TECHNICAL CONDITIONS OF CONTRACT FOR U/G CABLE WORK

1. Laying of 22/11KV U/G cable.

(i) 22/11 KV CABLE will be supplied by DGVCL while outdoor cable kit,

Straight Joint Kit will be supplied by Contractor.

(ii) Contractor has to transport 22/11KV cable drums from store to site

and empty drums from site to store at his risk& cost.

(iii) Contractor has to excavate 1200mm deep trench and cable should

only be laid under DGVCL supervision.

(iv) Before laying of cable 100mm Layer of good sand is to be provided.

(v) Contractor has to provide to lay good quality & specified size of RCC

half round pipes.

(vi) Before laying of cable same should be tested with 5 KV megger in

presence of the I/C engineer.

(vii) Cable ends should be sealed properly whenever cable is cut & laid

before providing straight/end termination to prevent ingress of

moisture/ water/dust etc.

(viii) Contractor has to carryout work in co-ordination with local authority

like Nagar Palika/Gram Panchayat, Telephone and GIDC authority.

2. Fixing of Heat Shrinkable type end termination & straight through joints.

(i) Contractor should clarify the make of heat shrinkable cable end

termination and straight through joint.

(ii) Duel wall molded liabing should be available in straight through joint.

(iii) After competing work of cable laying end terminations. through joints

following test shall be carried out jointly by engineer in charge of

DGVCL and contractor.

(A) Insulation resistance test before & after with 5KV meg

Erection, Testing and Commissioning of 22/11 KV Under

ground Cables (22/11KV Cables tobe supplied by DGVCL) with

cable end Termination, straight through jointing kit of Various

feeders of DGVCL.

(iv) Contractor has to provide CPRl latest amended Test certificate and

satisfactory product performance certificate.

(v) On competent supervisor with skilled knowledge shall have toco-

ordinate the site authority of the joint he has to do all communication

of site with engineer in charge of DGVCL.

(vi) It is essential to have suppliers certificate of training for cable jointing

of cable jointer.

(vii) Jointer has to ensure safety while making joints or other nearby

cables are not damaged.

The bidder shall have to keep their jointer team at Ankleshwar headquarters

at all the time .they have to provide name , contact details and address along

with contract agreement any delay beyond 2 Hrs. to reach at site will attract

1 % penalty of respective location work amount

TECHNICAL SPECIFICATION

CLASS OF TERMINATION:

The XLPE 11/22 KV Link Lineshall be class 1 termination as per IEEE-48-1990.

APPLICABLE STANDARDS:

IS 13573-1992 with latest amendment – Latest Amendment.

IEEE 48-1990. The termination shall be Class

ESI-09-13. Performance specification for high voltage cable accessories. The cable

accessories being supplied in the form of kit which has different components to be

assembled at site.

TECHNICAL SPECIFICATIONFOR 11/22 KV XLPE UNDERGROUND CABLE.

1 This specification lays down the material properties. Performance requirement of

11/22 KV XLPE Cable termination and jointing system for use on electrical systems

operating at voltage 11/22KV (i.e. voltage at which the cable termination kit is meant

2 The term 11/22 KV XLPE Cable refers to extruded or Molded Polymeric. Polymeric

material which are cross linked by gamma radiation to develop elastic memory and

supplied in an expanded or otherwise deformed size and shape. Bidders should submit

the proof that the tubes are cross linked by gamma radiations. However chemically

cross linked, crotch seal and lug seals are permitted. Heat shrink kit should be supplied

in a expanded or otherwise deformed size and subsequent heating in an unconstrained

state to temperature above the shrink temperature results in the material recovering

or shrinking to its original shape. The heat shrink kits should consist of the following:

STRESSCONTROL XLPE SCREEN CABLE:

(a) Required length of stress relief tube should have minimum length of 150mm

having volume resistivity of 108 ohm – cm and permittivity of 25 to give optimum

electrical stress control. The impedance of the tube should not change by

temperature Variation from 5C to 125C. The stress control tubing should be

void free. Tenderer must submit the graph showing the effect of stress,

temperature and aging on the impedance of stress control tubing along with the

NON-TRACKING EROSION AND WEATHERRESISTANTPROTECTIONTO THE

CABLE TERMINATION:

(b) A 11/22 KV XLPE underground Cable flexible tubing preferably colored red silicon

based both ultra violet resistant and possessing non-tracking erosion weather

resistant properties shall be used as external covering for the cable cores for

outdoor and indoor termination. The tubing shall confirm to the requirement

given in List 1 to ESI 09-13 including Atlas weather – O – meter testing non-

tracking performance as per ASTM D2303. Non-tracking performance as per

ASTM D2132 (Dust Fog Test) 1 IEC 112 (Comparative Tracking Index) and VDE

0303 (Tracking and Erosion Resistance Test) shall also be complied with offer.

Also bidder has to submit the test results for non-tracking properties along with

life assessment report.

ENVIRONMENTAL SEALING:

Adhesives and sealants shall be provided in the termination and jointing kits for

environmental sealing against ingress moisture and aggressive gases. The adhesive and

sealant will flow due to heating and heating of heat shrinkable components during

installation and will fill all the voids and adhere to metal connectors and cable sheets. In

short, all adhesives should be anti-tracking type and required sealants and mastics shall

form part of kit.

FOR TERMINATION:

At the end, sealing of the strand between the lugs barrel and cable insulation shall be

(a) Non-tracking, erosion and weather resistant heat shrinkable tubing, pre coated

with non-tracking sealant.

(b) Non-tracking sealants strip.

11/22 KV XLPE underground flexible polymeric tubing, preferably black colored pre coated

with adhesive shall be provided for sealing the exposed metallic sheaths and sheath/earth

PROVISION OF ADDITIONAL CREAPAGEFOR INDOOR/OUTDOOR

Single piece, 11/22 KV XLPE under ground cable weather sheds having non-tracking,

erosion and weather resistant properties shall be supplied with the kits for application

over non-tracking tubing. The quantity of sheds to be supplied shall depend on voltage

grade and indoor/outdoor application and shall be indicated along with offer. Each shed

shall give an additional cripage length of at least 100mm.

INSULATION AND SCREENREINSTATEMENTFOR JOINTS:

The reinstatement of insulation shall be by means of heat shrinkable, flexible, polymeric

tubing made from a discharge resistant polymer, preferably colored red. The tubing after

complete recovery shall have a minimum wall thickness to ensure provisions of adequate

insulation in step.

EARTH&SCREENCONTINUITYFORTERMINATION& JOINTS:

Screen continuity by using tinned copper mesh and earth continuity by using tinned

copper braids of appropriate size shall be provided for transfer of screen/earth in straight

through joints.

In termination, tinned copper braids of appropriate size shall be provided for joints for

the continuity of screen/armor.

LUGS & FARRULES:

The requisite number and type of aluminum lugs/ferrules shall be provided for

termination/joints.

Lugs and ferrules for XLPE cables shall be crimping type suitable for compacted circular

conductor having two nos. of holes.

GI PIPE & HDPE PIPE:

The GI pipe and HDPE pipe shall be provided as per standard of DGVCL.

COMMERCIAL TERMS & CONDITION

1. TENDER SPECIFICATIONS:

All technical specification should be ISS/ISI/BIS. Specification framed out by the

Company is separately brought out in the tender documents. No deviation in

specification shall be allowed and Company’s decision shall be final. The Company

also desires that all the suppliers should possess high quality ISO 9001 / ISO

certificate within 2 years from 1/1/2001 and other things being equal, suppliers who

possess ISO 9001 / ISO 9002 certificate will be given preference in quantity

LATE / DELYAED TENDER SHALL NOT BE CONSIDERED.

Incomplete bids and amendments and additions to bids after opening of the bids will

be ignored out rightly.

2. The Tenderer must give in his offer, the full name and address with phone, Fax

&mobile numbers of the Representative who has been authorized by the Tenderer to

do work with the Corporation on their behalf.

