Financial Standing: - The Bidders will be qualified only if they have minimum financial Capabilities as below:
T1-Financial Turnover: The bidder should have an aggregate financial turnover not less than 1.5 times the advertised Bid value during the last three previous financial years and in the current financial year up to the date of opening of the tender. The audited balance sheet reflecting financial turnover certified by chartered accountant with his/her stamp, signature and membership number shall be considered.
T2-Liquidity: The bidder should have access to or has available liquid assets, lines of credit and other financial means to meet cash flow that is valued at 5% of the estimated bid value net of applicant's commitments for other contracts. The audited balance sheet and/or banking reference certified by chartered accountant with his/her stamp, signature and membership number shall be submitted by the bidder along with bid. Banking reference should contain in clear terms the amount that bank will be in a position to lend for this work to the applicant/member of the Joint Venture/Consortium. In case the Net Current Assets (as seen from the Balance Sheets) are negative, only the Banking references will be considered. Otherwise the aggregate of the Net Current Assets and submitted Banking references will be considered for working out the Liquidity.
Work Experience: - The bidder's should have satisfactorily completed* in the last three previous financial years and the current financial year up to the date of opening of the tender, one similar single service contract** for a minimum of 35% of advertised value of the bid.
*Completed service contract includes on-going service contract subject to payment of bills amounting to at least 35% of the advertised value of the bid.

Name of Work: Annual Maintenance Contract for repairing and overhauling of ELGI make TRC 1000 MN and TRC 1000 MNUG main compressors of conventional electric locomotives for the period of 02 years.
The contract is governed strictly by the latest General conditions of contract as well as the special conditions and specifications. It must be clearly under stood that all the terms and conditions stipulated under special conditions are binding on the contractor. In all matters of dispute, the decision of the Sr. Divisional Mech. Engineer, Diesel Loco Shed, S.E.C. Railway, Raipur shall be final. Every effort has been made by the Railways to cover all the items required for executing the work. These items might have either been covered explicitly or implicitly in the specification and the tenderer shall however, provide free of cost all such items that may be required for proper execution. No extra claim whatsoever will be entertained by the Railways for such items provided by the contractor for proper execution or for ensuring satisfactory performance of the installations provided by them under this contract.
Completion period: The work is to be completed within 2 years (24 months) from the date of issue of Letter of Acceptance and the commencement work should be within 15 days from the date of issue of Letter of Acceptance or from the date of intimation and shall complete the work in all respects as specified in tender details. The Railway gives utmost importance to the timely completion of the work on or before the date contracted for. In this connection, the attention of the contractor is specially invited to the clauses regarding 'Liquidated of damage' and termination of contract owing of default of contractor provided for in General condition of contract for Service.
Place of work: Work related to the overhauling will be carried out at the Diesel Loco Shed, Raipur.
Execution of contract:
Work should be start within 15 days from date of issue of LOA or date of intimation to start the work, If firm not start overhauling work within 15 days a penalty will be imposed and Railway may resort of take action for termination of the contract as per SGCC- 2018.
This work shall be carried out in the area mentioned in the schedule, necessary permits only for the persons working in the area will be issued for entered and moving in the premises. The permits or gate pass with photograph signed by authorized Railway officials and contractor will have to be shown to the authorities as and when required during working in the Diesel Loco Shed, Raipur premises.
The contractor shall obtain license under contract labour (Regulation and Abolition) Act, 1971 and abide by the provisions there under, and other labour laws applicable to the labour employed by him.
The contractor shall submit a list with all details viz name, date of birth, address of persons he is employing for execution of work, Any addition/deletion or replacement in this list shall be done with the permission of Railway administration.
The contractor shall be responsible for any damage to Railway materials, or safety of his labour etc., during the course of work, the contractor shall submit a report immediately to the representative of DLS/R who is nominated for this purpose in case of any unusual occurrence or loss/damage occurred during the course of work, by his men.
The contractor shall provide standard and neat uniform to the workers approved by DLS/R for easy identification. Each employee of contractor shall have identity card attested by Railway official and signed by the contractor. The contractor's employee shall display the identity card by affixing it at a conspicuous place of his/her uniform while working in Railway premises.
