General Terms & EMD & Tender fee shall be submitted in electronic format only through online
Conditions (by scanning) while uploading the bid. This submission shall mean that EMD &
tender fee are received for purpose of opening the bid. Accordingly,
offer/tenders of those tenderers whose EMD & tender fee is received
electronically, shall be opened. However, for the purpose of realization of EMD
and Tender Fee, bidder shall send the EMD as well as Tender fee in required
format in original through RPAD / Speed Post so as to reach to Solid Waste
Management Department, Khanderao Market within 3 days from the last date
of submission of price-bid. Punitive action shall be initiated for non-submission
of EMD & Tender fees in original to Solid Waste Management Department,
Khanderao Market by bidder including abeyance of registration and
cancellation of E-tendering code for One year. All documents in supporting of
bid shall be in electronic format only through online (by scanning) during the
bidding period.”
All documents must be colored scanned to be seen as original. Scanning
in black and white or gray shall not be acceptable.
Documents in original must be notarized with clearly displaying stamp,
number and name of the notary. Documents submitted in photocopy
shall be attested with true copy.

GENERAL INSTRUCTIONS
1. The cost of Bid document i.e. tender fees will not be refunded under any circumstances.
2. EMD in the form specified in Bid document only shall be accepted.
3. The offer shall be valid for 120 days from the date of opening of Technical Bid.
4. Tender offers without tender fees, Earnest Money Deposit (EMD) and which do not fulfil all or
any of the condition or submitted incomplete in any respect will be rejected.
5. Conditional tender shall not be accepted. Municipal Commissioner, Vadodara reserves the
right to accept or reject such tenders without assigning any reason thereof.
6. Tenderers should carefully fill in the rates against the items mentioned in the schedule and
scrutinize them before submitting the tender. Any variation in rates etc. will not be allowed on
any ground such as mistake or misunderstanding etc. after the tender has been recommended or

8. Tenderers shall have his registered office with telephone. Tenderers shall furnish the date on

11. As per the Bombay Stamp Rules Act 1958, Appendix 1, Article 5, the successful bidder shall
enter in to an Agreement with the Corporation on Rs. 300 Stamp Paper.

INSTRUCTIONS TO SUPPLIERS
1) Vadodara Municipal Corporation invites tender for procurement of Rate Contract for
Procurement of Waste Bins of Different types, capacity and design as per VMC tender
specifications and requirements.
2) The requirement of Rate Contract for Procurement of Waste Bins of Different types,
capacity and design as per VMC tender specifications and requirements and their
detailed technical specifications are set out in Appendix 1. Interested and qualified parties,
based on qualification criteria set out in Appendix 2, are requested to submit information
about bidder and a single financial Quotation /price bid in a manner prescribed in
3) Each Supplier shall submit only one (1) Bid for each of the item, in response to this
Procurement Document (PD). Any Supplier who submits more than one Bid for the item
will be disqualified.
4) Not More than one tender shall be submitted by a contractor or by a firm of contractors.
No two or more concerns in which an individual is interested as a proprietor and / or a
partner & / or director shall submit tender for the execution of the same work / tender. If
they do so all such tender shall be liable to be rejected.
5) At any time prior 72 hours to the last date and time of submission of Bids, VMC may, for
any reason, whether at its own initiative or in response to clarifications requested by any
Supplier, modify the PD by the issuance of Addenda. All interested tenderer shall have to
check the VMC website. The Bidder shall not transfer the PD document to another
interested party.
6) The Bid shall remain valid for a period not less than 120 days from the date of opening of
tender i.e. technical bid (bid validity period). VMC reserves the right to reject any Bid,
which does not meet this requirement. In exceptional circumstances, prior to expiry of the
original Application Validity Period, VMC may request Applicants to extend the
Application Validity Period for a specified additional period. Applicants not extending the
Application Validity Period when so requested would automatically be disqualified.
7) Earnest Money Deposit (EMD)
Each Bid shall be accompanied by EMD of Rs. 2,00,000/- (Rupees Two Lakhs only).
