Cleaning and Fishing right of the Main Lake and Lake near Street No. 1/D in Chittaranjan Township measuring approx. total 421044 Sqm for a period of 05 (Five) years on yearly license basis in CLW/ Chittaranjan Township

1.This Bid(s) has been invited for and on behalf of the President of India for operation of temporary fishing right in Railway area. 2.The Railway may, of its own or in response to any clarification requested/suggested by any person including that from the bids, may modify this bid document at its sole discretion before the due date of opening of the bid. 3.RESERVE PRICE: The published Reserve Price given in the bid Notice is approximate and is meant only for the guidance of the bids. 4.INSPECTION OF SITE: Before submitting bid, bidders will be deemed to have satisfied himself, by actual inspection of the site and locality, that all conditions liable to be encountered during operation of the Fishing Right are taken into account for smooth operation of the same to the entire satisfaction of the Railway. 5.EARNEST MONEY/BID SECURITY: Amount of Earnest Money @ 2% of the advertised value required to be deposited through online along with bid. Tender without prescribed Earnest money shall be summarily rejected. Earnest money will be refunded in full without any interest, to all unsuccessful bidders after completion of tender procedure. There will be no liability on the Railway Administration in case of delay in this regard. The Earnest Money of the successful bidder will be retained and adjusted towards the Security Deposit (Which is 08% of the accepted value) payable by him for the proper & satisfactory execution and due fulfillment of the term & condition of the agreement. In the event of any bidder failing to turn up after the acceptance of his bid the Earnest Money deposited by him will be forfeited by the Railway administration. In the case of withdrawal of offer before expiry of the validity period of bid, Earnest Money deposited for the instant bid shall be forfeited. If any bidder deposits the Earnest Money less than the amount as mentioned in the bid form, the bid of the bidder will be cancelled, and Earnest Money will be forfeited. 6.PERIOD OF CONTRACT: The License will be awarded to the Successful bidder for a period of 05 years as per terms & conditions of the Bid/Tender Document. However, the Railway reserves the right to reduce the period of agreement in case of necessity, and the tenderer will not be entitled to claim any compensation in this regard. 7.VALIDITY OF OFFER: The tenderer shall hold the offer open for a period of 60 days from the date fixed for the opening of the same and will extend the same for another 30 days and subsequent 30 days also in case specifically asked to do so in writing. In default thereof it will be liable to forfeiture of Earnest Money deposited by the tenderer. The Railway will not accept any bid wherein a conditional offer has been given. Such conditional offer will be outrightly rejected and earnest money will be forfeited. 8.Execution of Contract Document: The Bidder whose bid is accepted shall be required to appear in person at the office of concerned Engineer, as the case may be, or if bidder is a firm or corporation, a duly authorized representative shall appear (there would be no need for appear in person if agreement is signed digitally) and execute the contract agreement within seven days of notice from Railways that the Contract Agreement is ready. Failure to do so shall constitute a breach of the agreement affected by the acceptance of the bid. The Contract Agreement shall be entered into by Railway only after submission of valid License fees.

9.The following documents form part of Bid/ Contract specified below: (a)Special Specification and Special Conditions of Contract (Mentioned in Part- II) (b)Non-schedule items (Yearly License fees) mentioned in Part-III 10. The tenderer whose bid is accepted by Railway will be advised in due course and on receipt of such information the successful bidder has to pay license fee along with Security Deposit equivalent to 8% of the yearly offered amount in the form of Demand Draft/Net banking/cash through NEFT/RTGS in CLW Bank Account payable to PFA/CLW/Chittaranjan within 15 days from the date of issue of the letter of acceptance of offer. The security deposit will be released/refunded on satisfactorily completion of the license period of 05 year, taking into consideration that all Railway dues in this respect has been cleared. 11.The Bid security money deposited online along with the bid -through Net Banking will be retained and held by the Railway Administration as a part of security Deposit. The amount so retained including amount of Security Deposit may not exceed 10% of the overall value (05 year) of the Contract. 12.In subsequent years, the Annual License Fee is required to be paid in the form of Demand Draft or Net banking/cash through NEFT/RTGS in CLW Bank Account payable to PFA/CLW/Chittaranjan, in advance prior to the expiry of the tenure of previous year, failing which the security money will be forfeited without assigning any reason. 13.If the tenderer deliberately give wrong information in their bids or create circumstances for acceptance of their bid, Railway Administration reserves the right to reject tenders at any stage. 14.If a bidder expires after the submission of his/her bid or after the acceptance of his/her bid the Railway shall deem such bid as cancelled. Also, if a partner of a firm expires after the submission of their bid or after acceptance of their bid, the Railway shall deem such bid as cancelled unless the firm retains its character. 15.The Administration will not be responsible for ignorance of implication of the details mentioned in the Tender Documents including all terms and condition mentioned as SPECIAL SPECIFICATION AND SPECIAL CONDITIONS OF CONTRACT which must be thoroughly read and under stood by the tenderer before tendering.

