FINANCIAL ELIGIBILITY CRITERIA (Please refer tender document attached below): The tenderer must have minimum average annual contractual turnover of V/N crores; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-E, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.
Bid Capacity: Not applicable.
Credentials if submitted in foreign currency shall be converted into Indian currency i.e., Indian Rupee as under: The conversion rate of US Dollars into Rupees shall be the daily representative exchange rates published by the Reserve Bank of India or entity authorized by RBI to do so for the relevant date or immediately previous date for which rates have been published. Where, relevant date shall be as on the last day of month previous to the one in which tender is invited. In case of any other currency, the GCC same shall first be converted to US Dollars as on the last day of month previous to the one in which tender is invited, and the amount so derived in US Dollars shall be converted into Rupees at the aforesaid rate. The conversion rate of such currencies shall be the daily representative exchange rates published by the International Monetary Fund for the relevant date or immediately previous date for which rates have been published.
Explanation for clause of Eligibility Criteria (Technical & Financial Criteria ).
Substantially Completed Work means an ongoing work in which payment equal to or more than 90% of the present contract value (excluding the payment made for adjustment of Price variation (PVC), if any) has been made to the contractor in that ongoing contract and no proceedings of termination of contract on Contractor's default has been initiated. The credential certificate in this regard should have been issued not prior to 60 days of date of invitation of present tender.
In case a work is started prior to 07 (Seven) years, ending last day of month previous to the one in which tender is invited, but completed in last 07 (Seven) years, ending last day of month previous to the one in which tender is invited, the completed work shall be considered for fulfillment of credentials.
If a work is physically completed and completion certificate to this extent is issued by the concerned organization but final bill is pending, such work shall be considered for fulfillment of credentials.
In case of completed work, the value of final bill (gross amount) including the PVC amount (if paid) shall be considered as the completion cost of work. In case final bill is pending, only the total gross amount already paid including the PVC amount (if paid) shall be considered as the completion cost of work. In case of substantially completed work, the total gross amount already paid including the PVC amount (if paid), as mentioned in the certificate, shall be considered as the cost of substantially completed work.
If a bidder has successfully completed a work as subcontractor and the work experience certificate has been issued for such work to the subcontractor by a Govt. Organization or public listed company as defined in note for item 2 of technical eligibility criteria, the same shall be considered for the purpose of fulfillment of credentials.
In case a work is considered similar in nature for fulfillment of technical credentials, the overall cost including the PVC amount (if paid) of that completed work or substantially completed work, shall be considered and no separate evaluation for each component of that work shall be made to decide eligibility.
In case of newly formed partnership firm, the credentials of individual partners from previous propriety firm(s) or dissolved previous partnership firm(s) or split previous partnership firm(s), shall be considered only to the extent of their share in previous entity on the date of dissolution / split and their share in newly formed partnership firm. For example, a partner A had 30% share in previous entity and his share in present partnership firm is 20%. In the present tender under consideration, the credentials of partner A will be considered to the extent of 0.3*0.2*value of the work done in the previous entity. For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deed(s), dissolution deed(s) and proof of surrender of PAN No.(s) in case of dissolution of partnership firm(s) etc.
In case of existing partnership firm, if any one or more partners quit the partnership firm, the credentials of remaining partnership firm shall be re-worked out i.e., the quitting partner(s) shall GCC take away his credentials to the extent of his share on the date of quitting the partnership firm(e.g. in a partnership firm of partners A, B & C having share 30%, 30% & 40% respectively and credentials of Rs 10 crore; in case partner C quits the firm, the credentials of this partnership firm shall remain as Rs 6 crore). For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deed(s), dissolution deed(s) and proof of surrender of PAN No.(s) in case of dissolution of partnership firm(s) etc.