The EMD shall be in the form of a crossed demand draft in favour of The Municipal
Commissioner, Vadodara on any Nationalized Bank/Schedule bank / Bank as per
VMC Circular only, payable at Vadodara.
The EMD shall be forfeited in the following cases:
a) If the Supplier withdraws its Bid during the interval between the Bid Due Date
and expiration of the Bid Validity Period.
b) If the successful supplier fails to provide the Performance Security within the
stipulated time or any extension thereof provided by VMC;
8) Performance Security
The successful Supplier would be required to submit Performance Security amounting
to Rs. 3,00,000/- ( Rs Three Lakhs only) in the form a crossed demand draft in favor
of The Municipal Commissioner, Vadodara on any Nationalized Bank/Schedule bank /
Bank as per VMC Circular, payable at Vadodara.
Irrevocable Bank Guarantee issued by a Nationalized Bank/Schedule bank / Bank as
per VMC Circular shall also be acceptable.
9) Formats and Signing of Bid
The Supplier would provide all the information as per this PD. VMC would evaluate
only those Bids that are received in the required format and are complete in all
respects. Each Bid shall comprise the following:
a) Details of the Supplier in the format set out in Appendix 3 On Line.
b) Qualification Criteria / Technical bid in the format set out in Appendix 2 On Line
c) Financial Quotation/ price bid for Waste Bins of Different types, capacity and design
in the format set out in Appendix 4 in E Tender Online Only. No physical submission
d) Tender fee in “TECHNICAL BID” only.
e) The Bidder shall duly sign all the sheets of the Tender Document.
f) EMD in “TECHNICAL BID” only. (Online price bidis Compulsory).
10) Sealing and Marking of Bid for submission of supporting Physical Tender
The outer envelope must be super scribed with the following information:

If the envelope is not sealed and marked as instructed above, VMC assumes no
responsibility for the misplacement or premature opening of the contents of the Bid
submitted and such Bid, may, at the sole discretion of VMC, be rejected.
Tender shall be submitted through E tendering only. (Online price Bid is compulsory).
11) Bid Due Date
Bids should be submitted before 1600 hours IST on 20.05.2026 up to in the manner
and form as detailed in this PD. Bid submitted by either facsimile transmission, hard
copy (without e tender) or telex or email or in person will not be accepted.
VMC may, in exceptional circumstances, and at its sole discretion, extend the above
Bid Due Date by issuing an Addendum.
12) Opening of Bids and Clarifications
VMC would open the Bids possibly on Bid Due Date as mentioned above in the
„General Description of Work‟ for the purpose of evaluation.
VMC reserves the right to reject any Bid not submitted on time and which does not
contain the information/documents as set out in the tender.
To facilitate evaluation of Bids, VMC may, at its sole discretion, seek clarifications in
writing from any Supplier regarding its Bid.
As part of the evaluation, the Bids shall be checked for responsiveness with the
requirements of the PD, samples etc. and only those Bids that are found to be
responsive would be further evaluated in accordance with the criteria set out in this
The Bid would be considered to be responsive if it meets the following conditions:
i. It is received /deemed to be received by the Bid Due Date including any
extension thereof.
ii. It is signed, sealed and marked as stipulated in Clause 8 and Clause
iii. It contains all the information and documents as requested in the PD.
iv. It contains information in formats specified in this PD.
v. It mentions the validity period as set out in Clause
vi. It provides information in reasonable detail. (“Reasonable Detail” means
that, but for minor deviations, the information can be reviewed and
evaluated by VMC without communication with the Supplier). VMC
reserves the right to determine whether the information has been
provided in reasonable detail.
vii. There are no inconsistencies between the Bid and the supporting
documents. A Bid that is substantially responsive is one that conforms
to the preceding requirements without material deviation or reservation.
A material deviation or reservation is one (i.) which affects in any
substantial way, the scope, quality, or performance of the project, or (ii.)
which would affect unfairly the competitive position of other Suppliers
presenting substantially responsive Bids.
