A. Instruction to Bidders
i. Content of the Bid Document
1. This Tender document is structured to provide prospective bidders with sufficient information
on which to prepare the bid and is organized in the following manner:

ii. Clarification of Bidding Documents
2. Bidders requiring any clarification on the bidding documents or questions on any matter that
may be raised at that stage, may send their queries in written, addressed to contact person as
mentioned in the Bid Data Sheet, latest by one day before the pre-bid meeting date mentioned
in the bid data sheet. The responses of the Authority will be uploaded only on the website
https://tender.nprocure.com/and shall not be communicated separately or individually to the
3. The Authority shall endeavour to respond to the questions raised or clarifications sought by the
bidders. However, the Authority reserves the right not to respond to any question or provide
any clarification, in its sole discretion, and nothing in this clause shall be taken or read as
compelling or requiring the Authority to respond to any question or to provide any clarification
which will have material adverse effect on the bidding outcome.
4. The Authority may also on its own motion, if deemed necessary, issue interpretations and
clarifications to all bidders. All clarifications and interpretations issued by the Authority shall
be deemed to be part of the bidding documents. Verbal clarifications and information given by
Authority or its employees or representatives shall not in any way or manner be binding on the

5. At any time prior to the deadline for submission of proposals, the Authority may amend the
Tender documents, including any Concession Agreement, by issuing an Addendum.

by fax to all short-listed bidders to whom the Tender documents are issued. The Authority bears
no obligation for any bidder not receiving the information of the addendum issued to this Tender
for any reason whatsoever.
iv. Conflict of Interest
7. A bidder shall not have the conflict of interest (the “Conflict of Interest”) that affects the bidding
process. Any bidder found to have a conflict of interest shall be disqualified. In the event of
disqualification, the Authority shall forfeit and appropriate the bid security or performance
security, as the case may be. Without limiting the generality of the above, a bidder shall be
considered to have a ‘conflict of interest’ that affects the ‘Bidding Process’, if:
i. Such bidder (or any constituent thereof) and any other bidder (or any constituent
thereof) have common controlling shareholders or other ownership interest; Or;
ii. A constituent of such bidder is also a constituent of another Bidder; Or;
iii. Such bidder receives or has received any direct or indirect subsidy from any other
bidder, or has provided any such subsidy to any other bidder; Or;
iv. Such bidder has the same legal / authorised representative for purposes of this bid as
any other bidder; Or;
v. Such bidder has a direct relationship with another bidder, that puts them in a position to
have access to each other’s information about, or to influence the bid of either or each
of the other bidder.
8. A bidder shall be liable for disqualification and forfeiture of bid security or performance security
and termination of contract as the case may be, if a conflict of interest on part of bidder is
discovered by the Authority during the bidding process or at the time of issue of letter of award
(LoA) or during the execution of the contract.

B. Preparation of Bids
i. Procedure for Participation in e-Tendering

10. Interested bidders can view detailed tender notice and download tender documents from the
above-mentioned website.
11. Bidders who wish to participate in online tender have to register with the website through the
“New User Registration” link provided on the home page. Bidder will create login id &
password on their own in registration process.
12. Bidders who wish to participate in this tender need to procure Digital Certificate as per
Information Technology Act-2000 using that they can digitally sign their electronic bids.
Bidders can procure the same from any of the CCA approved certifying agencies, or they may
contact (n) code Solution at below mentioned address and they will assist them in procuring the
same. Bidders who already have a valid Digital Certificate need not to procure the same. In case
bidders need any clarification regarding online participation, they can contact

13. Bidders who wish to participate in e-Tender need to fill data in predefined forms of tender fee,

iii. Preparation and Submission of Bids
17. The bidders have to prepare their bid online, encrypt their bid data in the Bid forms and submit
Bid of all the envelopes and documents related to the Bid required to be uploaded as per the
time schedule mentioned in the key dates provided in this tender document dafter singing of the
same by the Digital Signature of their authorized representatives.
i. Bidders are requested to visit our e-tendering website regularly for any clarifications and/or due
date extension or corrigendum.
ii. Bidder must positively complete online e-tendering procedure at given website.
iii. The Authority shall not be responsible in any way for delay/difficulties/ inaccessibility of the
downloading facility from the website for any reason whatsoever.
iv. In case, due date for submission & opening of bids happens to be a holiday, the due date shall
be shifted to the next working day for which no prior intimation will be given.
v. The Authority reserves the right for extension of due date of opening of technical bid.
iv. Bid Validity Period
18. The bids shall remain valid for a period specified in Bid Data Sheet from the due date of biding
as prescribed by the Authority. The validity of the bid can be extended by mutual consent in

