Eligibility Criteria

The intending bidders are advised to visit the site of work before submitting their tenders

The necessary certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e-tender document. The Original certificates/documents shall be produced on or before stipulated date and time for verification. Scanned signature of the bidder/authorized representative of the bidder shall be attached while uploading bid document

If any of the dates mentioned above happen to be a general holiday, the next working day holds good.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

If the percentage quoted by contractor for the work is below Ninety percent (90%) of the amount put to tender (updated cost as per CSR) then the successful contractor shall furnish an additional performance security in the form of bank guarantee for an amount equivalent to the difference between the cost as per quoted percentage and Ninety percent (90%) of the amount put to tender (updated cost as per CSR) before executing the agreement. In case of contractor quoting the percentage above One Hundred and Twenty five percent (125%) of the amount put to tender (updated cost as per CSR) then the amount over and above One Hundred and Twenty five percent (125%) of the amount put to tender (updated cost as per CSR) will be withheld during the progress of work. The additional performance security furnished in the former case/withheld amount in the later case will be released only after the entire work entrusted is fully completed and so certified by the Executive Engineer.

Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever.

Corrigendum will be published in web site for all modifications/corrections if any.

Maintenance period or the defect liability period for this work is one year from the date of completion of work.

Tendering by the joint venture will not be allowed

The contractor should furnish the name of the individual firm with address and Telephone numbers with place of registration, year of incorporation etc.

Royalty on construction materials and other taxes will be deducted as per prevailing Government orders.

No quarries are approved by KNNL for materials. The quarries considered are for the estimate purpose only. The intending bidders shall visit the site, identify the quarries, ascertain availability for the quantity and quality of the materials required for the work and shall quote his rates accordingly. No extra claim whatsoever will be entertained in this regard.

On account of restrictions on sand mining and scarcity of availability of sand, as an alternative the use of manufactured sand (M sand) may be allowed during the execution of work at no cost/implication with the written approval from the competent authority.

The rates includes all leads and lifts and work shall be carried out as per the instruction of Engineer-in-charge All specifications are as per relevant IS codes in vogue and Indian Road Congress. The rates for the specification in the Schedule B includes all lead and lifts irrespective of the distance and height, no extra claim will be entertained for additional lead and lifts.

The contractor should note that, the land required for the work shall be at his personal responsibility till the completion of work.

The intending Bidders should note that, if any part or whole of land required for the work is not yet acquired by the KNNL it shall be the responsibility of the contractor to procure possession of such land by consent by the land owner before commencement of work at no extra cost to KNNL and no claim whatsoever relating to non-availability of land would be entertained

The intending bidder should note that, as the tender invited is on percentage basis, if the bid amount based on the percentage quoted by the contractor is less than the amount put to tender, the contractor shall submit the additional performance security for an amount equal to the difference between the amount put to tender and quoted amount in the form of FDR as per security deposit clause mentioned in the tender document. In case of contractor quotes the rates above 110% of the estimated rates, then the amount over and above 110% will be withheld during the progress of work. The additional performance security will be released proportionately to the bill amount till the contractor achieves progress of entire work as per agreement

Within 20 Days of Receipt of the Letter of Acceptance the Successful tenderer shall deliver to the Employer a Security Deposit in any Of the Forms Given Below for An Amount Equivalent To 5 percentage Of the Contract Price Plus Additional Performance Security deposit for an amount equivalent to difference between quoted amount and estimated amount put to tender for Unbalanced Tenders FDR/Bankers Cheque /Pay Order in Favour of the Executive Engineer KNNL KPC Division No 01 Bidar. Specified Small Savings Instruments Pledged to the Executive Engineer KNNL KPC Division No 01 Bidar 1 percentage labour cess as per provision of building and the construction works welfare act 1996 will recover from each running bill of the contractor

The representative of the contractor who will attend for opening of tender should bring the authorization letter from the concerned contractor.

The validity period of EMD shall be for a minimum period of 180 days from the date of opening of the tenders.

EMD of the unsuccessful bidders will be refunded only after the acceptance of tenders by the competent authority (clause 21 of the Formal Tender Notice)

EMD amount and Amount put to tender will be as mentioned in the e-portal.

The Earnest Money Deposit. (E cash). The Earnest Money Deposit of Lowest bidder will be transferred to CAO, KNNL, and Account Dharwad and will be converted into security deposit and same will be refunded after maintenance period of the work

The proposed methodology and program of construction, backed with equipment planning and deployment, duly supported with broad calculation and quality control procedures proposed to be adopted, justifying their capability of execution and completion of the work as per technical specification within the stipulated period of completion as per milestones

In view of introduction of GST from 01.07.2017, in the NIT and Bid Document, the following stipulation shall be incorporated

The estimates are prepared based on the common SR 2023 24 continued 2024 25 and 18percent added to the estimated amounts as mentioned in SR. The estimated amount put to tender for the work is exclusive of GST. The contractor should bid based on the estimated amount put to tender (excluding GST but including all other charges as applicable. GST shall be paid to the tendered amount separately. Further the increase in GST shall not be paid in the extended period of contract for which the contractor alone is responsible for delay as determined by the authority while granting the extension of time.

COVER-II shall contain the financial bid in the Schedule B

The Cover-I (Technical bid) will be opened first and there after Cover-II (Financial bid) of only those bidders who fulfill the stipulated conditions in Cover-I, will be opened.

Issue and submission of tender documents will be as under

The aspiring bidders who have not previously obtained the user ID and Password for participating in e-tendering may now obtain the same by requesting the e-governance office, M.S. Building, Bangalore during office hours

The Contractor can pay the earnest money deposit (EMD) in e-procurement portal using any mode of payment such as Credit Card / National electronic fund transfer (NEFT) Over the counter (OTC).

To retain the EMD amount submitted in cash through E-procurement portal till the completion of tender procedure and after signing of the agreement, transfer the e-cash EMD of the successful bidders to KNNL Account.

The tender inviting authority would release EMD in cash through E-proc against Bank guarantee for similar amount.

To adopt such procedure in respect of all pending E-cash EMDs.

The necessary certificates / documents in support of fulfilling Clause 1.1 as stipulated shall be scanned and attached to e-tender document. Prior to awarding of work the Lowest -1 bidder should produce the original certificates / documents in support of the uploaded documents at the time of entering in to an agreement. If the L-1 bidder does not produce the original document for entering into an agreement then his bid can be treated as non-responsive bid as per Clause 26(4) of the KTPP Rules. The names of the bidder who does not produce the original documents can be removed from select list of KNNL enrolment and barred from participation in any of the tenders to be invited by KNNL apart from forfeiting the EMD paid through e-cash. As per updated circular of the senior Geologist, Department of Mines and Geology, Bengaluru, it is mandatory for contractors to obtain mineral material required for the work from the authorized agency/contractors having Mineral Dispatch permit (MDP) issued by Mines and Geology Department

Building operation and maintenance should be properly maintained and adhered in Defect and liability period.

Even though the Tenderers meet the above criteria, they are subject to be disqualified if they have made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements and or record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures etc.and or participated in the previous Tender for the same work and had quoted unreasonably high tender prices and could not furnish rational justification.