VMC reserves the right to reject any Bid, if:
i. If the tender is incomplete; or
ii. At any time, a material misrepresentation is made or discovered; or
iii. The Supplier does not respond promptly and diligently to requests for
supplemental information required for the evaluation of the Bid.
In case the Bid is found to be responsive, the Bid would be evaluated in accordance
with the Qualification Criteria, samples etc. as set out in Appendix
In case the Bid is found to be inadequate, VMC may request the Supplier for more
details to the Bid submitted. As part of the evaluation of the Bid, VMC may also
request the Supplier to submit clarifications.
The Financial Quotations/ Bid of only those Suppliers, who meet the Qualification
Criteria, would be opened.
The Supplier offering the lowest rate/s for the Waste Bins of Different types, capacity
and design would be declared as the Preferred Supplier for the same. However
separate lowest bidder will be evaluated based on rate quoted by different tenderers for
different types, capacity and design of waste bins as mentioned in price bid.
Interested tenderer / party can take part in any & / or all category (A to T) of waste
bin. However tender Fee, EMD & Performance Security Deposit amount will remain
same. It is not compulsory to quote for all category.
VMC may either choose to accept the Quotation of the Preferred Supplier or invite
him for negotiations.
In case there are two or more Suppliers quoting the same price, VMC may in such
case call all such Suppliers for negotiations and select the Preferred Supplier on the
outcome of the negotiations. The selection in such cases shall be at the sole discretion
VMC can finalize parallel rate contract & split order to more than one bidder at the
same rate of lowest bidder in that category based on requirement for any / all item/s.
Decision of Municipal Commissioner; VMC in this regards will be final & binding to
14) In the event of acceptance of the Preferred Supplier with or without negotiations, VMC
shall declare the Preferred Supplier as the Successful Supplier. VMC will notify the
Successful Supplier through a Letter of Award (LoA) that its Bid has been accepted.
15) Notwithstanding anything contained in this PD, VMC reserves the right to accept or reject
any quotation, or to annul the bidding process or reject all quotations, at any time without
any liability or any obligation for such rejection or annulment, without assigning any
reasons thereof.
16) If any dispute arises about the contract or any terms of contract, Municipal Commissioner,
VMC shall be the sole arbitration and his decision would be final and binding to both the
17) VMC can ask the tenderer to submit their sample at any stage of tender (if required) and if
sample of any tenderer is not found as per technical specifications &/or requirements of
VMC, bid of such tenderer/s will be rejected at any stage. Decision of Municipal
Commissioner, VMC in this regard will be final and binding to all tender.
18) This tender is for finalizing rate contract (1Year) of PE containers / Bins as per PD. Rate
sanctioned will be fixed for entire one year RC (Rate Contract) period. No price escalation
will be given during RC period. Only change in taxes, duties, govt. levies will be accepted
by VMC & consider for payment. RC period may be extended for further period of One
year by mutual confirmation. Decision of Municipal Commissioner; VMC will be final &
binding to all. Municipal Commissioner can order for further / extra quantity, if required
during entire RC period.
19) The price escalation or variation clause will not be accepted. Tenderer has to quote the
total price, net including of all taxes & duties etc. and for evaluation and finalization
purpose, the total price will be taken in to consideration. Transportation, Packing,
Forwarding, Insurance charges are included in the indicated price. However any change in
the GST will be considered at actual for which contractor will have to submit necessary
documentary proofs as required by department.
20) Interested and qualified tenderer can take part in all or any type and category of waste bin.
However tender fee, EMD etc. will remain same as per tender. However, separate price
evaluation will be carried out for different types of waste bin, and based on same, lowest
tenderer will be evaluated separately for each type & category of waste bin.
21) The technical specification for Waste Bins of Different types, capacity and design (for
general reference & idea) is given in Appendix1, however if required bidders are advice to
personally visit at Central Workshop, VMC site for better understanding of requirement of
22) EXTENSION FOR DELAY.
