Cleaning of WAG-9 Electric Locomotives of ELS ROU, for a period of 02 years.

Financial Standing: The bidders will be qualified only if they have minimum financial capabilities as below- a) T1- Annual Turnover: The bidder should have an annual financial turnover not less than 1.5 times the advertised bid value during the last three previous financial years and in the current financial year up to the date of opening of the tender. The audited balance sheet reflecting financial turnover certified by Chartered Accountant with her stamp, signature and membership number shall be considered. b) T2- Liquidity: The bidder should have accessed to or has availed liquid assets, lines of credit and other financial means to meet cash flow that is value at 5% of the estimated bid value net of applicant's commitments for the contracts. The audited balance sheet and / or banking reference certified by Chartered Accountant with her stamp, signature and membership no. shall be submitted by the bidder along with the bid. Banking reference should contain in clear terms the amount that Bank will be in a position to lend for this work to the applicant / member of the Joint Venture / Consortium. In case the Net Current Asset (as seen from the balance sheet) are negative, only the banking reference will be considered. Otherwise, the aggregate of the Net Current Asset and submitted banking reference will be considered for working out the Liquidity. The banking reference should be from a Schedule bank of India and it should not be more than three months old as on date of submission of bids. The balance sheet and all other financial documents attested/certified by CAs to substantiate fulfilment of Financial Eligibility Criteria should be with UDIN, failing which, the offer is likely to be rejected without any further reference. In case of JV firms' overall liquidity of JV firm shall be assessed by arithmetic sum of liquidity of all members of JV. The sample format is attached as Annexure-G of Instruction to Tenderer. Note: The banking reference should be from a Schedule bank of India and it should not be more than three months old as on date of submission of bids. The banking reference issued by bank should be certified by Chartered Accountant with her details as described in the format provided at Annexure 'G' of Instruction to Tenderer. Tenderer should upload the scan copy of all documents relating to Financial Standing & its compliance along with the offer, failing which their offer will be considered invalid and same shall be summarily rejected.

Work Experience: The bidder should have satisfactorily completed in the last three previous financial years and current financial year up to the date of opening of the tender, one *similar single service contract for a minimum of 35% of advertised value of the bid. Completed Service contract includes ongoing service contract subject to payment of bills amounting to at least 35% of the advertised value of the bid. Work experience certificate from private individual shall not be accepted. Certificate from public listed company / private company / Trusts having annual turnover of Rs. 500 crore and above subject to the same being issued from their Head Office by person of the company duly enclosing his authorization by the Management for issuing of such credentials. Note: The bidder shall submit details of work executed by them in the prescribed format Annexure-H & Annexure-I of Instruction to Tenderer along with bid for the service contracts to be considered for qualification of work experience criteria clearly indicating the nature/scope of contract, actual completion cost and actual date of completion for such c o n t r a c t . * Similar work implies- Cleaning OR Washing of "Filter/Radiator/Equipment/Loco body/Loco cab/Machine Room" of "Electric Loco/Diesel Loco/EMU/DMU" on "Indian Railway/Govt. Organization/Public Sector Undertaking." Tenderer should upload the scanned copy of all documents relating to Work Experience & its compliance along with the offer, failing which their offer will be considered invalid and same shall be summarily rejected.

