Eligibility Criteria

Tenders from Joint ventures are not acceptable.

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The amount put to tender is exclusive of GST. GST will be paid separately as per prevailing rates. The contractor shall quote the rates excluding GST.

The estimates are prepared based on Common SR for the year 2023-24. But the amount put to tender is worked out exclusive of GST. The bidder shall quote the rates considering the same as above. However, GST rates will be considered/ effected either during tender evaluation / tender agreement /Billing.

The following original certificates shall be scanned and attached to KPP PORTAL tender along with bid. (1) KPWD Class III & Above contractor registration certificate with validity (2)Valid GST Registration Certificate and the Authorized person should be enclosed specimen signature (3)Income Tax PAN card and Income Tax returns filed for the Financial year 2022-23 (Assessment year 2023-24) (4) Valid Employee Provident Fund (EPF) Registration Certificate and last month (Previous month) paid challan (5)For SC or ST reserved works, SC or ST eligible Contractor should have Caste Certificate from concerned Taluka Tahasildar and up load it in KPP-portal. At the time of tender opening or evaluation of tender same original copy should be produced for verification (6)As per the Karnataka Gazettee dated 16-09-2017 Finance Secretariat notification No. FD.876 Exp-12/2017, Bengaluru, dated 15-9-2017, the contractor belonging to Scheduled Castes or Schedule Tribes shall be domicile of the State of Karnataka for more than 10 years (7)Work done certificate: To qualify for award of this contract each tenderer in his or her name in the last five years (2019-20 to 2023-24) should have satisfactorily completed (at least 90% of Contract value Physcially & financially) as a prime contractor at least one similar work (ANY CONSTRUTION WORK) of the value not less than Rs 8.47 lakhs (usually not less than 25% of the amount put to tender under this contract) Work done Certificate issued by an Officer not below the rank of Executive Engineer of the concerned Division (The cost of completed work of previous year shall be given the weightage at 10% per year to bring it to the price level of financial year in which the tenders are invited) (8) To qualify for award of this contract each tenderer in his or her name in the last five years (2019-20 to 2023-24) should have achieved in at least One financial year minimum financial turnover of Rs 33.87 lakhs (usually not less than APT). The Financial turnover of previous year shall be given the weightage of 10% per year to bring it to the price level of financial year in which the tenders are invited. (UDIN NUMBER mentioned in C.A. Report compulsary) (9) Assessed available tender capacity (As per formula) (10) The bidders should scan and upload the his current postal address, email id and model signatures in the KPP PORTAL. All the above certificates documents in original shall be produced at the time opening of tender for verification

Tenderers who meet the above specified minimum qualifying criteria, will only be qualified, if their available tender capacity is more than the total tender value. The available tender capacity will be calculated as under: Assessed available tender capacity ( Ax N x 2.50- B ) where A Maximum value of civil engineering works executed in any one year during the last five years(2018-19 to 2022-23) (updated to 2023-24 price level) taking into account the completed as well as works in progress. N Number of years prescribed for completion of the works for which tenders are invited. B Value, at 2023-24 price level, of existing commitments and on-going works to be completed during the next 0. years (period of completion of the works for which Tenders are invited) Note: The statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the works listed should be countersigned by the Employer in charge, not below the rank of an Executive Engineer or equivalent

Cover I (Technical bid) will be opened in the office of the Executive Engineer Karnataka Neeravari Nigam KNNL GRBCC Division No 3 Gokak Belagavi District in presence of the bidders who wish to participate (2) Cover II (Financial bid) of the successful bidders who qualified in the technical bid will be opened after approval to the technical bid from the competent authority, by Executive Engineer Karnataka Neeravari Nigam KNNL GRBCC Division No 3 Gokak, Belagavi District

The requisite Earnest Money Deposit.(e-cash) the EMD should be remain in e-cash till the completion of the work including maintenance period.