Total value of License fees is Rs. 1,73,46,113.00 for 05 years. Calculation of License Fees for 05 (Five ) years are rounded in as under: 1st Year License fees Rs. 30,16,328.00, 2nd Year License fees : Rs.32,27,470.00, 3rd Year License fees : Rs 34,53,394.00, 4th Year License fees: Rs.36,95,131.00, 5th Year License fees: Rs 39,53,790.00. Mode of deposition of Licensee Fees: (a)1st year accepted License to be deposited to the Railway within 15 days from the issue of Letter of Acceptance. (b)2nd year accepted License Fee to be deposited to the Railway before expiry of the 1st year licensing period. (c)3rd year accepted License Fee to be deposited to the Railway before expiry of the 2nd year licensing period. (d)4th year accepted License Fee to be deposited to the Railway before expiry of the 3rd year licensing period. (e)5th year accepted License Fee to be deposited to the Railway before expiry of the 4th year licensing period. CONDITION FOR DELAYED DEPOSITION OF LICENSE FEES In case of failure to deposit yearly License Fee and Security Deposit before expiry of the previous year licensing period, on valid reason or circumstances, Licensee can deposit the same within 30 (Thirty) days with penal interest of 12% per annum shall be charged for the delay. In case the Licensee fails to submit the requisite yearly license fee and Security Deposit within 30 days from the stipulated time, the contract shall be terminated duly forfeiting Earnest money. The failed Licensee shall be debarred from participating in re-tender for fishing right of any lake in Chittaranjan township

SPECIAL SPECIFICATION AND SPECIAL CONDITIONS OF CONTRACT: 1. The Principal Chief Engineer/Deputy Chief Engineer/ Sr. Assistant Engineer of CLW are the final Authority to accept the bid but are not bound to accept the highest bid. The authority also reserves the rights of rejection any tender/tenders without assigning reasons and no claim on this account will be entertained. 2. Area of lake/lakes are purely approximate, no claims will be entertained by the Railway regarding this issue. 3. No permission for fishing rights will be granted to the successful bidder until the full amount of 1st year license fee and balance security deposit (08% of 1st year offered value) is deposited to CLW Administration 4. The successful bidder in whose favour, the bid has been accepted shall have to deposit full amount of 1st year license fee and balance security deposit (08% of 1st year offered value) within 15 days of issue of Letter of Acceptance. On compliance of the same an agreement will be executed. In case of failure to pay 1st year License Fee and Security Deposit, within stipulated date, a penal interest of 12% per annum shall be charged for the delay beyond 15 (Fifteen) days, i.e. from 16th day from the issue of Letter of Acceptance. In case the Licensee fails to submit the requisite 1st year license fee and Security Deposit within 30 days from the issue of Letter of Acceptance. The contract shall be terminated duly forfeiting Earnest money. The failed Licensee shall be debarred from participating in re-tender for fishing right of the lake 5. Annual License Fee Charges of Subsequent Years: The period of license will be 5 years from the date of license commencement. The license fee for the first year will be the bidder's offer accepted by the Railway Authority (Let "A"). For each subsequent year, the license fee will escalate by 7% over the previous year's fee. The calculation structure is as follows: • 1st Year : A (Accepted Bid Amount) • 2nd Year: B = A + (A x 07%) • 3rd Year: C = B + (B x 07%) • 4th Year: D = C + (C x 07%) • 5th Year: E = D + (D x 07%) 6. Licensee must pay the yearly license fee and Security deposit amount @ 08% of respective year within the stipulated date, which are as mentioned below: (i) 1st year License Fee + Balance amount of Security Deposit : within 15 days from the date of issue of LOA. (ii) 2nd year License Fee + Security Deposit amount : should be deposited before expiry of the first year licensing period (iii) 3rd year License Fee + Security Deposit amount: should be deposited before expiry of the second year licensing period (iv) 4th year License Fee + Security Deposit amount: should be deposited before expiry of the third year licensing period (v) 5th year License Fee + Security Deposit amount: should be deposited before expiry of the fourth year licensing period 7. For proper maintenance of lakes, initially cleaning of lakes should be done within 30 days or as early as possible after issuing of Letter of Acceptance. 8. The licensee shall obtain permission from the Principal Chief Engineer/Deputy Chief Engineer or Sr.Assistant Engineer to exercise fishing rights in the lake. All deployed workers must carry a valid identity card duly authorized by the licensee. No worker will be allowed in the lake area for any purpose without a valid identity card.