The contractor personnel shall not disturb normal working of shed and shall not involve in any other activities.
The contractor should abide by all Railway regulations in force from time to time and ensure that the same are followed by his representatives, agents or subcontractor or workman. The contractor should ensure that unauthorized, careless or inadvertent operation of installed equipment which may result in accident to staff and /or damage to equipment does not occur.
Contractor will have to follow all the applicable labour Laws as per the Government extant rules.
Contractor shall ensure to make payment to their worker as per the applicable minimum wages circulated by Labour Commissioner.
If at any time the works to be carried out directly concern the safety of trains, the contractor's staff must comply fully with Railway regulations given to him by the authorized Railway staff. The contractor's employees and workers may for no reason operate an installation concerning train safety or train movement, They shall notify the authorized representative of the purchaser/consignee who will take all necessary steps in this regard.
The contractor shall pay the wages as per the wages Act/Notification issued by Government from time to time in presence of authorized Railway representative and also shall counter sign the monthly wages payment statement and same is to be submitted along with bills.
Railway shall not provide any transport facility to the contractor for bringing his personnel for the duty, To and Fro transportation for the personnel of the contractor has to be provided by the contractor only.
The contractor should make his own arrangement for necessary relief arrangement to the persons for their leave etc.
The persons deployed by the contractor shall sign and mark their attendance in the attendance register with the Railway representative.
Only experienced and healthy man-power should be deputed to execute the subject work. The Railway shall free to remove such men who are found incompetent or causing damage to Railway property due to their negligent working.
In case of theft/pilferage/damages of Railway property by contractor's persons, the cost of the same shall be recovered from the agency. The contractor shall deploy such person who is of good character, fit, well behaved and skilful in their duties and also willing ti discharge duties sincerely. It should also be ensured that the persons deployed by the agency are having proven antecedents and no police case etc. is pending against such people. Such person who is indulged in antisocial activities shall be removed by the agency. The contractor shall be solely responsible for all acts of commission/omission of his persons.
Working Hours: The work execution period shall be 8 hours, (working hrs. is from 8 AM to 5 PM) (Including lunch break), starting from the time of handing over the compressor for the overhaul or as per requirement of Railway. The Contractor will be responsible for fulfillment of this condition during the execution of work for safe working of his staff. However, shift timing can be changed by Sr. DME/DLS/R or his representative during course of work as per requirement. Work as per scope need to be completed within the working hours. The said work is to be carried out at DLS/R. Therefore, the availability of compressor to carry out the said work shall be communicated to the firm / contractor's authorized representative in person/ by mobile or email or whats-App or by letter to the contractor., 24 hours in advance & same will be confirmed by firm.
Executed Time of Compressor for overhauling: Railway can give 01 no. compressor at a time. However, the quantity in a lot can be increased with the approval of authorized representative of Sr. DME/DLS/R depending upon the availability of compressor of WAG7 locomotives at DLS/R. The overhauling period of 1 no. compressor should have to complete within 02 working days and the overhauling of more than 1 no. compressor (up to maximum 3 nos. compressors) shall be completed within 3 working days from the date of handing over to the contractor.
Inspection: The work shall be inspected at all stages by the Sr. DME/DLS/R or his representative to ensure the quality of work and workmanship, as per the details mentioned in the Scope of Work.
Initial Joint Inspection: Before starting of work, contractor's representative will jointly inspect the work place of compressor with the Railway representative and necessary details will be recorded. After the work is carried out in compressor, it will be inspected and accepted by Railway representative.
Final Inspection: Final testing after overhauling of each compressor will be jointly done at shed, alignment of the motor and compressor is to be certified jointly by Railway consignee and firm.
The Railway will also have the right to impose any inspection or testing at any or all stages of operation.
In case of any dispute regarding the workmanship and methodology, the decision of the Sr. DME/DLS/R shall be final and binding on the contractor.
Warranty:
The contractor shall guarantee the quality of work trouble free performance each compressor unit for a period of 18 months from of the commissioning in the locomotive or 24 months from the date of successful completion and handing of the work to the Railway whichever is earlier.