3. The tenderers should invariably write the name and address of the Company, on

sealed covers of EMD. Otherwise the tender covers without the name and address will

not be opened which may please be noted.

4. The tender should be sent by R.P.A.D./Speed post only and addressed to The

Executive Engineer (O&M), D.G.V.C.L., Rural Division, Ankleshwar-

393001.(No Courier service will be accepted). Hand delivery of tenders will not be

DELAYED AND LATE TENDERS

No tender shall be accepted/opened in any case which are received after due date

and time of the receipt of tender irrespective of delay due to postal services or any

other reasons and company shall not assume any responsibility for late receipt of

tender. Any correspondence in this matter will not be entertained.

5. Tender fee (Non-refundable)

Tender fee (Non-refundable) plus GST as applicable notified in the tender notice

should invariably be paid by way of Demand Draft/ Bankers Cheque or cash otherwise

offer will be ignored out rightly. Indian Postal Orders (IOP’s) & Cheques are not

acceptable. Demand Draft/ Bankers Cheque should be in the “Name of Company.”,

Payable at Ankleshwar.

The Tender Fees is Non-Refundable under normal circumstances. However, if

purchaser company decides to scrap/ cancel the tender, by one or another reason, in

which bidders are not responsible for cancellation/ scrap of tender, in such case tender

fee may be refunded to bidder(s), at sole discretion of the purchaser company.

6. EARNEST MONEY DEPOSIT:

E.M.D. at the rate of 1% of the value of the Tender is payable. The EMD is

payable either in Cash or by Demand Draft in favour of The Dakshin Gujarat Vij

Company Ltd. Drawn on any Scheduled / Nationalized Banks payable at Ankleshwar.

7. SECURITY DEPOSIT:

Security Deposit should be paid within one week after receipt of the order. The

successful tenderers will be required to pay an amount equivalent to 5 % of the value

of the order as a Security Deposit for satisfactory execution of the contract. Such

Security Deposit will be payable in Cash / D.D.

Prices quoted should be FIRM and inclusive of all taxes, nothing will be paid ex

Prices quoted should be FIRM and or F.O.R. Destination basis (i.e. any of the stores

of COMPANY in Gujarat. However, the Tenderer should indicate in the Schedule-B

(i.e. Price Bid), the break-up of Total Unit F.O.R. Destination Prices and Total Unit End

Cost with GST and Cess as applicable stating the Unit Ex-works price, freight, packing

& forwarding charges, insurance charges, GST and Cess as applicable separately in

price bid, which is a must.

If the Supplier/Contractor has opted for the composition scheme of GST, the same

must be clearly specified with valid Declaration & self-certified Certificate from

Department. In the event of withdrawal/cessation of the Supplier from composition

scheme during the tenure of the contract, the rate (i.e. price) mentioned in the price

bid shall be final and any additional GST will have to be borne by the tenderer himself.

In no case additional amount towards GST or otherwise will be paid / reimbursed to

supplier/contractor. Further statutory variation clause will not be applicable in case

of Supplier/Contractor has opted for Composition Scheme under GST.

Also, please mention separate applicable HSN / SAC Code and rate of GST and Cess

as applicable for each item of Goods/Service. If not specifically mentioned then

COMPANY will have the option to take the prices as exclusive of taxes and duties at

maximum higher slab rates for the evaluation of the tenders.

The Tenderer should invariably indicate the total unit end cost price considering all

their costs / calculations in the Price bid itself for each item and all sub-items if any.

This is a must. Cost components hidden / furnished elsewhere will not be considered

and will be ignored out rightly.

Every bidder shall inform their GSTIN No. of the registered place(s) wherefrom the

bidder intends to supply the goods / services, meaning there by the bidder has to

supply the goods / services from the relevant declared / registered place of supply

9. VALIDITY OF THE OFFER:

The offer will have to be kept valid for a period of 120 days from the date of opening

of technical bids. In case of finalization of the tender is likely to be delayed, the

tenderer’s will be asked to extend the same without change in the prices or any terms

and conditions of the offer. If any change is made, original or during the extended

validity period, the offer will be liable for outright rejection without entering into

further correspondence in this regard and no reference will also be made.

10. PRICE EVALUATION:-

No price preference shall be given on any account. All tenders will be evaluated

on firm price basis. Company may go for the price L-2 depending upon the

exigency. If Company feels that there is lack of serious competition or any other

reasons, Company may negotiates with the L-1 party. Company’s decision shall be

final and binding to all the parties.

No price preference shall be given on any account. All Tenders shall be evaluated

on firm price End Cost (with GST and Cess as applicable) basis unless otherwise

mentioned in the Tender documents.

If the Tender is invited with Total Owning Cost (TOC) clause, the evaluation shall

be done accordingly. For the same, the Bidders have to give the detailed breakup

of the End Cost.

11. QUANTITIES:-

The quantities mentioned in the schedule attached herewith are tentative and tobe

procured / executed by the successful contractor the same rates accepted by the

DGVCL in various A/T and all the terms and conditions of the order.

However payment shall be made only for the actual quantities utilized / executed

to complete the work. The work is to be carried out in piecemeal, looking to its

nature and requirements, as per decision of the in-charge engineer.

12. PACKING AND FORWARDING CHARGES:-

The prices shall be inclusive of packing & forwarding charges. The stores should

be strongly and adequately packed to ensure safe arrival at destination.

13. PAYMENT TERMS:

Payment shall be made by the Rural Division Office, Ankleshwar on completion of

the job and production of work completion certificate of the Sub Division Office In-

charge, after following the procedures of D.G.V.C.L. R. A. Bill will be passed as per

Company’s Rules and Regulation.

14. REPEAT/ADDITIONAL ORDERS:-

The Company reserves the right to place repeat orders / additional orders on the

successful tenderer up to 50% of the original quantity of the A/T at the same

prices terms and conditions stipulated in the original order mutually agreed upon.

15. COMPLETION PERIOD:-

The Tenderer should agree with activity wise time bound program for completion

of supply and erection work in all respect as per terms and conditions of this

16. POST TENDERCORRESPONDENCE / ENQUIRIES:-

Any correspondence or enquiry subsequent to opening of Technical and

Commercial bids is not desirable, if the same is indulged into, it will be considered

for disqualifying the tender. The Tenderer will be required to abstain from pursuing

/ canvassing the matter, directly or indirectly with any Officers of the DGVCL, as

otherwise the same would also amount to disqualification of the tender.

17. The purchaser (i.e. Company) shall have the right to make any changes, additions

/ deletions or modifications in any terms / conditions of the tender and / or

specifications as may be deemed necessary by the Corporation at its sole discretion

at any time before the due date of opening of the tender.

18. TYPE TESTS:-

All the necessary Type tests will have to be carried out before submission of the

tender and to be submitted along with the Tender. The Type Tests which are more

than 05 (Five) years old (from the date of opening of the tender) will not be

considered (except otherwise specifically mentioned in the Guaranteed Technical

Particulars (i.e. GTP’s.) and such tenders will be rejected. All the required type

tests should not be older than 5 (five) years. All the required type tests on

one particular item must have been conducted in the span of one year

only. If the type tests for the tendered items are not carried out before the

submission of the tender, then it will at Company’s sole discretion to accept them

or NOT. However, depending upon Company’s requirement, if the Letter of Intent

(LOI) is placed subject to submission of type tests, then in such cases all the

necessary Type tests will have to be carried out by the firm within 30 (Thirty) days

of the issue of LOI or at Company’s discretion, failure to do so the LOI stands

cancelled and the detailed purchase order will not be placed and no further

correspondences in this matter will be entertained at any cost and will be out

rightly ignored.

19. Company does not accept the printed conditions of any Tenderer. It will be ignored

without any reference; hence tenderers should withdraw such printed conditions

if they have any.

20. Tenderer should furnish a list of orders for similar works executed by them

indicating the name of the party and their order reference to whom they have

worked to be furnished. Failure to do this will result on suppliers tender being

rejected without any reference. In case of bought out items they should furnish

the backup guarantee from their principals.

