Terms and Conditions of BRC
Submit following document with Technical bid with sign and seal of bidders
(1) GST Registration no & Date and issuing authority.
(3) Experience certificate (Non Mandatory).
(4) Certificate of Authorize dealership/distributorship (Non Mandatory).
(5) Signed tender copy with stamp on every page.
(6) In case of partnership, submit Partnership Deed & Powers of Attorney.
(7) In case of Company, submit MOM/Article of Association & Power of Attorney
(1). All the relevant documents as per requirement of the Tender to be submitted online
along with the Tender Fee, EMD on or before due date and time. Otherwise the offer will
not be considered and no any further communication in the matter will be entertained.
(2) The Price Bid and Technical Bid is to be submitted ON LINE only.
Note: - Bidders are requested to submit price – bid (Schedule – D) on-line only and not to
submit the price bid in physical form. This is mandatory. If price bid is submitted in
physical form, same will not be opened and only on-line submitted price bid will be
considered for evaluation. Further if the quantity quoted differs in any of the technical
bid forms and in price bid forms, it is discretion of Superintending Engineer, PGVCL to
consider the quoted quantity.
Any technical questions, information and clarifications that may be required
pertaining to this inquiry should be referred to The SUPERINTENDING ENGINEER,
PASHCHIM GUJARAT VIJ COMPANY LTD., CIRCLE OFFICE, SURENDRANAGAR-363035.
PGVCL reserves the right to reject any OR all tenders without assigning any reasons
Tender fee plus GST (Non-refundable) as notified in the tender notice should invariably
be paid by way of Demand Draft / Banker’s Cheque; otherwise offer will be ignored out
rightly. Indian Postal Orders (IPO’s) & Cheques are not acceptable. Demand Draft
should be in the name of “Paschim Gujarat Vij Company Ltd.”, Payable at
surendranagar. (Tender fee will be accepted in cash upto Rs. 10,000/- only at PGVCL
Circle office, surendranagar cash counter during working days between 11.00 AM to
02.00 PM and on working Saturday between 11.00 AM to 12.30 PM)
The tender fee is Non-refundable under normal circumstances. However, if PGVCL
decides to scrap/ cancel the tender, by one or another reason, in which bidders are not
responsible for cancellation / scrap of tender, in such case tender fee may be refunded
without GST to bidder(s), at sole discretion of PGVCL.
2. EARNEST MONEY DEPOSIT: (E.M.D.)
Tenderer has to pay EMD as mentioned in the tender notice.
The EMD is payable by Demand Draft / Banker’s Cheque in favour of the Paschim
Gujarat Vij Company Ltd. of any Scheduled / Nationalized Banks in surendranagar. It
can also be furnished by way of an irrecoverable Bank Guarantee from any
nationalized Bank in a standard format prescribed by PGVCL (Format given in this
tender document). Cheques are not acceptable. CORPORATE BANK GUARANTEES
The validity of the Bank Guarantee for EMD should be for a period of at least 7 (Seven)
Months from the last date of submission of tender.
If the EMD amount is more than Rs. 1 lakh, it should be paid either by demand draft
or Banker’s cheque or pay order or Bank Guarantee. Otherwise it should be paid
either in cash (upto Rs. 10,000/- only) at the office address specified in the tender
document or by Demand Draft or Banker’s Cheque or pay order only. Payment of
EMD by RTGS/NEFT/online shall be encouraged.
No Interest will be allowed against payment of E.M.D.
EMD will be forfeited if (i) The tender, which it covers, is withdrawn during the validity
of the offer or (ii) the Tenderer fails to furnish / deposit the Security deposit towards
Execution Period as per Condition of contract clause no. 2.0.
The EMD of unsuccessful tenderer beyond L3, if paid will be returned promptly on
submission of application and original Money Receipt. The EMD will be returned to
the successful tenderer and remaining unsuccessful tenderer after successful
tenderer furnishes the Security Deposit for performance and duly enters in to the
contract. If he fails to furnish the SD or to execute the contract for the work offered
to him, his EMD shall be forfeited and the tenderer may be disqualified from
tendering for further work.