If the supply is delayed by:
a) Force Majeure.
b) Abnormally bad weather, or
c) Serious loss or damage by fire OR
d) Civil commotion or strike or lockout of their principal workshop.
Any other cause, which is beyond the contractor~s control then upon the happening of any such
event causing delay, the contractor shall immediately inform in writing to the HoD-Solid Waste
Management but at the same time his best endeavors to make good the delay. The HoD-Solid
Waste Management in such event can take the final decision regarding the late delivery penalty for
23) PAYMENTS DUE FROM CONTRACTOR.
The Municipal Commissioner shall be entitled to recover costs, damages, or expenses for which
under the contract, the contractor is liable to the Vadodara Municipal Corporation from any money
due or becoming due to the contractor under the contract or Municipal Commissioner will have
the liberty to recover the amount from the contractor.
24) Payment Terms: As mentioned in tender.
25) Only manufacturer of PE containers and / or its authorized dealer / distributor can take
part in the tender for which necessary documentary proof should be enclosed with tender.
26) Tenderer has to submit all the relevant information likes;
Availability of local service point.
Warranty conditions
Detailed client list to whom such type of PE containers have been
supplied by them.
Details of Technical experience of tenderer.
27) Any company /subsidiary/associate/parent or any of their having same promoter are
not eligible to participate who has been blacklisted by any of Govt. Department or any
ULB‟s (Urban Local Bodies in India). If it comes to the notice of the VMC authority at
any point of time, during the tendering or execution stage of the work that the tenderer
has been blacklisted by any Govt. organization (as mentioned above), then all the
payments due to him shall be forfeited and firm will be blacklisted.
28) The bidder should provide accurate information on any litigation history or arbitration
resulting from contracts completed or under execution by him over the last seven years.
This should also include such cases, which are in process/progress. A consistent history
of awards against the bidder may result in failure of the bid. In case the bidder has not
provided such information and has come to the notice of the Authority, the tender will be
rejected at whatsoever stage and in such case all the losses that will arise out of this issue
will be recovered from the tenderer /contractor and he will not have any defense for the
29) The contractor shall not assign or sublet his contract or any substantial part thereof to
any other agency without writing permission of Municipal commissioner, VMC.
30) All articles supplied shall strictly conform to the specifications laid down in the tender
31) Any change in the constitution of the firm etc. shall be notified forth with by the
contractor in writing to the Corporation and such change shall not relieve any former
member of the firm, etc., from any liability under the contract.
32) The approved supplier shall be deemed to have carefully examined the total work;
conditions, specifications, size, make and drawings, scope of work etc. of the goods to be
33) If the Corporation does not purchase or issue work for any of the tender item/s, work or
purchases less than the quantity indicated in the tender form, the tenderer should not be
entitled for any compensation. This tender is for finalising the rate contract. If demand
available for particular design / model then only order will be issued, to RC holder as per
competent authority sanction which will be binding to all.
34) Insurance & License etc.
The Supplier is responsible for transit and all other insurances (if/as required) till the
items are delivered at the delivery location.
Tenderer must make their own arrangements to obtain import license if necessary.
35) Warranty/Guarantee clause~
The tenderer would give guarantee that the Equipment‟s would continue to confirm to the
description and quality as specified for a period indicated in the table given below from
the date of delivery of the Equipment‟s to be purchased and that notwithstanding the fact
that the Corporation may have expected and/or approved the said Equipment‟s, if during
the guarantee/warrantee period the said equipment be discovered not to confirm to the
description and quality aforesaid or have determined (and the decision of the Municipal
commissioner, VMC in that behalf will be final and conclusive) the corporation will be
entitled to reject the Machines/ Equipment‟s or such portion thereof as may be
discovered not to confirm to the said description and quality, on such rejection the
Equipment will be at the seller‟s risk and all the provision relating to rejection of goods,
etc. or such portion thereof as is rejection by the Corporation, otherwise the tenderer shall
pay such damage as may arise by reason of the breach of the condition herein contained.