In case of existing partnership firm if any new partner(s) joins the firm without any modification in the name and PAN/TAN no. of the firm, the credentials of partnership firm shall get enhanced to the extent of credentials of newly added partner(s) on the same principles as mentioned in item 6 above. For this purpose, the tenderer shall submit along with his bid all the relevant documents which include copy of previous partnership deeds, dissolution/splitting deeds and proof of surrender of PAN No.(s) in case of dissolution of partnership firm etc.
Any partner in a partnership firm cannot use or claim his credentials in any other firm without leaving the partnership firm i.e., In a partnership firm of A&B partners, A or B partner cannot use credentials of partnership firm of A & B partners in any other partnership firm or propriety firm without leaving partnership firm of A&B partners.
In case a partner in a partnership firm is replaced due to succession as per succession law, the proportion of credentials of the previous partner will be passed on to the successor.
If the percentage share among partners of a partnership firm is changed, but the partners remain the same, the credentials of the firm before such modification in the share will continue to be considered for the firm as it is without any change in their value. Further, in case a partner of partnership firm retires without taking away any credentials from the firm, the credentials of partnership firm shall remain the same as it is without any change in their value.
In a partnership firm "AB" of A & B partners, in case A also works as propriety firm "P" or partner in some other partnership firm "AX", credentials of A in propriety firm "P" or in other partnership firm "AX" earned after the date of becoming a partner of the firm AB shall not be added in partnership firm AB.
In case a tenderer is LLP, the credentials of tenderer shall be worked out on above lines similar to a partnership firm.
In case company A is merged with company B, then company B would get the credentials of company A also.
Evaluation of Technical Criteria in case of multiple L1: The financial proposal shall be evaluated to determine the lowest bidder. In case, the evaluated financial offers of two or more technically qualified bidders are Lowest and same, then the Bid of the bidder who is technically sounder (having scored higher marks in evaluation of technical bid as per the table given below shall be considered as the lowest. If the marks in the evaluation of technical bids of the lowest bidders are also found to be equal, then the bid of the bidder with the higher cumulative annual financial turnover over the last three years and the current financial year shall be considered as the lowest.(as per GCC Clause number 2.6.4)
Tenderer Credentials Documents testifying tenderer previous experience and financial status should be produced along with the tender. Tender(s) w h o is/are not borne on the approved list of RDSO/BLW/CLW Vendor directory manufacturing & supply /repair of Air Compressors , shall submit along with his/their tender. Non submission of the certificate by the tenderer shall result in summarily rejection of the his/their tender :
Certificates and testimonials regarding contracting experience for the type of job for which tender is invited in the form of Annexure-B, with list of works carried out in the past in the form of Annexure-B. The tenderer should also submit the list of works on hand indicating name of work, contract value, bill amount paid so far, due date of completion etc. to be furnished by contract in Annexure-C. Experience Certificate Annexure-D.
Verification of Tenderer's Credentials: The tenderers shall submit a copy of certificate stating that all their statement/documents submitted along with bid are true and factual. Standard format of certificate to be submitted by the bidder is enclosed as Annexure-V. In addition to Annexure-V, in case of other than company/Proprietary firm, Annexure- V(A) shall also be submitted by the each member of Partnership firm/Joint 6.1.1 Venture (JV)/Hindu Undivided Family(HUF)/Limited Liability Partnership(LLP) etc. as the case may be. Non-submission of above certificate(s) by the bidder shall result in summarily rejection of his/their bid. It shall be mandatorily incumbent upon the tenderer to identify, state and submit the supporting documents duly self-attested/digitally signed by which they/he is qualifying the qualifying criteria mentioned in the Tender Document and in tender document details.
Declaration for engagement of RETIRED RAILWAY EMPLOYEE: Declaration for engagement of any retired railway employee in Format-H should be submitted by bidder.
The Railway reserves the right to verify all statements, information and documents submitted by the bidder in his tender offer, and the bidder shall, when so required by the Railway, make available all such information, evidence and documents as may be necessary for such verification. Any such verification or lack of such verification, by the Railway shall not relieve the bidder of its obligations or liabilities hereunder nor will it affect any rights of the Railway there under.