The necessary certificates/documents in support of pre qualification criteria fulfilled as stipulated shall be scanned and attached to e-tender document. Scanned signature of the bidder / authorized representatives of the bidder shall be attached while uploading the bid document

Any bidder who is otherwise technically qualified withdraws from the bidding process at any stage before a final decision is taken on the tender, the EMD of such bidder shall be forfeited, the name of such bidder shall be removed from the category list of contractors at least for a minimum period of one year in KNNL, besides making such bidder liable for blacklisting (2)Bids submitted by all bidders in the process of bid evaluation will be opened even if, the bidder withdraws from the bidding process by not submitting the original documents for verification or for any other reasons and the prices quoted by them will be looked into the ascertain if there is collusion amongst the bidders to determine the competitiveness of the L1 price quoted by other bidders, as per the decision by the KNNL Board

The Contractor should pay of the earnest money deposit (EMD) in KPP PORTAL portal in any mode of payment such as, a)Credit card/ direct debit/ National Electronic Fund Transfer (NEFT) /Over the counter (OTC). The tenders without valid EMD shall be rejected. The entire EMD amount is to be paid in single transaction (2)The necessary certificates/documents in support of pre qualification criteria fulfilled as stipulated shall be scanned and attached to e-tender document. Scanned signature of the bidder / authorized representatives of the bidder shall be attached while uploading the bid document

The bidder should only submit / upload in procurement portal platform genuine certificates / documents , etc., that are as obtained from competent / concerned authorities against each required eligible criteria. Any of the submitted / uploaded certificates / documents etc., found to be fake after verification from issuing authority, then his / her EMD will be forfeited, besides proposed for making such bidders for blacklisting (2)The Bidder / Firm / Company / shall ensure credit of tender processing fee and EMD in to the respective receiving bank accounts of KPP Portal on or before the last date of bid submission (3)During technical evaluation, if the employer finds that any certificates / information furnished is false, such bidders will be disqualified and barred from participation in the bid (3)The intending bidders are advised to visit the site of work, make themselves familiar with local situation about the availability of construction materials, work men, land required for construction activities, etc (4)The royalty charges will be recovered as per the govt. Orders issued from time to time (5)The competent authority reserves the right to accept or reject any or all the tenders without assigning any reasons (6)The contractor shall be responsible for the safety of all activities on the site / loss of life/ limb/ property (7)Period of maintenance of the Scheme by the agency is for One year after the date of completion of entire works under the scheme. Amount put to tender is inclusive of maintenance charges for One year. The agency has to quote the rates including maintenance charges for one year. No extra charges will be paid for (8)The contractor whose tender is accepted shall execute the agreement within 15 days from the written intimation of acceptance of tender. Additional 30 days time may be allowed with a penalty of 0.50% of contract value(9)The Contractor whose FDR (Security Deposit) at 5% of the Approved Tender Amount submitted at the time of Agreement (10)The Contractor is responsible for any damages due to natural calamity the Government or Nigam will not give any compensation for

The Bidder shall be responsible for successful performance of the contract (2)The Bidder to participate in the tender under single bid basis only. Any violation will attract disqualification of the bid(3)If any of the dates mentioned above happen to be a general holiday, the next working day holds good (4)Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right reject any or all the tenders without assigning any reason whatsoever (5) Any change / extensions, etc in the tender schedule (calendar of events) will not be published / advertised through news papers changes will be updated on/in KPP portal only (6) The intending bidders should note that, if any of lands either in part/ parts or in whole required for the work is not acquired by the Nigam, it shall be the responsibility of the bidder to take the possession of such land and start the work by obtaining consent of the land owners before commencement of work at no extra cost to the Nigam and no claim / delays whatsoever relating to on account of non-availability of land would be entertained (7)If the percentage quoted by the contractor for the work is below ninety percent of the estimated amount put to tender or recast amount put to tender of the department, then the contractor shall furnish an additional performance security in the form of Fixed Deposit for an amount equivalent to the difference between the cost as per quoted percentage and 90% of the estimated amount put to tender or recast amount put to tender. In case of contractor quotation rates above 125% of the estimated rates then the amount over and above 125% will be withheld during the progress of work. The additional performance security will be released proportionately to the bill amount till the contractor achieves progress of the entire cost of the work as per the agreement (8) They should abide by the directions of Government towards recovery of 1% or as modified by the Government from time to time cess from the contractors bill under the provisions of building and other constructions worker welfare cess Act 1996 (9)The Tender processing charges paid by the Bidder, Firm, Company are not refundable even if the tenders are cancelled (10) Incomplete tender documents will be rejected