A certificate of warranty as in (9.1) above is to be issued for the items replaced, work done and the performance of the compressors and the contractor will arrange to provide a warranty certificate.
During the course guarantee period, in case any defect is noticed due to faulty workmanship necessary overhauling/repair/replacement has to be arranged to the entire satisfaction of the Railway and such works will be carried out at Firm's risk and cost.
The decision of Railway in regards to the cause of failure and nature of rectification to be carried out by the contractor during the warranty period shall be final and binding on the part of contractor.
The contractor shall give prompt and adequate service support while attending the warranty. The attention to the warranty should be given by the contractor within 15 days after receipt of the complaints from the Railways through mobile or email or whats-App or by letter to the contractor, 24 hours in advance & same will be confirmed by firm; otherwise penalty will be levied as per penalty clause.
The contractor must complete the overhauling/repair of the defective compressor(s) under warranty within 2 working days for a single compressor, and within 3 working days for more than one compressor (up to a maximum of 3 compressors), starting from the date of handover to the contractor. Otherwise, a penalty will be imposed as per the penalty clause.
The warranty period will automatically get extended corresponding to the period during which the equipment are not in service due to failure of contractor in fulfillment of the above obligations. For the purpose on every occasion, when these equipment go out of service, the duration between the date of intimation of the failure of the equipment of contractor and the date of handing over of the equipment after repairs in good condition duly tested and commissioned in the presence of Railways representative will be counted for the extension of the guarantee period till the equipment complete actual service for a total period.
PENALTY CLAUSE: The entire work shall be completed within 24 months from the date of issue of the Letter of Acceptance. The completion of work includes execution of entire scope of work as per contract conditions, including initial and final inspection, associated transportation of equipment / material between contractor's works and DLS/R and acceptance of work by Railway to the entire satisfaction of Engineer. The penalty will normally be deducted from the bills & if no bill is due, the amount due will be adjusted against Performance Bank Guarantee (PBG) etc. The total Liquidated Damages (LD) to be deducted shall be subject to the maximum limit as per SGCC- 2018 or its latest version.
Penalty for delay in overhauling: if the contractor fails to complete the compressor overhauling within stipulated time limit, the following penalties shall be applied: a)For 1 no. CP offered: if the overhauling period not complete within 02 days then delay/penalty charges for the overhauling for the compressor @ 5% of the accepted rate per day and up to maximum of 50% of the value for overhauling of each compressor will be levied. The amount will be deducted from the contractor bills. b)For more than 1 no. CP offered: : if overhauling period if not complete within 03 days then delay/penalty charges for the overhauling for the compressors @ 5% of the accepted rate per day and up to maximum of 50% of the value for overhauling of total offer compressors will be levied. The amount will be deducted from the contractor bills.
During Warranty Period: (a) The attention to the warranty should be given by the contractor within 15 days after receipt of the complaints from the Railways. The penalty @ 0.5% of the cost of overhauled compressor per day subject to maximum up to 10% of the total cost of overhauled compressor will be imposed by Railway on the contractor for delays in compliance of the warranty obligation. Such penalty will be recovered from the outstanding bills & if no bill is due, amount due will be adjusted against PBG/other Railway zonal accounts etc. (b) If the defective compressor requiring overhauling under warranty is not completed within the prescribed time mentioned in the warranty clause, a penalty will be imposed as per Sr. No. (10.1) of penalty clause. Such penalty will be recovered from the outstanding bills, and if no bill is due, the amount will be adjusted against the PBG/other Railway zonal accounts, etc."
Drunken Condition Penalty: If any contractor's staff found in drunken condition during the working hours a penalty of Rs. 1000/- (Rupees one thousand only) per person will be imposed and drunken condition twice in a month period he will not be allowed for further working during the contract period.
The penalty will normally be deducted from the bills & if no bill is due, amount due will be adjusted against PBG/other Railway zonal accounts etc. The total LD to be deducted shall be subject to the maximum limit as per GCC for service or latest.
Penalty for Other Contractual Obligations: if any other contractual obligations other than above mentioned, then Railway may impose token penalty as decided by Sr.DME/DLS/R based on the merits of the case. Cumulative penalty is subject to a maximum of 10% of the total contract value.
