Eligibility Criteria is as per PLW Specification No.PLW/M/BS/M&P/P-98/25- 26/EOT-30/5 TON, REV-01 (Attached) as under. The tenderer shall provide satisfactory evidence acceptable to purchaser to show that:
a) Firm is manufacturer, who regularly manufactures Double Girder EOT Cranes and has adequate technical knowledge and practical experience.
b) Firm should have supplied at least two nos. of Double Girder EOT Cranes of capacity having minimum 20 Ton in last five years to any Indian Railways Unit or Central Govt. Unit or State Govt. Unit or Centre Public Sector Undertaking (PSU) or State Public Sector Undertaking and the machine must have completed one year of operation from the date of its commissioning on the date of tender opening.
c) Performance certificate of minimum two Double Girder EOT Cranes confirming criteria as mentioned in item (b) above, from officer of Central/State govt/Manager level officer to be attached with the offer and the same shall be independently verified by PLW during evaluation of the offers.
d) Firm has financial strength and resources to meet the obligations under the contract for which firm is required to submit duly audited Annual financial statements (Balance sheet, profit & loss account etc.) for the last 3 years or a report from a recognized bank or a financial institution on financial position.
e) Firm has adequate plant and manufacturing capacity to manufacture and supply the items offered within the delivery schedule offered by it.
f) Firm has established quality control system and organization to ensure adequate control at all stages of the manufacturing process.
g) The evidence/documents submitted for meeting the qualifying requirements, if found false/fake/forged/manipulated at any stage during evaluation of offers and or even during the currency of Contract, the purchaser reserves the right to summarily reject the offer or terminate the Contract at his risk and cost and take action as per applicable law including banning of business dealings etc.
Note: 1. Firm to offer para wise comments on para (a) to (f) of Eligibility Criteria along with supporting documents. 2. Non submission of supporting documents shall result in summarily rejection of the offer.

The following items will need to be quoted additionally though will not be part of commercial evaluation: 1. Bidder to attach separate Price break up of individual items as Slings/Chains/lifting tackles as specified in schedule-I of section-II. Any other items of spares considered essential by the tenderer for two years normal maintenance, to cover the complete range of mechanical, hydraulic and electrical equipment, shall also be quoted for separately. Item-wise cost of spares as indicated in Schedule-IV shall be separately quoted.

Tenderers to quote on firm price basis. No price variation clause is applicable.
Firm should mention their type of industry like, MSE/Medium/LSI/PSU(Railway) /PSU(non Railway)/SC/ST/Women and attach relevant documents. If relevant documents are not attached by the bidder then the bidder will forfeit the claim for any such benefit accruing due to type of industry.
The bidders are required to submit the information in their bid [in format given in attached document of tender) about their sister-concerns (Name of Firm, Address, Phone No. and Email) who have participated in this tender themselves or through their authorized dealer/agent. If there is no sister-concern then also 'NIL' remark should be written. This information and declaration should be furnished as per format given in attached document of IBD in pdf. If it is found at any stage of tender/contract that there been wrong information or concealing of facts on part of bidder/supplier, it shall render the bid/contract liable for rejection/cancellation , in addition to other penal action which may be taken by Purchaser under provisions of laws governing the tender/contract.
Firm needs to confirm this clause:- "We hereby declare that in quoting the above price, we have taken into account the full effect of Input Tax Credit available under GST. We, further agree to pass an any financial gain/benifit as may become available in future in respect of all the input tax credit on the date of supply by way of reduction in price and advise the purchaser accordingly." We also undertake that we are aware of the provisions of section 171 of the CGST Act and consequences thereof if we fail to comply with the same.