21. The materials should be offered strictly confirming to ISS / BIS / Tender

specifications given in the tender. If the tenderer’s desires to quote with any

technical deviations they should specifically quote the deviation & the ISS or BIS

Nos. in the body of the tender itself under the respective Annexure of this tender

document. If technical deviations furnished by the Tenderer are not agreeable to

the Corporation, the offers may be ignored. However it will be solely at Company’s

discretion to consider the technical deviations OR not for considering the Tenderer.

No correspondences of the Tenderer after opening of the bid will be entertained

in this matter.

22. Revision of prices or any commercial terms affecting the price after opening of

technical bids shall not be considered and will be ignored.

23. Please give suitable declarations as under: I / We declare that we are Authorized

Distributor OR Dealer for all the tendered items.

24. Tenderer should specifically mention in the offers and should indicate in Block

letters the name of the Partners / Proprietor / Directors who is / are the signing

If the goods, stores and equipments found defective due to bad design or

workmanship the same should replaced by you free of charge if reported within

60 months (5 years) of their installation at site. You will be responsible for the

proper performance of the equipments / materials for the respective guarantee

26. OTHER CONDITION OF SUPPLY:-

The Company’s General Conditions of contract will apply to all contracts and

supplier will be deemed to be fully aware of the Company’s general conditions of

contract for the supply of plant equipment and materials except the conditions

modified in this commercial terms and conditions and any ignorance of these

Conditions, will not exempt supplier from their liability to abide by the same. Copies

are available from the Division Office

27. Although the materials have tobe supplied as per ISS and or as per the tender

specifications, the Company will take random samples from the materials supplied

and subject them to tests according to ISS in approved laboratories. The materials

should stand these tests and if the materials do not stand these tests, they will be

summarily rejected and the supplier should make immediate arrangement to

replace them with standard materials and after getting them duly inspected and

28. If in any company, the interest of any employee of the DGVCL or his relative as

defined in Section VI of the Company’s Act. 1956, is 10% or more, DGVCL will not

deal with such company at all. Tenderer therefore, must specifically is closet is fact

in his technical Bid. Non-disclosure of such facts would disqualify the Tenderer for

further dealing with DGVCL.

29. ARBITRATION:-

(1) Amicable Settlement:-All disputes, differences controversy or claim between the parties

arising out of or in relating to this contract with reference to the construction

interpretation breach, termination or validity thereof(hereinafter referred as “the

Dispute”) shall upon the written representatives of the disputing parties for resolution.

The authorized representatives shall promptly meet and attempt to negotiate in good

faith a resolution of the Dispute within thirty days of the service of the request.

(2) Arbitration:- If the parties fail to amicably resolve the disputes or differences

controversy or claims as indicated herewith in sub clause(1) of clause 9,arising under or

in connection with the present works contracts, whether pertaining to works contracts

alone or works and procurement both, the same shall be referred to arbitration under the

Gujarat Public works Contracts Disputes Arbitration Tribunal Act,1992.”

30. JURISDICTION:-

All questions, disputes or differences arising under out of or in connection with the

Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the

court under whose jurisdiction the place from which the tender / Acceptance of

tender is issued, is situated i.e. DGVCL, RURAL DIVISION, ANKLESHWAR.

31. SUBMISSION OF OFFERS:-

The firm having single legal entity and having two or more works / factory and

submits offers from two or more different works / factory, in such case Company

will consider only ONE lowest offer for allocation of quantity. Many of the

tenderers are submitting their offers with the conditions of advance

payment along with the order; such conditions are not acceptable by the

32. The Tenderer if being an agent, who submits its offer to Company, will have to

give information and declare the name of the principle from which he will procure

the materials and supply to Company along with company’s written confirmation

about quality and backup performance guarantee. Only on getting complete

information from Agent, such offer if found suitable shall be taken in consideration.

33. Company reserves the right to cancel any or all the offers / bids or to accept any

offer without assigning any reasons. Also in case Company finds that there is an

attempt of curtail in the prices, Company reserves the right to consider or reject

any or all the parties offers without assigning any reasons thereof.

34. Company reserves the right to increase or decrease the quantity against each

item/s while placing the order.

35. All the suppliers / manufacturers should possess high quality ISO 9001 / ISO

Certificate within 2 years. Other things being equal the company possessing the

ISO 9001 / ISO 9002 license will be given preference if other requirements match.

36. The tenderers are required to furnish the technical information and the guaranteed

technical particulars (GTP) along with company seal and signature of the Tenderer

on each and every page / papers of the tender documents.

37. All the costs of the stamp papers are tobe borne by you as per the Govt. Of India’s

latest guidelines.

38. Tenderer should invariably fill up all the details of all the Annexure including the

prices in the Price Bid Annexure of this tender document. This is mandatory. Also

all the Annexure should be duly signed by authorized signatories with their rubber

stamp and along with Company’s Rubber (Round) seal / stamp affixed on each

39. If the Tenderer fails to pay the Security Depositor defaults in execution of the

orders placed or if Company suffers any financial loss due to this, then Company

will be at liberty to adjust the amount from other orders of the same firm or by

encasing the Bank Guarantee.

40. LABOUR LAWS:-

Persons below the age of 18 years shall not be employed for the work. No female

workers shall be employed in the night shift between 07.00 P.M. and 6.00 .A.M.

Contractor shall maintain a valid labour license under the Contract

Labour(Regulation and abolition) Act for employing necessary man power required

by him. In the absence of such a licensee, the contract shall be liable to be

terminated without assigning any reason thereof. Contractor should also employ

qualified and experiences persons as per requirement of Electricity Act and rules

for carrying out supply and erection work under this contract.

The Contractor shall at his own expenses comply with all labour laws and keep the

DGVCL indemnified in respect thereof. Some of the major liabilities under various

labour and Rural laws which the Contractor shall comply which are as under:

Payment of contribution by way of Employer’s Contribution towards Provident

Fund. Family Pension Scheme Deposit Linked Insurance Scheme, Administrative

charges etc. at the rates made applicable from time to time by the Government of

Gujarat / Government of India or others Statuary / Authority.

Payment of Deposition respect of each contract labour with the Office of

Commissioner of Labour as per the Contract Lab our (Regulation and Abolition)

License fee as prescribed under the Contract Labour (Regulation and Abolition) Act

and Rules framed there under depending upon the number of workmen.

Paid leave facility and wages as per the provision of the Factories Act., at the rate

of one day for every 20 days of working. Identify Cards as prescribed under the

Factories Act., with photo affixed thereto for identification.

Payment of retrenchment compensation, Notice Pay and other liabilities as per

Rural Dispute Act., Any payment to the Contractor’s employee arising out of any

claim of dispute under the Rural Disputes Act,1947 or any other Labor Laws.

Payment of compensation in case of accidental injury.

Provision of crèche if the female laborers employees are more than

Maternity leave as per the provisions of the Maternity Benefit Act.

The above are some of the major liabilities of the Contractor in addition to other

liabilities prescribed under the various labor laws, in force from time to time, from

Statutory Authorities like State Government / Government of India, which the

Contractor shall have to comply with.

41. PROVIDENT FUND AND FAMILIY PENSION SCHEME:-

The Contractor shall submit along with his bills (Month wise ) a Statement

regarding deduction against employees Provident Fund and Family Pension

Scheme in respect of each concerned employees. The contractor’s contribution and

the workers’ contribution towards Provident Fund and Family Pension Scheme shall

be done at the rate made applicable by the Government from time to time and

deposited by the contractor with Regional Provident Fund Commissioner SURAT.

42. DEPOSIT LINKED INSURANCE SCHEME:-

The contractor shall have to deposit1.2% of the wages in respect of employees

who are members of the Provident Fund as the contribution to the Deposit Linked

Insurance Scheme with Regional Provident Fund Commissioner.

