Railways shall purchase this item from Pharma CPSEs approved by Railway Board. CPSE firms should invariably comply with the terms and conditions as mentioned in Railway Board letter No. 2010/H/4/1/1 dt.24.02.21 attached to this tender as ANNEXURE

Firm should attach the documentary evidence/proof of payment of Rs.50,000/- for registration with Railway Board etc.. for a period of 3 years. (Firms who are appearing in the list of firms advised by Railway Board that they have deposited the amount, are automatically eligible The condition of payment Rs.50,000/- of registration fee to Railway Board is not applicable to CPSE firms.

In case Pharma CPSEs fail to quote for the medicines, the procuring entity would be at liberty to make purchases from other Railway Board approved sources. If the Pharma CPSEs fail to perform as per P.O, they would also be subject to payment of liquidated damages or any other penalty as per IRS Conditions of Contract

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

IRS Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.
GENERAL TENDER CONDITIONS: The Contract shall also be governed by latest version (along with correction slips) of General Tender Conditions and Instructions to Tenderers.