Final decision: The decision of Sr.DME/DLS/R in this regard will be final and binding.
DAMAGE TO RAILWAY PROPERTY: The contractor shall ensure that all the Railway equipments, fittings, parts are well protected and do not suffer any damages during the course of the work or afterwards as a result of his work. The contractor shall be liable to pay for direct losses, damages caused to the Railways by him or his workmen knowingly / unknowingly while they are in Railway premises working or not working. The amount shall be determined by the Railway.
SPECIAL CONDITIONS FOR GETTING GATE PASS BEFORE WORK START AND PROTECTIVE ITEMS ETC.
Before commencement of the work, the contractor shall necessarily obtain the permission to start the work and gate passes for the personnel / staff to be inducted for execution of the subject work, submitting their identity proof (Copy of Aadhaar card / Driving license, / Voter Card etc.) with original documents for verification.
Before commencing the work, the contractor must provide personal protective equipments (PPE) to all the contract labours deployed by him. PPE includes safety shoes, hand gloves, helmets etc
The Contractor must ensure the safety of the Labours engaged by him while executing the work and shall take all precautionary measures not only to ensure protection of his own personnel moving about or working on the Railway premises, but also confirm to the rules and regulations of the Railways in this respect and the Railway will not be responsible for any injury sustained by the labours due to any accident or any other Fatalities. Contactor shall be directly responsible for safety of his labours and Tools & Tackles.
Sr.DME/DLS/R will be the competent authority to change / modify the Scope or work, Schedule of work and Inspection clause as deemed fit during the currency of work, if felt necessary. The decision of Railway Administration in this respect shall be final and binding and no claim in this respect shall be entertained. The contractor is bound to accept such changes/modifications, made during the currency of work
In case of any dispute of any nature arising on / during the execution of the contract, the decision of the Sr.DME/DLS/R will be final and binding on both parties.
Payment Terms:
The price shall include all taxes, transportation whatsoever and Railway shall have no liability for any of these charges. No advance payment shall be made. 100 % payment will be made after completion of work of each compressor and issue of Acceptance certificate by Sr.DME/DLS/R or his representative. Bills correct in all respect shall be submitted to Sr.DME/DLS/R along with relevant documents if any who will arrange payment through Sr. Divisional Finance Manager, Raipur S.E.C.Rly Payment shall be made through NEFT. All the payments shall be subject to compliance of all the payment formalities viz. verification of various documents, execution of contract agreement, measurement book entries etc. Income tax/TDS etc. to be deducted from contractor bills as per the present prevailing rate.
Payment through ECT/EFT (wherever this facility is available)
Tenderer to give consent in a mandate form for receipt of payment through ECT/EFT. Tenderer to provide the details of Bank A/c in line with RBI guidelines for the same. These details will include Bank Name, Branch Name & address, Account type, Bank A/c No. and Bank & Branch code as appearing on MICR cheque issued by bank. Tenderer to attach certificate from their bank certifying the correctness of all above mentioned information (as mentioned in point (ii) above). In case of non- payment through ECT/EFT or where ECT/EFT facility is not available payment will be released through Cheque.
Labour:
The contractor has to deploy sufficient, technically knowledge person at DLS/R, so as to ensure timely overhauling of compressor as per the instructions of authorized representative of Sr.DME/DLS/R. The contractor must provide sufficient labour for overhauling of compressor. A detailed list of laborers', along with a declaration, should be submitted to the Railway by the contractor before the commencement of work.
Contractor will have to abide by the labour laws in force and shall have to pay minimum wages as declared from time to time by the Govt. Any claims in this regard whatsoever will have to be borne by the Contractor only Such labour engaged is the liability of the contractor and Railway bears no liability whatsoever on such engagement.
Contractors shall not deploy any employee or any person of bad character or any person whose antecedents have not been investigated by the police and shall issue an appointment certificate, which shall contain a photograph of the employee specifying the employee's name, father's name, address (for identity proof i.e. Aadhaar, voter ID, driving license, nationalize bank identity proof & Govt. issued certificate etc.) and the place at which employed, with his/her left/right hand thumb impression affixed thereon in printer's ink which he will carry with him/her while on duty. The expenses for such verification as necessary shall be borne by the contractor.