43. ADMINISTRATIVE CHAGES:-

Administrative charges for maintaining Provident Fund Account shall be deposited

by the Contactor with Regional Provident Fund Commissioner, SURAT at the rates

44. PAID LEAVE FACILITY:-

Paid Leave Facility at the rate of one day for every twenty days worked by the

Contract Labour shall be provided by the Contractor to his workers. He shall

maintain Leave Records, Leave cards for individual labourer which shall be duly

verified approved and certified by the authorized Officer of the DGVCL.

45. WORKMEN’S COMPENSATIONACT AND EMPLOYER’S LIABILITY

The Contractor shall cover all his employees under workmen’s compensation act

and under its liability insurance. The DGVCL shall not be responsible for any

payments of compensation to the workers / supervisor of the contractor for fatal

or non fatal accidents during the tendency of the contract.

The contractor shall employee adequate number of qualified and experienced staff

at site for daily supervision and for maintenance of various registers and records

rejected under the law and contract. No payment for supervision shall be

admissible. The list of names of such persons with their qualification and

experience should be furnished with the tender.

46. CONTRACTOR TO INDEMIFY THE DGVCL:-

The Contractor shall indemnify the DGVCL and every officer and employees of the

DGVCL including, Engineer – In-charge and his staff against all actions,

proceedings, claims, demands, cost and expenses whatever, arising out of or in

connection with the matter referred herein above and elsewhere and against all

actions, proceedings, claims demands, cost and expenses which may be made

against the DGVCL or Government for or in respect of performance of the

obligation under the contract documents. The DGVCL shall not be liable for or in

respect of or in consequence of any accident or injury to any workman or other

person in the employment of the contractor or his sub-contractor and the

contractor shall indemnify and keep indemnified the DGVCL against all claims,

demands, proceedings, cost, charges and expenses whatever in respect thereof or

in relation thereto.

47. WORKMEN’SCOMENSATION AND EMPLOYEES LIABILITY INSURANCE:-

Insurance shall be effected for all the Contractor’s employees engaged in the

performance of this contract. If any of the work is subject, the Contractor shall

require the Sub-Contractor to provide workmen’s employer’s liability insurance for

the latter’s employees and ensure that such employees are covered under the

Contractor’s Insurance.

48. WAGES TOBEPAID&TIME OF PAYMENTETC. BY THE CONTRACTOR:-

The Contractor shall pay minimum wages per day to his Labours / Workers as per

rates fixed under the minimum wages Act. The wages of every Contract Labour

employed by him under this contract shall also be paid by him before the expiry of

7th day from the last day of the month in respect of which the wages are payable

( i.e. wages of a month have to be paid by him in the first week of the next month).

Any default will result in cancellation of contract work with or else the Contractor

shall be punishable to the extent of Rs. 100/- for each day of default.

The Contractor shall give his Addresses, Telephone Number and etc. to the

DGVCL, so that, in case of labour trouble etc. the Contractor can be contacted.

The Contractor shall arrange to have his office within working area and the

contractor keep himself present throughout the working hours.

The contractor who are having separate P.F. Code No. from RPFC, it should be

ensured that all the contract labourers are covered under the Provident Fund

scheme, and employees’ pension scheme and their contributions are remitted

regularly to the concerned Xerox copies of the challans in this regard be collected

from the concerned contractor and kept in the file of the concern contractor

49. INCOME –TAX:-

Income-tax at source at the prevailing rate will be deducted from your bill in

accordance with the provision of Income-Tax Law sand to that effect a certificate

will be issued to the contractor.

As the material is to be procured by the successful bidder, the contractor shall

make its own arrangement to avoid breakage, losses and wastages of material etc.

And no wastage on this account shall be considered payable by the DGVCL.

DGVCL reserve the right to check all the activities carried out by the successful

bidder at each stage or during execution to see that the work is executed as per

the various drawings, standards, norms, rules and the regulations of the DGVCL.

51. PRESENTATION OF BILLS:-

The bills in serially numbered for the work executed including cost of material

consumed is to be prepared in Triplicate and submitted to the E.E. (O&M) Rural

Division, Ankleshwar through concerned Sub Division.

The contractor may note that no payment shall be released for the additional

quality supplied which is not required for completion of line.

The Contractor has to submit the final bill along with the material consumption

statement along with other required data’s of the work carried within 3 months

from the date of completion of work.

For non-submission of part submission of above information, no bills shall be

SPECIAL TERMS AND CONDITIONS:

1. The work is to be executed in the area of DGVCL in all respect as per the instructions

of Engineer-in-charge by arranging all required materials tools, tackles equipment

including labors, transportation etc. DGVCL will not pay anything extra on this account.

2. The DGVCL reserves the rights of retrenching and dismissing any person employed

for the work if there is complaint against his misbehavior, misconduct or disloyalty

3. Terms and conditions regarding rural laws and other related matters shall be complied

be transferred/assigned or subject by the or indirectly to any person/firm or

instructions issued by the DGVCL from time to time related with the safety and security

6. DGVCL shall not be liable for any damages or compensation for any injury or for any

accident occurred to any person engaged by the contractor. The contractor shall keep

the DGVCL indemnified thereof.

7. The contractor shall be liable for making good all damages/losses arising out of

workmanship, breakages, pilferage, etc. to the DGVCL.

8. Contract period:

1) The contract period will be Twelve Months from the date of issue of the

any respect, job will be got executed through other agency at the risk and

10. The rates should be quoted in percentage in enclosed schedule only, both in words

and in figures, as specified therein. In case of any discrepancy between the

rates/amount quoted in words & figure, the rates/amount most favorable to the

DGVCL shall be considered.

11. Conditional tender will not be accepted and likely to be rejected.

12. The DGVCL do not bind themselves to accept lowest or any tender.

Viz. MGVCL/PGVCL/UGVCL/GSECL/ GETCO/DGVCL. If found during Tender procedure

DGVCL has rights to disqualify/reject at any stage of tender.

17. BIDDER TO SATISFY THE ENTIRE FOLLOWING PRE-QUALIFIYING

1. The bidder should have experience in erection, commissioned and

tested(11/22 KV or above voltage class) of HT cable laying works successfully

in last three years in electricity utility.

2. The same should have been in successfully commissioned and in working

condition in electricity utility.

3. All the Equipment proposed to be supplied shall have valid type test certificates

of relevant IS from Government approved/NAB Laboratory not older than

3 years & must be valid up to the expiry of validity of offer.

4. Average annual financial turnover during the last 3 years ending 31 march of

previous financial year should be at least 30% of the individual estimated cost.

5. Experience of successfully completion of similar type of work during last 7 years

i.e. ending last day of month previous to the one in which application are invited

should be either of following:

a. Three similar completed works costing not less than the amount equal to

40% of the tender value.

b. Two similar completed works costing not less than the amount equal to

50% of the tender value.

c. One similar completed works costing not less than the amount equal to 80%

of the tender value

5.1) Liaison charges with utilities, Electrical inspector & other local utilities like telecom,

GAS, & networking etc. Preparation of site drawing and approval of Railway for cable

21. Goods and Service Tax (GST) :

The F.O.R. Destination prices are including GST and Cess as applicable which will

be paid extra on a given taxable goods and/or services within the original

contractual delivery period. The amount of GST and Cess as applicable should

clearly be indicated separately. (FST/Cess means all applicable Tax/Cess under

GST Laws. GST Laws means IGST Act, GST (Compensation to the State for Loss

of Revenue) Act, CGST Act, UTGST Act and SGSCT Act, 2017 and all related

ancillary legislations).

It the Supplier/Contractor has opted for the Composition Scheme of GST, the same

must be clearly specified with valid Declaration & Certificate from department. In

the event of withdrawal/cessation of the Supplier from Composition Scheme during

the tenure of the contract, the rate mentioned in the price bid shall be final and

any additional GST will have to be borne by the tenderer. In no case additional

amount towards tax or otherwise will be paid / reimbursed to supplier/contractor.

Further Statutory Variation clause will not be applicable in case of Supplier /

Contractor has opted for Composition Scheme under GST.

