If the foundation of the structure is in an area with stagnant water or water is met with in the excavation due to spring seepage rain and other courses it shall be remove by suitable diversion boiling out or pumping as directed and the area of foundation or embankment shall be kept dry any loss to the public or private property during the course of excavation shall be the sole responsibility of the contractor which shall have to be duly compensated by him at his own cost in all cases.