9. Maintenance of Lakes:- (A) The licensee shall maintain the lakes in a neat & clean and hygienic. This requires the regular, systematic removal of all vegetation, carcasses, plastics, and other hazardous materials, as per requirement or as decided by the Site Engineer otherwise the Railway Administration shall issue a non-compliance notice directing the licensee for cleaning the lake. (B) The licensee shall remove all mud, clay, silt, vegetation, night soil, and plastics etc. up to a width of 10 metres from the edge of the bank of lake, or as directed by the Site Engineer. All cleared waste materials must be deposited to area approved by the site Engineer. (C) The licensee must successfully rectify all noted deficiencies and restore the lake to the required standard within 10 days from the date of issuance of the non-compliance notice (D) If the licensee fails to comply with the notice within the stipulated 10-day period, a penalty of 2,500/- per day per lake will be charged. This penal charge will start from the 11th day of the non-compliance notice and will continue until the rectification of deficiencies is certified by the Site Engineer. (E) If the licensee fails to rectify the deficiencies within 30 days from the date of the initial notice, the Railway Administration reserves the right to terminate the contract/license immediately and forfeit the entire Security Deposit. 10. No temporary structure, even katcha structure can be constructed without prior approval of Engineer. No other activity will be allowed in the area beside the lake except related to fishing. 11. No explosive should be used for fishing purposes. For fishing wooden boats to be used, no other boat will be allowed. 12. claim shall be entertained on account of less production in fishing from the lake. 13. The Railway Administration will not be responsible if fishes are stolen from the lake. 14. The licensee has full right to sell the fish outside market and railway shall not interfere in this regard. 15. No free passes what so-ever for travelling by rail will be allowed to the licensee in connection with this license. 16. The Railway will not be responsible for any damage or loss caused by or occurring during any force majeure event or natural disaster such as accidents, pilferage, theft, floods, washouts, earthquakes, cyclones, droughts, strikes, or epidemics and will not be liable for any compensation in this regard. 17.The licensee should provide full safe guard of the environment of the lake and provide protection to migratory birds when migratory birds are taking shelter in the lakes. Fishing to be done without disturbing the birds using the lake. For safety of migratory birds to be kept in top priority during fishing from the period from 15th November of the year to 15th March of the year. 18. In the license for right of fishing, drainage or procedure which is likely to foul water or render it muddy and unfit for drinking purpose will not be permitted. All fishing operations whether by net or rod must be carried out from the bank or from a boat or platform made for the purpose without spoiling the water. 19. If the lakes are required for exclusive administrative purposes, the Administration may use the lakes for such requirement by giving a 30 day prior notice to the licensee. The Administration shall not be liable for any compensation or damages on this account.

20. The licensee are responsible to see that he/she keep all the crossings clear within the area of the license and clear jungles, surface, hyacinths etc from safety point of view. 21. The licensee will have to arrange for seedlings from authorized dealers at their own costs. 22. The licensee shall not add manure or any fish food or any chemicals to the lakes which may pollute the water or make the water unhygienic and unhealthy harmful to migratory birds coming to the lake and those are prohibited by the Government of India or State Government. 23. The Railway reserves the rights to carry out necessary anti-mosquito measures or other measures on the lakes in general interest of public health. 24. The Railway shall be at liberty to withdrawal of water for emergency purpose and re-excavate the lakes or also undertake repair to the bunds, pipelines etc. as and when necessary at its discretion and the Railway shall not be liable to pay any compensation. The Railway shall not be responsible or liable for any damage or loss that may be suffered or sustained by the licensee for natural drying out of the lakes or due to causes beyond the control of the administration. Using water from the lake for reasons of natural scarcity of water in the Railway premises shall be deemed to be natural drying out. 25. The Railway reserves the full right to draw water from the lakes throughout the year to maintain the water supply to the CLW Complex, for construction works, production work and other purpose and the licensee shall not be entitled to claim on damage or compensation or deduction in license fee regarding the same. 26. The Railway reserves the right to operate valves provided at different positions of lakes /dams to decrease / increase the water level of the lakes /dam for the safety of the structure. 27. The Railway shall have free access at all time for inspection of the said lake and shall have the right to construct / install any asset in or at the site of lakes as may be required. If the administration requires lowering the water level for the purpose, the licensee will be given due intimation. 28. The licensee shall not disturb and/or tamper the system surrounding the lake to retain the water and shall take all precautions to ensure that no damage is caused to the valves and its accessories fitted in the lakes. 29. The licensee will not be allowed to pump out water from the lake and to dry it up without permission of Railway Administration. 30. No tree or plants are to be injured by the licensee. 31. The licensee will be responsible to prevent/dispute any unauthorized encroachment or withdrawal of water from the lake by unauthorized person and shall promptly bring to the notice of the Railway Administration any such incident. 32. Water to be maintained in drinkable condition as the lake water is used for Workshop and Colony water supply of CLW. No chemical to be used in feeding fishes which gives toxic effect to the lake water. 33. No poaching of migratory and Indian birds is permitted. If it is noticed, then action will be taken as decided by Environment Department of the Government. 34.Do not allow washing of animals and grazing in the lake. 35. Railway have full authority to utilize the lakes for boating, aquatic events like swimming, boat racing, to allow the lakes for ceremonials/culture activities.

36.On the expiry of the period of license, it shall be binding on the licensee to vacate the Railway land by dismantling the structure constructed as may be permitted by Railway. 37.In the event of any irregularity or disputes in respect of possession after deposit of required license fee, the decision of Principal Chief Engineer/Dy.Chief Engineer is final and binding upon the licensee.