Supplier/Contractor should charge GST in Invoice at the rate as agreed to /

mentioned in acceptance of tender only and any deviation in the same shall not

be accepted. Further, any additional liability of GST (later on due to wrong

mentioning of GST rate, mis-interpretation of HSN/SAC Code, etc.) over and above

as charged in the invoice shall be borne by the Supplier/ Contractor. However,

any refund received by the supplier / contractor on account of GST charged from

the company; such refund shall have to be passed on to the company, along with

interest if any. Such refund along with interest needs to be passed on suo-moto

by the supplier / contractor.

In case, Govt. revised the rate of GST rate / Code during the tenure of the contract,

the provision of GUVNL’s statutory variation clause shall apply.

22. INPUT TAX CREDIT BENEFIT

In the event of any statutory increase in the rate of Input Tax Credit and / or due

to inclusion of any other additional item of their inputs / input services under the

ambit of the Input Tax Credit provisions under the GST Act, subsequent to the

date of submission of the offer, the same should be passed on to COMNPANY

and you should inform such changes to COMPANY from time to time.

23. STATUTORY VARIATION:

Any statutory increase or decrease in the taxes and duties including GST and Cess

as applicable or in the event of introduction of new tax/cess or cessation of existing

tax/cess subsequent to suppliers offer if it takes place within the original

contractual delivery date will be to COMPANY’s account subject to the claim being

supported by documentary evidence. However, if any decrease takes place after

the contractual delivery date, the advantage will have to be passed on to company.

Statutory Variation clause shall not be applicable in case of Supplier / Contractor

has opted for Composition Scheme under GST.

The terms and conditions stated above are carefully read by me/us and are

TERMS & CONDITION

1) DE will give the programme to the contractor under intimation to the Division Office, with

the details of work under each item with quantity feeder wise and location wise and

accordingly on receipt of such intimation the contractor shall have to start the work within

10 days, failing which the particular work shall have to be got completed by the DE

concerned through sources at the cost and risk of the contractor. The expenditure incurred

in excess in such cases, then the tendered rates shall have to be recovered from the amount

due to the contractor.

2) According to the contractor, if he feels more errection work than actually intimated to him

by the DE concerned through sub-work order he should not carry out such work at his own

accord but he should point out the same to the DE and only if he agrees to the same and

issued supplementary sub-work order, than only such work should be carried out. For the

work carried out without such sub-work order will not be paid to the contractor.

3) The contractor should prepare a detailed list of work carried out by him location wise as per

sub-work order and he should obtain the signature there on of the DE OR JE of the S/dn

and the same should be presented to the DE for preparation of bill.

4) Whenever any material is required to be replaced the contractor shall be given such material

from the sub-division office and for the same he will have to send full account to the S.D.O.

similarly any broken or scrap material gathered from such work should be credited to sub-

division office. If no such old scrap material is available on line, he should obtain clear

certificate to that effect from the DE OR JE concerned.

5) What so ever material is required to be use by the contractor as per schedule of the tender,

he will have to bring the same to the notice of the DE OR JE and the same should be utilized

as per there instruction, only when such materials are approved by them.

6) For Tools, Tackles, Hand Carts etc. the contractors shall to make their own arrangement.

7) The contractor should obtain insurance policy in respect of his lab ours towards accident risk

and the Xerox copy thereof should be produced to the Division Office along with the contract

documents executed.

8) Before starting the work on any line the contractor shall have to obtain shut down on that

line through the DE/JE concerned and regarding the shut down obtained he should get such

shut down order. If the contractor fails to obtain such order from the DE/JE concerned,

them in cases of any event of accident or otherwise, the contractor will be only responsible.

9) Carryout the work as per R.E. norms.

19) The sample of HDPE pipe shall be getting approved at concern (DIVISION level prior to commence

supply of HDPE pipe. The testing certificate & type test certificate of HDPE pipe shall be submitted at

the time of passing of bills.

20) The lot wise inspection of sample randomly selected from the lot of HDPE pipe is to be carried out at

NABL approved testing LAB/CIPET prior to supply of HDPE pipe and then work for HDPE vertical

laying/HDD work is to be executed.

21) Erection, Laying, Testing, Commissioning and satisfactory operation of the Distribution lines

are deemed to be included in the scope of the specification unless specifically excluded.

1.Bidder will have to submit inquiry in CBUD ( Call Before U Dig ) before execution of work and

will have to sent snapshot of raised inquiry to Engineer Incharge. Bidder will also carry out joint

survey with concerned underground utilities before starting HDD/Open excavation work in all

6. Depth chart should be provided at every 100 meter with mentioning landmark.

7.Partial Discharge test to be carried out on sample part of cable before charging as decided by

incharge engineer.

8.Qualified cable jointer with Minimum five years of experience required with necessary

certification regarding qualification and specific experience.

9.End termination and straight joint kit should be of premium quality .Technical specifications

for the same to be submitted along with bid.

10.Cable straight joint should be done with mid span joint instead of long barrel Lug.

11 In case of Damage to government/Utility assets due to Non-Usage of CBUD Application

before execution of any excavation/digging activity recovery and penalties must be imposed

on the contractor/agency.

TECHNICAL & COMMERCIAL CONDITIONS OF CONTRACT FOR O/H LINE

a) The work entrusted as per the contract should be speedily executed in accordance

with the best practice & should be present neat appearance when completed. All the

works have to be carried out according to the drawing and specifications and as per

the instructions of Engineer-in-charge. There should not be any damage to DGVCL's

material or to other's property during transport or erection otherwise damages will

be at the cost of contractor & decision of the Ex.Engr. will be final.

b) Before commencing erection of lines the contractor will provide with the pole

schedule and layout map of the area, which will give one of the location marked in

the layout map. The pole, guy and earthling locations will be shown by Engineer-in-

charge. Other drawings referred to the pole schedule will be available for consultation

with the DGVCL's staff at the site or at the S/Dn. office. Cutting of tree branches

which come in the way of the line will be arranged by the DGVCL.

c) Marshy or water logged locations must be avoided as far as possible. If it becomes

inevitable to locate poles at such point, special precautions about foundations will

have to be taken and work carried out as per instructions of the Engineer-in-charge

by the contractor at the tendered rate.

d) The spans shall be as specified in the pole schedule and the minimum spacing

between the power conductors and neutral shall be as shown in approved drawing.

2. SUPPLY OF MATERIAL:

All material such as rails, RS joints, or other poles [except PSC] fabricated material,

copper aluminum, or ACSR conductor, VIR wire insulators guy wire, etc. required for

erections will be supplied at DGVCL's store at Ankleshwar. PSC poles for line supports

will be transported and stacked by the DGVCL along road side for HT/LT line and at

one place near the site of work within a range of 2kms.The line supports may be Rail,

PSC or any other type and be 28 to 36 feet in length and weight40 to 100 lbs/yds.

The conductor will be either aluminum or ACSR and vary in size from 13mm2to

30mm2 area. The conductor will be supplied in coils or in drums as per standard

packing received from suppliers. The rolls should be returned to the Store and

stacked at the directed place. For damaged or lost empty crates/drums of conductor

recovery @ Rs.125/- for each will be effected. Anti-climbing device like GI barbed

3. POLE ERECTION:

The work includes shifting of supports particularly PSC poles from the stacking place

as mentioned in Clause No.2, to the site of actual work excavation of pit, fixing of top

insulator fitting, cross arms, clamps numbering etc. complete inclusive of painting,

fixing of danger DGVCL caution plates and fitting anti-climbing devices for double or

four pole structures Railway or River crossing or transformer structures etc. The work

further includes fixing cross arms packing, cross bracing etc., mounting of AB switch,

DO or HG type fuse units. Poles must not be erected along the edge of cutting or

embankments or where the soil is liable to be washed away Unless special precautions

are taken to ensure durable foundation when setting the pole. The pit shall be ample

size to allow easy entrance of the pole and base plate with out any damage to it.

After the pole is erected vertically the pit is to be refilled with the excavated earth

and properly rammed. The erection cost of single or double pole structures, stay sets

and pipe or plate type earthing is inclusive of excavation of pit refilling of excavated

earth and cost of coke & salt in earthing arrangement as specified. All the poles must

be in plumb, fabrication fitting on pole must be tight.