Nothing herein contained shall prejudice any other right of the in that behalf under this
contract or otherwise.

reasonable time have access to the supplier‟s premises and shall
have the power at all reasonable time to inspect and examine
the materials and workmanship of the equipment/machineries
during manufacturing process or afterwards as may be decided.
i. The tenderer shall furnish complete address of premises of his
office, go down and workshop where inspection can be made
together with name and address of the person who is to be
contacted for the purpose.
ii. The firm is liable to execute any minor change/modification
suggested at the time of inspection for which no extra payment
36) Rejection —
Articles not approved during inspection or testing shall be rejected and will have to be
replaced by the tenderer at his own cost within the time.
37) Notwithstanding anything contained in this tender document, Corporation reserves the
right to accept or reject any tender, or to annul the bidding process or reject all tenders, at
any time without any liability or any obligation for such rejection or annulment, without
assigning any reasons thereof
38) If any dispute arises out of the contract with regard to the interpretation, meaning and
breach of the terms of the contract, the matter shall be referred to by the parties to the
Municipal Commissioner, VMC whose decision shall be final.
39) Schedule of equipment and technical specifications:
i. The bidders shall complete the schedule (s) and technical
specifications for the goods and equipment to be supplied in
their entirety so as to demonstrate their compliance with the
requirements of the bidding documents.
ii. The materials, equipment and services to be supplied under the
contract shall be like that use of such materials equipment and
services shall not infringe or violate any industrial property or
intellectual property rights or claims of any third party.
40) Drawings: The bidder will submit drawings showing all dimensions, materials, process
etc. of the proposed Waste Bins / items along with the bid. Successful bidder will be
required to submit detailed drawings of all the equipment‟s.
41) Specifications and standards:
a) The supplier shall ensure that the goods and related services
comply with the technical specifications and other provisions of
b) The goods and related services supplied under this contact shall
conform to the standards of the technical specifications, when no
applicable standard is mentioned, the standards shall be equivalent
or superior to the official standard whose application is
appropriate to the country of origin of the goods and suitable to
Indian (Vadodara) weather conditions and usage.
c) Wherever references are made in the contract to codes and
standards in accordance with which it shall be executed, the
edition or the revised version of such codes and standards shall be
those specified in technical Specifications. During contract
execution, any changes in any such codes and standards shall be
applied only after approval by the Corporation and shall be treated
in accordance with the conditions of contract.
d) Volume Capacity shown for each category of waste bin is
approximate. Exact capacity shall be as per the design &
dimensions of the tenderer submitted by them in technical bid.
For each category appx. 5% variation (upper / lower) in capacity
will be allowed based on design of the tenderer. Tenderer has to
submit detailed dimensional drawing & photograph of their actual
product for which they have quoted.
e) Overall shape shall be matched by tenderer for different category
of waste bins. However actual dimensions & shape of bin (with /
without lid) shall be as per drawing submitted by them.
f) Tenderer has to clearly mention the details of raw material for the
model they have quoted in different category, however all raw
material must be Virgin & necessary test repot must be submitted
by them as & when asked by department; from NABL approved
Laboratory / CIPET as per VMC requirements, for raw material
and finished product.
42) The supplier shall correct any defects covered by the warranty immediately on being
notified by the Purchaser of the occurrence of such defects.
43) An authenticated test certificate in confirmation to the specifications of the tender, for
which testing at site is not possible has to be produced by the tenderer at their cost, as &
when asked by VMC.
44) Right to Owner to accept or Reject Tender: The right to accept the tender will rest with
the VMC. The A.M.C, however, does not bind itself to accept the lowest tender, and
reserves to itself the authority to reject any or all the tenders received without assigning
any reason whatsoever. Tenders in which any of the particulars and prescribed
information are missing or are incomplete in any respect and/or the prescribed condition
is not fulfilled are liable to be rejected. In addition to the above, the tender will also be
liable to be rejected outright if ~
i] The tenderer proposes any alterations in the works specified or
in the time allowed for carrying out the work or any condition
or correction made in specifications.
ii] Any of the page or pages of the tender is/are removed or replaced.
iii] All corrections, additions or pasted slips are not initialed by the tenderer.

