Eligibility Criteria

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

1.Tenderer who are found as non-payee of wages & statutory payments such as EPF & ESI in any previously worked offices from any source are liable to be directly rejected without any notice.2.The amount put to tender arrived is exclusive of GST, However GST will be paid separately to the tendered amount during billing duly after producing paid challans.3.The amount put to tender is excluding GST.The bidder should quote for the amount put to tender.However GST will be paid separately as per the applicable laws subject to the conditions mentioned in the Govt. circular No. FD 417 EXP-12/2024 dated 09-08-2024

4.Estimate rates are excluding GST as per current Common SR and as per labour rates for the year 2025-26 and prevailing GST (18% of Amount Put to tender) amount is kept in form of Lump sum in sanctioned estimate according to guidelines in Common SR (GO:PWD 51 RDF 2019 Bangaluru Dt:18.03.2022). Therefore, amount put to Tender and ECV amount are excluding GST. KPPP-PORTAL format has No Options to add GST Separately at stage of Draft Tender Schedule Process for Over All amount put to Tender, tender has been inviting through an Option with INCLUSIVE. But the item wise rates do not include GST. Hence, GST will be paid separately for the quoted amount accordingly. Declaration Certificate shall be uploaded as per the Annexure II enclosed.

5.In the KPP Portal the amount put to tender is exclusive of GST.However in the display of table of pricing details in the heading display says it is inclusive of GST.This difference shall be rectified during evaluation of tender(Financial bid) duly considering GST.

6.The contractor should neither make any alteration in the conditions of contract or not stipulate any conditions of his own.7.Tenderer who are found as non-payee of wages & statutory payments such as EPF & ESI in any past worked offices from any source are liable to be directly rejected without any notice 8.Any bidders who is otherwise technically qualified withdraws from the bidding process at any stage before a final decisions taken on the tender, the EMD of such bidder shall be forfeited, the name of such bidder shall be recommended for removal from the KPWD list of contractors at least for a minimum period of one year in KNNL, besides making such bidders liable for black listing

9.If there are more than one number of eligible L1 bidder then bidder selection will be done by lottery process at Division office level and the decision of the tender inviting authority is final in this regard at the time of financial evaluation.10.The Tenderer has to quote his service charges for supplying of manpower for individual service for the arrived amount considering minimum wages for Manpower.11.The Contractor is bound by Prevailing labour act & other statutory requirements during the course of Contract/services.12.Payment of the employee should be made on or before 7th day of every month and the tenderer should give 3 bill receipts in which one is given to the employee two should be submitted for the payment of concerned office

13.The Tenderer should pay the Employees salary and deductions prior within 7th of every month and payment should be made by the agency with his fund and then submit his bills to the KNNL/Nigama for reimbursement.14.The Tenderer is bound to pay the Employees salary even if there is non availability of grant 15.Bidder should be in position to pay Employees salaries though the payment made by department is delayed.16. Should mention name of the Man Power Service Provider and Firms fully address (Attach letter head), Office Phone, Fax, and Mobile No and E-mail ID17.Conditional tenders are liable to be rejected. The Officer competent accept the tenders shall have the right to reject any or all the tenders without assigning any reason and whatsoever.18.Corrigendum will be published in the web site for all modifications/corrections, if any. 19.During the time of opening of tender, if the employer finds that any certificate/information furnished through kpp portal is false such bidders will be disqualified and barred from participating in the bid.20.The tender is required to ensure browser compatibility of the computer well in advance until the last date and time for receipt of tenders.The department shall not be responsible for non accessibility of completed tender documents due to internet connectivity issues and technical glitches

21.Delay in the payment of labour by the Agency or any harassment to the labour, complaint shall be lodged against that agency in the police station for necessary action by the department and the successful Tenderer must submit the stamp paper of requisite value during the execution of contract assuring that he is directly responsible for the payment of the labours, all round issues of the labours and he should take care about strike from labours against the Department.22.Any lapses regarding the payment to the labour, the agency will be seriously reviewed and rescinding proposal will be sent.23.The receipt of ESI/PF of the Employee should be submitted to the office of Executive Engineer, KNNL,UTP Division,Shivamogga every month

24.Accidental benefit insurance records of each employee should be provided to the Department.25.Considering the availability of funds the bill of the agency will be paid.26.Each of the documents uploaded to the kpp-portal should be attested by a Notary and all the originals to be provided at the time of agreement.27.The agency whomsoever enlisted in the blacklist will not be eligible in the participation of tender process.

28.The tenderer should make the payment or salary to the employees based on Minimum Wages Act for the respective months.29.Employment of the employee working in the department should be continued if instructed by the department. Removal of the employee without any appropriate reason, advance deposition of money and question of forfeiting their salary should not be arised. If arises the tender of particular agency will be rejected ( As per rules, action will be initiated against any employee by the department)30.There should not be any complaints by the labourers against the contractor in any office regarding dues of statutory payments (EPF/ESI). If any such complaints are found to be existing and found to be true after verification, then the tender of such contractor is liable to be rejected/terminated at any stage without any notice