4. PAINTING AND NUMBERING:

RAIL Poles, RSJ, Steel tubular poles or all the steel mounting shall be given one coat

of approved red oxide paint and two coats of approved aluminum paint. There should

be sufficient interval between every coat of paint. The bolts and nuts shall be dipped

in anti-corrosive liquid before insertion and shall overlapping surface of steel should

be given a fine coat of red oxide paint before bolting. For the rails and RSJ/Steel

tubular poles the lower portion upto three feet above ground level shall be cleared of

rust. Where concreting is not to be done, this ground surface should be given a base

coat of red oxide and an additional coat of black bitumen paint which should extend

up to 3ft. above ground level of muffing before inserting in ground. The rest of the

surface of the rails of RSJ/Tubular pole shall be cleaned of all rust and painted with

one coat of red oxide and two finishing coats of approved aluminum paint. The paint

which should be ISI marked should be got approved by the Engineer-in-charge before

using on works and will have to be arranged by the tenderers, as painting is included

in the offer. Every pole after erections shall be numbered in bold black figures both

in English and Gujarati at a height of about 8ft. from the ground level as per

instruction of Engineer-in-charge. PSC poles need not be painted but they should be

properly cleaned and fabrication on PSC need be only painted as specified above.

5. CONCRETING/MUFFING:

The proportion of concrete mixture and the quality of the sand metal should asunder:

a) Cement concrete proportion for concreting of Rail/RSJ/Tubular steel poles should

be cement one part, sand three parts 1 ½" metal six parts [1:3:6].

b) The sand shall be clean, grippe and composed of hard, strong & durable grains, it

shall be free from clay or organic matter. If there is any trace of earthy matter, the

sand must be washed, before using sand for concreting work it should be got

approved from the Engineer-in-charge.

c) Metal should be hard and durable stone, to pass through a mesh of 1½" as far as

Possible. All metal must be perfectly clean, being washed, necessary and free from

any Sculpture. Size of metal must be got approved from the Engineer-in-charge.

d) Unless otherwise specified the concrete shall be mixed in the above proportions

and should be thoroughly mixed at least three times in a dry state before water is

added, and finally wet mixture be used. All concrete must be mixed on a water-tight

platform. In vessel any case, finished work, must be absolutely true inline and level

and finished-off smooth. One finishing coat of cement paste should be applied on

outer surface of the muffing. The concrete block must be kept wet continuously for a

period of seven days.

e) If the Engineer-in-charge of the works or the Supervisors, finds that cement

concrete is not of the quality and as specified, the same will be rejected.

f) The contractor should procure metal, and sand himself as specified above. Only

steel poles are to be muffed and the size of muffing far steel poles should be 12" dia

X 24"total height [12" below 12" above ground level] or as per instruction of

Engineer-in charge.

6. STRINGING OF CONDUCTOR:

Stringing of stranded ACSR/Aluminum/Al.Alloy conductor include the erection of

necessary HT &LT strain and pin insulators, jump ring& binding wire, jointing etc. The

rate quoted should be per conductor route kilometer inclusive of the above.

Appropriate tools should be used and proper scientific methods are to be applied to

protect against cuts, scratches or kinks. He should particularly follow the instructions

of Engineer-in-charge while making jumpers, joints and bindings. While executing

this work equipment& tools like turn table or draw-wise etc., should be arranged by

the contractor. For stringing of aluminum or ACSR conductor, aluminum or wooden

pulley must be used for supporting contact on poles. Generally 30-40 meter span

should be kept on HT/LT line.

7. ERECTION OF STAY SET:

The erection of stay set may be completed with stay clamp, binding of GI stay wire

at either end turn buckle, anchor plate with rod. The binding of stay wire for guy

insulator at both the end should be done properly. The stay shall be erected suitably

for local conditions. The rate should quoted for erection of complete set inclusive of

excavation of pit and refilling of earth and painting. Stay Rod pit must be as per

The earthing device shall be of the coil type or pipe type or plate type as indicated in

the pole schedule. The work of earthing must be carried out as per instructions of

Engineer-in-charge and at the places selected by the field Engineer. The coke or

charcoal powder and salt will have to be procured by the contractor should preferably

use earth auger excavation of earth pit. The contractor should satisfy himself as well

as to supervisor for satisfactory earthing by carrying out

test using earth tester. All earthing is to be covered upto 2.5mtr. [8feet] from ground

level by earthing sleeves which will be provided by the DGVCL. The earthing to be

provided in a separate pit i.e. other than that of pole. All conductors, earth wire and

stay sets must be tight.

Guard cradle will be provided below HT line/LT line. The guarding must also be

provided where railway tracks, telephone line, and licensees HT, LT lines are passing

below DGVCL's HT lines. The guarding for the above comprises of GI main bearer

wire GI lacing wire and GI binding wire etc. complete. The work has to be carried out

as per instruction of Engineer-in-charge. The cradle guard consists of 2nos. of SWG

No.8 GI wire for binding, guarding for railway crossing is to be carried out as per

instruction of the Engineer-in-charge.

10 ERECTION OF TRANSFORMER SUB-STATION:

Transformer sub-station will be of the outdoor type & will consist of the following

a) 25 to 200KVA transformer complete with its accessories.

b) One set of HT distribution type lightning arrestors.

c) One distribution box with necessary wiring.

d) The contractor should lay the cable as per instruction of Engineer-in-charge & use

crimping lugs for termination of cable as per requirement and the crimping tools to

be arrange by contractor. Pipe earthing to be provided on either side of the

transformer center providing earth wire for lightning arrestor, transformer tank and

Dist. box and two separate wires of distinct earthlings for neutral with T/c SWG-8

copper or GI wires. The rate should be quoted inclusive of painting of structure &

transportation from the DGVCL's Store to the site of erection.

GENERAL CONDITION OF CONTRACT:

1) DELAYED AND LATE TENDERS

No tender shall be accepted/opened in any case which are received after due date

and time of the receipt of tender irrespective of delay due to postal services or any

other reasons and company shall not assume any responsibility for late receipt of

tender. Any correspondence in this matter will not be entertained.

2) Tender fee (Non-refundable).

Tender fee (Non-refundable) plus GST as applicable notified in the tender notice should

invariably THROUGH Online NEFT/RTGS mode only ( In bank account as mentioned in

the tender notice copy of receipt must be uploaded online in pre-qualification stage)The

Tender Fees is Non-Refundable under normal circumstances. However, if purchaser

company decides to scrap/ cancel the tender, by one or another reason, in which bidders

are not responsible for cancellation/ scrap of tender, in such case tender fee may be

refunded to bidder(s), at sole discretion of the purchaser company.

Each tender must be accompanied by Earnest money equivalent to 1% of the

estimated value and it must be paid online through NEFT or RTGS mode only copy of

receipt must be attached online in prequalification stage. Earnest Money deposits

paid shall be liable to be forfeited in the event of failure accept the contract by

successful tenderers, EMD will be refundable to all unsuccessful tenderers on demand

and upon submission of original money receipt and after finalization of contract. The

successful tenderers will be eligible for refund of EMD after payment of security

4) DESCRIPTION OF WORK: As mentioned in the Schedule ‘B’.

The quantities mentioned in the accompanying Schedule are only approximate.

Actual quantities may increase or decrease according to the requirements. The

company reserves the right to revising or deleting any of the quantities actually

executed by the contractor will be calculated and paid at the rate given in contract

schedule of rates.

6) PERIOD OF CONTRACT:

The contract will remain in force for 1 Year. The contractor shall on completion of

the work, prepare and render the final detailed material account of the material

received by him from the company store within one month from the date of

completion of work. If however, the contractor does not render the material account,

Regd. A.D. Notice will be issued to the contractor to render the material account

within 10 days from the date of Notice, failing which the material account, will be

finalized and recoveries will be made as per the company’s procedure which shall

have to be accepted by the contractor and dispute if any raised shall not be

(7 Days a week) subject to maximum 10% of value of uncompleted work.