EMD will be returned to the successful Bidders, only on their submission of Security
Deposit towards execution period against LOA released on them.
If the successful bidder fails to submit a Security Deposit within 15 days from the date
of LOA of the contract or fails to sign the contract agreement then the EMD amount
will be forfeited in favour of PGVCL without any notice or and action for “Stop deal”
will be initiated as decided by tender inviting authority.

Terms and Conditions of BRC
1. Equipment’s are located at Circle Office and All Division as well as Subdivisions in
surendranagar district area (As per Schedule B).
2. You have to work as per the instruction of IT Section, in addition any dispute decision of
Superintending Engineer will be final.
3. Payment Terms: Payments are payable monthly against advance stamp receipt.
4. The quantities of systems are mentioned above are approximate and may be increased or
decreased while placing the order. Please quote your rates inclusive of all Government Taxes
(With GST). Also, please quote your PAN in your quotation. Other registration should also be
required if taxes are claimed.
5. The work order will start from issue of order. Alternatively, please quote your time limit
within which you will be able to start the maintenance contract. This time limit has to be
strictly adhered to. Work order will be of two years.
6. The bidders should thoroughly read all the following clauses before submitting
their tender. The original copy of the Commercial terms and conditions duly signed,
stamped with company’s seal must be submitted along with the bid. Bidders should submit
the required documents with page no. & sequence as per Check. This is mandatory.
7. PRICE EVALUATION: No price preference shall be given on any account. Price will evaluated
on lowest on total for all items for single quantity. The evaluation is to be carrying out on Net
unit end cost after buy back as per schedule-C with all Tax. The parties however will have to
give the detailed break-up of the end cost. PGVCL’s decision shall be final and binding on all
8. Security Deposit: The bidders whose tender is accepted shall have to pay 10% as security
Deposit of the of Order cost, in Cash/D.D within 7 days from the receipt of the LOI before
placing order. In case contractor fails to pay up the security Deposit within the specified time,
his earnest money will be forfeited without issuing any notice.The same will be refundable
as soon as all replaced parts (during BRC) warranty is over and on receipt of No Objection
Certificate from our I.T. section, Surendranagar Circle, and PGVCL.
9. PERFORMANCE BANK GUARANTEE: The performance bank guarantee, amounting to 10% of
the order value shall be furnished in B.G (Bank Guarantee) from scheduled bank approved
by government. The Performance guarantee shall be furnished by supplier for satisfactory
performance of the printers which should be valid up to warranty /guarantee period from
the date of commissioning. The bank guarantee should be executed on the standard form
prescribed by the P.G.V.C.L. In case of bank guarantee the supplier should undertake to
renew the guarantee at least one month before the expiry of the validity date, failing which
the P.G.V.C.L will be at liberty to encash the bank guarantee.
10. POST TENDER CORRESPONDENCE / ENQUIRIES: Any correspondence or enquiry subsequent
to opening of Technical and Commercial bids is not desirable, if the same is indulged into, it
will be considered for disqualifying the tender. The Bidders will be required to abstain from
pursuing / canvassing the matter, directly or indirectly with any Officers of PGVCL, as
otherwise the same would also amount to disqualification of the tender.
11. The purchaser (i.e. PGVCL) shall have the right to make any changes, additions / deletions or
modifications in any terms/ conditions of the tender and/ or specifications as may be
deemed necessary by PGVCL at its sole discretion at any time before the due date of opening
12. PGVCL does not accept the conditions of any Bidders. It will be ignored without any
reference; hence bidders should withdraw such printed conditions if they have Any.
13. Revision of prices or any commercial terms affecting the price after opening of technical bids
shall not be considered and will be ignored.
14. OTHER CONDITION OF SUPPLY: PGVCL/GUVNL (Formerly GEB) General Conditions of
contract will apply to all supply to contracts and supplier will be deemed to fully aware of
PGVCL/GUVNL (Formerly GEB) general conditions of contract for the supply of plant
equipment and materials except the conditions modified in this commercial terms and
conditions and any ignorance of these conditions will not exempt supplier from their liability
to abide by the same. Copies are available from PGVCL Office.