(a)In case of any information submitted by tenderer is found to be false, forged or incorrect at any time during process for evaluation of tenders, it shall lead to forfeiture of the tender Bid Security besides banning of business for a period of up to five years. (b)In case of any information submitted by tenderer is found to be false, forged or incorrect after the award of contract, the contract shall be terminated. Bid Security, Performance Guarantee and Security Deposit available with the railway shall be forfeited. In addition, other dues of the contractor, if any, under this contract shall be forfeited and agency shall be banned for doing business for a period of up to five years.
Non-compliance with any of the conditions set forth therein above by the bidder is liable to result in the rejection of his/their bid.
Similar nature of work defined as: OEM/Authorized dealer for carrying out Comprehensive or Non-Comprehensive Annual Maintenance Contract of Air Compressors of Minimum Capacity -300 CFM and working air pressure 10 Kg/CM2 in any Zonal Railway or Central Government Organization or State Government Organization or Public Sector undertaking. OR Experience in carrying out Comprehensive or Non- Comprehensive Annual Maintenance Contract of Air Compressors of Minimum Capacity-300 CFM and Working air pressure 10 Kg/CM2 in any Zonal Railway or Central government organization or State Government Organization or Public Sector undertaking.
For firms who are sources approved by RDSO/BLW/CLW eligible for manufacturing & supply /repair of Air Compressors , the technical and financial eligibility criteria is dispensed as per Railway Board's letter no.94/Elect(TRS)/441/1 Pt III Dated 06.8.09.
Firms not featuring in sources approved by RDSO/BLW/CLW eligible for repair, supply & manufacturing of Air Compressor RDSO/BLW/CLW eligible for manufacturing & supply/repair of Air Compressor, shall have to fulfill the Eligibility Criteria and shall have to submit the documentary 1.1.1 proof in support of their credentials/satisfactory performance till last day of the month previous to the one in which tender is invited to fulfill the eligibility criteria. Organization, work experience certificate issued by Public listed company having average annual turnover of Rs. 500 crore and above in last 3 financial years excluding the current financial year, listed on National Stock Exchange or Bombay Stock Exchange, incorporated/registered at least 5 years prior to the date of closing of tender, shall also be considered provided the work experience certificate has been issued by a person authorized by the Public listed company to issue such certificates. Location: Diesel Loco Shed/Raipur.
Make of compressor: ELGI (500CFM/10.5 Kg/Cm2) Model: EG 110
Completion Period: 03(Three) years from the date of commencement of work.
This contract shall be covered by "General Conditions of Contract (GCC) for services 2018" of Railway with latest amendments. In executing this contract it would be deemed that the contractor has kept himself fully informed of the provisions of the GCC including all corrections and amendments. In the event of any conflict or inconsistency between General terms and Conditions of Contract and Special Terms and Conditions of Contract, the latter will prevail.
While signing the tender papers, the tenderer should specify whether he is a sole proprietor or is he a partner or is he signing on behalf of the firm as an attorney (in the case of power of attorney, the copy in prescribed from should be submitted). In case of partnership, a copy of partnership deed should also be furnished for verification.
For dealing with variation, latest rules of railway as on date will be followed.
No cost addition or alteration in respect of materials, tools and transportation will be entertained during currency period of the contract. SVC will only be acceptable on Taxes, Duties etc which will be imposed by Central or State Govt. newly/any variation during the execution period of the contract on production of valid documentary evidence regarding the increase in existing or newly imposed by Central or State Govt.
The Tenderer should carefully read all the conditions about the nature of work involved as per technical specifications and scope of work. Tenderer may contact office of Sr.DME (D)/Raipur for any clarifications if required. All decision on behalf of the Railway Administration will be taken by Sr.DME (D)/Raipur.
Sr.DME (D)/Raipur reserves the right to reject/accept the whole or part of the offer or for the portion of the quantity indicated in the offer without assigning any reason there upon and vary the quantity of work up to +25% and the right to open negotiations and to call for revised offers or to alter or to modify any of the conditions or to incorporate any new conditions as found necessary till the contract is finally executed.