19. The Tender Document shall be available for download to concerned eligible bidders
immediately after online release of the bids and up to scheduled time and date as set in the key
dates. The bid document can be downloaded free of cost; however, the bidders have to pay bid
document fees, of the amount as mentioned in the bid data sheet, at the time of their online bid
submission. The payment for the cost of bid document must be made in the form of Fix
Deposit/Demand Drafts exclusively from authorized banks as listed in Appendix-3, payable to

20. Shall be Paid as per Bid Data Sheet.
21. No interest shall be payable on the EMD. The Bidder shall bear the cost relating to providing
its EMD. Any bid not accompanied by the EMD shall be rejected by the Authority as being a
non- responsive Bid.

22. The EMD of unsuccessful bidders will be returned within 30 days (or after the date of work
order of L1 bidder, whichever is later) of the date of finalization of successful Bidder or signing
of the Concession agreement with the successful bidder whichever is later. If the Bid is
cancelled for any reason whatsoever, the EMD shall be returned to all the bidders within
days from the date of such cancellation.
23. The EMD of the successful Bidder will be retained by the Authority and returned after 15 days
of signing of Concession agreement and furnishing the performance guarantee by the successful
bidder. The successful bidder shall ensure that its EMD remains valid during such period.
24. The EMD will be forfeited if:
i. Any bidder withdraws its bid during the validity period of the bid;
ii. The Authority finds out that the bidder has involved in corrupt and fraudulent practice
or has given any material miss-representation in its bid knowingly or unknowingly
iii. Any other reason thereof mentioned in this bid document.
vi. Technical Proposal
25. The Technical Proposal shall comprise of the following documents
(i) Essential Qualification Documents as specified in this tender.
(ii) Technical Bid comprising of the documents in prescribed formats attached in Annexure.
26. All the documents/ information enclosed with the technical proposals should be self- attested
and certified by the Bidder. The bids will be technically disqualified if it is not provided as per
the required formats or any missing documents found online and hard copy.
vii. Financial Proposal / Price Bid
27. The bidder shall quote for the complete requirement of goods and services specified in the
schedule of requirements detailed in the Draft Concession Agreement (Volume II), failing
which such bid will not be taken into account for evaluation and will not be considered for

29. The price quoted by the bidder shall be entirely in Indian currency (INR).

30. The Amount in the Financial Proposal shall be quoted in figures as well as in words. If any
difference in figures and words found, lower of the two shall be taken as valid and correct.
31. The rates and prices quoted by the bidder shall be fixed for the duration of the contract and shall
not be subject to any adjustments on any account.
viii. Documents Comprising the Bid
32. The Bid submitted by the bidder shall comprise of the following parts:

ix. Alternative Proposals by Bidders
33. Bidders shall submit offers that fully comply with the requirements of the TENDER, including
the conditions of contract (payments or time for completion), basic technical design as indicated
in the drawing and specifications. Conditional offer or alternative offers will not be considered
further in the process of Bid evaluation.
x. Format and Signing of Bid
34. The Bidder shall prepare copy of the documents comprising the bid as described in Bid Data
Sheet, bound with the volume containing the "Technical Bid" in separate parts and clearly
marked "ORIGINAL" as appropriate. In the event of discrepancy between them, the original
35. The original and copy of the Bid shall be typed or written in indelible ink and shall be signed
by a person or persons duly authorized to sign on behalf of the Bidder, pursuant to Sub- Clauses.
36. All pages of the bid where entries or amendments have been made shall be initialled by the
person or persons signing the bid.
37. The Bid shall contain no alterations or additions, except those to comply with instructions issued
by the Authority, or as necessary to correct errors made by the bidder, in which case such
corrections shall be initialled by the person or persons signing the bid.
xi. Language of Bid
38. The bid and all related correspondence and documents shall be written in the English language.

may be in any other language provided that they are accompanied by an appropriate translation
into English. Supporting materials that are not translated into English shall not be considered.
For the purpose of interpretation and evaluation of the Proposal, the English language
translation shall prevail.