In case of Damage to government/Utility assets due to Non-Usage of CBUD

Application before execution of any excavation/digging activity recovery and

penalties must be imposed on the contractor/agency.

8) JURISDICTION: For any disputes the jurisdiction shall be circle office and the

decision of CEO & SE (O&M) shall be final.

9) SECURITY DEPOSIT:

The successful tenderer will have to pay security deposit equivalent of 5% of the

order value. This amount will be payable either in cash or through demand draft on

any Schedule bank drawn in favor of DGVCL. This amount will be refundable after

completion of work and/upon submission of NOC of engineer-in-charge. Order will be

issued to successful bidder after payment of security deposit.

If during 12 calendar months from the date of handing over charge after completion

of work, the erected lines are found defective in any way the same should be made

good by the contractor free of cost.

11. INDEMNITY BOND:

The contractor will have to execute an indemnity bond on stamp paper of Rs.300/-

at his cost before commencement of work stating that for any accident to the

contractor’s staff/equipment of any person or any other fatal or non-fatal due to non-

observing of safety measures, DGVCL shall not be held responsible.

12) SOLVENCY CERTIFICATE:

He shall have to produce the solvency certificate as per the company’s rules if the

order value exceed Rs.15000/-.

The contractor will also have to execute an agreement on a non-judicial stamp paper

of Rs.300, in line of acceptance of contract.

14) CONTRACTOR’S LIABILITY:

For any accident either fatal or non-fatal to the workers due to non-observance of

the safety measures and line clearance procedure, company shall not be held

16) UNDERTAKING BY CONTRACTOR:

Should this tender be accepted I/We hereby agree to abide by and fulfill all the terms

and conditions/provisions of the ‘Tender’ and contract for works as applicable and in

default there of to forfeit and payable to the company the sum/s of money as may

Income tax will be deducted from contractor’s bills.

GST is applicable as per the finance Act-2017 or latest revision. The registration with

government for GST is must. Otherwise it is mandatory to submit letter head on

which bidder has to clearly mention whether GST to be paid is eligible or not.

18) Goods and Service Tax (GST) :

The F.O.R. Destination prices are excluding GST and Cess as applicable which will be paid

extra on a given taxable goods and/or services within the original contractual delivery

period. The amount of GST and Cess as applicable should clearly be indicated separately.

(FST/Cess means all applicable Tax/Cess under GST Laws. GST Laws means IGST Act,

GST (Compensation to the State for Loss of Revenue) Act, CGST Act, UTGST Act and

SGSCT Act, 2017 and all related ancillary legislations).

If the Supplier/Contractor has opted for the Composition Scheme of GST, the same must

be clearly specified with valid Declaration & Certificate from department. In the event of

withdrawal/cessation of the Supplier from Composition Scheme during the tenure of the

contract, the rate mentioned in the price bid shall be final and any additional GST will

have to be borne by the tenderer. In no case additional amount towards tax or otherwise

will be paid / reimbursed to supplier/contractor. Further Statutory Variation clause will

not be applicable in case of Supplier / Contractor has opted for Composition Scheme

Supplier/Contractor should charge GST in Invoice at the rate as agreed to / mentioned in

acceptance of tender only and any deviation in the same shall not be accepted. Further,

any additional liability of GST (later on due to wrong mentioning of GST rate, mis-

interpretation of HSN/SAC Code, etc.) over and above as charged in the invoice shall be

borne by the Supplier/ Contractor. However, any refund received by the supplier /

contractor on account of GST charged from the company; such refund shall have to be

passed on to the company, along with interest if any. Such refund along with interest

needs to be passed on suo-moto by the supplier / contractor.

In case, Govt. revised the rate of GST rate / Code during the tenure of the contract, the

provision of GUVNL’s statutory variation clause shall apply.

19) INPUT TAX CREDIT BENEFIT

In the event of any statutory increase in the rate of Input Tax Credit and / or due to

inclusion of any other additional item of their inputs / input services under the ambit of

the Input Tax Credit provisions under the GST Act, subsequent to the date of submission

of the offer, the same should be passed on to COMNPANY and you should inform such

changes to COMPANY from time to time.

20) STATUTORY VARIATION:

Any statutory increase or decrease in the taxes and duties including GST and Cess as

applicable or in the event of introduction of new tax/cess or cessation of existing tax/cess

subsequent to suppliers offer if it takes place within the original contractual delivery date

will be to COMPANY’s account subject to the claim being supported by documentary

evidence. However, if any decrease takes place after the contractual delivery date, the

advantage will have to be passed on to company.

Statutory Variation clause shall not be applicable in case of Supplier / Contractor has

opted for Composition Scheme under GST.

21) PRICE EVALUATION:

No price preference shall be given on any account. All Tenders shall be evaluated on firm

price End Cost (with GST and Cess as applicable) basis unless otherwise mentioned in

the Tender documents.

If the Tender is invited with Total Owning Cost (TOC) clause, the evaluation shall be done

accordingly. For the same, the Bidders have to give the detailed breakup of the End Cost.

The SOR rates shown under schedule- B are excluding of GST in case of erection

of HT/ LT line & T/C work, whereas in case of underground cable work, the SOR

rates under schedule-B are inclusive of GST.

The terms and conditions stated above are carefully read by me/us and are

acceptable to me/us.

giving details of Name of s/s, Name of feeder, type of kit used ,date of

providing kit, sub orderno.etc. utilized by them to The E.E (O&M), DGVCL,

for business dealing and /or black listed by GUVNL and / or their any

subsidiary company Viz. MGVCL/PGVCL/UGVCL/GSECL/ GETCO/DGVCL.

If found during Tender procedure DGVCL has rights to disqualify/reject at any

stage of tender.

If the Supplier/Contractor has opted for the composition scheme of GST, the same must

be clearly specified with valid Declaration & self-certified Certificate from Department. In

the event of withdrawal/cessation of the Supplier from composition scheme during the

tenure of the contract, the rate (i.e. price) mentioned in the price bid shall be final and

any additional GST will have to be borne by the tenderer himself. In no case additional

amount towards GST or otherwise will be paid / reimbursed to supplier/contractor.

Further statutory variation clause will not be applicable in case of Supplier/Contractor has

opted for Composition Scheme under GST.

Also, please mention separate applicable HSN / SAC Code and rate of GST and Cess as

applicable for each item of Goods/Service. If not specifically mentioned then COMPANY

will have the option to take the prices as exclusive of taxes and duties at maximum higher

slab rates for the evaluation of the tenders.

The Tenderer should invariably indicate the total unit end cost price considering all their

costs / calculations in the Price bid itself for each item and all sub-items if any. This is a

must. Cost components hidden / furnished elsewhere will not be considered and will be

ignored out rightly.

intends to supply the goods / services, meaning there by the bidder has to supply the

SPECIAL TERMS AND CONDITIONS OF CONTRACT

1. For any damage to the equipment or persons working for the job, DGVCL will not

be responsible for the same.

2. The contractor should fulfill the conditions of contract of Labor Regulations and

Abolition Act 1970 and will have to furnish records failing which payment will not be made.

The contractor should specify License No. Contractor should possess the GST& should also

intimate PF Code No. & contractor are also bound to fulfill all the conditions as per the provision

of EPF and MP Act 1952 & Schemes framed the render otherwise Tender will be liable

for termination.

3. Any liabilities arising in connection with GST will be of contractor.

4. The rates are asked for only on percentage basis against estimated amount i.e. item wise rates

stated in the Schedule ‘B’ The tender offer must be specify the percentage either above or

below to the estimated amount. And it should be clearly specified both in figures and words.

5. No conditional offer will be accepted in any circumstances.

6. The contractor should sign all the tender documents wherever necessary, failing which the

offer is liable to be ignored.

7. In case of any mistake, in writing the percentage offer between the figures and words, the

13. In case of any ambiguity, discrepancy or dispute the decision of Executive Engineer(O&M)

Ankleshwar Rural Division DGVCL will be final and shall be binding to the tenderer.