The submission of the tender will be deemed to imply that the memorandum and all documents enclosed have been studied and understood, that the tenderer is aware of the full scope of the work to be done and the conditions affecting the execution. In token of this, the tenderer he or his authorized representative signing the tender documents will be required to sign/initial or each and every page of the tender schedule at the bottom.
PENALTY CLAUSE: Penalty shall be levied @ 1000 per day beyond allowed period of 48 hrs (2 days) after reporting of failures by email/phone with acknowledgements. 02days shall be taken excluding date of reporting. 1.Allowed time from compressor failure reporting date till arrival of service Engineer.2 days excluding reporting date by email/phone., there after delay in days shall be counted for penalty in days or part there of. 2.Allowed time for repairing of each Air Compressor 3days from reporting date of service engineer. Thereafter Delay in days for repair shall be counted for penalty. 3.Allowed time for supplying of spares/component, if it is to be supplied by Contractor 2 days from the date intimation by service engineer/contractor in writing. The service engineer/contractor shall intimate the defective spare/component within the 3 days of reporting. If any delay in intimation occurs beyond these 3days of reporting, the number of Days delayed shall be counted for penalty calculation. 4.Allowed time for fitment of spares/components supplied by Railway 02 days shall be allowed from the date of handover of spares to the service engineer, beyond these 2days,if any delay occurs, it shall be taken for penalty calculation (in days or part there of).
In case the tenderer fails to provide AMC services successfully, the AMC SD/PG will be forfeited. This will be in addition to penalty clause 13, above.
Penalty as deemed fit by Sr.DME (D)/R may also be imposed due to unsatisfactory work carried out by the contractor which will be totally at the discretion of the Sr.DME (D)/R.
Decisions of Sr.DME (D)/Raipur, S.E.C.Railway, regarding imposition of penalty shall be final and binding on the contractor.
Overall penalty in any case shall not exceed 10 % of the contract value.
Payment Terms:
On account payment will be made to the firm/contractor on Quarterly basis based on actual quantity of work done by the contractor during particular period. The contractor should submit the following documents to the paying authority as signed by the consignee. a)Consignee's certificate for work done as per Annexure'II' with calculation penalty applicable. b)A certificate by consignee that no spare part is due with the tenderer. c)Bills submitted by the tenderer & accepted by consignee.
Contractor has to submit Tax Invoice towards his/her claim clearly indicating HSN/SAC Number. Railway shall pay GST along with the bill but before processing the next bill he/she has to submit document/challan of deposition of GST to the Government. Payment/deposition of GST is the solely responsibility of Contractor.
All Statutory deductions as required in any Central or State Act and Rules shall be deducted/ paid from/to the contractor.
A bill in triplicate in Railways prescribed form and as per Railway's rules in force has to be prepared, which has to be signed by the contractor. Discrepancies, if any found on the Bill shall be notified to the contractor by Railways for rectification.
Taxes as applicable at the time will be recovered from the bill. The contractor's bill duly signed & dated by the contractor for each on account payment will be submitted to Sr.DME (D)/DLS/Raipur in triplicate along with relevant documents.
Sr. DME (D)/DLS/Raipur will be Bill passing officer and Sr. DFM/Raipur will be Bill Paying officer.
Mode of Payment:
Tenderer to give consent in a mandate form for receipt of payment through ECS/EFT.
Tenderer to provide the details of Bank A/c in line with RBI guidelines for the same. These details will include Bank Name, Branch Name & address, account type, Bank A/c No. and Bank & Branch Code as appearing on MICR cheque issued by bank.
Tenderer to attach certificate from their bank certifying the correctness of all above mentioned information (as mentioned in Para (ii) above).
In case of non-payment through ECS/EFT or where ECS/EFT facility is not available, Payment will be released through cheque.