DISQUALIFICATION OF BIDDERS: 1.1) Employment / Partnership etc. of Retired Railway Employees a) Should a Bidder be a retired Manager of the Gazetted rank or any other Gazetted Officer working before her retirement, whether in the executive or administrative capacity or whether holding a pensionable post or not, in any department of any of the railways owned and administered by the President of India for the time being, or b) Should a Bidder being partnership firm have as one of its partners a retired Manager or retired Gazetted Officer as aforesaid, or c) Should a Bidder being an incorporated company have any such retired Manager or retired officer as one of its directors or d) Should a Bidder have in her employment any retired Manager or retired Gazetted Officer as aforesaid, then the full information as to the date of retirement of such Manager or Gazetted Officer from the said service and in case where such Manager or Officer had not retired from Government service at least one year prior to the date of submission of the Bid as to whether permission for taking such contract, or If the contractor be a partnership firm or an incorporated company, to become a partner or Director as the case may be, or to take the employment under the contractor, has been obtained by the Bidder or the Manager or Officer, as the case may be from the President of India or any officer, duly authorised by her in this behalf, shall be clearly stated in writing at the time of submitting the Bid. Bids without the information above referred to or a statement to the effect that no such retired Manager or retired Gazetted Officer is so associated with the Bidder, as the case may be, shall be rejected. 1.2) Should a Bidder or contractor being an individual on the list of approved Contractors, have a relative(s) or in the case of partnership firm or company of contractors one or more of her shareholder(s) or a relative(s) of the shareholder(s) employed in gazette capacity in any department of Indian Railway, the authority inviting bids shall be informed of the fact at the time of submission of Bid, failing which the bid may be disqualified/rejected or if such fact subsequently comes to light, the contract may be rescinded in accordance with the provision in clause 7.4 of the General Conditions of Contract for Service. The declaration to this effect shall be furnished by the contractor in the format as in Annexure E of Instruction to Tenderer. 1.2.1) If the bidder or any of its constituents has been levied with a penalty for violation of labour laws for three times in the last two years (from the date of opening of tender) by the appropriate enforcing agency like the Labour Commissioner etc. 1.2.2) The contractor shall be disqualified from participating in the bidding for services in a Railway division, i) If any previous contract of the bidder or any of its constituents had been terminated within the previous 2 years from date of submission of bids.

ii) In that Railway division, the bidder or any of its constituents has been imposed a penalty equivalent to the maximum penalty that can be imposed under a previous contract, such a figure being specified, within the previous 2 years from date of submission of bids. (Period of 2 years shall be reckoned from the date on which the total accrued amount of penalties has reached the maximum penalty that can be imposed under the contract, as specified by the Competent Authority) The declaration to this effect shall be furnished by the contractor as a part of his bid document. Annexure-E & F of Instruction to Tenderer in this regard shall be filled and submitted by the contractor. In case this declaration is found to be false, process for 'banning of business' against the bidder/contractor shall be initiated as per extent rules.

Tenderer has to upload the scanned copy of Proprietorship certificate or Partnership deed etc., along with the offer.

Tenderer has to upload the scanned copy of PAN card & GST registration certificate along with the offer.

Tenderer has to upload the scanned copy of vendor mandate form, duly filled from BANK, as per format given in Annexure-C of Instruction to Tenderer.

The bidders shall be required to submit an undertaking certifying the truthfulness of all the documents submitted/ uploaded along with the tender. This shall be mandatory for all the bidders. In case of failure of the bidder to submit the undertaking, their offer shall be summarily rejected. Format for such undertaking is annexed as Annexure 'D of Instruction to Tenderer'.

In addition to Annexure 'D', in case of other than Company/Proprietary firm. Annexure 'D (A)' (format available in Instruction to Tenderer) shall also be submitted by the each member of a Partnership Firm/ Joint Venture (JV) / Hindu Undivided Family (HUF / Limited Liability Partnership (LLP) etc, as the case may be. Non submission of above certificate(s) by the bidder shall result in summarily rejection of his/their bid.

Tenderer has to upload details of work executed by them as per Annexure-I in the format for consideration to qualify for work experience criteria clearly indicating the nature / scope of contract, actual completion cost and actual date of completion for such contract.

Tenderer has to upload List of works on hand as per Annexure-H indicating description of work, date of award of contract, Description of the awarding agency, contract value, and due date of completion.

Tenderer(s) shall submit along with his / their tender, the list of personnel / organization on hand and proposed to be engaged for the tendered work. Similarly, list of Plant & Machinery available on hand and proposed to be inducted and hired for the tendered work, has to be submitted.

The details of organization / firm mentioning number of years in operations. Company establishment / registration certificate and company's work order copy / agreement copy /completion certificate etc. as proof of operation. Years shall be counted from the date of agreement of the work.

Size of workforce of the firm, EPFO challan or bank account statement in support of available manpower (duly submitted to EPFO) in respect of the previous four quarters preceding the date of opening of bid should be submitted in support of their qualification.

Certificate of Information regarding Employment/ Partnership etc. of Retired Railway Employees with the tenderer is to be mandatorily submitted as per format attached as per Annexure- E of Instruction to Tenderer. Non-submission of the same shall lead to rejection of the tender.

