Retro Fitment of Air Conditioning in Cabs with Provision of Thermal Insulation of cabs in Electric Locomotives.

Financial Eligibility Criteria: The tenderer must have minimum average annual contractual turnover of V/N or 'V' whichever is less; whereV= Advertised value of the tender in crores of RupeesN= Number of years prescribed for completion of work for which bids have been invited.The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover.The tenderers shall submit requisite information as per Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.

Technical Eligibility Criteria: The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited:(i)Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, or(ii)Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, or(iii)One similar work costing not less than the amount equal to 60% of advertised value of the tender.Similar Nature of Work: Similar Nature of Work for this tender shall be as follows: Manufacturing, Supply, Erection, Testing, & commissioning of: Cab air conditioning system for Electric Locos/Diesel Locos/EMUs/MEMEUs/DEMUs or Roof mounted AC package unit along with its control panel of AC Coaches/Metro coaches/EMUs, /MEMEUs/DEMUs over Indian Railway OR AMC/CAMC/Repairing/Servicing/Rehabilitation of : Cab air conditioning system for Electric Locos/Diesel Locos/EMUs/MEMEUs/DEMUs or Roof mounted AC package unit along with its control panel of AC Coaches/Metro coaches/EMUs, /MEMEUs/DEMUs over Indian Railway. OR Supply, Installation, Testing, and commissioning or Repairing or Reconditioning or AMC of Centralized AC Plants/Heating ventilation & Air Conditioning System (HVAC)/ Chiller plants for Air conditioning system over Govt. organization.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

1.The tenderer must submit attested copy of valid Electrical Contractor License issued by any state government in the name of firm as mandatory with the tenderer/offer, without submission of valid Electrical License the offer will be summarily rejected.2.Completion Period: The completion period for the work shall be 24 months from the date of receipt of the Letter of Acceptance by the contractor.3.Ordinarily, the location for carrying out this work shall be Rolling Stock Workshop, Charbagh, Lucknow. However, the Railways reserves the right for execution of the work at any other location within the boundaries of the Lucknow Municipal area and the contractor shall execute the work at such location(s) as directed by the Railways without any additional costs.4.The work shall be executed by the contractor at the specified Railway premises after arranging all necessary and requisite facilities.5. Water, Compressed air as required and necessary for execution of this work shall be provided to the contractor free of charge by the Railways at the nearest available point of supply. The Railways shall not make specific arrangements for carriage of water, air to the point of actual usage and this shall be under the scope of the contractor.6.All other items such required or as directed by Railways for execution of this work shall be under the scope of supply by the contractor.7.The contractor may need to depute suitable skilled workmen to satisfactorily execute the work on any given day. However, the requirement of manpower may vary based on actual workload and T&P etc deployed by the contractor. The contractor must therefore make his own assessment and deploy adequate manpower along with necessary T&P for satisfactory execution of the work. Lack of adequate resources resulting in unsatisfactory work shall be viewed seriously and shall invite penalties as mentioned in the GCC and herein under.8.Payment for the execution of Work shall be made on the basis of actual quantity executed satisfactorily and the accepted unit rate.9.The contractor has to complete Installation Testing and Commissioning of Air Conditioning (With or without Trough) with thermal Insulation in Cabs of Electric Locomotives within 10 days per loco from the date of handover. Otherwise penalty will impose upon the contractor.

10.PENALTY: a.The contractor should complete scheduled work of each Locomotive as per scheduled time (10 working days from allotment) otherwise penalty of Rs. 1000/- per day per Locomotive will be charged for delay delivery. b.Any adverse remark by any railway officials during inspection of housekeeping/material handling works or wastage of any material etc., a penalty Rs. 1000/- per occasion will be imposed.c.A penalty of Rs. 200/- per person per occasion will be imposed for not wearing/having PPEs as specified in as specified at relevant Para. d.Contractor will provide the list of his staff verified by SSE/E-I /ELPOH /SSE/BSR/ELPOH along with Identity card to the administration. If staff found without identity card, a penalty Rs. 200/- per staff per occasion will be imposed. e.The copy of police verification report of each staff deployed for the work by the contractor shall be submitted to Railway before start of work or in reasonable time (as decided by Railway Administration) without which gate pass shall not be prepared. At any stage of contract work, if any staff of contractor found whose police verification report not submitted or gate pass not issued, a penalty of Rs. 200/- per staff per occasion will be imposed. f.Irreversible damage to the railway property caused by careless working or improper working procedure by the contractor staff or bad workmanship which could not pass final inspection even after repeated repair / reworks by contractor shall attract penalty as specified under clause "Damage To Railway Property or Private Life & Property" as per clause no. 24 of General Condition of Contract. g.If the work is not as per instruction of consignee or satisfactory, the contractor has to do rework without any extra cost on the same day. In case, the contractor has not performed the re-work on the same day as per instruction of consignee, penalty of Rs. 1000/- per day will be imposed. h.Any excuse for late arrival/early departure/absence of required no. of labours at workplace, delay in the work, unsafe work, delay in the work due to failure of tools, plants and equipment's on contractor's account will be treated as an act of bad workmanship and penalty will be imposed as mentioned at relevant para of this document.i.In the event of causing any damage to any railway stock / component during the execution of work by him or his workmen due to mishandling or improper working or non-adherence of instructions including safety instructions by Railways, the contractor shall be liable to bear the complete cost of damage(s) and shall indemnify Railways from any liability arising on this account. The cost of such damages will be deducted from the running bills of the contractor.j.The contractor shall ensure that his workmen keep the shop floor area neat and clean and do not litter waste water, muck or any other items that make the shop floor dirty. In case of the shop floor becoming dirty due to his activities, the contractor shall ensure that such areas are immediately cleaned up by his workmen failing which a penalty of 1,000/- shall be imposed for every such instance.