15. ARBITRATION: All questions, disputes or differences whatsoever which may at any time arise
between the parties to this agreement touching the agreement or subject matter thereof,
arising out of or in relation there to and whether as to construction or otherwise shall be
referred to the decision of the Sole Arbitrator, appointed by the MD of PGVCL, for that
purpose, who shall be a retired High Court Judge or retired District and Sessions Judge, and
the decision of the said Arbitrator shall be final and binding upon the parties. Reference to
the arbitration shall be governed by the provisions of Indian Arbitration & Conciliation Act.
1996 as amended from time to time and the rules made there under.
16. JURISDICTION: All questions, disputes or differences arising under out of or in connection
with the Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the
court under whose jurisdiction the place from which the tender / Acceptance of tender is
issued, is situated i.e. Surendranagar.
17. PGVCL reserves the right to cancel any or all the offers / bids or to accept any offer without
assigning any reasons. Also in case PGVCL finds that there is an attempt of cartel in the prices,
PGVCL Reserves the right to consider or reject any or all the parties offers without assigning
Any reasons thereof.
18. PGVCL reserves the right to increase or decrease the quantity against each item/s while
placing the order.
19. If the Bidders fails to pay the Security Deposit or defaults in execution of the Orders placed
or If PGVCL suffers any financial loss due to this, then PGVCL will be at liberty to adjust the
amount from other orders of the same firm or by enchasing the Bank Guarantee.
20. Please note that any additional conditions / deviations, if any, found in the Commercial terms
& conditions then the Price Bids of such bidders will not be opened and no further
correspondences in the matter will be allowed.
21. The successful tender shall have to execute a stamped agreement on non-Judicial Stamp
Paper of Rs.300/-, and bond on non-judicial stamp paper of RS 300, duly notarized in the
standard form of the Company and will have to sign the contract Booklet Viz. TENDER AND
CONTRACT FOR WORKS “at his own cost before commencing the work. In case partnership,
firm’s necessary partnership record will have to provided verification authority to sing the
bills, measurement and enter in to contract as well as corresponds with the Company
wherever required necessary power of attorney will have to be produced especially (If
require). When the partnership deed is silent on the point of authority to deal with the
Company. If the contractor happens to be a sole trader, then he will have to produce on
affidavit made before Magistrate to that effect.
22. In case of partnership Firm/Company notarized copy of power of attorney in favor of a
person authorized to sign tender document & submit partnership deed/mom copy with the

24. The undersigned reserves the right to accept any or reject any or all quotations without
assigning the reasons thereof.
25. Service includes unscheduled, corrective and remedial maintenance on 24x7.basis.
26. The tenderer should mention the name of the representative and contact number for overall
coordination of BRC.
27. The tenderer provides 1 phone number which will be available from 8 AM to 8 PM and
email address for logging complains of above mentioned systems and you should have
provided complain no for each complain log.
28. At least 1 engineers dedicated to this BRC with have deep knowledge about LAN and
computer maintenance must be appointed for the support purpose, also 1 engineer should
be on standby if complaints are more for smooth work execution. In case of engineer is not
available, he should be substitute immediately and inform the same to concerned authority
of our office in advance.
29. Scheduled preventive maintenance (i.e. cleaning hardware equipment with blower, etc.)
required as and when called basis 24x7.basis with blower and cleaning PC every quarter with
30. Service to set-right a mal-functioning of the system includes solution to hardware / software
problems, protection against computer viruses, spyware, etc. and replacement of
unserviceable parts. The computer system should be work smoothly after replacement of
new hardware against faulty hardware. The computers and printers are connected through
LAN so, problems related to network, replacement of LAN cables, connectors and LAN
configuration, etc. need to be solved. Operating System related problems like not booting of
PCs and corrupted files lead to not loading OS will be covered under BRC and should be

32. Service Levels: Service call should be attended within 1 working day. and solved within
working days from complain date, failing which, penalty plus 18% GST of will be charged as

33. We may carry out the delayed fault correction through other party at your cost and risk. The
amount so paid to the other party will be deducted from your bill without any further
intimation or correspondence in said matter. Company standard penalty clause will be
applicable to maximum 10% of Contract value + 18% GST.