SCOPE OF WORK: As per Annexure 'A' of Instruction to Tenderer.

CONSIGNEE: SSE/E5/TRS/ROU will be the consignee of work. JE/LCS shall be overall coordinator for the work of- Cleaning of WAG-9 Electric Locomotives of ELS ROU and related activities in shed. Sr. DEE/TRS/ROU shall be the bill passing authority and Sr. DFM/CKP shall be the bill paying authority.

COMPLETION PERIOD: This work will be completed within 02 years from the date of issue of LOA. However, the work should start within 15 days of issue of letter of acceptance. If firm fails to start the work within 15 days from date of issue of LOA, penalty as per penalty clause shall be levied.

QUANTITY: The total number of locomotives for scheduled inspection, unscheduled inspection and waterless urinal to be Cleaned/Washed during 02 years is 2344, 264 and 240 nos. respectively. Accordingly, in a daily basis approximately 04, 01 and 01 loco respectively, shall be offered to the contractor for cleaning work. However, this quantity is not fixed and it may vary on daily basis, as per loco visit/ availability.

PLACE OF WORK: The work shall be carried out at shed premises of Electric Loco Shed, Rourkela.

PRICES: The rates quoted should be inclusive of all taxes and charges including GST. All the bidders/tenderer should ensure that they are GST compliant and their quoted tax structure/ rates are as per GST Law.

MATERIAL: As per Scope of Work.

RELEASED MATERIAL: Released material, if any, shall be returned to the (consignee) Railways.

INSPECTION OF WORK: All work executed by the contractor shall be subject to inspection by the authorized representative(s) of the Railway. The contractor shall ensure that all tasks are completed to the full satisfaction of the inspecting authority. In the event that any work is found to be unsatisfactory, incomplete, or not in conformity with the specified standards, it shall be treated as incomplete work, and appropriate penalties shall be imposed as per the provisions of the Penalty Clause of the contract. (a) The contractor shall accept all reasonable suggestion towards quality improvement and standard practice that may be made by the Railway's representative during the progress of the work. (b) The Railway's officers reserve the right to check the progress of work as desired by Railways during any stage of this contract. (c) Further details are provided in Scope of Work.

WORK SCHEDULE & DEPLOYMENT OF MANPOWER: a)The contractor must engage sufficient numbers of manpower every day for completing the whole cleaning work of offered locomotives in their Scheduled Inspection on the same day, by 5.00 P.M in case the locomotive is offered in General Shift, and up to 10:00 p.m. in case the locomotive is offered in P3 shift. Any delay in this regard will attract penalty. Further, in the case of cleaning of locomotives in their Unscheduled Inspection, the cleaning work shall be completed within two hours from the date and time of offering of the locomotive. Any delay in this regard will attract penalty. b)One qualified Diploma Holder Engineer should be deployed by the contractor at ELS/ROU during execution of the subject work, vide Railway Board's letter No. 2012/CE-I/CT/O/20, dated 10.05.2013. The contractor shall ensure this aspect prior to starting of the work. This deployed engineer shall maintain a register for record of daily work performed. The security of the contractor's stores/materials will be contractor's responsibility. Prior to commencement of the contract, the contractor shall furnish the name, mobile phone number, email ID, and local address of his authorized representative(s), who shall be the point of contact for receiving work instructions and communication regarding job allocation. c)In case contractor wants to replace existing labour and engage any new labour(s) at later stage of the contract, the new staff will be allowed to work only after the contractor intimates Sr. DEE/TRS/ROU, in writing, along with the requisite educational certificate and Police verification certificate of the new labour. d)WORKING HOURS: As a general practice, work shall be offered during the general shift, i.e., from 08:00 AM to 05:00 PM, with a lunch period from 12:00 noon to 1:00 p.m. and during P3 shift, i.e., from 02:00 PM to 10:00 PM. However, the contractor may be required to undertake the work at any time, any day, including Sunday, NH & PH, depending on the requirements of the Railways. No female contractual labour shall be employed by the contractor before 6.00 a.m. or after 7 .00 p.m. of any day. The contractor is obligated to respond promptly and carry out the assigned work without delay. e)Actual working hours may vary as per availability of locomotives. At the time of carrying out the cleaning of WAG-9 Electric Locomotives of ELS ROU, contractor shall ensure that undergoing schedule activity of the locomotives should not be disturbed. f)No child labour shall be allowed, in any form.