Persons deployed by the contractor shall have 'NO CLAIM' to be a Railway personal in any capacity what so ever.
The list of the persons deployed should be got approved by the any officer of DLS/R. Whenever deployed staff changed prior approval for new staff must be obtained from railway.
The agency will be responsible for compliance of all statutory observation under the Factory Act, Contract Labour Act, Minimum Wages Act, contribution under EPF, professional Tax, EPF & ESIC Act etc. in respect of his personals. It is the sole responsibility of contractor to observe and abide by the provision of Labour Act, such as Workman compensation Act, etc. and other regulations framed by the Govt. and revised time to time. Railway will not be responsible for any violation of the Act or Regulation by contractor.
The offer is to be made after considering the prevailing rates and assessing the probable increase in the rates of minimum wages in future during the period of contract. Railway shall not entertain any claim from the agency about escalation on account of increase in rates of minimum wages. Any increase in rates of minimum wages, from time to time shall be required to be paid by contractor.
Uniform with badges, safety shoes & helmet must be provided to staff by Contractors. Name badges duly authenticated by Sr.DME/DLS/R; have to be prominently displayed by the labour. Cost of such incurrence would be borne by the contractor and no extra cost would be paid by the Railways. Staff members to be wear dark blue uniforms, whereas supervisors wear green or other colour as decided by Railway.
Quality Assurance Programme:- The quality Assurance programme such as maintenance of various register on the part of Railways as well as the contractor, for the subject works contract is necessary for system improvement. Hence, the following ledgers are to be maintained of the subject works contract depending upon the nature of work at site:
Work Register: The agency will be required to maintain work register to ensure that contract work is being executed as per scope of work and after completion of work every compressor, joint signature of contractor's/contractor's representative and SSE (Pneumatic) of DLS/R or his representative is to be taken. This register is to be kept in the custody of SSE (Pneumatic).
Material Transaction Register: Material transactions, Compressors lifted for overhauling and after overhauling received compressors are to be recorded by firm and Railway separately.
Daily progress & Labour Register: Daily attendance register will be maintained and attendance will be taken. The attendance register will be jointly signed by contractor and Railway representative daily.
Apart from above mentioned register if any other registers requires for repair/overhauling, contractor should be maintain (Engineer decision shall be final).
Transportations: Railways will not provide any type of transport to the contractor for bringing the staff on duty and other required material for overhauling of compressor, to & fro transportation for the personals.
Railways responsibility: The place/electricity, water required for the work in Railway premises will be given free of cost. Special Tools, Kerosene/petrol and Waste Cotton, Paint, Electricity, External Compressor Air, Overhauling Kit, Lubricants Testing facility, Spares if any required consumable items and space to work will be provided by Railway. The contractor has to make his own arrangement
Contractor responsibility: Labour, transport, material handling equipment, tools, tackles and equipment shall not be provided by the Railway for execution of work unless otherwise specifically mentioned. Safety items like helmet, hand gloves, gumboot, safety shoes, safety harness etc. are mandatory and will be arranged by contractor to be wear by staff of contractor during work in shop premises.
DISPOSAL OF THE RELEASED MATERIALS: For all the parts that are replaced from the each compressors, old parts shall be returned back to Engineer in charge of DLS/R, A register also to be maintain and to be jointly signed by Contractors representative & Railways authorized representative.
Terms of Payment to Contractor:
Following documents shall be required to produce before processing of bills: a)Payment towards executed work to the contractor shall be done on quarterly basis after verification of records preferably and compliance of all respect of contract agreement. b)Inspection certificate. c)Warranty certificate for compressor.
Payment will be made to the contractor on quarterly basis for the work done during the months in terms of the cost incurred for the staff.
A bill in duplicate in Railways prescribed form and as per Railway's rules in force has to be prepared, which has to be signed by the contractor. Discrepancies, if any found on the Bill shall be notified to the contractor by Railways for rectification.
