Annual Maintenance Contract of LIFT installed at PF no 2/3 BSP end FOB of Uslapur railway station including supply of all spares for a period of 3 years."

The following documents should be submitted along with the Tender:

List of tools & plants as per format given in Annexure-A

List of Personnel Organization as per format given in Annexure- B

List of work in hand under progress/completed as per format given in Annexure-C.

Tenderer is required to submit "Certificate of completion" as per format given in Annexure D.

Tenderer is required to submit "TENDER FORM OFFER LETTER" as per format given in Annexure F.

Instructions to Tenderers and Conditions signed by Tenderer is required to be submitted as per format given in ANNEXURE G.

The Tenderer has to submit bank mandate details as per format given in Annexure-E

Please submit a certificate in the prescribed format (as per format given in Annexure Z) for verification / confirmation of the documents submitted for compliance of eligibility / qualifying criteria.

CONSTITUTION OF THE TENDERER'S FIRM : The tenderer shall clearly specify whether the tender is submitted on his own (proprietary firm) or on behalf of a partnership Firm / Company /Joint Venture(JV) / Registered Society / Registered Trust / HUF /LLP etc. Based on their constitution of the firm, they must submit the mandatory documents mentioned hereunder, as applicable . The tenderer(s) shall enclose the self attested copies of constitution of their concern, and copy of PAN card along with their tender. Tender Documents in such cases are to be signed by such persons as may be legally competent to sign them on behalf of the Firm, Company, Association, Trust or Society, as the case may be.

Sole Proprietorship Firm: The bidder shall submit the notarized copy of the affidavit.

Partnership Firm: The bidder shall submit self-attested copies of (i) registered/notarized Partnership Deed and (ii) Power of Attorney duly authorizing one or more of the partners of the firm or any other persons(s), authorized by all the partners to act on behalf of the firm and to submit & sign the Bid, sign the agreement, witness measurements, sign Measurement Books, receive payment, make correspondences, compromise/settle/relinquish any claim (s) preferred by the firm, sign 'No Claim certificate', refer all or any dispute to arbitration and to take similar action in respect of all Bids/contracts OR said Bid/contract.

Joint Venture (JV): The Bidder shall submit documents as mentioned in Clause 2.4 to GCC service.

Company registered under Companies Act-1956: The Bidder shall submit (i) the copies of MOA (Memorandum of Association) and AOA (Articles of Association) of the Company; and (ii) Power of Attorney duly registered/notarized by the company (backed by the resolution of Board of Directors) in favour of the individual, signing the Bid on behalf of the Company.

Society: The Bidder shall submit (i) self-attested copy of the Certificate of Registration, (ii)Deed of Formation and (iii) Power of Attorney in favor of the Tender signatory

POWER OF ATTORNEY : The tenderer whether sole proprietor / a company or a partnership firm / joint venture (JV) / registered society / registered trust / HUF / LLP etc if they want to act through agent or individual partner(s), should submit along with the tender, a copy of power of attorney duly stamped and authenticated by a Notary Public or by Magistrate in favor of the specific person whether he/they be partner(s) of the firm or any other person, specifically authorizing him/them to sign the tender, submit the tender and further to deal with the Tender/ Contract up to the stage of signing the agreement except in case where such specific person is authorized for above purposes through a provision made in the partnership deed / Memorandum of Understanding / Article of Association/Board resolution.

Certificate of information regarding employment/partnership etc. Of retired railway employees with the tenderer as per format given in Annexure-N.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

Tender form cost- Tender must be accompanied by a sum of amount mentioned above as tender form cost in account of FA& CAO/SECR/BSP payable at Bilaspur (Chhattisgarh) deposited through payment channel of IREPS (i.e. internet banking, credit/debit card), failing which the tender will not be considered and will be summarily rejected.

Contractor also must hereby agree to abide by the IRS-General Conditions of Contract(GCC) for Services, 2018; with all correction slips up-to-date

In case the date of closing mentioned in the Notice Inviting Tender is declared holiday/ bandh/ strike on any account, the date of closing tender online will not be changed as the application in the website of IREPS does not permit submission of any offer after closing date and time of the tender. However, opening of tender online will be on any convenient day.

The tender form is not transferable. Tender documents should be Digitally signed by the tenderer positively as tenderer shall be constrained to follow all terms & conditions as laid down in the tender documents for execution of the work.

If the tender documents are signed by the Representative/Partner of the firm, the Power of Attorney towards authorized signatory/partnership deed issued from proprietor in proper manner should be produced along with the tender documents.

The Tender shall be consisting of "One Bid System".

The Railway reserves the rights to increase/decrease the quantity of work as per GCC (Service) -2018 with latest correction slip

The offered rates will be valid for 45 days only from the date of tender opening.

The accepted rates will be valid for entire Contractual period of work from the date of execution.

The work should be executed as per schedule & scope of works.

The transportation charges towards the carrying of materials, equipments and man power etc. will be borne by the tenderer himself.