PAYMENT TERMS: a)All the claims for payment, i.e., contractor's invoices, shall be accompanied with joint inspection note and other relevant documents i.e. documentary proof for payment of wages as per latest labour rate, EPF, ESI, Bank statement, wage slip etc. b)Applicable Minimum wages including ESI, PF etc. are to be paid by the contractor to all workers. In case, the contractor fails to pay the minimum wages to the deployed manpower, the work may be terminated. c)100% Payment will be made after completion of the work and after admissible deduction i.e., from the accepted amount. d)Part payment is admissible subject to monthly basis. e)Delay in payment or non- payment of the contractors' bill will under no circumstances be accepted as an excuse for contractor's failure to carry out the work as per the terms and condition of the contract satisfactorily. f)Payment for only that activity under Schedule of Rate shall be done which have been performed successfully by the firm and are accepted by the consignee vide its final joint inspection note. Partially completed work to any extent shall be treated as 'no work done', and no payment request in any proportion shall be entertained for such work.

PERFORMANCE GUARANTEE: Details are provided in Instruction to Tenderer.

SHRAMIK KALYAN PORTAL: i.Contractor is to abide by the provisions of various labour laws in terms of clause 54, 55, 55-A and 55-B of the Standard General Conditions of Contract. In order to ensure the same, an application has been developed and hosted on website 'www.shramikkalyan.indianrailways.gov.in'. Contractor shall register his firm/company etc. and upload requisite details of labour and their payment in this portal. These details shall be available in public domain. The registration/ updation in Portal shall be done as under: (a)Contractor shall apply for onetime registration of his company/firm etc. in the Shramik kalyan portal with requisite details subsequent to issue of Letter of Acceptance. Engineer shall approve the contractor's registration in the portal within 7 days of receipt of such request. (b)Contractor once approved by any Engineer, can create password with login ID (PAN No.) for subsequent use of portal for all Letter of Acceptances (LoAs) issued in his favour. (c)The contractor once registered on the portal, shall provide details of his Letter of Acceptances (LoAs) / Contract Agreements on shramik kalyan portal within 15 days of issue of any LoA for approval of concerned Engineer. Engineer shall update (if required) and approve the details of LoA filled by contractor within 7 days of receipt of such request. (d)After approval of LoA by Engineer, contractor shall fill the salient details of contract labours engaged in the contract and ensure updating of each wage payment to them on shramik kalyan portal on monthly basis. (e)It shall be mandatory upon the contractor to ensure correct and prompt uploading of all salient details of engaged contractual labour & payments made thereof after each wage period. ii.While processing payment of any 'On Account Bill' or 'Final Bill' or release of 'Advances' or 'Performance Guarantee / Security Deposit', contractor shall submit a certificate to the Engineer or Engineer's representatives that "I have uploaded the correct details of contract labours engaged in connection with this contract and payments made to them during the wage period in Railway's Shramikkalyan portal at 'www.shramikkalyan.indianrailways.gov.in' till ____Month,____Year."

PENALTIES FOR INFERIOR QUALITY OF WORK/ SERVICE: As per Instruction to Tenderer.

LEGAL CHARGES: A fee of Rs. 200/- only per legal document executed before or after execution of the contract will be paid by the contractor for obtaining legal advice in law office. This amount will be received by this office in the form of money receipt issued by any cash counter of S. E. Rly. This amount will be deposited under allocation Z-652 or 930652-00.

COMMUNICATIONS TO BE IN WRITING: All notices, communication, reference and complaints made by the Railway or the Manager or the Manager's Representative or the Contractor inter se concerning the works/ services shall be in writing and no notice, communication, reference or complaint not in writing shall be recognized.

INDEMNITY BY CONTRACTORS: The Contractor shall indemnify and save harmless the Railway, from and against, all actions, suit proceedings, losses, costs, damages, charges, claims and demands of every nature and description brought or recovered against the Railways by reason of any act or omission of the Contractor, her agents or employees, in the execution of the services/works wherever applicable or in her guarding of the same. All sums payable by way of compensation under any of these conditions shall be considered as reasonable compensation to be applied to the actual loss or damage sustained, and whether or not any damage shall have been sustained.