Income Tax: In terms of Income tax act 1961, as amended from time to time, the Railway administration shall at the time of arranging payment to the contractor for carrying out the work under this contract is entitled to deduct income tax at prevailing rate. The Railway administration shall furnish a certificate to the extent of income tax deducted at source under this contract.
The contractor shall be responsible for the general conduct and discipline of his staff. Railway administration reserves its right to take necessary action as deemed fit in all cases of misconduct/indiscipline. Tenderer shall ensure good credential of staffs engaged for this work in shed. If any staff of the tenderer is found in misconduct/indiscipline/illegal activities, then he will be immediately removed from the work.
Inspection of Site: The Contractor before tendering shall inspect the site of work, examine the nature of work, and check up the availability of working space. The tenderer / contractor is required to inspect the site of works and acquaint himself with the site conditions, availability and approaches for transporting materials, space and other factors relating to the work etc before quoting his rates.
E-Way Bill: E-Way Bill generation shall be responsibility of the contractor. For generation of E-Way Bill, GST No. of the Consignee will be provided by Railway.
The contractor shall be liable to pay for direct losses, damages caused to the Railway Administration by him or his workmen knowingly or unknowingly while they are in Railway premises working or not working. The amount so recovered will be determined by Sr.DME (D)/DLS/Raipur.
Care of Staff: No quarters will be provided by the Railway for accommodation of the contractor or any of his staff employed on the work. The contractor shall not be allowed to erect any staff camps for housing the staff at or near the work on available Railway land. No passes or privilege tickets will be issued to the contractor or any of his staff by the administration.
The contract will remain in force for a period of 03 years from the commencement of the work. However, Railway Administration may terminate the agreement by giving to the contractor duly notice without assigning any reason thereof and in the event of breach of any condition therein, committed by the contractor in the event of any misconduct on the part of the contractor or his workman, it shall be lawful for the Railway Administration to terminate this agreement forthwith without any notice and to forfeit the whole or part of security deposit at his discretion without being liable to the contractor for any loss and damage whatsoever.
The contractor shall remain liable for theft of any Railway material by his staff and he must take necessary proceeding against each staff to prevent such occurrence and shall reimburse to administration for the loss suffered if any. In the event of this being reported cases, the contract shall be terminated by giving notice and the contractor shall be liable for the damage suffered by the administration.
Rate quoted in the tender shall be deemed to be inclusive of all taxes, royalties, payable by the contractor's to payment or local authority. No additional amount will be paid or claim entertained on this account by the Railway.
Safety Precautions: The contractor shall at all times adopt such safe methods of work as will ensure safety of structure, equipment and staff. The contractor shall provide all necessary personal safety gears such as hand gloves, apron, helmet, mask and safety shoes to all his staff. If at any time the Railway finds the safety arrangements are inadequate or unsafe, the contractor shall take immediate corrective action as directed by the Railway's representative at site. Any direction in the matter shall in no way absolve the contractor of his sole responsibility to adopt safe working methods. The Contractor should take utmost care to ensure that no damage to the locomotive/Railway property takes place due to any act of workmen, while carrying out the work under this Contract. It will be the responsibility of the contractor to ensure that all his workmen observe Industrial safety rules, procedures, methods, practices etc. The Railway Administration shall not be liable for any accident, injuries etc. to his workmen.
The Contractor should not employ children below age 14 as staff directly or through the petty contractors or subcontractor for the execution of the work. Under no circumstances, the staff employed by the contractor will have any claim for employment in the Railways.
The contactor alone shall be responsible for any or all the losses of material or property of Railways or any third party resulting from/during execution of the work or any other activity undertaken by the contractor in execution of the contract for whatsoever reason.
Conservancy Cess Charges: As per Railway Board letter No. F (X) 1/95/1/1 Dated: 07.09.2021, "Conservancy cess charges" will be deducted from the contractor's bills based on the average number of laborers/workmen employed per day by the contractor for the work.