C. Submission of Bids
i. Online submission of Bids
39. The bidders have to submit their respective bids online, as per the instructions provided on the
website www.tender.nprocure.com for online submission of bids. The bidders shall submit
their bids dully completed in all respect on or before the due date of bid submission as per Bid
ii. Physical Submission of Bids (if Applicable as per Bid Data Sheet)
40. The bidders have to submit Technical Proposal in original physical form (“the physical bid
submission”) within the date and time for physical bid submission as mentioned in the Bid data
41. The physically submitted bid, “The Technical Proposal”, shall be typed or written in indelible
ink and signed by the authorized signatory of the Bidder (Photocopy/ Scanned Copy of the
signature will not be accepted). The pages in Proposal should be numbered. Each page shall be
initialled by an authorized signatory of the Bidder. All alterations, omissions, additions, or any
other amendments made to the Proposal shall also be initialed by the person(s) signing the
42. The physically submitted bid shall be enclosed in a sealed envelope, and superscripted as
“Physical Submission of Technical Proposal For (Insert Name of Work)”. The envelope shall
bear the due date of physical bid submission, name and address of the authorized signatory of
the bidder and shall be addressed as mentioned in the Bid data sheet.
43. The Authority expects bidders to adhere to the sealing and marking instructions given above
and assumes no responsibility for the misplacement or premature opening of the contents of the
proposal submitted.
iii. Bid Due Date
44. The due date and time of the bid submission is as mentioned in the Bid data sheet. The online
bid and the physical bid should be submitted on or before the due date of bid submission. The
Authority may, in its sole discretion, extend the bid due date by issuing an Addendum in
accordance with clause in this tender uniformly for all bidders and publish on the website

iv. Withdrawal, Substitution and Modification of Bids
45. Bidders can withdraw and modify their respective online submitted bids till the end of the due
date of bid submission. The bidder will not be able to modify a bid after the due date of
submission of these bids. The bid for which withdrawal request has been received by the
Authority after the due date of bidding shall be declined from the bidding process. In the event
of withdrawal of a Bid by the Bidder, after the due date of its submission, the authority reserves
the right to forfeit the EMD of the bidder at its sole discretion.

D. Bid Opening and Evaluation
i. Procedure for Bid opening and Evaluation
46. The Authority designated officer will open the bids online on the bid opening date and time as
specified in the Bid Data Sheet. The Authority designated officer will subsequently examine
and evaluate the bids in accordance with the provisions set out in this section.
47. Proposals shall first be checked for responsiveness with the requirements of the tender and only
those proposals which are found to be responsive would be further evaluated for qualification
in accordance with the criteria set out in this Tender.
48. The Technical proposal shall be evaluated on the criteria set out in this TENDER documents.
The Financial bids of only those bidders who qualifies the technical qualification shall be
opened. All technically qualified bidders will be notified for opening of the Financial Bids.
49. Authority have right to reject or accept any bid if there is conflict between bidder & Authority.
Authority and Bidder shall decide to appoint arbitrator if there is legal Conflict between bidder
ii. Clarifications
50. To facilitate evaluation of proposals the Authority may, at its sole discretion, seek clarifications
from any bidder during the evaluation period. Such clarification(s) shall be provided within the
time specified by the Authority for this purpose. Any request for clarification(s) and all
clarification (s) shall be in writing. If a bidder does not provide clarifications sought within the
prescribed time, its Proposal shall be liable to be rejected. In case the Proposal is not rejected,
the Authority may proceed to evaluate the Proposal by construing the particulars requiring
clarification to the best of its understanding, and the Bidder shall be barred from subsequently
questioning such interpretation of the Authority.
51. Bidders are advised that the evaluation of proposals will be entirely at the discretion of the
Authority. Bidders will be deemed to have understood and agreed that no explanation or
justification on any aspect of the Bidding Process or selection will be given.
52. Any information contained in the proposal shall not in any way be construed as binding on the
Authority, its agents, successors or assigns, but shall be binding against the bidder if any project
is subsequently awarded to it under the bidding process on the basis of such information.
53. The Authority reserves the right not to proceed with the bidding process at any time without
notice or liability and to reject any proposal without assigning any reasons.