k.The work has to be executed by the contractor to the entire satisfaction of the Engineer as per his instructions in accordance with the terms and conditions of this contract. In case of unsatisfactory work noticed by the Engineer or upon being brought to his notice, the contractor shall be liable for rework without any additional cost to the satisfaction of the Engineer along with imposition of penalty of up to 5,000/- in each such instance.11.Inspection:i.Inspection of the work executed shall be done by the Engineer or any other representative as nominated by the Dy. CEE/ELPOH/RSW/CB.ii.The nominated representative shall keep a record of the work executed, the satisfactory completion of the work and date and time of completion of the work.iii.The inspection record shall be signed jointly by the contractor and the Railway's representative(s) nominated for each area/activity. 12.Identification of staff :i.The contractor will employ labour not less than 18 years of age and shall provide identification card/name for their identify. The contractor should provide suitable uniform with company name to their workmen working under them for the said work so as to identify the workmen belonging to the contractor.ii.The contractor shall give the names of all concerned staff engaged by him during the execution of the contract. The entry of contractor's labour will be done on the basis of gate-pass and I-cards. All labours should be in proper uniform & uniform should be approved by Contractor/Railway.13.Payment Terms: l)Payment will be made quarterly after successfully completion of work in each quarter 1.1.1 period at RSW/ Lucknow for actual quantity executed and supported with proper certification of the official in charge as per scope of work.m)All the claims for payment shall be produced in prescribed standard bill Performa after filling measurement book and shall be accompanied with the following documents:a.Material receipt certificate i.e. receipt of material by consignee in good condition.b.Inspection by Railway Representativec.All test reports (if required) of material.d.Certificate from contractor that all material used is of CLW/RDSO approved source.Note: a)No payment will be released against supply of any material .The payment will be released only after successful completion of work.b)No payment shall be made to the contractor for idle manpower, tools plants and machinery, if clear side is not made available or otherwise. The contractor is expected to take necessary steps to avoid his losses in such cases.c)Final bill will be payable only after satisfactory completion of whole work, supported with proper certification of the official in-charge.d)Compulsory deductions (like Income Tax, surcharge, cess etc.) shall be made as per rules from the bill submitted by contractore)All the payments shall be subject to observation of all formalities viz. signing of agreement furnishing of Security Deposit, verification of power of attorney if any, MB formalities, Bill in Railways standard from etc.f)All completed work shall be jointly recorded by contractor with Railways in the duly issued "Measurement Book" which will be available with Rly's supervisor. No work, other than those recorded in MB, will be recognized.

14.Warranty:- i. The subject work in each locomotive shall be warranted by the contractor, towards the defect free service and satisfactory performance for a period of 24 months from the date of commissioning / dispatch of the locomotive from Charbagh Workshop to the respective homing shed / Railway. ii. Any defects noticed / pointed by the homing shed of the locomotive during the warranty period, which may be due to bad workmanship or any other reason on the part of contractor should be attended by the contractor free of cost. The decision of Railway in regards to the cause of failure, place and nature of rectification to be carried out by the contractor during warranty period shall be final and binding on part of contractor.iii. Any complain brought to the notice during the warranty/guarantee period shall be attended by the contractor promptly without any extra cost within 07 days time at the customer homing Electric Loco Sheds (any Zonal Railway) of this workshop, as informed by this office.15.The contractor should engage the labour whose character and antecedents have been verified before they are utilized to work in Railway. 16.The contractor shall be responsible for the general conduct and discipline of his laborers. Railway administration reserves its right to take 1.1.2 necessary action as deemed fit in all cases of misconduct/indiscipline. 17.The contractor shall be liable to pay for direct losses, damages caused to the Railway Administration by him or his workmen knowingly or unknowingly while they are in Railway premises working or not working. The amount so recovered will be determined by Dy. CEE/ELPOH/CB or his representative.18.It will be the responsibility of the contractor to ensure that all his workmen observed Industrial safety rules, procedures, methods, practices etc. The Railway Administration shall not be liable for any accident, injuries etc. to his workmen.19.After approval of LOA by Engineer, contractor shall fill the salient details of contract labours engaged in the contract and ensure updating of each wage payment to them on Shramik Kalyan portal.20.Rate of Recovery of Conservancy Cess Charges as per Railway Board L. No. F(X)I/95/1/1 dated 07.09.2021 or latest shall be followed.21. Stock of all cleaning material and all machines as per scope of work shall be maintained by contractor at all times during execution of contractI/We have read and understood the Special conditions of this tender and hereby agree to abide by them and also agree to work in accordance to these Special Conditions.