The Bidder/ Firm/ Company shall send the authorization letter for their representatives duly attesting their signature (2) Typographical errors, if any, will not be the ground for any claims by the Bidder/ Firm/ Company (3) Photo Copies of the work undertaken in the stages of before execution, Work under progress, and Completion of the work should be produced at the time of submitting the bill by the Contractor on his own cost (4) The evaluation of the technical bid will be done based on the information provided by the contractor in KPP portal as per his documents, duly verified if necessitates (5)The necessary certificates / documents in support of eligibility criteria to be fulfilled as stipulated shall be scanned and attached to e- tender document. The scanned copy (preferably in PDF form) of the required pre-qualification documents should be uploaded to the tender and the self-attested copies of the document of all details uploaded to the KPP Portal & original documents should be produced, for verification on the date of opening of Bid. If failed, the tender will be treated as non-responsive bid and will be rejected (6) The detailed tender notification can be obtained from the web site www.KPPP.karnataka.gov.in and linking to e-tender or from the office of the under signed (7) The bids for works remain open for acceptance for a period of one hundred eighty (180) days from the date of opening of bids. If any bider withdraws his bid before the said period or makes any modifications in the terms and conditions of the bid which are not acceptable to accepting authority then the whole amount of Earnest Money Deposit shall be forfeited to KNNL. The department is also at liberty to take any other penal action as it deems fit against such contractor (8) No interest will be paid by Karnataka Neeravari Nigam Limited on the Earnest Money deposited (9) All materials like steel, cement, blasting materials should be procured by the contractor only. The power supply (electricity) should be arranged and procured by the contractor on his own risk and cost, and First Aid facilities at each site shall be made available by the agency at his cost (10) The Agency should provide gum boots, helmets, hand gloves, safety belfts and other safety equipments for all the workers and staff at work site

Even though the agency/firm meets the qualifying criteria, they are subjected to disqualification if they have made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements and incomplete filling of details in the prequalification document and or record of poort performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation, history of financial failures etc (2) Karnataka Neeravari Nigam Ltd., Reserves the right to verify the correctness of the statements and documents furnished and inspect the jobs executed by the agency /firm, if found necessary (3) CORRUPT OR FRAUDULENT PRACTICES The employer requires that the bidder observe the highest standard of ethics during the evaluation and execution of such contracts. In pursuance of this policy, the employer (a) Defines for the purposes of this provision, the terms set forth below as follows (i) Corrupt practice means the offering giving, receiving or soliciting of any thing of value to influence the action of a public official in the evaluation process or in contract execution and (ii) fraudulent practice means a misrepresentation of facts in order to influence an evaluation process or the execution of contract to the detriment of the employer and includes collusive practice among bidders (prior to or after bid submission) designed to establish bid prices at the artificial non- competitive levels and to deprive the employer of the benefits of free and open competition (b) Will reject a proposal for award if it determines that the bidder recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question (c) Will declare a firm ineligible either indefinitely or for a stated period of time to be awarded a contract if it at any time determines that the firm has engaged in corrupt or fraudulent practices in competing for or in executing a contract All Contractors must obtain Employee Compensation Act (ECA) policy for the workers engaged under the works. And this office will not be having any liabilities under the said Act provisions