PUBLIC PROCUREMENT ORDER 2017- REVISION : Provisions laid down in public procurement order 2017 -revision as circulated by ministry of commerce and industry vide their letter dated.19.07.2024 (copy enclosed) shall be applicable. Clause 3(b) of the said order shall be applicable in this tender. Minimum local content for purchase preference shall be 50% and the margin of purchase preference shall be 20%. As per this policy only 'class-I local suppliers' and 'Class-II local suppliers' are eligible to bid.Public procurement of this item is restricted to Class I/Class II local suppliers only and the vendors who do not qualify to the Class I/Class II local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to a Class I/Class II local supplier for the tendered item participates, it does so at it's own risk and cost and Railways shall not be liable for any loss or damages caused to the vendor.
Firm needs to give the following self declaration towards the percentage local content mentioned by the firm in this tender: We have examined the information, records and book of Accounts and certify that the local content, which is the amount of value added in India (i.e. the total value of the item procured excluding net domestic indirect taxes, minus the value of the imported content. If any, of the above mentioned item including all custom duties) as a proportion of the total value in percent is as mentioned in relevant column of the tender. We are aware that any false declarations in this respect will be in breach of the code of integrity under Rule 175(1) (i)(h) of the General Financial Rule for which our firm can be debarred for up to two years as per 151(iii) of the General Financial; Rules along with such other actions as may be permissible under law.
In terms of the provisions laid down in Para 10(d) of the Public procurement order 2017 -revision as circulate by ministry of commerce and industry vide their order no. P-45021/2/2017-PP (BE-II)- Part (4) Vol. II dated 19.07.24 attached as Annexure 5.7 of IBD, Entities of countries which have been identified by the ministries of Railways as not allowing Indian companies to participate in their Government procurement for any item related to this ministry shall not be allowed to participate in India for all items related to this Ministry, except for the list of items published by the Ministry permitting their participation. The term 'entity' of a country shall have the same meaning as under the FDI Policy of DPIIT as amended from time to time. "Bidders hereby confirms that the bidder has nothing to report to the Nodal Ministry in this regard."
Amended Rule 144 (xi) General Financial Rules (GFRs) 2017 is applicable as per Annexure A-5.9 of IBD (uploaded). Bidder must enclose a certificate as per annexure A-5.10 of IBD stating that "l have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India; I certify that this bidder is not from such a country or, if from such a country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered." Where applicable, evidence of valid registration by the Competent Authority shall be attached. If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law.
Following documents must be submitted by the tenderer along with the offer: 1. Clause wise comments on technical specification. 2. Documentary evidence of previous supplies to other Railways. 3. Tender specific Authorization certificate of OEM in case of Authorized dealer. 4. Detailed list of spares covered under warranty, 5. Details asked as per Various Clauses above. 6. Details of deviations from specification (if any).
All bidders should confirm to submit E- bills through IREPS for this item. No manual bills will be accepted.
Offers of Original Equipment manufacturers [OEM] or their authorized Dealers/Agents only shall be considered for ordering. Dealers/Agents should submit valid tender specific authorization from OEM along with offer.
Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
INSTRUCTIONS TO BIDDERS FOR FILLING TECHNICAL BID:As per clause no.1.0 of Section-I of PLW Specification No.PLW/M/BS/M&P/P-98/25-26/EOT-30/5 TON, REV-01(Attached).
Unless otherwise stated, latest alterations/ revisions of specifications/ standards/ drawings shall be applicable. In respect of safety standards and environmental standards relevant to the machine, the machine manufacturers shall ensure compliance with international (CE/ASO/DIN/JIS) /National standards (IS) (wherever applicable).
Tenderer should offer and quote for all the specified concomitant accessories, as these are considered essential for commissioning and utilization of the machine. Even if bidder does not recommend the purchase of any of these accessories, the price must be quoted for comparison purposes and their recommendation/suggestion to be indicated in the offer. Tenderer should also quote for optional accessories, spares and consumable spares as asked in the specifications.
In case, any item is required in sets, please specify nos./pieces per set. This is essential for proper technical evaluation of the offer. Offers received without this may be considered as incomplete and liable to be rejected.
The bidder should quote only for the specified make of sub-assemblies and equipment wherever specified. Makes of sub-systems other than the specified ones will normally not be acceptable. In case, some other make is quoted, specific reasons for the same including its features/advantages over specified makes must be brought out in the offer.
In case there is a contradiction in any information provided (some parametric values given in the specification and those given in the brochure or some other document enclosed by the tenderer) unless specifically mentioned in the deviation cum confirmation statement under Annexure A of Section III the values as given in the specification shall be taken as confirmed by the tenderer and offer evaluated accordingly.
Bidder or his authorized agent, in their own interest, should visit the consignees listed in clause 3 Section-I with prior appointment with Controlling Officer and acquaint themselves with existing process of manufacturing/remanufacturing, site conditions, availability of crane facility etc.
The Purchaser may accept internationally accepted alternative specifications which ensure equal or higher quality than the specifications mentioned in the Technical Specification. However, the decision of the Purchaser in this regard shall be final. A copy of the alternative specifications offered should be sent along with the offer. The Tenderer should also furnish "Statement of Deviations" from tender specifications (as per Annexure A, Section-III) along with the offer.