14. Against the approved rate contract engineer-in-charge will issue detailed work order T.S.wise

during the validity period of contract. The actual quantity may vary according to the quantum

of work to be executed during contract period.

15. Wherever, there is an excess work carried out by the contractor, beyond the Technically

sanctioned amount against the work order, approval for the excess quantity of work done

should be obtained from the competent authority as per DGVCL’s rules.

16. The work will be carried out as per program laid by the DGVCL and the DGVCL and the

contractor should thoroughly supervise the execution of work throughout by being present

on the work site throughout.

17. No tools will be supplied by the DGVCL and the contractor should make his own

Arrangement to get adequate quantities of all tools in order to complete the job within the

prescribed period.

18. The contractor shall be responsible for breakage, loss or theft of material during transit or

erection, issued to him from stores, till the time the work is handed over and taken over

19. Starting of works and completion period: The erection work should be commenced

within seven days from the date specified in the offer to commence work, issued by the

Deputy Engineer (O&M) and should be completed within the prescribed period for each work.

20. Bills be prepared once month looking to the progress of the work and payment will be made

A] Running bill may be paid on the progress of work carried out and measurement recorded

up to 80% on submission of material account.

B] Final bills for contracts will be paid after completion of works &recording measurements

submitting material Account. If contractor proceed further and finalize the bill.

21. No material of the DGVCL should be left on the line without supervision.

22. For stringing of aluminum or ACSR conductor, aluminum or wooden pulley must be used for

supporting contact on poles.

23. All conductors, earth wire & stay sets must be tight.

24. All the poles must be in plumb.

25. Fabrication fittings on poles must be light and painted.

26. Stay Rod pit must be as per instruction.

27. Generally 30-40mtr. Span should be kept on HT/LT line.

28. All road crossings must be provided with guarding arrangement and minimum 22 feet

clearance must be kept between conductor and road level.

29.Contractor must get the requisition, three days well in advance before they require the material

on site, from Engineer-in-charge.

30.The payment to the contractor through RA bill be to the extent of 100% of the value of the

work done provided the contractor furnishes the material account in respect of the previous

RA bill before the next RA bill is paid. If this is not complied with by the contractor the

payment through RA bill shall be made only to extent of 80% of the total value of the work

done, the amount so withheld will be released on furnishing by the contractor the material

account of the relative RA bill.

31.The contractor shall on completion of work prepare RA bill and render the final detailed

material account of the material received by him from the DGVCL’s store within one month

from the date of completion of work. If however, the contractor does not render the material

account, a Regd. A.D. Notice will be issued to the contractor to render the material account,

within 10 days from the date of Notice, failing which the material account will be finalized

and recoveries made as per the DGVCL’s account which shall have to be accepted by the

contractor and disputes if any raised shall not be entertained.

32. The contractor is bound to complete the work within the specified period from each, work

given by the Engineer-in-charge.

33. Priority of works would be decided by the engineer in charge and the contractor shall carry

out the work within stipulated time for order issued by Engineer in charge.

34. The contractor must have adequate resources and gang of unskilled & skilled personnel to

undertake the work at the different places.

35. For rate contracts, the contractor will be given separate order for each work on the basis of

the rate contract order. The date of commencement and date of completion of work will be

stipulated in order which the contractor has to agree otherwise the penalty will be levy able

for late completion of work as per DGVCL’s standard conditions.

36. The contractor will be governed by the following clauses and to be signed by him:

a) Should this tender be accepted I/We hereby agree to fulfill all terms and provisions of the

Tender & Contract for works as applicable and in default thereof to forfeit and pay to the

DGVCL the sum/s of money as may become due.

b) The full value of the ‘Earnest Money Deposit’ paid herewith shall be absolutely forfeited to the

DGVCL should I/WE not deposit the full amount of specified Security Deposit in time.

c) The competent authority will delete any item in Schedule ‘B’ in the Tender.

d) The contractor will have, to produce a solvency certificate before commencement of work.

e) For any accident either fatal or non-fatal to the workers due to non-observance of safety

measures & line clearance DGVCL shall not be responsible.

f) Any loss sustained due to this will have to be borne by the contractor.

g)Contractor has to provide separate PF Code No. from the RPFO for their employee/s it is to be

ensured that any contractor who do not posses separate PF code should not considered for

acceptance of tender.

h) Contractor shall pay minimum wages to each laborer as per the minimum wages act 1948and

rules therein, as applicable from time to time in pursuance to the Govt. Notification and

compensation Act applicable Workmen Compensation Act.

i) Contractor will have to carry out works in any area of Ankleshwar Rural [O&M] Division if need

be as per the instruction of Executive Engineer (O&M) Ankleshwar Rural Division.

j) Executive Engineer (O&M) Ankleshwar Rural Division can discontinue contract at any time with

out assigning any reasons/can take, further actions as per DGVCL’s rules against the

TERMS & CONDITION

22) DE will give the programme to the contractor under intimation to the Division Office, with

the details of work under each item with quantity feeder wise and location wise and

accordingly on receipt of such intimation the contractor shall have to start the work within

10 days, failing which the particular work shall have to be got completed by the DE

concerned through sources at the cost and risk of the contractor. The expenditure incurred

in excess in such cases, then the tendered rates shall have to be recovered from the amount

due to the contractor.

23) According to the contractor, if he feels more erecting work than actually intimated to him by

the DE concerned through sub-work order he should not carry out such work at his own

accord but he should point out the same to the DE and only if he agrees to the same and

issued supplementary sub-work order, than only such work should be carried out. For the

work carried out without such sub-work order will not be paid to the contractor.

24) The contractor should prepare a detailed list of work carried out by him location wise as per

sub-work order and he should obtain the signature there on of the DE OR JE of the S/dn

and the same should be presented to the DE for preparation of bill.

25) Whenever any material is required to be replaced the contractor shall be given such material

from the sub-division office and for the same he will have to rend full account to the S.D.O.

similarly any broken or scrap material gathered from such work should be credited to sub-

division office. If no such old scrap material is available on line, he should obtain clear

certificate to that effect from the DE OR JE concerned.

26) What so ever material is required to be use by the contractor as per schedule of the tender,

he will have to bring the same to the notice of the DE OR JE and the same should be utilized

as per there instruction, only when such materials are approved by them.

27) For Tools, Tackles, Hand Carts etc. the contractors shall to make their own arrangement.

28) The contractor should obtain insurance policy in respect of his lab ours towards accident risk

and the Xerox copy there of may should be produced to the Division Office along with the

contract documents executed.

29) Before starting the work on any line the contractor shall have to obtain shut down on that

line through the DE/JE concerned and regarding the shut down obtained he should get such

shut down order. If the contractor fails to obtain such order from the DE/JE concerned,

them in cases of any event of accident or otherwise, the contractor will be only responsible.

30) Carryout the work as per R.E. norms.

31) The painting works to the fabricated material is must.

32) The numbering work is must.

33) As these works are under TASP scheme and to be executed in specified time limit therefore

time limit of work shall be four months and works shall be executed in equated monthly

portion with ref. to total cost of tender failing which action shall be taken in conformation

with the prevailing rules of the company.

34) You will have carry out the work any S/Dn. office under control of Ankleshwar (O&M)

Division if required with same rates & same terms & conditions.

35) Security deposit amount will be refunded after six months from the completion of last job

36) Rates are inclusive of PF and work contract tax exclusive of GST whichever is applicable.

37) I/We declare that I/We am/are not black listed / stop dealing in any organization

38) DGVCL all rights reserve to black list/stop dealing if the contractor is found defaulter/non

satisfactory work or violation of conditions of contract.

39) It is mandatory for all bidders to submit their tenders documents by both forms of oneline

(e-tendering) and physical in schedule time. If tender is submitted in any form, i.e. either

by online OR physically, the bid shall not be considered.

40) Following documents are mandatory for physical submission alongwith tender at office of

executive Engineer (O&M), Ankleshwar Rural Division, Ankleshwar only through Speed-