The number of Waste Bins of Different types, capacity and design is as per
requirement of VMC and availability of budget / grant. No minimum fixed
quantity of any type of Waste Bin shall be guaranteed. Further this tender will be for
annual ( 2 Year) requirement and rate contract will be fixed for two year of period from
the date of work order. However, actual number of procurement will be at the sole
discretion of VMC. Municipal Commissioner can order for further / extra quantity, if
required during entire RC period.
Tender Validity period
The Validity period is 120 days.
Rate Contract Validity:
Rates approved under this tender will be valid for 2 (two) year period, during this period if
VMC Central workshop get demand of any category of waste bin, same shall be ordered to
the successful bidder/s of that category as per Sanction of Competent authority of VMC.
After expiry of two year RC period, it can be extender for further one year period (as / if
required) with mutual consent of both the party (i.e. VMC and successful bidder/s). No
price escalation will be given during entire RC period, including extended period if any.
Procurement period (i.e. Delivery Period)
The procurement period shall be 60 days from date of each work order. Delivery period will
commence from the date of order to the supplier. However, based on site conditions,
requirement of VMC etc. this can be changed and will be mentioned in each order (if / as
required). Further if any change, staggered delivery required will be informed to contractor.
They have to execute as per such order.
Delivery Schedule
However, as per requirement, VMC will give delivery schedule (if delivery required in
staggered manner/delay as mentioned above) to the successful bidder/s. The price quoted as per
Appendix 4, will be valid for the entire one year Rate Contract period, which will be
binding to the supplier.
Delivery location: At various offices / Locations of VMC; Vadodara, Gujarat at site
specified by VMC based on budget / grant details.
Successful bidder/s has to supply material of each elected representative separately as per
delivery requirements in different zone / area in coordination with zonal SWM / related dept.
Logo - Printing :-
Successful tenderer/s has to print logo & messages as per VMC & / or H'ble elected
representative requirement on each budgeted work / item separately. Good quality printing
shall be carried out by tenderer, Sample shall be first shown to VMC & after
approval agency has to print.
For supply of PE Bins, preferable after satisfactory Delivery at our central workshop/ at
site and on required certification from the authority; preferably within 30 days .
The Security Deposit will be paid back by after the expiry of warranty period/ rate contract
period whichever is later , without any interest.
Transit Insurance
The Supplier is responsible for transit and all other insurances (as/if required) till the items
are delivered at the location mentioned in the Procurement Order/ informed to bidder.
Taxes and duties
Shall be included in the indicated price. Tenderer has to quote the total price, net including
of GST & all taxes & duties etc., and for evaluation and finalization purpose, the total price
will be taken in to consideration (Based on actual GST applicable on such item by Govt.
Dept.). Transportation, Packing, Forwarding, Insurance charges shall be included in the
indicated price. Tenderer has to properly examine GST rate schedule before filling the
tender; VMC will not be responsible later on & will not give any change unless otherwise it
is changed by Govt. authority.
However any change in the GST, tax etc will be considered at actual for which contractor
will have to submit necessary documentary proofs as required by department.
Warranty Period
Supplier shall warrant that the supply shall be warranted against faulty materials and
workmanship for Waste Bins and / or items of Different types, capacity and design for a
period of 12 months from the date of supply.
The bidder/s will make arrangement for inspection of the PE waste bin/s and / or items by
Third Party along with VMC (if required ), before delivery , at factory site. Inspection of
the PE waste bins / items will also be carried out at Vadodara at site specified by VMC. If
any discrepancy is found in the material supplied and technical specifications approved, the
same lot shall be rejected and bidder will have to collect rejected material within seven
days. No claim for the rejected material shall be entertained. Necessary test certificate/s
from NABL approved test Laboratory shall be submitted by successful bidder/s as & when
asked by VMC for different lot/s.
