(a) Restricted to procure from OEMs or their authorized dealers only. Authorized dealers have to submit tender specific authorization from OEM with their offer, otherwise their offer will be summarily rejected. If the firm is OEM/Manufacturer then it has to submit OEM self-certification mentioning the offered make/brand and model in the self-certification letter. (b) Tender specific authorization/OEM self-certification should be on OEM's letterhead and must contain offered make/brand & model, full name, designation, active e-mail address, mobile number and signature of authorized signatory of the OEM along with company stamp. Tender specific authorization/OEM self-certification should preferably be in the format attached as Annexure-II with General Tender Conditions. (c) Offers received without OEM self- certification/tender specific authorization in the format mentioned above will not be considered as valid and offer will be summarily rejected without any back reference and no representation will be entertained. Buyer can seek the authenticity of tender specific authorization from OEM, if required.
A) In Keeping with the Public Procurement (Preference to Make in India) Order, 2017, as amended, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore public procurement of the item is restricted to Class I local suppliers only and the vendors who do not qualify to be Class I local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I local supplier for the tendered item participates in the tender it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. B) Provisions of latest Rly Bd letter regarding Public Procurement (Preference to Make in India), Order 2017 - Revision vide Lr. No. 2020/RS(G)/779/2/Pt.1(E3322671) dt 20.08.2024 are applicable.
Offers received without make/brands or with vague mentions like "0", NIL, "as per tender" etc will be summarily rejected. Participating firms should mention their offered make/brand with model against tendered item in the corresponding make/brand column without fail. Ambiguity in the form of offering multiple make/brands or not mentioning make/brand will be treated as disadvantage to the bidder and such offer is liable to be rejected.
The tenderers who are offering make/brands other than M/s DORMA (or) M/s GEZE (or) M/s YALE should submit - (a) certificate of compliance of their offered make/brand for door closer/door closing mechanism as per EN-1154, and (b) parameter-wise test details of their offered make/brand in accordance with Table-1 of RCF Drawing. Failure to submit above will result in summarily rejection of firm's offer.

Firms willing to avail benefits of micro and small enterprises, must submit documentary evidence of being micro or small enterprises for tendered item in the certificate issued by nodal agencies as per public procurement policy, failing which firms offers will be treated as Non-MSE firms. For detailed instructions refer Para 15 of General Tender Conditions attached with NIT and/or available as Public Document on IREPS website Goods and Services/SCR.
If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate the percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprise [in percent of order value] with further breakup of MSE owned by SC/ST. MSE benefits are not applicable to authorised dealers or traders.

EARNEST MONEY DEPOSIT (EMD) shall be deposited by all vendors for tenders with estimated value above Rs. 10 Lakhs subject to the applicable exemptions: (a) EMD shall normally not be called against Limited tenders with estimated value up to Rs. 25 lakhs (including single tenders, global limited tenders) and Open Tenders with estimated value upto Rs. 10 lakhs. If considered necessary, authority competent to issue tender may incorporate the condition to call for EMD even in such limited tenders, on a case to case basis. (b) MSEs irrespective of relevance of product category registered with the UDYAM (UDYAM Registration Certificate) will be exempted from payment of earnest money in terms of Rly Bd Lr. No. 2022/RS(G)/363/1 dated 21.09.2022. (c) Other Railways and Government departments in terms of Rly Bd Lr. No. 2004/RS(G)/779/11 dated 24.07.2007. (d) Indian Ordnance Factories in terms of Rly Bd. Lr. No. 92/RS(G)363/1 dated 08.04.1993. (e) PSUs owned by the Ministry of Railways and PSUs for the group of i t e m s that are manufactured by them in terms of Rly Bd. Lr. No. 2003/RS(G)779/5 dated 10.09.2004. (f) Vendors registered with South Central Railway for the trade group of the item tendered upto their monetary limit of registration. (g) Vendors appearing on the approved vendors list of RDSO/PUs/CORE (As available on IREPS/UVAM), subject to approval status being valid on the date of tender closing. (h) Vendors registered with Railway Board/SCR for supply of medicine, medical equipment and consumables shall be exempted from submission of EMD for these items. (i) In the tenders issued against PAC, EMD shall be mentioned in tenders as the EMD exemption is applicable for OEMs in whose favor PAC is issued but not to the authorized agent. KVIC shall be exempted from EMD for items supplied by them. Note: (i) There shall be no exemption to such bidders from submitting EMD and SD for all tenders published during the period of time they are disqualified as per declaration signed by them. (ii) If authorized agents participate on behalf of OEM/vendors appearing on the approved vendor list of RDSO/PUs/CORE, such authorized agents can%u2019t claim EMD exemption based on its own or its OEM/Approved vendors MSE certificate. (iii) OEMs are not exempted from payment of EMD where the OEM has participated in the tender and requests to place order on their authorized agent. (iv) Offers submitted without EMD will be summarily rejected.
Failure consequences: In case the firm fails to execute the contract within the original delivery period, the purchaser will be entitled to impose liquidated damages for extension of delivery period. For any reason, if the supplier fails to supply goods as per the conditions of contract, as amended from time to time, Purchaser shall have the right to levy damages from the supplier for failing to comply with the contractual conditions, not by the way of penalty, an amount equal to 5% of the defaulted order amount. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly.
Price Variation Clause is not applicable for this tender
Force majeure clause is applicable.
Split Clause: With regard to splitting of quantity being ordered on more than one source as indicated in General Tender Conditions, is applicable for this tender. For details refer Para 2.2 of General Tender Conditions.

Inspection by a nominated Third Party Inspection (TPI) agency at the manufacturer premises and direct dispatch from the premises of the manufacturer after the material has been inspected and passed by the nominated Third Party Inspection (TPI) agency. Firm to upload/mention full address and place of inspection. Any request from the firm to change TPI agency from one to another post- contract will not be entertained.
The bidder confirms that Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms quoted anywhere else should be ignored. [Denial of this condition not Recommended].
The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of Contract and [or] special Conditions and [or] other Conditions specified/attached with the tender. [Denial of this condition not Recommended].
For multi consignee item, the rate should be quoted by Firm on FOR destination basis for each consignee separately. The inter-se ranking of offers will be decided for each consignee separate.

Validity of Offer: No deviation from the offer validity period stipulated in the tender is permitted. Validity will be reckoned from the closing date of tender.
Firms are expected to quote for a quantity not less than 50% of the tendered quantity. Offers received for quantity less than 50% of tendered quantity will be considered unresponsive and will be summarily rejected.