TERMINATION OF CONTRACT: In case of failure on the part of the contractor to complete the work within the stipulated period or authorized extended period and breach of any terms and conditions of the contract by the contractor, the Railway administration reserves the right to terminate the contract without notice. In cases, where performance or/and quality of services is/are found to be dissatisfactory, Manager or his representatives shall impose penalty as mentioned in bid document, subject to cumulative penalty for such dissatisfactory performance or/and quality of services does not exceeds 10% of original contract value or as prescribed in the bid document.

SUB-LETTING OF CONTRACT: The contractor shall not sub-let, assign or part with this contract nor shall take any partner or any other person / persons interested in the contract without the prior written consent of the Railway Administration. Any breach by the contractor in respect of the clause will entitle the Railway Administration without prejudice it's any other right or rights to terminate the contract forthwith.

POWER OF ATTORNEY: The tenderer shall submit "Power of Attorney" in favor of persons authorized, duly certified by Notary Public to execute and sign legal and financial documents.

FORCE MAJEURE: If at any time, during the continuance of this contract, the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of public enemy, civil commotion, sabotage, serious loss or damage by fire, explosions, epidemics, strikes, lockouts or acts of God (hereinafter, referred to events) provided, notice of the happening of any such event is given by either party to the other within 30 days from the date of occurrence thereof, neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other in respect of such nonperformance or delay in performance, and works/ services under the contract shall be resumed as soon as practicable after such event has come to an end or ceased to exist, and the decision of the Manager as to whether the works/ services have been so resumed or not shall be final and conclusive, PROVIDED FURTHER that if the performance in whole or in part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 120 days, either party may at its option terminate the contract by giving notice to the other party.

VARIATIONS IN QUANTITIES: As per GCC for Service, 2018 or latest.

TIME EXTENSION CLAUSE: As per GCC for Service, 2018 or latest.

LEGAL OBLIGATIONS TO CONTRACTOR: The buyer will in no way be responsible for the violation of any rules and/or infringement of any other laws from the time being in force, either by the manpower or by the service provider. The manpower as well as the service provider shall comply with the relevant rules and regulations applicable at present and as may be enforced from time to time, for which the buyer will not be liable or responsible in any manner. The onus of compliance to all the applicable laws/act/rules etc. shall only rest with the service provider.

USE OF INTOXICANTS: The contractor or her staff or any labour employed through sub-contractors or petty contractors, shall be prohibited from the use of any intoxicating substances including, but not limited to, intoxicating beverages during the service period or on site or near the site or in any of the trains, stations, buildings, encampments or tenements owned, occupied by or within the control of the Contractor or any of her/ his employees. The Contractor shall exercise influence and authority to the utmost extent to secure strict compliance with this condition.

RESTRICTIONS ON THE EMPLOYMENT OF RETIRED MANAGERS OF RAILWAY SERVICES WITHIN ONE YEAR OF THEIR RETIREMENT: The Contractor shall not, if she is a retired Government Manager of Gazetted rank, herself engage in or employ or associate a retired Government Manager of Gazetted rank, who has not completed one year from the date of retirement, in connection with this contract in any manner whatsoever without obtaining prior permission of the President and if the Contractor is found to have contravened this provision it will constitute a breach of contract and administration will be entitled to terminate the contract at the risk and cost of the contractor and forfeit earnest money deposit (EMD) and performance guarantee (PG) of the contract.

POLICE VERIFICATION OF LABOUR EMPLOYED BY CONTRACTOR: The contractor is required to submit Police Verification certificates for all contractual staff that she/he will be hiring for delivery of services for Indian Railways, prior to commencement of work. No contractual staff without police verification report shall be allowed to work. The expense for such verification shall be borne by the contractor. The format for the same is provided in the Annexure 'J'.

OPENING OF TENDER: The tender will be opened on the schedule date and time at ELS/ROU.

VALIDITY OF THE TENDER: The offer shall remain open for acceptance for a period of 60 days from the date of Tender closing. Within this period the contractor/Tenderer cannot withdraw his offer subject to the period being extended further if required by mutual agreement from time to time. Any contravention to the above condition will make the Tenderer liable for forfeiture of his Bid security.