34. Income tax (TDS), GST (TDS) and CESS whenever applicable will be deducted/recovered as
per Govt. rules and regulation. All new taxes will be applicable as per Govt. rules.
35. The payment shall be made monthly based on call report provided by you. These call reports
include details like Fault resolution date, Name, signature, stamp of our employee and other
details. (Like name of the replaced part).
36. Sufficient stock of necessary spares should be available with you so that fault or defect etc.
is rectified immediately in order to have smooth functioning of the Computer System.
Optimum quantity of all working and OEM/genuine parts including Items Described in
Schedule – D (Price Bid).
37. All the Parts, must replace with brand new condition with min 1-year warranty/ guarantee
except consumable items like cables, CMOS cell, Processor FAN etc. Warranty/ guarantee of
parts will be covered from the date of new part installation. Contractor have to maintain
record of the installed parts which comes with company warranty with its CPU or LED Sr no
and date on which it is installed. If Parts with warranty/guaranty within this contract period
becomes faulty then it must be replaced by contractor. After completion of this contract if
warranty of any parts is pending beyond contract period then contractor has to provide this
part list to IT section with its CPU/ LED Serial number in which it installed and date of
installation of part. Contractor have to provide name and address of the shop/company from
which the parts will be replaced under warranty/guaranty after completion of this contract.
38. As per Item no. 15 & 16 there can be LAN Cabling work anywhere under surendranagar circle
39. Call charge Description : Surendranagar city or offices within 8km around Surendranagar
city are RSO,Circle Office,Surendranagar LAB,GUVNL Police Station, Surendranagar Division,
Surendranagar City1 SDn, Surendranagar City2 SDn, Wadhvan SDn, Joravarnagar

outside surendranagar city area
Because some offices are in same compound, If you attend more then one complaint on
single day in same office campus or same office then full call charge will be given only one
time, for other complaint on same day or for second time visit for earlier complaint it will be
half of the price that will be entered in price bid.

40. LAN maintenance include cable crimping with RJ45 pin.
41. Provision of Tools and spares - Crimping tool, punching tool, screw driver kit along with pliers,
cutter, multi meter, CD Drive, pen drive, blower and other essential part for diagnose/repair
PC etc. will be provided to your support engineer by the contractor. The PGVCL reserves the
right to terminate the contract if your service is found unsatisfactory and in that event, the
amount paid as Security Deposit shall be forfeited and damage occurred on account of your
fault shall also be recovered from you.
42. For any dispute court jurisdiction will be Surendranagar.
43. Traveling cost will be bear by the contractor for visiting Circle office/ Division office / Sub
Division Office
44. Payment will be done on call basis and the bill of Parts, which will be replaced, is to be
produced separately with call report.
45. A Complaint report (Including Details of Complaint i.e Name, Date, Office name etc) must
be made with every call attended and must be signed by user/employee with stamp. Report
should be in dual copy. One copy is to be given to user/employee and other is to submitted
46. You have to execute an agreement on stamp paper of Rs 300/- and indemnity bond on stamp
paper of Rs 300/- before commencement of work starting the mater conversing that any
accident to the contractors, staff or any person either fatal or non-fatal due to non-observing
of safety measure PGVCL should not be responsible.
47. If party possesses GST registration No. on their name on which work order issued, then GST
will be reimbursed to contractor on production of proof for payment made to concern
Department for particular work, up to satisfaction of officials of PGVCL. However, there
would be total responsibility of contractor for any none or partial payment of service tax as
per rules of concerned Government Department. however, this may be noted no any type of
penalty of GST will be reimbursed during or after completion of contract. New tax rules as
per Govt. will be applicable as per rules.