54. The Authority shall ensure that the rules for the bidding proceedings for the project are applied
in a non-discriminatory, transparent and objective manner. The Authority shall not provide to
any bidder information with regard to the project or the bidding proceedings, which may have
the effect of restricting competition.
55. Information relating to the examination, clarification, evaluation, and recommendation for the
short-listed pre-qualified bidders shall not be disclosed to any person who is not officially
concerned with the process or is not a retained professional advisor advising the Authority in
relation to or matters arising out of or concerning the bidding process. The Authority will treat
all information, submitted as part of proposal, in confidence and will require all those who have
access to such material to treat the same in confidence. The Authority may not divulge any such
information unless it is directed to do so by any statutory entity that has the power under law to
require its disclosure or is to enforce or assert any right or privilege of the statutory entity and/
or the Authority.
56. Any effort by a bidder to influence Authority’s evaluation of bids or award decisions will result
in the rejection of the bidder’s Bid.
iv. Bid Evaluation Process & Criteria
57. Envelope 'A' shall be opened first online at the time and date notified and its contents shall be
checked. In cases where Envelope 'A' does not contain all requisite documents, such bid shall
be treated as non-responsive, and Envelope "B" and "C" of such bid shall not be opened.
58. In the next step of evaluation, the Envelop ‘B’ shall be opened online at the time and date
notified. The bidder shall have freedom to witness opening of the Envelope ‘B’ of the Bid
59. A detailed Technical Evaluation of the responsive bids shall be carried out and the bidder shall
be considered technically qualified if:
i. The online bid has been submitted in the manner as specified in this tender.
ii. The technical proposal contains all the documents as specified in this tender.
iii. Physical bid had been received by the Authority within the specified time and it contains
all the documents in original and has been submitted in the manner as specified in this Bid
iv. It is fulfilling the Qualification Criteria as specified this tender and furnished all the
necessary support documents in support of such qualification.
v. It has provided all the other information and documents as directed in this tender document

corresponding to the technical qualification of the bidder.
vi. The Technical Proposal will be evaluated on the basis of Qualification Criteria Laid in the
tender, Bidders experience, its understanding of scope of work and scope of services.
60. Envelope 'C' (Financial Proposal) of bidders who are not qualified in Technical Bid
(Envelope 'B') shall not be opened.
61. Envelope 'C' (Financial Proposal) of the technically qualified bidders shall be opened online
at the date time & notified by the Authority. The bidder shall have freedom to witness opening
of the Envelope 'C'.
62. After opening Envelope 'C' the Financial proposal shall be checked for responsiveness. A
Financial Proposal shall be responsive if it has been submitted in the manner as specified in this
TENDER. If the financial proposal of a bidder is non-responsive, it shall be declined from the
bidding process.
63. All the responsive Financial Bids would then be ranked in ascending order of the quoted
financial offer, with the Bidder quoting the lowest shall be ranked First as “L1” and the Bidder
quoting the second lowest Financial offer shall be ranked Second as “L2” and so on.
64. The Financial Bids will be evaluated under Least Cost Selection (LCS) after evaluation as
indicated above. All the responsive Financial Bids would then be ranked in ascending order of
the total evaluated Bid Price, and the lowest evaluated bid price of the Bidder shall be ranked
First as “L1” and the second lowest evaluated bid price of the Bidder shall be ranked First as
“L2” and so on.
v. Successful Bidder
65. The Bidder ranked first (the “L1”) in accordance with the above procedure would be declared
as the successful Bidder.
66. In the event that two or more Bidder’s Financial Bids are exactly the same, then the Authority
reserves the right either to:

E. Award of Contract
i. Negotiations & Post qualification
68. The Authority will determine to its satisfaction whether the bidder that is selected as having
submitted the lowest evaluated responsive bids meets the criteria specified in this tender and is
qualified to perform the contract satisfactorily.
69. The determination will take into account the bidder's financial, technical, production capabilities
etc. It will be based upon an examination of the documentary evidence of the bidder's
qualifications submitted by the bidder, as well as such other information as the Authority deems
necessary and appropriate.
70. The Authority may either choose to accept the Rates of the Preferred Bidder or invite him for

71. Subject to clause specified in this tender, the Authority will award the contract to the successful
bidder whose bid has been determined to be substantially responsive and has been determined
as the lowest evaluated price, provided further that the bidder is determined to be qualified to
perform the contract satisfactorily.
iii. Right to vary Quantities
72. Usually there shall be no change in the quantity of works to be done. The selected bidder shall
have to follow the plan as submitted in the technical bid and presentation. However, during the
contract duration for better performance the selected bidder shall be free to vary quantities after
getting a written consent by the Authority. The Authority shall have a right to allot partial works
or full works based on the offer received from the bidder.
iv. Authority's Right to Accept Any Bid and to Reject Any or All Bids
73. The Authority reserves the right to accept or reject any bid, and to annul the bidding process
and reject all bids at any time prior to contract award, without thereby incurring any liability to
the affected bidder or bidders’s.

v. Notification of Award
74. Prior to the expiration of the period of bid validity, the Authority will notify the successful
bidder (the “L1”) in writing by registered letter or email that its bids have been accepted &
issue a 'Letter of Award' (LOA) as per format provided in the tender.
75. The successful Bidder shall acknowledge his acceptance of the ‘LOA’ issued by the Authority
within 7 (seven) days as evidenced by signing and sending a copy of the ‘LOA’ issued. In the
event the duplicate copy of the ‘LOA’ duly signed by the Authorized signatory of the selected
bidder is not received within the stipulated date, the Authority may, unless it consents to
extension of time for submission thereof, appropriate the EMD of such bidder on account of
failure of the selected bidder to acknowledge the ‘LOA’.
76. The notification of award will constitute the formation of the Contract. The Draft of the
Concession Agreement is attached with the tender.
vi. Performance Security
77. Upon issue of LOA, the successful bidder shall have to furnish Performance Security within
days to the Authority in the form of bank guarantee (“the Performance Bank Guarantee” (PBG)
issued by a Bank as per list attached in Appendix-3 only. It Should be in the appropriate format,
for an amount equivalent to (as per Bid Data Sheet).
78. Failure of the successful bidder to comply with the requirements of above clause, shall
constitute a breach of contract, cause for annulment of the award, forfeiture of the EMD, and
any such other remedy the Authority may take under the contract, and the Authority may resort
to awarding the contract to the next ranked bidder.
79. The PBG shall be valid for 1 Year and is required to be renewed (before expiry) annually till
the end of Project Term. The PBG shall be reduced to amount specified in Bid Data Sheet
upon the commencement of the operation period.
80. The proceeds of the PBG shall be payable to the Authority as compensation for any loss
resulting from the Bidder’s failure to complete its obligations as per the concession agreement.
vii. Signing of Contract Agreement
81. Upon Submission of PBG as directed in clause above and the selected Bidder and authority
shall sign the concession agreement within 21 days.
82. The signing of agreement shall be reckoned as intimation to commencement of work. No
separate work order shall be issued by the Authority to the selected Bidder for commencement

83. In the event of failure of the successful bidder to submit PBG and or sign the Contract
agreement, his EMD shall stand forfeited without prejudice to the right of the Authority for
taking action against the bidder.