AGREEMENT: The successful tenderer shall be required to execute an agreement on a prescribed format based on accepted terms and conditions. Payment against bills shall only be eligible after execution of the agreement.

OTHER TERMS & CONDITIONS: a) The contractor shall abide by all the statutory provisions and laws of Central and State Government including Hours of Employment Regulation. No staff should be deployed beyond eight (08) hours/day. b) This work is a labor-intensive work. The contractor shall not employ children below the age of 18 or as defined by the labour ministry as labourers directly or indirectly for the execution of work. c) The labours deployed by contractor for the entire work must have individual Bank Account in their own name. The payment to the labour by contractor shall be made as per the latest minimum wages issued from Chief Labour Commissioner through bank accounts of the individual labour only and not in cash. d) The contractor shall be responsible for employment of his labour and be liable for observance of all statutory provision of Government. No claim for employment of labour so engaged by the contractor in Railways whatsoever ground shall be entertained. e) The contractor will maintain the following registers: Attendance, Wage Register, Wages Slips etc. The contractor will be under obligation to show the statutory records, registers and various amenities of the labour to be maintained by him to the Principal Employer or his representative as and when required by former. f) The contractor shall ensure that all the fittings and parts/equipment of the locomotive are well protected and don't disturb /damage during the course of the work or afterwards. The contractor shall be liable to pay for direct losses, damages caused to the Railways by him or his workmen knowingly/unknowingly while they are in Railways premises working or not working. The amount shall be determined by the Senior Divisional Electrical Engineer, Electric Loco Shed, Rourkela. g) The contractor should submit the following documents to the office of Sr. DEE/TRS/ROU pertaining to each contractual supervisor/ staffs proposed to be deployed for execution of this particular contract before commencement of the contract and also for any subsequent changes in staff made during the execution of work: - a) Full name of the staff. b) Pass port sized photograph. c) Residential/permanent address with Telephone No./Mobile No./Copy of Aadhar card or any other ID card issued by govt. d) Copies of educational qualifications & age duly attested by Gazetted Officer (State or Central). e) Police verification certificates of all staff & supervisor. f) Details of bank account of each manpower, details of individual registration of PF/ESI, labour license (if applicable).

OTHER TERMS & CONDITIONS: h) Daily attendance register of labour deployed by the contractor will be maintained duly countersigned by contractor's representative/ supervisor and Railway's representative(s). All workers of the contractor will give their attendance (to consignee) in the shed every day sharp at 8.00 A.M., unless stated otherwise. i) Railway will not provide to the contractor, any type of tools, departmental staffs and to & fro transportation of the contractor's labour, towards execution of this work. j) The facilities which are given to Railway's staff, will not be given to contractor's labour, like traveling passes, medical facility etc. k)The contractor shall be responsible for safe custody of materials and safety of his labours. l) The contractor shall be responsible to settle any grievances of the labour deployed by him, in coordination with Railway's authorized representatives. m) The contractor shall take requisite precautions and use his best endeavors to prevent any riotous or unlawful behaviors by or amongst his workmen and other employed directly or indirectly on the works and for the preservation of peace and protection of the inhabitants and security of property in the vicinity of the works. In case any worker or the contractor found involved in any type of police case, antinational or anti-social activity etc. then the sole responsibility will be of contractor and in such cases, he will be liable for penalty and/or termination of contract. n) Contractor's labour & supervisor will be given one day general training regarding safety measures to be taken at the time of working on locomotive's roof or in close proximity to moving locomotives and 25 KV OHE as well as inside shed for safety of staffs. Contractor's supervisor and his labour have to give undertaking that they have understood the safety measures to be taken as mentioned above. Contractor will also ensure in writing that his staff & supervisor have clearly understood all the safety measures to be adopted and satisfied with the aforementioned training imparted by railway. If any extra safety related training requires, the contractor should write to JE/LCS/TRS/ROU in advance. Any employee changed in between the contractual tenure of 02 years will also have to undergo this safety training before they are deployed for execution of this work. o) It will be the responsibility of the contractor to ensure that all his workmen observe industrial safety rules, discipline, procedures, methods & practices etc. The railway shall not be liable for any accidents, injuries etc. to his workmen. If any worker comes in intoxicated condition and it is detected by the Railway representative, then that staff should be withdrawn from the engaged work immediately without any further consideration. p) The contractor shall be liable to pay for direct losses, damages caused to the railways by him or his workmen knowingly/unknowingly while they are in railway premises working or not working. The amount shall be determined by Sr. DEE/TRS/ROU. q) Every employee, deployed by the contractor should keep in his possession, the identity card, issued by the contractor, throughout the execution of the work. Failure in possession of such identity shall lead him/ her to be treated as an unauthorized person in the Railway's premises.