Taxes as applicable at the time will be recovered from the bill. The contractor's certificate duly signed & dated by the contractor for each on account payment will be submitted to Sr.DME/DLS/R, S.E.C.Railway, Raipur in duplicate along with relevant documents.
The firm shall submit the relevant document along with bills to the office of Sr.DME/DLS/R which will be verified & forwarded to Sr.DFM/R for arranging payment. GST amount will be hold of firm in condition of non-submission of GST paid certificate/challan along with bill/invoice (only applicable for 1st bill).
Special condition for police clearance (police verification)
The Contractor shall furnish complete details of the personnel to be deployed to Sr.DME/DLS/R or his authorized representative before starting the actual work. The contractor should submit Police clearance (Police verification) of all the engaged manpower/staff for this work from the police station to which the person belongs. Police Verification of staff/labour deployed by Contractors on Railway Premises.
Variation of work under total amount of contract value:- Any work as mentioned in scope of work can be increased/decreased/deleted under total amount of contract value. The contractor shall be bound to carry out the work at the accepted rates of contract.
EPF/ESIC:-
Minimum wages act-1948 shall be complied by the Tenderer(s) and wages to the employee engaged by him shall be paid as per rate defined by Chief Labour Commissioner (C) New Delhi time to time accordingly during contract/extended period.
Contribution towards Employee Provident Fund (EPF) Act-1952 and Employee State Insurance (ESI)-1948 of the employee has to be made by the contractor as per prevailing rate or rate applicable at the time during entire contract period/extended period on payable amount against daily/monthly wages of the employee. Amount payable against contributions of EPF & ESI will be solely borne by the contractor; railway will not be reimburse any such contributions amount.
Rate quoted shall be inclusive of all taxes and levies including contributions of EPF & ESI of the employee, contractor's profits, expenditure to full fill the contract condition or any such taxes enforced by the Railway, state/central government or labour ministry time to time.
It is the sole responsibility of contractor to pay the EPF/ESIC to the labour engaged by Him/her. The challan of the same to be submitted with the bill for passing.
Minimum wage and Payment of Labour by contractor:
Payment will be made on monthly basis on submission of bill by the contractor duly forwarded by consignee. The Payment to the contract Labour/Supervisor should be made through Shramikkalyan Portal only is essential and copy of proof must be submitted for preparation & passing of bills. In order to increase transparency in payment of Contract Labour wages and other payments, a web based E-application has been developed and hosted on website www.shramikkalyan.indianrailways.gov.in. All contractors are required to upload details of their LOA's, engaged workmen, wage payment details, PF/ESI details, bonus details etc., on monthly basis. The details so uploaded shall be available in public domain. In order to ensure prompt and proper uploading of details related to LOA's, engaged workmen, wage & other payment details, Railways/PUS etc. shall introduce a special condition in their tender documents of the tenders to be called henceforth. The special condition is as under: Contractor is to abide by the provisions of Payment of Wages act 7 Minimum Wages act in terms of clause 54 and 55 of Indian Railways General Condition of contract. In order to ensure the same, an application has been developed and hosted on website 'www.shramikkalyan.indianrailways.gov.in' Contractor shall register his firm/company etc. and upload requisite details of labour and their payment in this portal. These details shall be available in public domain. The registration/ updation of Portal shall be done as under: Contractor shall apply for onetime registration of his company/firm etc. in the shramik kalyan portal with requisite details subsequent to issue of Letter of Acceptance (LOA). Engineer shall approve the contractor's registration on the portal within 7 days of receipt of such request. Contractor once approved by any Engineer, can create password with login ID (PAN No.) for subsequent use of portal for all LOA's issued in his favour. The contractor once registered on the portal, shall provide details of his Letter of Acceptances (LOA)/ Contract Agreements on shramikkalyan portal within 15 days of issue of any LOA for approval of concerned engineer. Engineer shall update (if required) and approve the details of LOA filled by contractor within 7 days of receipt of such request. After approval of LOA by Engineer, contractor shall fill the salient details of contract labours engaged in contract and ensure updating of each wage payment to them on shramik kalyan portal on monthly basis. It shall be mandatory upon the contractor to ensure correct and prompt uploading of all salient details of engaged contractual labour & payments made thereof after each wage period. While processing payment of any On Account bill or final bell or release of 'Advances' or 'Performance Guarantee/Security deposit', contractor shall submit a certificate to the Engineer or Engineer's representatives that "I have uploaded the correct details of contract labours engaged in connection with this contract and payments made to them during the wage period in Railway's Shramikkalyan portal at www.shramikkalyan.indianrailways.gov.in' till __________ Month,____________ Year. The Railway Board in its letter no. 2018/CE-I/CT/4, dated 17.10.2018 has advised that all contractors are required to upload details of their LOA's, engaged workmen, wage payment details, PF/ESI details, bonus details etc on monthly basis and also follow as above.