F. Fraud and Corrupt Practices
84. The Bidders and their respective officers, employees, agents and advisers shall observe the
highest standard of ethics during the Bidding Process and subsequent to the issue of the LoA
and during the subsistence of the Contract Agreement. Not with standing anything to the
contrary contained herein, or in the LoA or the Contract Agreement, the Authority shall reject
a Bid, withdraw the LoA, or terminate the Contract Agreement, as the case may be, without
being liable in any manner whatsoever to the Bidder or Selected Developer, as the case may be,
if it determines that the Bidder or Selected Developer, as the case may be, has, directly or
indirectly or through an agent, engaged in corrupt practice, fraudulent practice, coercive
practice, undesirable practice or restrictive practice in the Bidding Process. In such an event,
the Authority shall forfeit and appropriate the EMD or Performance Security, as the case may
be, is found by the Authority to have directly or indirectly or through an agent, engaged or
indulged in any corrupt practice, fraudulent practice, coercive practice, undesirable practice or
restrictive practices, as the case may be.
85. For the purposes of Clause above, the following terms shall have the meaning hereinafter
respectively assigned to them:
i. Corrupt Practice means (i) the offering, giving, receiving, or soliciting, directly or
indirectly, of anything of value to influence the actions of any person connected with the
Bidding Process (for avoidance of doubt, offering of employment to or employing or
engaging in any manner whatsoever, directly or indirectly, any official of the Authority
who is or has been associated in any manner, directly or indirectly with the Bidding Process
or the LoA or has dealt with matters concerning the Contract Agreement or arising there
from, before or after the execution there of, at any time prior to the expiry of one year from
the date such official resigns or retires from or otherwise ceases to be in the service of the
Authority, shall be deemed to constitute influencing the actions of a person connected with
the Bidding Process) ; or (ii) engaging in any manner whatsoever, whether during the
Bidding Process or after the issue of the LoA or after the execution of the Contract
Agreement, as the case may be, any person in respect of any matter relating to the Project
or the LoA or the Contract Agreement, who at any time has been or is a legal, financial or
technical adviser of the Authority in relation to any matter concerning the Project;
ii. Fraudulent practice means a misrepresentation or omission of facts or suppression of facts
or disclosure of incomplete facts, in order to influence the Bidding Process;
iii. Coercive practice means impairing or harming or threatening to impair or harm, directly

employed or engaged by the Authority with the objective of canvassing, lobbying or in any
manner influencing or attempting to influence the Bidding Process; or (ii) having a Conflict
of Interest; and
v. Restrictive practice means forming a cartel or arriving at any understanding or arrangement
among Bidders with the objective of restricting or manipulating a full and fair competition
in the Bidding Process.

62 Lights & Wiring
All wiring need to be of ISI Specified quality and concealed. The Switches need to be of
standard ISI Brand. The Switch boards need to be poly carbonate.
Painting of full vehicle exterior with PU paint. Paint shall be of Superior quality to ensure
long lasting structure life suitable to use under corrosive operations. Prior to painting 1 coat
of anti-corrosive zinc based primer/red oxide shall be applied as per the paint manufacturing
standard. The outside shall be painted as per Porbandar Municipal Corporation - colour
scheme of first quality paint.
- All angle and channels and other raw materials are as per Indian standard.
- All MS material shall be of Tata / SAIL / Jindal / Vishakhapatnam steel/ Essar / Ispat/
(for angle/ channel if not available of above brand then it shall be of IS/ISO
approved make) only. Contractor has to submit necessary test report and/or invoice
88. Procurement period (i.e. Delivery Period):- The total procurement period is 30 days. Other
wise late delivery will be considered for such delay period. However, delivery period will
commence from the date of invoice of chassis to the unit manufacturer by chassis supplier.
However unit manufacturer must have to issue complete procurement order (as per the
requirement of chassis supplier) to the chassis supplier immediately within 7 days from the date
of receipt of Work Order order. Other wise late delivery will be considered for such delay
89. Delivery Schedule:- As per requirement the Authority, will give delivery schedule (if delivery
required in staggered manner/delay) to the successful bidder. The price quoted by the Bidder,
will be valid for the entire procurement period, which will be binding to the supplier. Further
this rate contract will be valid for one year from the date of purchase order during which if
Authority requires extra quantity, same shall be supplied by contract at same approved rate and
terms conditions. However, actual number of procurement will be at the sole discretion of

