required under the construction contract to enable
the contractor to complete his obligations under his contract in a timely manner.
5. Direct and 100% witness from time to time such tests regarding construction materials and
equipment and workmanship as required under the construction contract to be executed by
the contractor or elsewhere and instruct the contractor to undertake corrective action in case
of non-compliance with the speci ication or the applicable standards.
6. Supervise the contractor’s detailed investigations and testing of existing facilities, if any, in
regard of compliance with the plan of action and decide on the basis of the results of the testing
on whether the said facilities are suf iciently sound to be incorporated in the permanent works
and shall note adversely effecting later operation and functioning.
7. In the event of technical problems arising on site, assist the contractor in overcoming them in
the interest of the department. Within the tender total or such other sum as may become
payable to the contractor under the provisions of his contract and within the scheduled time
for completion.
8. The consultant shall advise the EPC contractor for stages of payment prescribed in the tender
document and its relationship with completion of various items of bill of quantities.
9. Issue instructions to carry out work on a day-work basis as and when necessary.
10. Upon having obtained approval of the client, issue variation orders or order extension of time
as required under the construction contract
11. Monitor received material & equipment at site from quality & quantity aspect and generate
reports on periodical basis
12. Supervision of construction including commissioning and testing of entire system.
13. Report with photographs / Album of work at regular interval and make presentation during
visit of QC or higher Authority.
14. Ensuring setting up of ield laboratories.
15. Contractors internal test on materials, concrete, mortar etc. Pipe line trenching, bedding

19. Pipeline hydro testing and pre commissioning test.
20. Proper alignment of pipeline trenching.
21. Major / minor road crossings.
22. Nala / Railway / Culvert / Bridge / Canal crossing.
23. Orientation, location of structures depth of foundation etc. with respect to approved
drawings and approved test plan
24. Dimensions, reinforcement, concreting in foundation for major civil works. Shuttering, plumb,
dimensions, concreting etc. in sub structure including vertical wall, ring beams, tie beams,
columns, slab etc. as per approved inspection test plan.
25. The items listed in scope of works are major items covered under the construction contract.
26. The miscellaneous items and any other major items remained in the lists but required for the
successful implementation of the project shall also form the part of scope of work under this
27. All the inspection shall be carried out after receipt of R.F.I. (Request for Inspection) from the
Contractor representative.

4.6.7. MEASUREMENT CERTIFICATION SETTLEMENT OF CLAIMS AND FINANCIAL CONTROL
1. The consulting firm shall carry out 100 % physical verification of measurements at site and
certify the same. Star rate & price variation bills prepared by contractor shall be scrutinized
2. Monthly or otherwise periodically measure the permanent works and value them in
accordance with the methods of measurement and notes on pricing as well as the unit rates
of the bill of quantities as included in the construction contract.
3. Receive the contractor's monthly statement and upon veri ication against the measurement,
arithmetic checking as necessary, certify the statements or correct them as required under
the construction contract and forward them to the department for payment.
4. Keep accurate records to maintain an effective cost control system in order that the cost of
works execution remains within the approved amount of contract during the period of the
execution of the works, the estimate of the total costs shall be continuously updated and the
department kept informed of his inancial commitments and when he shall be required to
5. Keep accurate records of all variations made and all Claims forwarded by the contractor,
together with the reasons thereof, which may affect the sum becoming payable to the
contractor under the provisions of his contract; claims shall be veri ied skilfully, but fairly
interpreting the provisions of the construction contract and shall only be agreed upon when
truly justi ied.
6. Record, review and certify measurements in running bill given to the agency and other stages
of work such as handing over, taking over, construction completion, and maintenance
4.6.8. REPORTING AND CO-ORDINATION
The Consultant shall not exercise any direct control over the contractor, but shall report to the
department’s representative who shall be the sole point of contact with the Contractor. The
Consultant shall co-ordinate with all such persons for the ful ilment of obligations, but shall
report solely to the department’s representative.
4.6.9. OPERATION AND MAINTENANCE MANUALS

5. During the defects correction period, the Consultant shall inspect the Project Site at intervals
of one month in order to monitor technical performance of the Project. He shall also be
available “On-Call” without extra cost.
4.6.11. POST CONTRACT WORK
The consultant shall assist the department to inalize the part of the EPC contract, till
commissioning of the pipeline project - in accordance with the provisions of EPC contract.
This includes issuance of various certi icates as prescribed in the EPC contract, release of
retention money, guarantees, securities, recoveries from the EPC contractors if any etc.