The Contractor should complete whole of the work in all respects on or before the date fixed by the Railway or any authorized extension thereof. The Railway administration is entitled to recover penalty as stipulated in the general conditions of the contract, if the contractor is in default. It should be ensured that minimum inconvenience is caused to users while for executing the work. For this the work shall be programmed in such a way in consultation with the authorized representative of Sr.DME (D)/DLS/Raipur.
A fee per legal document, like partnership deed or power of attorney executed before or after the execution of the contract, will be recovered from the contractor for obtaining legal Advice from Law Officer.
The contractor shall not sublet or assign this contract or allow any person for any reason to become interested therein in any manner without the written permission of the Sr.DME (D)/DLS/Raipur. In the event of contractor subletting or assigning the contract or transaction, Railway administration shall be free to cancel the contract as per the General conditions of contract and also to recover payments of any loss or damage from such cancellations. The amount of which will be determined by the Sr.DME (D)/DLS/Raipur.
Trespass: The contractor shall all time be fully responsible for any damages of trespass committed by his agents or workmen in carrying out the work even if such trespass is unauthorized by the engineer.
Arrangements for permits and license: For arrangements for permits and license for materials, contractor will have to make his own arrangements. Also no import license shall be arranged by the Railway for this work. The contractor should make his own arrangements for the required vehicles, such as tractors, trailers, road lorries etc and other tools and plants etc for the expeditious progress of work at his own cost with men and consumable stores The contractor should bring the mater]al for the work, to work spot with proper RPF gate entry.
Damage to railway property or Life: The contractor shall be responsible for all risk to the works and for trespass and shall make good at his own expense all loss or damage whether to the works themselves or to any other property of the railway or the lives persons or property of the others from what so ever causing connection with the works. This is governed by para 4.24 in whole of the General Conditions of Contract (GCC) for service 2018.
Procedure for settling of disputes with contractor: The provision of clauses 7.4 & 7.5 of VII and VIII of the general condition of the contact will be applicable for settlement or claims or disputes between the contractor and Railway administration.
Statuary Variation Clause (SVC): SVC will be applicable. Any statuary variation in Taxes and Duties or any fresh Taxes and duties imposed by the Central or State Government during execution of contract will be paid by railway on submission of documentary evidence of such payment.
Goods and Service Tax (GST): All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. GST will be reimbursed as applicable, on production of authentic documentary evidence. In case there is any further change in the GST tax structure till the date of completion of work or any error is noticed in the calculation of amount payable recoverable till the release of Final Bill amount to contractor, the same shall be paid by the Railways or recovered from the contractor's bills/security deposit or any other dues of contractor with the Govt. of India.
No any compensation will be awarded by the Railway administration to the labour of contractors in case of any accidental injury or death within Railway premises during the execution of the work.
Right of Railway to determine the contract: As per "General Conditions of Contract (GCC) for service 2018" clause VII, the Railway shall be entitled to determine and terminate the contract at any time should, in the Railway's opinion, the cessation of work becomes necessary owing to paucity of funds or from any other cause whatever.
Errors and omissions and discrepancies:-The Tenderer shall not take any advantage of any misinterpretations of the conditions due to typing or any other error and if any contradiction, only the printed rules and books should be followed and no claims for the misinterpretation shall be entertained.
Labour Laws: Adherence of the labour laws will be onus of the contractor and should have EPF, ESI and other applicable registration with statutory authorities.
Payment of Wages Act, 1936 (amended version), if applicable.

DEVIATION: Deviation from any of the clauses of the above must be clearly pointed out in a letter which must accompany the tender. Clauses not so commented on will be taken as having met with the approval of the Tenderer and will therefore be binding on the Contractor.
DISPUTE: In all matters of dispute, the decision of the Sr. Divisional Mechanical Engineer, DLS/Raipur/South East Central Railway shall be final and binding.
All other terms & conditions will be applicable as per General Conditions of Contract (GCC) for service 2018.of Railway with latest amendments.