OTHER TERMS & CONDITIONS: r) Railway will not be responsible for any accident (fatal or non-fatal) or injury to any person of the agency or any financial implications arising there upon. No liability of the Railways will be accepted in the event of any untoward incident /accidents. s) All contractor's labour should be in proper uniform and remain well behaved, and it is the duty of the contractor to ensure the same. t) The contractor shall, when working in the premises, perform its obligations under the contract in accordance with the Indian Railways environmental policy, which is to conserve energy, water, wood, paper and other resources, reduce waste and phase out the use of ozone depleting substances and minimize the release of greenhouse gases, volatile organic compounds and other substances damaging to health and the environment. u) Other terms and conditions are applicable as per latest General Conditions of Contract for Services, issued by Indian Railways.

As per Rly. Bd's letter No.2018/CE-I/CT/9 Dtd.04.06.2018, the contractor shall have the option to take payment from Railways through Letter of Credit (LC) arrangement. The details are furnished in Document uploaded in document section. (For the tender value equal to or greater than Rs.10 Lacs)

Bid Evaluation - Technical Criteria table has been provided in Instruction to Tenderer.

Tenderer has to upload the scanned copy of EPF and ESI registration certificate.

The Bid Form (First Sheet) as per Annexure 'K' shall be required to be submitted by the tenderer along with the bid duly filled in as per instruction to tenderer

The contractor has to ensure compliance to major Labour Reforms and applicable provisions of Labour Codes and carry out strict implementation of the following: 1) Timely payment of wages through bank transfer within prescribed period. Wages Period- Monthly, Time limit for Payment of Wages- Within 7 days of next month. 2) Issuance of identity cards to workers and Appointment Letters, as per Annexure 'L'. 3) Issuance of Wage Slips indicating earnings, deductions and bank details, as per Annexure 'M', after every monthly payment of wages. 4) Ensure that my firm will be responsible to settle any grievances of the deployed labour by us, in coordination with Railway's authorized representatives. 5) Ensure that eSHRAM portal and Shramik Kalyan Portal are updated at all times, after every monthly payment of wages. 6) Maintenance of attendance records at work site. 7) Maintenance of wage register and other statutory registers as per applicable rules. 8) Maintenance of records relating to EPF and ESIC contributions of both employees and employers. 9) Provision and maintenance of statutory amenities at the work site as prescribed under the applicable labour codes. 10) Compliance with all other applicable statutory provisions of labour codes. Necessary declaration as per Annexure 'N' of Instruction to Tenderer, must be duly filled up, signed and mandatorily submitted by the contractor along with his bid.

Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

System of Verification of Tenderer's credentials: It has been decided to adopt the certificate-based system of Credential verification. The tenderer shall submit along with the tender document, documents in support of his/their claim to fulfill the eligibility criteria as mentioned in the tender document.

The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the Railway shall not relief the bidder of its obligation or liabilities hereunder nor will it affect any rights of the Railway thereunder.

Before submitting a tender, the tenderer will be deemed to have satisfied himself by actual inspection of the site and locality of the works, that all conditions liable to be encountered during the execution of the works are taken into account and that the rates he enters in the tender forms are adequate and all-inclusive for the delivery of services to the entire satisfaction of the Engineer.

When the service is bidded for, by a firm or a company of contractors, the Bid shall be signed by the individual legally authorized to enter into commitments on their behalf. Railway shall not be bound by any power of attorney granted by the Bidder or by changes in the composition of the firm made subsequent to the execution of the contract. It may, however, recognize such power of attorney and changes after obtaining proper legal advice, the cost of which will be chargeable to the contractor.