In case of any accidental injury/death to the staff of Contractor within Railway Premises during execution of the work, no Compensation will be awarded from the Railway Administration side.

Execution of contract documents:- The successful tenderer ( s ) shall be required to execute an agreement with the president of India acting through the South East Central Railway for carrying out the work according to Standard General condition of contract ( GCC ) for Services - 2018, Special conditions/specifications. annexed to the tender and specifications for work and materials of Railway as amended/corrected upto latest correction slips, mentioned in tender form (first sheet).

Price Variation Clause: Price variation shall be applicable as prescribed by the Ministry of Railways through instructions/circulars issued from time to time. All the relevant clause of GCC (Service) -2018 shall be applicable. Railway Board's letter applicable in this regard are as under: Letter No. 2017/EnHM/25/11 dtd. 14/05/2019 which points out that "service contracts are quite different from works contracts and involve substantial manpower component which is governed by minimum wages act and paid accordingly since beginning. As such no monetary limit has been prescribed for service contracts for application of PVC on materials component except the period beyond 18 months."

Communications to be in writing: All notices, communications, reference and complaints made by the Railway or the Contractor inter-se concerning the works shall be in writing and no notice, communication, reference or complaint not in writing shall be recognized

A checklist for the submission of documentary proof by the tenderers should be furnished folio wise and attached along with tender form.

Railway Passes: No free Railway passes shall be issued by the Railway to the Contractor or any of his employee / worker

All the bidders / tenderers should ensure that they are GST compliant and their structure / rates are as per GST law.

The Rly. Reserves the rights to order / cancel/ amend or modify tender with out assigning any reasons.

Earnest Money Deposit - Tender must be accompanied by Earnest Money Deposit * separately with tender document cost. Same can be paid on account of FA & CAO / SECR / BSP payable at Bilaspur ( Chhattisgarh ) deposited through payment channel available on IREPS, failing which the tender will not be considered and will be summarily rejected.( *if exempted from EMD, Bid Security Declaration must be compulsorily submitted in standard format as given in attachments.)

The bidder shall have to submit the documentary proof for MSME or OEM / Authorized dealership (issued by competent authority ) if the firm avail exemption in Tender document cost and EMD.

The above tender notice and tender document is available on the Web Site of Indian Rly - www.ireps.gov.in. Same can be filled and submitted online. However a separate payment to be done towards the cost of tender document separately in addition to earnest money while submitting the tender, otherwise the tender will be summarily rejected.

Rly. Administration shall not be responsible for any delay/difficulties/inaccessibility while submitting tender form through e-tendering by tenderer. In case of any discrepancy, Master copy available in the office shall be treated as reference and No claim on this account shall be entertained.

The General Conditions of Contract GCC (Service)-2018 with latest correction slip of Railway Board will be applicable.

In case of any ambiguity GCC (Service)-2018 with latest correcting slip will prevail over.

Tenderers are to bid online only in the above mentioned website. All the mandatory places in this tender, filled with marked with (*) are to be filled in by the tenderer. No manual offer is acceptable against this tender. No tender document in hard copy will be sold against this tender no. TENDERER'S POSTAL ADDRESS of tenderer: - The address, email id and Mobile phones, other phone nos. and other Details given in the portal while registering will be considered as official address and all Correspondence to the tenderer will be made in these registered modes. All communications sent in time to the tenders by post at the said address shall be deemed to have reached the tenderer duly and in time. Important documents shall be sent by registered post. However, an undertaking has to be given in the enclosed annexure by uploading a scanned copy of duly filled in form in the portal.

THE SCHEDULE OF WORKS The Schedule of works is also available separately in the website online and Rates are to be quoted online and submitted online duly signed digitally.

OPENING OF TENDER

Opening of e-tender online: The e-tender will be opened online using the IREPS portal. No representative is required to be present for opening of tender and taking notes of rates quoted and ranking as the complete details of rates etc. of all the bidders shall be available to the bidders in the website after the opening of the tender.

Submission of Document in support of Eligibility Criteria:All documents in support of fulfillment of Eligibility criteria if applicable with respect to completion of "similar nature of work for Technical Eligibility Criteria" and "total contract value for Financial Eligibility Criteria" should be uploaded online in the website with scanned copy at the time of tender bidding with details showing in the Annexures. Eligibility of the tenderers shall be decided solely on the basis of the documents submitted along with the tender offers.No post tender correspondence for submission of additional documents shall be entertained after opening of the Technical and Commercial offers. Even post tender letters of the tenderers shall be treated as NULL & void.

The maintenance of power car and escorting of power car and LSLRD shall be carried out by same agency. Maintenance (A,B/M1,C/M2+M3,D/M4 & E/M5 and Escorting works to be executed by respective OEMs. OEM can get the work done through their authorized dealers for Escorting and A,B &C checks. D and E checks have to be carried out by OEMs only. OEM will participate in Railway tender of DA set maintenance and escorting. Full responsibility regarding execution of work will be of OEM only and billing will also be done in name of OEM.