Safety: Safety of labour in all respect shall be the responsibility of contractor. Repair/overhauling work in shed should be done in the guidance of the representative of Railway Administration.
IDENTIFICATION OF STAFF: After the award of the contract, the contractor will employ a supervisor who will look after this work along with identity cards and telephone/mobile numbers. The contractor shall be responsible for the general conduct and discipline of his labours/staff deputed for this work. However, Railway reserves the right to take action against contractor's staff due to any misconduct during the period of contract.
Special conditions, if any, proposed by Tenderer/Contractor: Special conditions if any given by Tenderer/Contractor must be such that they can be evaluated in Technical & Financial terms and if it is not followed the tender is liable for rejection.
Price Variation: Price Variation clause (PVC) is not applicable to this tender as per extant Railway rules. Hence, the rate quoted by the tenderer and accepted by Railways shall be treated as firm during the entire period of contract agreement.
Conservancy Cess Charges: As per Railway Board letter No. F(X)1/95/1/1 Dated: 07.09.2021, "Conservancy Cess Charges" will be deducted at the rates given below from the contractor's bills based on the average number of laborers'/workmen employed per day by the contractor for the work.
Goods and Service Tax (GST): All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. GST will be reimbursed as applicable, on the production of authentic documentary evidence. In case there is any further change in the GST tax structure till the date of completion of work or any error is noticed in the calculation of the amount payable recoverable till the release of Final Bill amount to the contractor, the same shall be paid by the Railways or recovered from the contractor's bills/security deposit or any other dues of the contractor with the Govt. of India. If the firm is liable to be registered under CGST/IGST/UTGST/SGST Act shall submit GSTIN along with other details required under CGST/IGST/ UTGST/ SGST Act to railway immediately after the award of contract, without which no payment shall be released to the contractor. The contractor shall be responsible for deposition of applicable GST to the concerned authority. In case the firm is not liable to be registered under CGST/IGST/ UTGST/SGST Act, the railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned authority. GST has been levied @ 18%, this will be subjected to revision as per Government guidelines henceforth. GST will be reimbursed as applicable, on production of authentic documentary evidence. In case there is any further change in the GST tax structure till the date of completion of work or any error is noticed in the calculation of amount payable recoverable till the release of Final Bill amount to contractor, the same shall be paid by the Railways or recovered from the contractor's bills/security deposit or any other dues of contractor with the Govt. of India. Any reduction in rate of tax on any supply of goods or services or the benefit of input tax credit shall be passed on to the recipient by way of commensurate reduction in prices. TDS on GST will be made as the clauses of relevant acts. Payment of GST will be made as prevalent on the date of execution of work.
Right of Railway to determine the contract: As per "General Conditions of Contract (GCC) for service 2018" clause VII, the Railway shall be entitled to determine and terminate the contract at any time should, in the Railway's opinion, the cessation of work becomes necessary owing to paucity of funds or from any other cause whatever.
All decisions on behalf of Railway administration will be taken by Sr.DME (D)/Raipur, S.E.C. Railway and shall be final and binding on the contractor.
For the conditions not covered in this document, General Conditions of contract service-2018 shall apply. This concludes the contract and is issued for and on behalf of the president of India.
As per RB letter no. 2018/CE-I/CT/30/Pt-2 dated 05.12.2022 Service Contracts in IR-WCMS as per GCC of Service Contract will be followed.