90. Delivery location: Porbandar, Gujarat at site specified by Authority
91. Payment Terms:- The Payment Shall be made after delivery of all the physical parts at the site
and successful completion of commissioning and trial done by Municipal Corporation. No part
payment will be made between any stage of work. The Payment shall be made upon
submission of the following documents:
(i) All Documents and Copies of the supplier's invoice in favors of The Municipal
Commisionner Porbandar in Original.
92. Transit Insurance:- The Selected Bidder is responsible for transit and all other insurances (if
required) till the equipments are delivered at the location mentioned in the Procurement Order.
- The Selected Bidder warrants that the Goods supplied under this Contract are new, unused, of
the most recent or current models and those they incorporate all recent improvements in design
and materials unless provided otherwise in the Contract. The Selected Bidder further warrants
that all Goods supplied under this Contract shall have no defect arising from design, materials
or workmanship (except when the design and/or material is required by the Purchaser's
Specifications) of from any act or omission of the Supplier, that may develop under normal use
of the supplied Goods in the conditions prevailing in the country of final destination.
- This warranty shall remain valid for 12 months after the Goods or any portion thereof as the
case may be, have been delivered to and accepted at the final destination indicated in the
Contract or as specifically mentioned in the work order.
- The Authority shall promptly notify the Selected Bidder in writing of any claims arising under
this warranty. Upon receipt of such notice, the Selected Bidder shall, within 15 days and with
all reasonable speed, repair or replace the defective Goods or parts thereof, without cost to the
- If the Selected Bidder, having been notified, fails to remedy the defect(s) within the period
specified above, the Authority may proceed to take such remedial action as may be necessary,
at the Selected Bidder's risk and expense and without prejudice to any other rights which the
Authority may have against the Supplier under the Contract.
94. Performance Guarantee:- The performance guarantee shall be returned to the Selected Bidder
without any interest on the successful completion of the warranty period when the contract
ceases to be under any obligation.

95. Force Majeure:- Notwithstanding the provisions of tender, the Selected Bidder shall not be
liable for forfeiture of its performance security, liquidated damages or termination for default,
if and to the extent that, its delay in performance or other failure to perform its obligations under
the Contract is the result of an event of Force Majeure. If a Force Majeure situation arises, the
Selected Bidder shall promptly notify the Authority in writing of such conditions and the cause
thereof. Unless otherwise directed by the Authority in writing, the Selected Bidder shall
continue to perform its obligations under the Contract as far as is reasonably practical, and shall
seek all reasonable alternative means for performance not prevented by the Force Majeure
For purposes of this Clause, "Force Majeure" means an event beyond the control of the Supplier
and not involving the Supplier's fault or negligence and not foreseeable. Such events may
include, but are not limited to, acts of the Purchaser either in its sovereign or contractual
capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight
96. Taxes and duties:- All taxes and duties shall be included in the quoted price. Bidder has to
quote the total price, net including of all taxes & duties etc. and for evaluation and finalisation
purpose, the total price will be taken in to consideration. Transportation, Packing, Forwarding,
Insurance charges are included in the indicated price. However any change in the GST, govt.
statutory levies will be considered at actual for which contractor will have to submit necessary
documentary proofs as required by department.
97. Inspection:- The Selected Bidder will specify, make arrangement (all expenditures will be bear
by Selected Bidder) for inspection of any parts, vehicles, equipments at any site of
manufacturing/ fabrications” by any officials of the Authority &/or Third Party (if required)
along with officials of the Authority, before delivery at the site.
98. Inspection and commissioning:- Inspection and commissioning will also be carried out at at
site specified by officials of the Authority (if required). If any discrepancy is found in the
material supplied and technical specifications approved, the same lot shall be rejected and
bidder will collect rejected material within seven days. No claim for the rejected material shall
be entertained.
99. Liquidated damages & Penalty for delay:- Selected Bidder in accordance with the schedule
specified in the tender shall make delivery of the equipments. An unexcused delay by the
supplier in the supply of its delivery obligations, supplier will be hold liable and Authority can
take actions to forfeit of his performance security, imposition of liquidated damages and/or
termination of the contract by default. If the Selected Bidder fails to deliver any or all of the

equipments within the said period, Authority shall deduct from the contract price as liquidated
damages. (Late delivery penalty) It will be calculated on the basis of delayed days for delayed
quantum (delayed work amount) of work and rate of calculation will be 2% per month of
delivery price will be recovered from the Selected Bidder without any reference to the
Selected Bidder. The amount of Liquidated damages will be however subject to the maximum
of 10% of the total Contract Value.
100. Termination of Contract:- Delay in excess of one hundred (100) days after completion of
delivery period may be cause for termination of contract and forfeiture of all security for
performance. Final decision in this regards shall be taken by Municipal Commissioner,
Porbandar to the successful bidder.