Liquidated damages for delay
Supplier in accordance with the schedule specified in the tender shall make delivery of
the equipment‟s.
An unexcused delay by the supplier in the supply of its delivery obligations, supplier
will be held liable and VMC can take actions to forfeit of his performance security,
imposition of liquidated damages and/or termination of the contract by default.
If the supplier fails to deliver any or all of the equipment‟s within the said period (as
informed by VMC based on requirement), VMC shall deduct from the contract price as
liquidated damages (Late delivery penalty) will be calculated on the basis of delayed days
for delayed quantum (delayed work amount) of work and rate of calculation will be 2% per
month of delivery price will be recovered from the supplier without any reference to the
supplier. The amount of Liquidated damages will be however subject to the maximum of
10% of the total contract sum.
However, Delay in excess of one hundred (100) days after completion of delivery period
may be cause for termination of contract and forfeiture of all security for performance.
PERFORMANCE GUARANTEE.
For Supply of Bin:
As a contract security, the contractor shall furnish performance guarantee in the form of
Bank Guarantee or by Demand draft/pay order/BG within 15 days from the date of order for
the amount Rs. 50,00,000/- ( Rs. Fifty Lakhs only) from any Nationalized Bank/Schedule
bank / Bank as per VMC Circular and made payable to the ~Municipal Commissioner,
Vadodara Municipal Corporation~ Payable at Vadodara.
The performance guarantee shall be returned to the contractor without any interest on the
successful completion of the warranty period, When the contract ceases to be under any
Notwithstanding the provisions of tender, the Supplier shall not be liable for forfeiture of its
performance security, liquidated damages or termination for default, if and to the extent
that, it~s delay in performance or other failure to perform its obligations under the Contract
is the result of an event of Force Majeure.
For purposes of this Clause, ~Force Majeure~ means an event beyond the control of the
Supplier and not involving the Supplier~s fault or negligence and not foreseeable. Such
events may include, but are not limited to, acts of the Purchaser either in its sovereign or
contractual capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and
freight embargoes.
If a Force Majeure situation arises, the Supplier shall promptly notify the Purchaser in
writing of such conditions and the cause thereof. Unless otherwise directed by the Purchaser
in writing, the Supplier shall continue to perform its obligations under the Contract as far as
is reasonably practical, and shall seek all reasonable alternative means for performance not
prevented by the Force Majeure event.

Pre-Qualification Criteria
Following are the minimum requirements for tenderer to qualify in the bid.
A. Only duly registered Firm/Company can submit Bids. Provide Certificate of
Registration. (I.e. GST/IT etc.)

Authorised dealer/Distributor of such type of Waste Bin manufacturer. If the
tenderer is Authorised dealer / Distributor of the manufacturer, a latest Authority
letter should be submitted, for this tender.
C. The tenderer shall furnish the list of Municipal corporations / ULBs / Institutions
with Address & Tel. no. To whom vehicles have been supplied during the
preceding seven years and the numbers of such waste Bins supplied & its order
D. The tenderer shall furnish at least 2 Nos. certificates of satisfactory performance
of such waste Bins supplied together with copies of purchase orders received
from those clients.
E. Certificate from Chartered Accountant about turnover of past three financial
years shall be attached.
F. The Supplier should meet the financial criteria as set out below: The Tenderer
should submit data for the F.Y. 2022~2023, 2023~2024 and 2024~2025 year.
CA certificate must also be attached with tender. The tenderer should have
minimum average annual turnover of Rs. 300 Lakh (Rs Three Crore only) for
the last three financial years as mentioned above. If any tenderer has completed
his / their books of account with filing of income tax return for year 2026-27, in
such case they can submit the same and it will be considered in last 3 FY data.
G. Sealed tenders, for the above work are invited from the bidders. The bidders shall
be a single entity only, bidding for the Project. The Bidder should have

higher / lower) in last seven years ending 31-03-2026 as under;