Tenderers will examine the various provisions of the Central Goods and Services Tax Act, 2017(CGST)/Integrated Goods and Services Tax, 2017 (IGST)/Union Territory Goods and Services Tax Act, 2017(UTGST)/respective state's State Goods and Services Tax Act (SGST) also, as notified by Central / State Govt. & as amended from time to time and applicable taxes before bidding. Tenderers will ensure that full benefit of Input Tax Credit (ITC) likely to be availed by them is duly considered while quoting rates.

The successful tenderer who is liable to be registered under CGST/IGST/UTGST/SGST Act shall submit GSTIN along with other details required under CGST/IGST/UTGST/SGST Act to railway immediately after the award of contract, without which no payment shall be released to the contractor. The contractor shall be responsible for deposition of applicable GST to the concerned authority.

In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned authority.

Input Tax Credit, if any, availed by the contractor should be passed on to the Railway Administration, in course of operation of the subject contract.

The buyer will in no way be responsible for the violation of any rules and/or infringement of any other laws from the time being in force, either by the manpower or by the service provider. The manpower as well as the service provider shall comply with the relevant rules and regulations applicable at present and as may be enforced from time to time, for which the buyer will not be liable or responsible in any manner. The onus of compliance to all the applicable laws/act/rules etc. shall only rest with the service provider.

Contractor will have to abide by the labour laws in force and shall have to pay minimum wages as declared from time to time by the Govt. Any claims in this regard whatsoever will have to be borne by the contractor only. Such labour engaged is liability of the Contractor and Railways bears no liability whatsoever on such engagement.

BIDDER'S CREDENTIALS: a) The bidder shall submit along with the Bid document, documents in support of their claim to fulfill the minimum eligibility criteria as mentioned in the bid. In two packet system of bidding, each bidder shall be assigned score for their technical bid. The score of technical bid should be more than or equal to minimum qualifying marks as mentioned in bid document. The system of assigning score shall be as per the bid document. b) Each page of the copy of documents / certificates in support of credentials, submitted by the bidder, shall be self- attested/ digitally signed by the bidder or authorized representative of the bidding firm. Self-attestation shall include signature, stamp and date (on each page). Only, those documents will be considered for evaluating bid, which are duly self-attested as above. After opening the technical bid, the tender committee shall verify the credentials of the bidder who is declared as the lowest bidder (L1) for their authenticity. In case the credentials of L1 are not found to be in order, her bid shall be treated as technically unresponsive and thus invalid. The process shall be repeated for the next higher bidder till the valid L1 is established. If any document (or copy thereof) submitted by a bidder is found to be false / forged: a) The bidder / each partner / member of the bidding firm shall be liable to legal actions apart from punitive actions, as decided by competent authority of Railways. In such an eventuality, the bid shall also be summarily rejected. b) If the contract has already been awarded, or Letter of Acceptance (LOA) has been issued and in the event of any failure to comply with the above, the contract shall be terminated, irrespective of the stage of progress in execution of the work. In such an eventuality, Security Deposit (SD), Performance Guarantee (PG) and partial / full payments otherwise due to the contractor, in respect of the partial/full work executed by the contractor, shall be forfeited by the Railways. c) Other punitive actions, like banning the bidder and partners / members of the bidding firm for future dealings with Indian Railways and / or the Government of India may also be taken by the Railway / Govt. of India authorities.

Evaluation of financial bid: The financial proposal shall be evaluated to determine the lowest bidder. In case, the evaluated financial offers of two or more technically qualified bidders are Lowest and same, then the Bid of the bidder who is technically more sound (having scored higher marks in evaluation of technical bid as per technical scoring) shall be considered as the lowest. If the marks in the evaluation of technical bids of the lowest bidders are also found to be equal, then the bid of the bidder with the higher cumulative annual financial turnover over the last three years and the current financial year shall be considered as the lowest.

It shall not be obligatory on the authority to accept the lowest tender and no tenderer/tenderers shall demand any explanation for the cause /rejection of his /their tender.

If the tenderers deliberately give/gives wrong information in his /their tender or create /creates circumstances for the acceptance / his/ their tender, the Railways reserves the rights to reject such tender at any stage.

Bidder may visit the works site and be aware of the site conditions.

If the date of opening happens to be a BANDH or Holiday, the tender will be opened at the same time on the following working day.

Conditional offers, offers with condition, conditional rebates will not be considered and will be summarily rejected.