Sr. QUALIFICATION CRITERIA
01 Turn over certificate: -
Average annual financial turnover during last 3 years, ending 31st march of previous financial year,
should be at least 50% of Estimated cost i.e. Rs. 15 Lacs. Scan copy of Turnover certificate should be
02 Certificate of Dealer from Principal Manufacturer.
03 Bank Solvency Certificate: -
The Bidder should submit Solvency certificate minimum value of at least 20% of Estimated cost i.e. Rs.
2.00 Lacs, Issued by Scheduled bank/Nationalized bank.
(Considering Validity as 1 year from date of issue of Solvency Certificate)
Scan copy of Solvency Certificate should be submitted.
04 In the case of an order from Gem (Government e-marketplace), the Gem Contract copy with CRAC /
Gem Contract copy will be considered as a work completion certificate.
05 Work Experience certificate.
Experience of successfully completing similar works of fully built chassis mounted Sab Vahini in Last
Similar work experience will be considered of Hersh van/Ambulances/ICU on wheels / Body Building
Work of ambulances during last 3 years ending last day of month previous to the one in which
applications are invited. The work experience shall be with Central govt/State govt/Local self-
government body/PSU will be considered.
- In Last three years 5 nos. of Ambulances/Sub Vahini/Hersh van should be supplied.
1. In case the authorized dealer appointed by Chassis OEM is not having such certificate then certificate
of the bidder or its Chassis OEM having supplied same or similar category product in Central
govt/State govt./Local self-government body/PSU will be considered.
2. Bidder need to submit scan copy of the work completion certificate which include minimum
following details like name of contractor, name of work, date of starting the work, date of completion
of the work (as per contract agreement), actual date of the completion of the work, amount of work
done, satisfactory work completion remarks and issuer details.
3. In the case of an order from GeM (Government e Market), the GeM contract copy with CRAC/GeM
contract copy with a copy of the delivery challan will be considered as a work completion certificate.
Please note that the final decision of accepting or not accepting this proof will be made by

Term and Conditions:
1. Bidder need to upload Original Demand draft of EMD for the said amount, favoring of

2. All quoted rates must be inclusive of Insurance, All Taxes (RTO Tax, TCS and Others)
RTO registration charges, number plate charges and also F.O.R. up to delivery Decided
places. Qualified bidder must have to deliver said items at district at his own cost.
3. Bidder must have at least work Experience for Last 3 Financial Year. Providing
similar type of product to any Central/State Government Organization/P.S.U. copies of
Relevant Contracts /Orders and CRAC certificate to be Uploaded Along with Bid.
4. Bidder must need to upload last 3 years turnover certificate from the duly signed by CA.
5. Bidder must need to upload BIS certificate/ARAI Certificate of any Vehicle in name of
bidder attached along with the bid documents.
6. Bidder need to upload ATC (All terms and conditions) accepted certificate.
7. The bidder must have to submit an undertaking on Rs. 300 stamp paper that they have not
been blacklisted, bank corrupt /debarred by any state government /central government / PSU
in last three years as on last date of bid submission.
8. Commissioner, Porbandar Municipal Corporation has a right to increase the time limit for
bid/supply unexpected reason.
9. In case of item delay supply from the bidder side, Commissioner, Porbandar Municipal
Corporation have right to impose penalty for it and bidder must abide with this condition.
10. If any unexpected problems will accure after or before bid rate finalization, then
Commissioner, Porbandar Municipal Corporation decision will be final and the bidder
must have to agree with the same.
11. Commissioner, Porbandar Municipal Corporation has a right to cancel the agreement with
bidder without any prior notice if the bidder will not be followed any single condition.
12. For the any issue related to these bid, legal jurisdiction will be PORBANDER only.
Commissioner, Porbandar Municipal Corporation decision will be final decision for all
terms and condition. If in case bid is cancelled by buyer then bidder cannot take any
objection on it.
13. No advance payment will be paid by buyer. Payment will be done after successful supply of
required specified item.

understand that except to the extent as expressly set for thin the Contract Agreement, we shall have
